Research Crux: Development in temporary communities has been tangibly colored. Such

matter has rendered individuals be much contingent on money to the extent of that a

large percentage of individuals transgress on others' money; procrastinate in satisfying

debts though being opulent. Rather, some individuals would eschew or dodge the law,

fail to execute court rulings. Consequently, complaints have piled up due to the

procrastination of debtors.

Thus, there is a pressing need for defining the concept and limits of fund seizure and

confiscation. As well as there is a dire need for defining the relevant regulations and

provisions.

Therefore, the following question has to be answered.

What is the subject of fund seizure and confiscation in the Saudi Legislative

Proceedings System?

Dissertation Importance:

Such dissertation derives the importance from that of the topic it handles since defining

the seizure and confiscation of funds in the court rulings considerably contribute to

establishing sound social relationships among the community individuals. As being

considered the only means to settle disputes and conflict between the Creditor and

Debtor, the sought objective is that rights be retrieved by Owners so that the community

individuals manage skip the most impediment confronted in their financial dealings.

Dissertation Objectives:

The research targets the definition of the essence of funds owned by the individual, the

extent of disposition, the concept of confiscation, types and kinds of confiscation and

seizure. Further, the dissertation aims at defining the concept of execution and its

importance, types and means, hence defining the funds likely to be seized and

confiscated, in addition to those possibly not to be seized and confiscated.

Proposals of Dissertation / Questions Raised

Major Question of Dissertation:

What is the subject of fund seizure and confiscation in the Saudi Legislative

Proceedings System?

Out of the aforesaid question, the following questions are derived:

-Define the concept of confiscation. What are the types and means of confiscation?

-Define Execution and its importance. What are the types and means of execution?

-Define the funds likely to be confiscated and executed?

-Define funds that may not be subject to be seized or confiscated.

Dissertation Approach:

The researcher resorts in his dissertation to the Analytical Inductive Approach. The

researcher is to infer the texts related to fund confiscation and execution stipulated in

the Saudi Legislative Proceedings System, Comparative Law, in addition to analyzing the

legislative fundamental principles. Such analysis is to be contingent on scientific studies

conducted by Islamic Shari Scholars, and law interpreters.

Core Results

The study has concluded the following.

1. It is agreed upon that preserving court rulings shall render parties to dispute

in fully compliance with such.

2. Objective of confiscation and execution of the Debtor's fund represents the

optional satisfaction of such debt and performance of obligations thereof

3. The Lawmaker is not to be sufficed with the permission of resorting to court of

law in order to maintain right thereof, but rather the satisfaction of such debt.

4. The ruling sought to be implemented shall stipulate what stated in the court

ruling of being awarded as per genuine dispute, being binding, lucid and

indicative.

5. The Debtor is to be dealt with in a manner preserving dignity and honor

thereof, as the lawmaker has not left the Debtor to the Creditor to forcibly

taking right thereof.

6. In the Saudi Legislative Proceedings System, the Lawmaker is keen to avert

damages likely to be sustained by the confiscated Debtor. Therefore, the

Lawmaker has obliged the Creditor to furnish guarantee sufficient for making

up for the Debtor in case of failure to establish the case.
