Research Problem: The protective custody is the most jeopardized investigation procedures, it is clearly leads to depredation the freedom of accused person, and it is incompatible with the principle of original innocence supposition. The contradiction has been clearly distinguished between two contradictory interests, the government's interest in keeping security from one side and the interest of individuals in maintaining their personal rights and freedoms. Research Importance: The importance of this research appears in its dealing with an important subject that concerning with human freedom and dignity, which requires to a judiciary, formality, and objectivity guarantees, so the explanation of the rules of this subject in Islamic Figh, Saudi regulation and positive law would enhance the human rights and protect himself from any abusive procedures, in addition to the practical importance that represented in studying ten cases which concerns the provisional detention.

Research Objectives:
1. Explanation of Shariah and regulation basis for protective custody. 2. Stating of judiciary, formality, objectivity guarantees that accompanied
by protective custody in Islamic Shariah and the regulation of punishment procedures and positive law.
3. Appearing the distinction of Islamic Shariah in treating several procedural questions such as the protective custody.
4. To know how to compensate the victim of protective custody in its both sides material and morale.
Research Hypotheses: Questions: - What is the Shariah and Regulation basis of protective custody? - What are the Judiciary, formality and objectivity guarantees accompanied
to protective custody? - How The Islamic Shariah Treated the subject of protective custody? - What is the Shariah and Regulation basis in compensating the victim of
protective custody? Research Methodology: Empiricism, Analytic comparative through a complete inducting the articles of Saudi system of punishment procedures and positive law and comparing it by what have been explained in Islamic Shariah. The applied part of the subject will be through analyzing the cases which includes the protective custody for the accused people, in addition to cases which have judiciary cases that issued from injustices council about compensation of those who were affected from protective custody. Main Results:
- The protective custody is: detention of a person and forbid him to do anything by himself, whether in his house or in the mosque.
- The Islamic Shariah has decided the original innocence principle, and organized regulations and rules to it, this what is implemented by Saudi organizer and positive codifier.
- The Saudi organizer has restricted detaining of the accused person in the investigation phase for six months, after which he should be released or exposed to the court.
- The Saudi organizer has reported objective, formality and judiciary guarantees for detaining the accused person.
