The research strives to exactly determine or define professional secret through the adoption of a

specific legal measure that leads to a clear distinction between secrets or pieces of information

which its disclosure is legally permissible.

Research Importance:

Undoubtly there are some secrets that are related to the State, administration of the State or

individuals which need strictly be kept and given top confidentiality. If they are disclosed huge

losses may be inflicted.

Research Objectives:

. To illustrate the concept of professional secrets.

. To be aware of the stances of Islamic Sharia, Saudi legal system and positive laws, on the

protection of professional secrets and determine the various penalties pertaining to the

crime of professional secrets disclosure.

Research Questions:

. What is professional secret?

. What are stances of Islamic Sharia, Saudi legal systems and positive laws on the protection

of professional secrets? What are the penalities which suits the commission of professional

secret disclosure in terms of grade and danger?

Research Methodology:

The researcher adopted the inductive analytical and comparative approach, through analyzing

professional secrets and then held a comparison between the stances of Sharia, Saudi legal

system and the Egyptian legal system on the crime of professional secret disclosure.

Important Results:

. There is dire need for the approval of a special decree on the confidentiality of the State

secrets in the Kingdom of Saudi Arabia. The decree should amalgamate and synthesize in a

one unified charter the scattered laws and regulations considering the secrets of the State.

Further the decree evades repetitiveness, clearly define the professional secrets of the state,

and determine the punishment deserved in conditions of intentional or non-intentional

violations by an employee or any individual. The proposed decree should carry the name.

Law on the protection of States secrets.

. To clearly and detailfully codify the duty of protecting the professional secrets of civil

service regulations and differentiate between it and duties pertaining to job performance.

. There is pressing need for authoring a prospectus on the ideal ethics of public jobs holders.

Unique among these is top confidentiality in dealing with the States secrets, as well as the

secrets of the administration and individuals.

. Awareness, from the Sharia and secular laws stand point of view on the significance of

keeping secrets, should be promoted. By doing so people would not try getting informed

on the secrets be them State secrets or otherwise.

. Employees in charge of Materials containing secrets, need be recruited on basis of the

standard of their morale, good conduct and righteous behavior.

. Jurisdictions pertaining to secrets disclosure and punishment inflicted on committers of

this crime, need be made public and be proliferated as much as possible so as to act as

deterrent against any probable similar behavior.
