Research Problem: The problem of this study is focusing on guiltlessness judgment and its effect in compensation in Saudi system through talking about the extend of argument of criminal judgment with guiltlessness in civil jurisdiction and the extent of claimant deserves the compensation with deciding judgment of guiltlessness. Research importance: The importance of this study clears through two following aspects: a. Theoretical importance: which represents in researcher seeking for studying the effect of guiltlessness judgment on compensation through comparative theoretical study between some Arabic legislations the thing which will has its effect in enriching this aspect, where the researcher notices the lack of researches in this field. b. Applied Importance: it appears that the researcher has conducted a number of cases that related to guiltlessness and its effect on compensation that seen by jurisdiction systems in Kingdom of Saudi Arabia and applying the theoretical study on it.

Research Objectives: 1. Stating the conception of judicial judgment and its effect in Jurisprudence and system.
2. Stating the conditions of the argument of guiltlessness judgment.
3. Stating the cases of the argument of guiltlessness judgment.
4. The effect of guiltlessness judgment on compensation.
Research Hypotheses/Questions: 1. What is the definition of guiltlessness in jurisprudence and system?
2. What are the conditions of argument of guiltlessness judgment?
3. What are the cases of argument of guiltlessness judgment?
4. What is the effect of guiltlessness judgment on compensation?
Researcher Methodology: The researcher has followed Inductive, originated, analytical comparative methodology,
through studying the effect of guiltlessness judgment on compensation, an originated
comparative study through referring to jurisprudence and legal resources that tackled
this issue.
Main Results: 1. The Islamic Shariah has anteceded the other positive systems in stating the principle of
compensation as a right of the victim.
2. The guarantee is most generalized than compensation because compensation is in
money and guarantee is in money and persons.
3. The judicial judgment in Islamic Jurisprudence has the argument of completed issue
unless it is differ from the correctness of decided issues in Shariah rules.
4. Non activating the principle of criminal judgment argument in front of civil judicial
leads to instability of judgments.
5. The reason in prevailing of criminal lawsuit on civil lawsuit is the connection of criminal
lawsuit with souls and freedoms other than civil lawsuit that often related to individual
interests.
6. The origin in civil compensation doesn't connect with punishment, where it is correct to
judge by it even if the sentence is guiltlessness, with stipulation that the guiltlessness
would be cleared on: that the event was not occurred at all, incorrectness, or its
attribution has not proofed to the accused person.
