2. 禁止生物武器制度• 《 1925 年日内瓦议定书》

–禁止使用生物武器• 《生物与有毒武器公约》（ BTWC ）

–进一步禁止研发生物武器• 《禁止化学武器公约》

–包括 禁止使用有毒武器• “ 预防网”

–添加了相关的法律和规范

3. 《 1925 年日内瓦议定书》• 商讨了关于在一战中对化学武器的使用

– 波兰代表团认为生物武器也同样危险，并易于获取，因此也需要禁止使用生物武器。• 普遍的遵守和保留条款的删除加强了对生物武器使用的禁止。

– 此议定书是基于先前的协议起草的，但根据现在的标准，这是一份非常简易的国际协议。

4. 《生物与有毒武器公约》• 此公约

–商讨时间为 20 世纪 60 年代末 /70 年代初–越来越多的国家开始遵守

• 公约结构–前言描述了协商者的目的–15 条法律条款

• 每五年一次的公约审议大会–使公约不断完善

5. BTWC 规定的义务（ 1 ）• 第一条

–“ 本公约各缔约国担允在任何情况之下，绝不发展、生产、储积或用其他方法取得或保留：• 1. 微生物或其他生物剂，或任何来源或任何方法生成的毒素，只要种类或数量不是预防、保护或其他和平用途所应当有的；”

6. BTWC 规定的义务 (2)• 第二条

– 应在本公约发生效力后九个月内，将一切用剂、毒素、武器、设备或投送工具销毁或改供和平用途。• 第三条

– 绝不将任何用剂、毒素、武器、设备或投送工具让与任何接受者，也绝不用任何方法，协助、鼓励或劝诱任何国家、国家集团或国际组织制造或用其他方法取得上述用剂、毒素、武器、设备或投送工具。• 第四条

– 本公约各缔约国应依照本国宪法程序，采取必要措施来禁止及预防在它领域内，在它管辖或控制下的任何地方，发展、生产、储积、取得或保留本公约第一条所称的用剂、毒素、武器、设备和投送工具。

7. BTWC 规定的义务 (3)• 第五条

– 本公约各缔约国担允互相协商合作、来解决对本公约的目标或本公约条款的适用可能引起的任何问题。依本条进行的协商合作，也可以在联合国体制内，依照符合联合国宪章的适当国际程序来进行。• 第六条

– 本公约任何一个缔约国发现另一缔约国的行为违反因本公约规定而起的义务时候，可以向联合国安全理事会提出控诉。本公约各缔约国对于安全理事会依照联合国宪章规定，根据所接控诉可能发动的调查，担允协力进行。

8. BTWC 规定的义务 (4)• 第九条

–担允继续诚意谈判，以便就化学武器裁减条约达成协议。• 第十条

–担允在和平利用微生物学用于疾病预防和其他和平用途方面进行国际合作；本公约的实施，应设法避免妨碍各缔约国的经济和技术发展或国际合作。

9. 了解 BTWC• BTWC由几种“制度”组成

– 遵约制度– 发展制度–永久 / 制度化制度– 研究制度

• 这些制度的发展不平衡，研究制度尤其需要得到更多重视。

10. 遵约（ 1 ）• 遵约与查验是不同的概念

– 第 1 、 2 、 3 条列出了重要的裁军义务。– 第 4 、 5 、 6 、 7 条提供了能够替代查验的方式。

• 由于最初的查验系统不够好，使用了其它的方法。–建立信任措施（ CBMs ）在 1986 年得到通过，在 1991 年得到改善。– 20 世纪 90 年代 VEREX(政府专家小组 ) 和特别小组的协商，但仍然没能在 2001 年达成《查验议定书》。

11. 遵约 (2)• 建立信任措施 (CBMs)• 在 1986 年的第二次公约审议大会上达成协议，在

1987 年进行了详细阐述。• 每年必须提交以下方面的声明

–交换符合极高安全标准的研究中心和实验室的数据； –交换关于突发传染病和毒素引起的类似情况的资料 – 鼓励将与本公约有直接关系的生物研究成果发表在容易获取的科学杂志上– 积极促进参与到与本公约有直接关系的生物研究的科学家间的联系，包括在双方同意的基础上开展的联合研究的交流。

12. 遵约 (3)

• 1991 年对 CBMs 的修改–经过修正，新的 CBMs 包含了 A-G7 个措施。–例

•建立信任措施“ A” 将对符合极高安全标准的设施作出声明改为对国家生物战防御研究活动作出声明。•新的建立信任措施“ E” 要求宣布在执行 BTWC时的立法、规章和其他措施；

• 但是 CBM带来的回报不论是在数量上还是在质量上都不够令人满意。• 虽然如此，一些缔约国还是在网上向公众公布了

CBM带来的回报。

13. 研发• 第十条提到了促进信息交换的义务

–本公约各缔约国关于使用细菌（生物）剂及毒素于和平用途，担允便利并且有权参加设备材料及科学和技术资料的尽量充分交换。• 第十条也包含了监管的义务

–本公约的实施，应该设法避免妨害本公约缔约国的经济或技术发展……协助促进与应用细菌学（生物学）方面的科学发现……• 该条款很少得到发展

14. 永久制度 / 制度化（ 1 ）• 第十二条

–“ 本公约发生效力满五年时……缔约国会议……在瑞士日内瓦举行，审议公约的实行情况，以确保前文的宗旨和公约的规定，包括关于化学武器的谈判在内，都在实施中……”• 第十二条的余下部分

–“……这项审议应该顾及到与本公约有关的任何新的科学和技术发展。”

15. 永久制度 / 制度化（ 2 ）• BTWC 于 1975 年生效• 1980 年召开了第一次公约审议大会• 1986 年召开了第二次公约审议大会

–授权制定 CBMs– 1987 年对 CBMs 进行了详细阐述

• 1991 年召开了第三次公约审议大会–授权修改 CBMs–授权 VEREX 对查验的科学和技术方面进行分析

16. 永久制度 / 制度化（ 3 ）• 1994 年的特别会议

–收到 VEREX 的结果，授权特别工作小组商讨《查验议定书》• 1996 年的第四次公约审议大会

– 鼓励特别工作小组完成其任务• 2001 年 -2002 年的第五次公约审议大会

– 制定新的会间会进程（ ISP ）• 2006 年第六次公约审议大会

– 同意 ISP 会议进入新阶段– 同意建立小型履约支持机构（ ISU ）

17. 研究（ 1 ）• BTWC 的第一条没有提及研究。• 但 1991 年的公约审议大会认为研究也需要得到关注。

–“ 本次会议认识到，如若实验涉及到露天释放对人类、动物或植物有害的病原体或毒素，此类实验不是出于预防、保护或和平目的，此实验与第一条内容不符。”• 但是很难判断实验是否属于被禁止的类型。

18. 研究（ 2 ）• 2006 年的第六次公约审议大会再次强调了禁止政策的复杂性。• “ 会议确认第一条的重要性，第一条界定了《公约》的范围。会议宣布，《公约》的范围是全面的，第一条明确包括类型和数量不属于预防、保护或其他和平用途所正当需要的所有天然或人造或人工改变的微生物剂或其他生物剂和毒素及其组分，不论其来源或生产方法如何，不论其是影响人、动物还是植物。”

19. 第一次 ISP （ 1 ）• 2003 年 -2005 年大会讨论的议题

—“(1) 采取必要的国家措施，包括制定有关刑事法律，以执行《公约》所载的禁止规定； — (2) 确保和维护微生物和毒素病原体的安全并进行监督的国家机制； — (3) 加强对据称使用生物或毒素武器的案件或可疑的疾病突发事件作出反应、进行调查和减轻后果的国际能力；”

20. 第一次 ISP （ 2 ）• 2003 年 -2005 年大会讨论的议题（接上页内容）— “(4) 加强和扩大国家机构和国际机构在监测、检测、诊断和防治影响人类、动物和植物的传染性疾病方面所做的努力以及现有的机制；— (5) 科学家行为守则的内容、公布和遵行。”
