WHAT WAS DONE?

Legal due diligence was carried out, during which the violations of the current legislation of the Russian Federation were detected. The potential customer of a share in the LLC was given recommendations on elimination of viola-tions before conclusion of the purchase and sale agreement in order to minimize risks connected with the purchase of this asset.

ESSENCE OF THE DISPUTE: Federal State Budgetary Institution «Veterinary Center» filed a claim to the Commercial Court of Moscow against “Firma Vektor+” CJSC on the recovery of penalty in the amount of more than 16 million rubles for the violation of the terms of timely performance of the building and installation works under the government procurement.

RESULT OF THE DISPUTE: The plaintiff’s claim is upheld, the decision of the court of the original jurisdiction is confirmed by court orders of the courts of appellate and cassational jurisdiction.

CLIENT: «GTL» JSC

PLAINTIFF: Moscow Department of Science, Industrial Policy and Entrepreneurship

ESSENCE OF THE DISPUTE: the claim against “GTL” JSC on recovery of the subsidy because the company did not submit the report on the expenditure of money according to the inten-ded purpose.

RESULT OF THE DISPUTE: The plaintiff’s claim was denied.
