Regoli tal-2016 dwar it-Trobbija u ż-Żamma tal-Majjali

BIS-SAĦĦA tas-setgħat mogħtija bl-artikoli 5(1), 7, 8, 9(1), 11u 34 tal-Att dwar is-Servizzi Veterinarji, il-Ministru għall-IżviluppSostenibbli, Ambjent u Tibdil fil-Klima għamel ir-regoli li ġejjin:-

Titolu u applikabilità.

1. (1) It-titolu ta’ dawn ir-regoli huwa r-Regoli tal-2016dwar it-Trobbija u ż-Żamma tal-Majjali.

(2) Persuni li diġà qegħdin fil-pussess ta’ majjali miżmumabħala annimali domestiċi qabel il-bidu fis-seħħ ta’ dawn ir-regoligħandhom jiġu konformi mar-regola 20(b) u (f) fi żmien sitt xhurmill-bidu fis-seħħ ta’ dawn ir-regoli u mar-regola 20(d) fi żmien senamill-bidu fis-seħħ ta’ dawn ir-regoli.

Servizzi Veterinarji biex iżżomm u tgħammar majjali għal skopijietta’ trobbija sabiex jiġu prodotti majjali għall-bejgħ;

"Direttur" tfisser id-Direttur tas-Servizz Veterinarju u tinkludikull uffiċjal tad-Dipartiment tas-Servizz Veterinarju awtorizzatminnu sabiex jaġixxi għan-nom tiegħu;

"skart domestiku" tfisser kull skart organiku li joriġina minnresidenzi privati;

"min issemmen" tfisser kull persuna liċenzjata mid-Direttur tas-Servizzi Veterinarji biex iżżomm majjali għat-tismin f’razzettliċenzjat sew għall-qatla jew għall-bejgħ bħala annimali domestiċi;

"min iżomm" tfisser kull persuna reġistrata mid-Direttur tas-Servizzi Veterinarji biex iżżomm majjali bħala annimali domestiċiiżda li ma tkunx awtorizzata li tnissel, tbiegħ jew toqtol il-majjaligħall-konsum;

"mikroċippa" tfisser identifikazzjoni elettronika, permezz tat-twaħħil ta’ ċippa jew transponder li jkunu konformi mal-istandard11784 jew l-Anness A ISO standard 11785 għall-finijiet tal-monitoraġġ u biex tirregola l-identifikazzjoni elettronika ta’ majjalmiżmum bħala annimal domestiku;

"sit" tfisser kull post fejn jinżammu majjjali bħala annimalidomestiċi;

"fdalijiet" tfisser kull skart organiku li joriġina minnstabbilimenti tal-ikel bħal lukandi, ristoranti (inklużi r-ristoranti lijsajru għal barra), ristoranti żgħar (inklużi canteens), każini,stabbilimenti tal-komunità u bini ieħor fejn l-ikel jiġi mħejji, servut,ippakkjat jew mod ieħor. Fdalijiet għandhom jirreferu wkoll għall-iskart tal-fornimenti internazzjonali kif imfisser fir-Regolamenti dwarProdotti Sekondarji mill-Annimali (Regolament Nru. KE 1069/2009);

"majjali" tfisser kull annimal tal-ispeċi Sus scrofa u Sus scrofadomesticus u għandha tinkludi majjali miżmuma bħala annimalidomestiċi inklużi l-majjali kollha ta’ derivazzjoni jew razza eżotika umajjali li jkunu miżmuma għal skopijiet ta’ esibizzjoni biss;

"razzett tal-majjali" tfisser post liċenzjat mid-Direttur biexjintuża għat-trobbija tal-majjali;

"min iżomm" tfisser kull min għandu l-majjali bħala annimalidomestiċi u fl-istess waqt ma jistax jgħammar, ibiegħ l-istess, jewjoqtolhom għall-konsum;

"trabbi" tfisser li tnissel u, jew issemmen il-majjali.

Liċenza u reġistrazzjoni.

3. (1) Ebda persuna m’għandha trabbi jew iżżomm majjalisakemm ma tkunx reġistrata għal dan il-għan mas-ServizziVeterinarji u tkun fil-pussess ta’ liċenza xierqa maħruġa mid-Direttur:

Iżda liċenzi għaż-żamma tal-majjali għandhom jinħarġufir-rigward tal-majjali partikolari li huma intiżi li jinżammu bħalaannimali domestiċi.

(2) Kull post li huwa intiż biex jintuża għat-trobbija tal-majjaligħandu jkun liċenzjat mid-Direttur bħala razzett tal-majjali.

Rekwiżiti biex tinkiseb liċenza biex jitrabbew il-majjali.

4. Ebda persuna m’għandha tinħarigilha liċenza biex trabbi l-majjali sakemm ma tissodisfax ir-rekwiżiti li huma mniżżla fl-IskedaIII.

Liċenza biex jinżammu jew jitrabbew il-majjali.

5. (1) Ebda persuna ma tista’ iżżomm jew trabbi majjalisakemm ma tkunx inħarġitilha liċenza maħruġa mid-Direttur skontdawn ir-regoli.

(2) L-applikazzjaoni biex persuna żżomm jew trabbi majjaligħandha ssir lid-Direttur fuq il-formola xierqa li għandu jkollha d-dettalji preskritti fl-Iskeda I:

Iżda d-Direttur jista’ jitob informazzjoni addizzjonali jewdokumentazzjoni mill-applikant kif ġustifikat b’mod raġjonevoli uoġġettiv:

Iżda wkoll applikant għal liċenza m’għandux jibda’ iżommjew irabbi majjali qabel ma tinħareġ liċenza formali mid-Direttur.

(3) Liċenza għandha titqies nulla ab initio jekk jirriżulta li r-rekwiżiti tal-applikazzjoni ma ġewx sodisfatti jew l-informazzjonijew id-dokumentazzjoni sottomessi kienu foloz jew skoretti:

Iżda l-ebda rifużjoni ta’ xi miżati li tħallsu m’għandha ssirf’dawn il-każijiet.

Liċenza għal razzett tal-majjali.

6. (1) L-ebda post m’għandu jintuża biex jitrabbew il-majjali sakemm ma jkunx liċenzjat mid-Direttur bħala razzett tal-majjali skont dawn ir-regoli.

(2) Applikazzjoni għal razzett tal-majjali għandha ssir lid-Direttur fuq formola xierqa u għandu jkollha d-dettalji preskritti fl-Iskeda II:

dokumentazzjoni addizzjonali mill-applikant kif raġjonevolment uobjettivament huwa ġustifikat:

Iżda wkoll applikant għal liċenza m’għandux jibda jużadak il-post bħala razett tal-majjali qabel ma tinħareġ liċenza formalimid-Direttur.

(3) Liċenza għandha titqies nulla ab initio jekk jirriżulta li l-ħtiġiet tal-applikazzjoni ma ġewx osservati jew jekk l-informazzjonijew dokumentazzjoni mogħtija kienu foloz jew skoretti:

Iżda l-ebda rifużjoni ta’ miżati li tħallsu m’għandha ssirf’dawn il-każijiet.

Ipproċessar ta’ applikazzjoni.

7. (1) Id-Direttur għandu minnufih jgħarraf li rċievaapplikazzjoni u li rċieva l-miżata tal-liċenza applikabbli bil-miktublill-applikant.

(2) Applikazzjoni tiġi kkunsidrata bħala mhux kompluta, utintbagħat lura lill-applikant jekk ma tkunx akkumpanjata bl-informazzjoni kollha u, jew id-dokumentazzjoni mitluba minn dawnir-regoli.

(3) Meta jirċievi formola ta’ applikazzjoni kompluta, id-Direttur għandu fi żmien disgħin (90) jum kalendarji mid-data li jkunirċieva l-formola ta' applikazzjoni:

(a) jinforma lill-applikant dwar il-ħtieġa li jipprovdikwalunkwe informazzjoni jew dokumentazzjoni addizzjonali;jew

(b) joħroġ il-liċenza soġġetta għall-kundizzjonijiet lijidhirlu li huma xierqa; jew

(ċ) jirrifjuta l-applikazzjoni għal liċenza u jagħti r-raġunijiet tiegħu għal tali rifjut.

Ħlas ta’ miżata għal liċenza.

8. Kull liċenza maħruġa taħt dawn ir-regoli għandha tkunsoġġetta għal ħlas ta’ miżata u kull sena wara:

Iżda liċenza ta’ min iżomm il-majjali għandha titħallasdarba biss malli timtela’ l-applikazzjoni.

Sospensjoni jew revoka ta’ liċenza.

9. (1) Id-Direttur jista’, b’ordni notifikat lid-detenturi ta’liċenza, fi kwalunkwe żmien jissospendi liċenza:

(a) jekk id-detentur tal-liċenza huwa jikser xikondizzjoni tal-liċenza;

(b) jekk id-detentur tal-liċenza jikser dawn ir-regoli jewkwalunkwe leġislazzjoni oħra applikabbli għat-tgħammir,żamma jew tismin tal-majjal kif ikun il-każ;

(ċ) jekk fl-opinjoni tad-Direttur hemm riskju tal-introduzzjoni jew tixrid ta’ mard.

(2) Is-sospensjoni għandha tkun għal perjodu ta’ żmienspeċifikat fl-ordni u soġġetta għall-kondizzjonijiet li jinsabu fl-istessordni.

(3) Meta jissospendi jew jirrevoka liċenza d-Direttur jista’,skont kif ikun il-każ:

(a) jimponi xi kondizzjonijiet meqjusa bħala meħtieġa;

(b) jwaqqaf t-trasferiment tal-annimali kollha jew ta’ xiwħud minnhom li għalihom tirreferi l-liċenza inkluż lejnbiċċeriji;

(ċ) jordna l-qtil u, jew il-qatla, biex jitnaqqsu, tal-annimali kollha jew ta’ xi wħud minnhom milquta mill-ordni ta’revoka jew sospensjoni f’biċċerija approvata;

(d) jordna l-qtil ta’ annimali, biex jitnaqqsu, fis-sit fejnkienu qed jitrabbew b’mod li jkun effikaċi u uman;

(e) jordna r-rimi ta’ karkassi skont il-Regolament dwarProdotti Sekondarji mill-Annimali (Regolament KE 1069/2009);

(f) jieħu kull miżura oħra li jidhirlu li hija meħtieġa.

Validità ta’ liċenzi.

10. (1) Il-liċenzi ta’ min isemmen u dawk li jrabbugħandhom jinħarġu għal perjodu ta’ sena kalendarja waħda, usakemm ma jkunux mod ieħor sospiżi jew meħuda lura, dawngħandhom jiġġeddu bla ħsara għall-konformità kontinwa mar-rekwiżiti ta’ dawn ir-regoli inkluż il-ħlas tal-miżati rilevantiapplikabbli għalihom.

(2) Liċenzi għal min iżomm għandhom ikunu validi għall-ħajja kollha tal-majjali miżmuma bħala annimali domestiċi.

(3) Il-liċenzi msemmija fis-subregoli (1) u (2) jistgħu jinħarġubiss ġaladarba d-dispożizzjonijiet ta’ dawn ir-regoli jiġu osservatigħas-sodisfazzjoni tad-Direttur u ġaladarba il-miżati ta’ liċenzipreskritti jkunu tħallsu skont ir-regola 25.

Approvazzjoni ta’ sit li fih jitrabbew il-majjali.

11. Ebda persuna ma tista’ trabbi majjali f’xi post li ma jkunxġie spezzjonat u approvat mis-Servizzi Veterinarji u liċenzjat bħalarazzett tal-majjali.

Azjendi illegali tal-majjali.

12. (1) Id-Direttur għandu jkollu d-dritt li jidħol fikwalunkwe sit mingħajr avviż minn qabel, fejn huwa suspettat li qedjinżammu jew jittrabbew majjali mingħajr il-liċenza xierqa.

(2) Kull sit mhux reġistrat fejn jinstabu l-majjali jkun meqjusli huwa bi ksur ta’ dawn ir-regoli u d-Direttur jista’, minkejja kullazzjoni oħra li tista’ tittieħed skont dawn ir-regoli, jaġixxi malli jkunhemm ksur billi japplika d-dispożizzjonijiet mniżżla fir-regola 22.

Pjanijiet, estensjonijiet u alterazzjonijiet ta’ siti li fihom jitrabbew il-majjali.

13. (1) Kull applikazzjoni għal liċenza għat-trobbija ta’majjali għandha tkun akkumpanjata minn permess, inklużi l-permessita’ żvilupp, u l-pjanti tas-sit ta’ trobbija maħruġa mill-awtoritajietkompetenti rilevanti.

(2) Estensjonijiet jew alterazzjonijiet għas-siti li fihomjitrabbew il-majjali jistgħu jsiru biss wara li jkunu nkisbu l-permessirilevanti u soġġetti għall-approvazzjoni tad-Direttur.

Ċaqlieq ta’ majjali.

14. (1) Majjali m’għandhomx jiġu mċaqalqa minn post għalieħor sakemm dak iċ-ċaqliq m’huwiex permess permezz ta’approvazzjoni bil-miktub li tkun saret qabel mid-Direttur.

(2) L-approvazzjoni tad-Direttur għaċ-ċaqliq ta’ majjaligħandha tkun mitluba permezz tas-sottomissjoni tal-formola xierqa lijkun fiha d-dettalji stabbiliti fl-Iskeda IV.

(3) Kull persuna li ċċaqlaq majjali minn xi post għal ieħorgħandha tagħmel dan b’mod aċċettabbli u uman u f’vettura litassigura l-kondizzjonijiet xierqa għall-benesseri tal-annimal. L-imsemmija persuna għandha żżomm fuqha l-approvazzjoni bil-miktub tad-Direttur li tawtorizzaha sabiex iċċaqlaq il-majjali.

Fdalijiet, skart u prodotti sekondarji.

15. (1) Fdalijiet u skart domestiku m’għandhomx jingħatawbħala ikel lill-majjali.

(2) Prodotti sekondarji mill-annimali (ħlief skart mill-forniment internazzjonali) jistgħu jkunu awtorizzati bħala għalf għall-majjali mid-Direttur skont ir-Regolament dwar Prodotti Sekondarjimill-Annimali (Regolament tal-Kunsill 1069/2009).

(3) Id-Direttur jista’ jawtorizza l-użu prodotti sekondarji tal-industriji tal-ikel bħala għalf għall-majjali meta huwa jkun sodisfatt lil-oriġinatur tagħhom huwa reġistrat mas-Servizzi Veterinarji u huwasoġġett għall-kontrolli regolari skont il-leġislazzjoni rilevanti fis-

seħħ.

Projbizzjoni li jinġabru, jiġu trasportati fdalijiet, skart jew prodotti sekondarji.

16. (1) Ebda persuna liċenzjata biex trabbi l-majjali ma’tista’ tiġbor jew tittrasporta fdalijiet, skart, jew prodotti sekondarji.

(2) Ebda vettura użata għall-ġbir jew għat-trasport ta’ fdalijiet,skart jew prodotti sekondarji m’għandha tinżamm fi kwalunkwe sitapprovat bħala razzett tal-majjali.

(3) Id-Direttur jista’ jawtorizza kwalunkwe persuna liċenzjatabiex trabbi majjali, biex tiġbor u tittrasporta l-prodotti sekondarjipermessi bħala għalf għall-majjali skont ir-regola 15(2) u (3).

Produtturi tal-għalf fir-razzett.

17. Persuni liċenzjati għat-trobbija u t-tismin tal-majjalijistgħu jkollhom impjant li jipproduċi għalf jew teknoloġija għat-taħlit tal-għalf fis-sit fejn il-majjali jkunu qed jiġu mrobbija sakemmdak is-sit huwa reġistrat u, jew approvat skont id-dispożizzjonijiet tar-Regolament (KE) Nru, 183/2005 li jistabbilixxi r-rekwiżiti għall-iġjene tal-għalf.

Akkwist ta’ drafeġ.

18. (1) Ebda persuna liċenzjata għat-tnissil jew tismin ta’majjali m’għandha takkwista majjali minn xi ħadd li ma jkunxazjenda u soġġetta għall-identifikazzjoni tal-majjali kif ukoll il-ksibtal-awtorizzazzjoni għaċ-ċaqliq meħtieġa skont ir-regola 14.

(2) Detenturi tal-liċenza jistgħu jakkwistaw majjali biss warali tkun ingħatat awtorizzazzjoni biex jagħmlu dan wara li tkun sarettalba għal ċaqliq tal-majjali li tkun ġiet milqugħha mid-Direttur qabelisir iċ-ċaqliq.

Konformità ma’ liġijiet jew regolamenti oħra applikabbli għall-majjali.

19. Persuna liċenzjata biex trabbi l-majjali skont dawn ir-regoli m’għandhiex tkun eżentata milli tikkonforma mar-rekwiżiti ta’kull liġi oħra jew regolament ieħor applikabbli għall-majjali minnżmien għal żmien.

Żamma ta’ majjali bħala annimali domestiċi.

20. Majjali jistgħu jinżammu bħala annimali domestiċi skontil-kondizzjonijiet li ġejjin:

(a) min bi ħsiebu jżomm majjal għandu jkun approvatbħala tali wara li japplika għal liċenza li jżomm majjal bħalaannimal domestiku skont dawn ir-regoli;

(b) il-majjali għandhom jiġu identifikati permezz ta’mikroċippa imdaħħla taħt il-ġilda tal-widna tax-xellug minnveterinarju li għandu warrant;

(ċ) mal-ħlas tal-miżata preskritta, liċenza għandhatinħareġ mid-Direttur bil-kundizzjoni li d-dispożizzjonijietkollha ta’ dawn ir-regoli ġew osservati;

(d) ma jistax jkun hemm aktar minn żewġ majjali fuq sitwieħed u mhux iktar minn majjal wieħed għandu jinżamm minnkull persuna;

(e) il-majjali jistgħu jiġu mċaqalqa biss minn sitiapprovati bl-approvazzjoni minn qabel tad-Direttur, ħlief għalżjarat veterinarji ta’ emerġenza li għandhom jiġu kkonfermatibħala tali bil-miktub mill-veterinarju li jkun inkarigat li jieħuħsieb il-majjali miżmuma bħala annimali domestiċi;

(f) majjali maskili għandhom jkunu kirurġikamentsterilizzati permezz ta’ kastrazzjoni;

(g) it-tgħammir ta’ majjal minn min iżomm il-majjalhuwa pprojbit;

Kap. 439.

(h) persuni li japplikaw għal liċenza skont dawn ir-regoli għandu jkollhom tmintax-il sena jew aktar u kapaċi biexjieħdu ħsieb majjal miżmum bħala annimal domestiku. Kullpersuna li tkun instabet ħatja ta’ reati kontra l-Att dwar it-Trattamnet Xieraq tal-Annimali għandha tkun pprojbita milliżżomm majjali jew li tapplika għal liċenza għal żammatagħhom;

(i) id-Direttur għandu jiġi notifikat fi żmien sebat ijiemminn meta jmut xi majjal liċenzjat miżmum bħala bħala annimaldomestiku;

(j) id-Direttur għandu jiġi notifikat fi żmien tmienja uerbgħin siegħa minn min iżomm il-majjal fil-każ ta’ telf ta’majjal liċenzjat biex jinżamm bħala annimal domestiku permezzta’ mezz xieraq ta’ notifika kif jista’ jiġi stipulat mid-Diretturminn żmien għal żmien;

(k) il-karkassi ta’ majjali miżmuma bħala annimalidomestiċi m’għandhom qatt jidħlu fil-katina alimentari jewinkella jintużaw għal konsum mill-bniedem jew mill-annimali.Tali karkassi għandhom jintremew skont ir-Regolament dwarProdotti Sekondarji mill-Annimali (Regolament tal-UE Nru(KE) 1069/2009).

Ċaqliq ta’ majjal f’Malta u barra minn Malta.

21. (1) Il-majjali jistgħu jiġu impurtati f’Malta jewimċaqalqa lejn Malta minn Stati Membri jew pajjiżi terzi skont id-dispożizzjonijiet ta’ leġislazzjoni li tkun fis-seħħ minn żmien għalżmien li tirregola l-importazzjoni, il-kummerċ u t-trasport.

(2) L-awtoritajiet kompetenti għandhom jiġu notifikati b’kullmajjal li ser jidħol jew jitlaq minn Malta fi żmien tmienja u erbgħin

siegħa qabel it-trasferiment. Kull majjal li jidħol Malta bħala annimaldomestiku għandu jiġi identifikat minnufih b’mikroċippa skont ir-regola 20(b) u reġistrat mas-Servizzi Veterinarji mal-wasla tiegħu.

(3) L-ebda majjal ma għandu jidħol f’Malta minn StatMembru u, jew minn pajjiż terz meqjusa mid-Direttur bħala infettatiminn kwalunkwe marda rilevanti.

Infurzar.22. Id-Direttur, fid-diskrezzjoni tiegħu, jista’:

(a) jordna s-sospensjoni taċ-ċaqliċ kollu lejn u ’l barraminn siti approvati kif ukoll lejn jew barra minn Malta għal xiraġuni meqjusa neċessarja għall-protezzjoni tal-istokk kurrentijew minħabba nuqqas ta’ konformità minn detentur ta’ liċenzama’ dawn r-regoli jew ma’ xi kondizzjoni tal-liċenza;

(b) jordna l-qatla ta’ majjali meqjusa mhux tajbin għaż-żamma jew għall-konsum mill-bniedem ibbażata fuq ir-riżultatita’ spezzjoni;

(ċ) jordna r-rimi b’mod adegwat ta’ karkassi meqjusamhux tajbin għall-konsum jew użu ieħor wara spezzjoni qabeljew wara l-mewt;

(d) jordna il-qerda u r-rimi ta’ majjali jew prodottiderivattivi meqjusa mhux tajbin għall-konsum skont il-paragrafu (ċ);

(e) jordna r-ritorn ta’ majjal lejn il-post tal-oriġinitiegħu jekk jirriżulta li jkun hemm xi ksur ta’ dawn ir-regoli;

(f) iwettaq jew jagħmel kwalunkwe ordni oħra meqjusaxierqa mid-Direttur.

Kontroll ta’ majjali.

23. (1) Uffiċjal tal-Pulizija jew kull uffiċjal awtorizzat mid-Direttur jista’ jaqbad u jżomm kwalunkwe majjal għall-iskop li jiġiidentifikat.

(2) Min inissel, min isemmen, jew min iżomm il-majjal magħandux jabbanduna l-majjali tiegħu.

(3) Ebda majjal ma għandu jkun permess f’post pubblikuminbarra f’esibizzjonijiet, wirjiet, fieri u attivitajiet simili mingħajr l-approvazzjoni minn qabel tad-Direttur.

Spejjeż.24. L-ispiża ta’ kwalunkwe azzjoni meħuda jew ordnata mid-Direttur skont dawn ir-regoli għandha dejjem titħallas mis-sid tal-majjali.

25. (1) Persuni li jnisslu il-majjal u li jrabbu il-majjalgħandhom japplikaw mad-Direttur għal liċenza permezz tal-formolali jkun fiha d-dettalji fl-Iskeda I u, wara, dawn għandhom iħallsu l-miżata annwali tal-liċenza.

(2) Persuni li jżommu majjal għandhom japplikaw għand id-Direttur għal liċenza li tibqa’ valida għall-ħajja ta’ majjal permezztal-formola fl-Iskeda I u għandhom iħallsu l-miżata tal-liċenzjar ta’darba waħda.

Swine Rearing and Keeping Rules, 2016

IN exercise of the powers conferred by articles 5(1), 7, 8, 9(1),11 and 34 of the Veterinary Services Act, the Minister forSustainable Development, Environment and Climate Change hasmade the following rules:-

Citation and applicability.

1. (1) The title of these rules is the Swine Rearing andKeeping Rules, 2016.

(2) Persons already in possession of swine as pets before thecoming into force of these rules shall conform with rule 20(b) and (f)within six months from the coming into force of these rules and withrule 20(d) within one year from the coming into force of these rules.

Interpretation. 2. For the purpose of these rules and unless the contextotherwsie requires:

Veterinary Services to keep and breed swine in order to produceswine for onward sale;

"Director" means the Director of Veterinary Services, andincludes any officer of the Department of Veterinary Services dulyauthorised by him to act on his behalf;

"domestic waste" means any organic waste originating fromprivate dwellings;

"fattener" means any person licensed by the Director ofVeterinary Services to keep swine for fattening on a licensed farmwhether for slaughter or for onward sale as pets;

"keeper" means any person registered by the Director ofVeterinary Services to keep swine as a pet but is not authorised tobreed, sell, or slaughter swine for consumption;

"microchip" means electronic identification by means of theimplantation of a chip or transponder which complies with ISOstandard 11784 or Annex A ISO standard 11785 for the purpose ofmonitoring and regulating the electronic identification of pet swine;

"site" means any place where swine are kept as pets;

"swill" means any organic waste originating from cateringestablishments such as hotels, restaurants (including takeawayrestaurants), diners (including canteens), clubs, communityestablishments and other premises where food is prepared, served,packaged or otherwise. Swill shall also refer to international cateringwaste as defined in the Animal By-Products Regulation (RegulationNo. EC 1069/2009);

"swine" means any animal of the species Sus scrofa and Susscrofa domesticus and shall include pigs kept as pets including allpigs of exotic derivation or breed and pigs that are kept for exhibitionpurposes only;

"swine farm" means a place licensed by the Director to be usedfor the rearing of swine;

"to keep" means to own a swine as a pet whilst forbidden tobreed, sell the same, or slaughter for consumption;

"to rear" means to breed and, or fatten swine.

Licence and registration.

3. (1) No person shall rear or keep swine unless he isregistered for this purpose with the Veterinary Services and is in

possession of the appropriate licence issued by the Director:

Provided that licences for the keeping of swine shall beissued with regards to the particular swine that is intended to be keptas a pet.

(2) Any place which is intended for rearing swine shall belicensed by the Director as a swine farm.

Requirements to obtain a licence to rear swine.

4. No person shall obtain a licence to rear swine unless hesatisfies the requirements laid down in Schedule III.

Licence to keep or rear swine.

5. (1) No person shall keep or rear swine without a licenceissued by the Director in terms of these rules.

(2) An application for keeping or rearing swine shall be madeto the Director on the appropriate form and shall contain the detailsprescribed in Schedule I:

Provided that the Director may request additionalinformation or documentation from the applicant as reasonably andobjectively justified:

Provided further that an applicant for a licence shall notcommence to keep or rear swine before a formal licence is issued bythe Director.

(3) A licence shall be deemed null ab initio if it transpires thatthe requirements of the application have not been fulfilled or theinformation or documentation submitted was false or incorrect:

Provided that no refunds of any fees paid shall be made insuch cases.

Licence for a swine farm.

6. (1) No area shall be used to rear swine unless it islicensed by the Director as a swine farm in terms of these rules.

(2) An application for a swine farm shall be made to theDirector on the appropriate form and shall contain the detailsprescribed in Schedule II:

Provided that the Director may request additionalinformation or documentation from the applicant as reasonably andobjectively justified:

Provided further that an applicant for a licence shall notcommence to use the area as a swine farm before a formal licence isissued by the Director.

(3) A licence shall be deemed null ab initio if it transpires thatthe requirements of the application have not been fulfilled or theinformation or documentation submitted was false or incorrect:

Processing of an application.

7. (1) The Director shall without delay acknowledgereceipt of an application and receipt of the applicable licence fee inwriting to the applicant.

(2) An application shall be deemed to be incomplete, and shallbe returned to the applicant if it is not accompanied by all theinformation and, or documentation requested in these rules.

(3) Upon receipt of a complete application form, the Directorshall within ninety (90) calendar days from the date of receipt of anapplication form:

(a) inform the applicant of the need to supply anyadditional information or documentation; or

(b) issue the licence subject to any conditions he maydeem fit; or

(c) refuse the application for a licence giving its reasonsfor such a refusal.

Payment of licence fee.

8. Any licence under these rules shall be subject to thepayment of a fee and annually thereafter:

Provided that the licence of a keeper shall be payable onlyonce on filing of the application.

Suspension or revocation of a licence.

9. (1) The Director may, by order notified to licenceholders, at any time suspend a licence:

(a) if the licence holder is in breach of any condition ofthe license;

(b) if the licence holder is in breach of these rules or anyother legislation applicable to the breeding, keeping or fatteningof swine as the case may be;

(c) if it is the Director’s opinion that there is a risk ofthe introduction or spreading of disease.

(2) Suspension shall be for a period of time specified in theorder and subject to the conditions contained in the same.

(3) In suspending a licence the Director may, as the case maybe:

(a) impose any conditions deemed as necessary;

(b) halt the transfer of any or all animals to which thelicence refers including to slaughterhouses;

(c) order the slaughter and, or culling of any or allanimals affected by the order of revocation or suspension in anapproved slaughterhouse;

(d) order the culling of animals on the site where theywere being reared in a manner that is effective and humane;

(e) order the disposal of carcasses in accordance withthe Animal By-Products Regulation (Regulation EC 1069/2009);

(f) take any other measures he may deem necessary.

Validity of licences.

10. (1) Licences for fatteners and breeders shall be issuedfor a term of one calendar year and, unless otherwise suspended orforfeited, shall be renewable subject to the continued compliance withthe requirements of these rules including the payment of the relevantfee applicable thereto.

(2) Licences for keepers shall be valid for the entire lifetime ofthe swine kept as a pet.

(3) The licenses referred to in sub-rules (1) and (2) may onlybe issued once the provisions of these rules are complied with to thesatisfaction of the Director and once the prescribed licensing fees arepaid in accordance with rule 25.

Approval of site in which to rear swine.

11. No person shall rear swine in any place which has not beeninspected and approved by the Veterinary Services and licensed as aswine farm.

Illegal holdings of swine.

12. (1) The Director shall have the right to enter, withoutprior notice, any premises where there is the suspicion that any swineis being kept or reared without the appropriate licence.

(2) Any unregistered site where swine are found shall bedeemed to be in breach of these rules and the Director may,notwithstanding any other action which may be taken in terms ofthese rules, act upon such a violation by applying the provisions laiddown in rule 22.

Plans, extension and alterations of sites in which to rear swine.

13. (1) Each application for a licence to rear swine shall beaccompanied by a permit, including development permits, and plansof the site of rearing issued by the relevant competent authorities.

(2) Extensions or alterations to sites within which to rearswine may only be carried out following the obtainment of relevantpermits and subject to the approval of the Director.

Movement of swine.

14. (1) Swine shall not be moved from one location toanother unless the said movement is allowed with the prior writtenapproval of the Director.

(2) Approval of the Director for the movement of swine shallbe sought through the submission of the appropriate form containingthe details established in Schedule IV.

(3) Any person moving swine from any location to anothershall do so in an acceptable and humane manner and in a vehicleassuring the right conditions for the well-being of the animal. Thesaid person shall also carry with him the Director’s written approvalwhich authorises the movement of the swine.

Swill, waste and by-products.

15. (1) Swill and domestic waste shall not be fed to swine.

(2) Animal by-products (except international catering waste)may be authorised as feed for swine by the Director in accordancewith the Animal By-Products Regulation (Regulation No. EC 1069/2009).

(3) The Director may authorise the use of by-products of foodindustries as feed for swine when he is satisfied that the originatorthereof is registered with the Veterinary Services and is subject toregular controls according to relevant legislation in force.

Prohibition to collect, transport, swill, waste or by-products.

16. (1) No person licensed to rear swine shall collect ortransport swill, waste, or by-products.

(2) No vehicle used for the collection or transport of swill,waste or by-products shall be kept in any site approved as a swinefarm.

(3) The Director may authorise any person licensed to rearswine to collect and transport by-products allowed as feed for swinein accordance with rule 15(2) and (3).

On-farm feed producers.

17. Licensed swine breeders and fatteners may have a feedingmill or feed mixing technology on the site where the swine are beingreared provided that the site is registered and, or approved in line withthe provisions of Regulation (EC) No. 183/2005 laying down the

requirements for feed hygiene.

Acquisition of weaners.

18. (1) No licensed fattener or breeder shall acquire swinefrom anyone other than a holding and subject to such swine’sidentification as well as the obtainment of the necessary movementauthorisation in accordance with rule 14.

(2) Licensed keepers shall only acquire swine followingauthorisation to do so after an application for movement of the swinewhich is upheld by the Director prior to the movement.

Compliance to other laws or regulations applicable to swine.

19. A person licensed to rear swine under these rules shall notbe exempt from compliance with the requirements of any other law orregulation applicable to swine from time to time.

Keeping of swine as pets.

20. Swine may be kept as a pet on the following conditions:

(a) the intended keeper is to be approved as such afterapplying for a licence to keep swine as a pet in terms of theserules;

(b) swine shall be identifiable by a microchip insertedbeneath the skin of the left ear by a warranted veterinarian;

(c) on payment of the prescribed fee, a licence shall beissued by the Director provided that all provisions of these ruleshave been complied with;

(d) there may be no more than two swine on one siteand no more than one swine shall be kept per person;

(e) swine are only to be moved from approved siteswith the prior approval of the Director except for emergencyveterinary visits which are to be confirmed as such in writing bythe veterinarian attending to the swine kept as a pet;

(f) male swine shall be rendered surgically sterilethrough castration;

(g) breeding of swine by keepers is prohibited;

Cap. 439.

(h) persons applying for a licence in terms of these rulesshall be eighteen years old or over and able to take charge of aswine kept as a pet. Any person convicted of offences againstthe Animal Welfare Act shall be forbidden from keeping aswine or applying for a keeper licence;

(i) the Director shall be notified within seven days from

when any licensed swine kept as a pet dies;

(j) the Director shall be notified within forty-eighthours by a keeper in the case of the loss of a licensed swine keptas a pet through an appropriate means of notification as may bestipulated by the Director from time to time;

(k) carcasses of swine kept as pets shall never enter thefood-chain or otherwise be used for human or animalconsumption. The said carcasses are to be disposed of in termsof the Animal By-Products Regulation (Regulation No. EC1069/2009).

Movement of swine into and outside of Malta.

21. (1) Swine may only be imported or moved into Maltafrom EU Member States or third countries in terms of the legislationfrom time to time in force governing importation, trade and transport.

(2) Competent authorities must be notified of any swine due toenter or leave Malta within forty-eight hours prior to the transfer. Anyswine entering Malta as a pet must be immediately identified with amicrochip in accordance with rule 20(b) and registered with theVeterinary Services upon arrival.

(3) No swine shall enter Malta from within a Member Stateand, or third country deemed by the Director to be infected by anyrelevant disease.

Enforcement.22. The Director may, at his discretion:

(a) order the suspension of all movements into and outof approved sites as well as into or out of Malta for any reasondeemed necessary for the protection of current stock or due tonon-compliance by a licence holder with these rules or with anylicence condition;

(b) order the slaughter of swine deemed unfit forkeeping or for human consumption based on the results of aninspection;

(c) order the adequate disposal of carcasses deemedunfit for consumption or other use following an ante or postmortem inspection;

(d) order the destruction and disposal of swine orderivative products deemed unfit for consumption in accordancewith paragraph (c);

(e) order the return of swine to its place of origin if

there results to be any breach of these rules;

(f) carry out or make any other order deemed fit by theDirector.

Swine control. 23. (1) A Police officer or any officer authorised by theDirector may seize and detain any swine for the purpose ofidentifying it.

(2) Breeders, fatteners and keepers shall not abandon theirswine.

(3) No swine shall be allowed in a public place except forexhibitions, shows, fairs and similar activities without the priorapproval of the Director.

Expenses. 24. The cost of any action taken or ordered by the Director interms of these rules shall always be borne by the owner of the swine.

Licensing fees. 25. (1) Breeders and fatteners shall apply with the Directorfor a licence using the form containing details in Schedule I and theyshall thereafter pay the annual licensing fee.

(2) Keepers shall apply with the Director for a lifetime licenceusing the form in Schedule I and they shall pay a one-time licensingfee.

Offences and penalties.

26. Any person who acts in contravention of these rules shallbe guilty of an offence and shall, on conviction, be liable to thepenalties contemplated in the Act.

Pre-requisites for holding of a Licence to Rear Swine

1. Environment and Resources Authority permit with approved plans foranimal holding for new applicants.

2. Proven experience in pig husbandry or possession of relevantqualification equivalent to Malta Qualification Framework Level 4 oran equivalent, relevant and recognised qualification as deemedappropriate by the Director.
