بقلم المحكمة‑ أدين جميس إيريك مور بجناية حيازة الكوكايين الخام بقصد الترويج خالفا ألحكام المادة 841 بفقرتيها (أ)(1) و(ب)(1)من الفصل 21 من مجموعة قوانين الواليات المتحدة األمريكية.

مع األخذ باالعتبار كمية الكوكايين المصنع٬ احتسب القاضي نطاق الحكم واجب التطبيق على قضية مور في تقرير ما قبل النطق بالحكمبموجب إرشادات الحكم في الواليات المتحدة األمريكية٬ الذي ينص على حبس المدان في مثل هذه القضية مدة تتراوح بين 151 و 188شهرا.  وعند النطق بالحكم٬ طلب مور إلى المحكمة اإلقليمية أن تفرض عليه حكما أقل من الحد األدنى المنصوص عليه باإلرشاداتوذلك على ضوء قرارنا في قضية (الواليات المتحدة األمريكية ضد بوكر) وكذلك على ضوء المعاملة التفاضلية للكميات المتشابهة

للكوكايين المصنع والكوكايين الخام.

إال أن المحكمة اإلقليمية رفضت الطلب قائلة: “فيما يخص الفرق بين الكوكايين الخام والكوكايين المصنع٬ فهذا هو القانون.  إنني أطبقالقانون كما هو قائم اآلن.  أما قضية تغييره فهو أمر مرهون بالكونغرس.  فالكونغرس هو الذي ينظر في اإلرشادات ويقرر ما إذا كان

سيضعها حيز النفاذ أم ال. …وليس ذلك شأن القضاة بل هو شأن المشرعين.  ولقد أديت قسما أن أطبق القانون وهذا ما سوف أفعل في هذاالحكم.”   (الملحق ج لطلب التمييز 55‑56).  وهكذا٬ حكمت المحكمة اإلقليمية على مور بالحبس 188 شهرا وإخضاعه لست سنوات من

الرقابة.

لم يرض مور بالقرار فاستأنف الحكم لدى محكمة االستئناف في الواليات المتحدة األمريكية للدائرة الثامنة التي أكدت على اإلدانةوالحكم. (الواليات المتحدة ضد مور).  وردا على ادعائه أن المحكمة اإلقليمية كان عليها أن تأخذ باالعتبار التفاوت بين الكوكايين المصنعوالخام٬ قالت المحكمة “أصابت المحكمة اإلقليمية في استنتاج أن: ال قضية بوكر وال المادة 3553(أ) من مجموعة قوانين الوالياتالمتحدة٬ الفصل ٬18 تخول المحكمة اإلقليمية برفض نسبة كمية الكوكايين الخام إلى الكوكايين المصنع التي نص عليها الكونغرس

والمتبعة في اإلرشادات.”

وبينما كان طلب التمييز الذي تقدم به مور ما زال قيد الدراسة٬ أصدرت هذه المحكمة رأيها في قضية كمبرو ضد الواليات المتحدةمستخلصة أنه “يجوز للقاضي أن يأخذ بعين االعتبار الفرق بين معاملة اإلرشادات لجرائم الكواكيين الخام والمصنع” عند تطبيق المادة

3553(أ) من الفصل 18 لمجموعة قوانين الواليات المتحدة األمريكية “حتى في القضايا العادية”.

وبذلك قبلنا طلب التمييز المقدم من مور ورددنا القرار المميز موضوعا للدائرة الثامنة لتعيد النظر فيه على ضوء قضية كمبرو.  وعندإعادة النظر في الحكم ودون مرافعات جديدة٬ أكدت الدائرة الثامنة على الحكم مجددا وفي هذه المرة قالت المحكمة: “لعدم صدور أي

معارضة في ذلك الحين من الدائرة الثامنة [أي بخصوص القرارات التي مارس فيها القضاة االجتهاد والسلطة التقديرية]٬ فإننا نفترض أنالمحكمة اإلقليمية كانت تدرك أن قضية بوكر منحتها السلطة التقديرية في النزول عن الحد األدنى للحكم وفقا ألثر إرشادات الكوكايين

المصنع على المدعى عليه٬ لكنها مع ذلك اختارت عدم ممارسة هذه السلطة التقديرية.”

إثر ذلك٬ ترافع مور عن نفسه دون محام وقدم مجددا طلبا لتمييز القرار قائال إن تشخيص الدائرة الثامنة الجديد لمحضر المحكمة اإلقليميةخاطئ (يشوبه القصور) وأنه كان من الواضح أن “المحكمة اإلقليمية ظنت ألت القضاة ال يتمتعون بحق ممارسة السلطة التقديريةلرفض” النسبة المحددة في اإلرشادات.  توافق الواليات المتحدة على أن الدائرة الثامنة قد جانب الصواب ونحن نرى ذلك أيضا.

عندما قالت المحكمة اإلقليمية ” فالكونغرس هو الذي ينظر في اإلرشادات ويقرر ما إذا كان سيضعها حيز النفاذ أم ال. …وليس ذلك شأنالقضاة بل هو شأن المشرعين” فإنها بذلك  تظهر أنها لم تكن تعتقد أنها تتمتع بالسلطة التقديرية التي مورست في فترة الحقة في قضيةكيمبرو.  وقد أقرت الدائرة الثامنة ذلك في قرارها األول واصفة “المحكمة اإلقليمية على أنها استنتجت (وأصابت في استنتاجها وفقا

للسابقة القضائية للدائرة الثامنة) أنها لم تكن “مخولة …لرفض” التفاوت بين الكوكايين المصنع والكوكايين الخام.   وعلى ضوء تعليقاتالمحكمة اإلقليمية عند النطق بالحكم كان على محكمة االستئناف أن ترد القضية إلى المحكمة اإلقليمية إلعادة الحكم على ضوء قضية

كيمبرو.  ونحن ال نبدي أي وجهة نظر حول كيفية ممارسة المحكمة اإلقليمية لسلطتها التقديرية عند إعادة الحكم.

لذلك قررنا قبول طلب التمييز ورد القرار المميز موضوعا وكذلك قررنا قبول طلب مور بتأجيل دفع الرسوم.  يفسخ القرار المميزموضوعا ويعاد إلى الدائرة الثامنة إلعادة النظر فيه بما ينسجم مع هذا الرأي.
