Introduction (for SULEV (PZEV)only)

Certain 2007 328i models are certified to Califor-nia’s stringent Super Ultra Low Emission Vehicle(SULEV) standards and also qualify as a PartialZero Emission Vehicle (PZEV) under the Califor-nia Air Resources Board Zero Emission Vehicleprogram. In addition to very low tailpipe and zero-evaporative emissions, this PZEV certificationincludes a unique warranty when the vehicle isregistered in California and certain Northeasternstates as indicated in the SULEV (PZEV) sectionbeginning on page 40. SULEV(PZEV) modelsregistered in Oregon and Washington are cov-

ered by the California Emission Warranty begin-ning on page 37.

The emission certification standard can be veri-fied on the Vehicle Emission Control Informationlabel located in the engine compartment. A rep-resentative label is shown below; the SULEV(PZEV) certification is stated on the bottom line.

The BMW Maintenance Program -

All 2007 3 SeriesThe BMW Maintenance Program is a benefitdesigned to help reduce the cost of ownership.

2007 3 Series vehicles purchased from anyAuthorized BMW center in the United States orPuerto Rico are covered by The BMW Mainte-nance Program for 48 months or 50,000 miles,whichever occurs first. Coverage begins on thedate of first retail sale or the date the vehicle isfirst placed in service as a demonstrator or com-pany vehicle, whichever is earlier.

Any authorized BMW center in the United Statesor Puerto Rico will perform the scheduled main-

tenance services on your vehicle at no expenseto you. The maintenance schedule intervals arebased on average driving conditions and opera-tion. Should you request more frequent main-tenance service, the cost of these serviceswill not be covered by the MaintenanceProgram.

Coverage

The BMW Maintenance Program covers allfactory recommended maintenance, as deter-mined by the Condition Based Service (CBS)system. Additional items that need replacement

due to normal wear and tear, and that are not cov-ered by the original New Vehicle Limited War-ranty - such as brake pads, brake rotors, andwiper blades inserts - are included, providedwear and tear exceeds BMW wear limits. Anyadjustments required due to normal operatingconditions are also included. See pages 5-6 of this booklet for additional information.

Maintenance Intervals

Time intervals should be followed using themaintenance interval as indicated by the BMWCondition Based Service (CBS) display.

This BMW Service and Warranty InformationBooklet should be presented to your BMW cen-ter when maintenance is required. Your BMWcenter will stamp this booklet documenting theservices or maintenance performed.

Exclusions from coverage

– Items reimbursable under your New VehicleLimited Warranty.

– Gasoline.

– Windshield washer additive (except when inconjunction with scheduled maintenance).

– Tires, wheel alignment, tire balance androtation.

– Wear and tear of soft trim items, such as: seats,carpets, moldings, headliner, door panels andall chrome trim.

– Damage detected when performing the rustperforation inspection.

– Damage which results from negligence,

improper operation of the vehicle, wear and tearor deterioration due to driving habits or condi-tions, improper repair, environmental influ-ences, flood, accident or fire damage, road saltcorrosion, alteration, installation of non-BMWaccessories, or use of improper, poor quality orcontaminated fuel.

– Altered or unreadable Vehicle IdentificationNumber (VIN) or odometer irregularities or vehi-cles where the true mileage cannot bedetermined.

– Maintenance or repair after the vehicle isdeemed a total loss.

– Maintenance or repairs performed by otherthan an Authorized BMW center within theUnited States or Puerto Rico.

– Vehicles used in competitive events.

– Oil changes performed outside the recom-mended maintenance intervals as indicated bythe Service Interval Display.

Maintenance Upgrade Option

Please contact your authorized BMW center forinformation and availability on the optional Main-tenance Program Upgrade for coverage up to 6years and 100,000 miles.

Maintenance Program

The BMW Maintenance Program has beendevised with the following objectives: to maxi-mize vehicle safety, reliability, and resale value by

minimizing breakdowns resulting from wear, and

minimizing cost and inconvenience by comput-ing maintenance intervals based upon the spe-cific manner in which each individual vehicle isdriven.

Maintenance intervals on motor vehicles haveconventionally been specified based upon accu-mulated mileage. However, driving conditionshave a major influence on routine maintenancerequirements; distance traveled is only one of thesignificant factors. A vehicle driven for 50,000miles of short trips in the city with numerous coldstarts, prolonged periods of idling, stop-and-godriving, and high engine speeds during accelera-tion requires more frequent maintenance inter-

vals than a vehicle driven for 50,000 miles forlong distances at low engine speeds primarily atoperating temperature.

The advanced technologies at BMW have led tothe development of the unique BMW ConditionBased Service (CBS) system which computesthe actual optimum maintenance requirementsbased not only upon the accumulated mileage,but taking into account important factors such ashigh or low engine speeds, short or long trip driv-ing, and condition of the engine oil and brakepads.

The BMW Maintenance Program

Condition Based Service (CBS)

CBS is a further development of the ServiceInterval Indicator System. Sensors and sophisti-cated algorithms take even more detailedaccount of the various conditions of vehicle use.

The remaining times for selected maintenancetasks as well as any legally prescribed dates aredisplayed to you individually:

CBS thus determines the current and futuremaintenance requirements. This data can also beread from the vehicle key by your BMW ServiceAdvisor and used to propose the optimum scopeof maintenance.

Have maintenance and repair work performed byyour BMW center. Make sure that the mainte-

nance work is stamped in this Service and War-ranty Information Statement. These entries arethe evidence of regular maintenance of your vehi-cle and a requirement for warranty claims.

Disconnecting the battery during periodsof long-term storage will interrupt the

calculation of time-based services. Have all itemsrequiring time-based maintenance, such asbrake fluid and possibly also the engine oil andmicrofilter, brought up to date by your BMW cen-ter. Also see the section on battery care on page15 of this statement.

The distance remaining until your next servicebriefly appears when you switch on the ignition.

The Info Display immediately switches toits compute mode when you press one of the two buttons in the turn signal indicatorlever.

Control Display screen contents

The current Status of Service items determinedby the CBS are shown in the Control Display.

You can view additional information on serviceand maintenance procedures by selecting the

OB data menu.

Confirm to exit the list.

The vehicles current service status is automati-cally saved in the vehicles ignition key. The Ser-vice Advisor at your BMW center has a devicecalled a key reader. When your Service Advisorinserts your key into the key reader, all pertinentvehicle and servicing data will be available, and acustomized maintenance checklist is printed outbased on the specific operations called for by theCondition Based Service.

The performance of certain subsequent mainte-nance elements, as required by the BMW New

Vehicle Limited Warranty, will be specified atintervals computed by the BMW Service IntervalIndicator as follows:

– Oil Service: Engine oil should be changed withthe engine at operating temperature. Note:Change oil at least once a year.

All 2007 model year 3 Series vehicles are facto-ry-filled with BMW High Performance Syntheticoils. At the time of the printing of this booklet, thefollowing oils are strongly recommended andapproved by BMW:

• BMW High Performance 5W-30 Synthetic Oil(BMW part number 07 51 0 017 866)

Mobil 1 0W-40BMW is evaluating various synthetic oils forinclusion in our list of recommended engine oils.For the most current list of synthetic oils, pleasecontact your BMW center, or call BMW of North

America, LLC. at 1 800 831-1117. You can alsoobtain this information from our website,www.bmwusa.com/.

BMW recommends that you check your engineoil level whenever you add fuel to your vehicle. If you need to add oil between oil changes and areunable to obtain BMW High Performance Syn-thetic Oil, Mobil 1 or another special oil on thelist, use a synthetic oil with an API rating of SH orhigher.

The following maintenance elements must beperformed at the mileage/time stated (time inter-vals begin from the vehicles production date):

– Brake Fluid Service: Change brake fluid everytwo years, or when specified by CBS.

– Oxygen Sensor Service: The oxygen sensordeteriorates strictly on a mileage basis andmust therefore be replaced every 120,000miles to maximize vehicle fuel economy andminimize exhaust pollution. For the 328iSULEV (PZEV) models, the oxygen sensormust be replaced every 150,000 miles. Thereplacement of the oxygen sensor is requiredunder the terms of the applicable BMW emis-sion system warranties.

– Spark Plug Service:328i — Replace at 100,000 miles, or whenspecified by CBS.335i — Replace at 45,000 miles, or when spec-

ified by CBS.– The engine coolant has a lifetime rating and

does not need to be changed.

For your convenience, you may also wish to haveyour BMW center perform any necessary opera-tions to fulfill any state inspection requirementsin your area concurrent with the maintenanceelements specified above during other repairs.

Make sure that confirmation of maintenancework is always entered in this Service and War-ranty Information Booklet. You may need this forany warranty claims that become necessary, andlater on as evidence that your car has been given

the correct and regular maintenance that justifiesits resale or trade-in value.

BMW has applied the most modern technologi-cal advances not only to the design and produc-tion of your vehicle, but also to computing of the

• Check operation of horn, headlight flasher andhazard warning flashers.

• Check instrument and control lighting andheater/air-conditioning blower.

• Check lighting system: turn signals, back-up,license plate, interior (incl. map, reading lights),glovebox, flashlight, luggage area lights.

• Safety belts: check condition and function.

• Check windshield wiper and washer jetpositions.

Battery Care

If your car is driven only for short distances of less than 10 miles over a prolonged period of time, without an occasional drive at highwayspeeds, the engines charging system will notmaintain the battery. Insufficient use of the vehi-cle could result in short term starting problems

and in the long term could damage the battery.In case the car is not operated for several weeksit is advisable to:

a. consider using a proper trickle charger, follow-ing the charger manufacturers instructions, tomaintain the batterys state of charge; or

b. consult your BMW center regarding batteryremoval. Once removed, the battery must becharged and stored in a cool, dry place whereit can be protected from freezing. If the batterywill be stored for over 3 months, it must berecharged every 3 months, or else it willbecome damaged and useless.

Please consult with your BMW center for furtherguidance and information.

Corrosion Protection

Extensive corrosion protection measures imple-mented by BMW now make it possible to offer atwelve-year unlimited milage anti-corrosion war-ranty against rust perforation on your vehicle pro-vided that the vehicle is maintained inaccordance with the provisions of the New Vehi-cle Limited Warranty as outlined in the WarrantySection of this Booklet (page 31).

The major degree of corrosion protection is dueto the electrophoretic dip painting process whichcathodically deposits paint particles on all bodyparts, attracting paint particles into the minutestcavities or seams. Body parts are designed toprovide optimum corrosion protection.

During manufacture, exterior body parts receivean additional corrosion protection coat. Hood,trunk, doors and other body parts are coated withPVC and sealed from the outside.

All floor panels receive a resilient coating of PVCfor maximum protection against damage due tostones, etc.

Corrosion protection materials tested over manyyears are applied to the surfaces of cavities andto the entire underside of the vehicle during andafter assembly.

Requirements for maintaining the 12-year unlim-ited mileage anti-corrosion warranty are outlined

in the Warranty Section of this Booklet (page 32).

Restoring corrosion protection

Please take care that anti-corrosion material isreplaced when your car is repaired after body orchassis damage.

BMW will not accept any liabilityfor any partsand accessories not approved by BMW.

Underbody maintenance

The underbody has to be cleaned at least once ayear, in spring, with plain water in order to removemud, chemical sediments and other deposits. If those materials are not removed, corrosion (rust)will occur on metal components.

Your BMW center will do this anti-corrosion ser-vice for you.

Do not apply additional undercoating or rust-proofing on or near the exhaust manifold, exhaustpipes, catalytic converter or heat shields. Duringdriving,thesubstanceusedforundercoatingcouldoverheat and cause a fire.

Customer Assistance -Notification

During a specific period (for example, the earlierof 12 months or 12,000 miles, though this periodvaries by state), some states require us or ourauthorized BMW center, to repair in a reasonable

number of attempts, any defect or conditionwhich substantially impairs the use, value, orsafety of a new vehicle sold, leased or registeredin that state.

A reasonable number of attempts is generallydefined as (i) four or more attempts to repair thesame defect (the number of attempts vary bystate) or (ii) the vehicle is out of service by reasonof one or more repair(s) for more than a cumula-tive total of 30 days (this period varies by state),except for delays created by conditions beyondour control.

If we are unable to correct a defect or conditioncovered by these statutes in a reasonable num-

ber of attempts, we may be obligated either toreplace the vehicle or reimburse the owner/les-see in an amount equal to the purchase price orlease payments paid by the owner/lessee, lessthe amount directly attributable to use of thevehicle by the owner/lessee.

If your concern is still not resolved to your satis-faction, BMW offers additional assistancethrough BBB AUTO LINE in ARKANSAS, CALI-FORNIA, GEORGIA, IDAHO, IOWA, KENTUCKY,MARYLAND, MASSACHUSETTS, MINNESOTA,PENNSYLVANIA, OHIO, and VIRGINIA. BBBAUTO LINE is a dispute resolution programadministered by the Council of Better BusinessBureaus. BBB AUTO LINE resolves disputesthrough mediation or arbitration. Mediation is aninformal proceeding whereby a neutral third party(mediator) helps the parties to find an acceptableresolution. Arbitration is also an informal pro-ceeding in which an impartial third party renders

a decision after a hearing at which both partieshave an opportunity to be heard. You can selectmediation or arbitration or both.

5. BBB AUTO LINE staff may try to help resolve

your dispute through mediation. If mediationis not successful, or if you do not wish to par-ticipate in mediation, claims within the pro-grams jurisdiction may be presented to anarbitrator at an informal hearing. The arbitra-tors decision should ordinarily be issuedwithin 40 days from the time your complaintis filed; there may be a delay of 7 days if youdid not first contact BMW about your prob-lem, or a delay of up to 30 days if the arbitra-tor requests an inspection/report by animpartial technical expert or further investiga-tion and report by BBB AUTO LINE.

6. You are required to use BBB AUTO LINEbefore asserting in court any rights or reme-dies conferred by California Civil Code Sec-tion 1793.22. – The same nonconformity [a failure to con-form to the written warranty that substan-

tially impairs the use, value or safety of the

vehicle] results in a condition that is likely tocause death or serious bodily injury if thevehicle is driven AND the nonconformity hasbeen subject to repair two or more times byBMW or its agents AND the buyer or lesseehas directly notified BMW of the need forthe repair of the nonconformity; OR

The same nonconformity has been subject torepair 4 or more times by BMW or its agentsAND the buyer has notified BMW of the needfor the repair of the nonconformity; OR

The vehicle is out of service by reason of repair of nonconformities by BMW or its

agents for a cumulative total of more than 30calendar days after delivery of the vehicle tothe buyer.

It is available for U.S. version BMWs in all 50states, Canada, and Puerto Rico 24 hours a day,365 days a year.

It is a valuable benefit provided to you at no addi-tional cost. (Subject to certain limitations andexclusions noted on page 29).

Owners Eligibility

You are covered if your vehicle is:

– A new BMW automobile, distributed by BMWNA, and purchased at an authorized BMW cen-ter, OR;

– A new BMW automobile, purchased under theBMW NA European Delivery Plan, OR;

Be prepared to give:

1. Your name and address.

2. Your complete Vehicle Identification Number(found on your vehicle registration, your per-manent Roadside Assistance card or on thebottom drivers side of your windshield).

3. Model description of your vehicle.

4. Date of purchase.

5. License plate number of your vehicle.

6. Vehicle location (including nearby cross-roads/intersections, highway mile markers,street numbers, landmarks, etc.).

7. Location you are calling from (including atelephone number where you can bereached). If you are calling from a publicphone wait there for the return call. Do notleave this location without informing theRoadside Assistance service representative.

8. A description of your vehicles problem. Spe-cific and accurate information will enable the

Roadside Assistance service representativeto provide the proper help.

Emergency Valet service. Should there be aneed beyond BMW Roadside Assistance, Emer-gency Valet service will provide a personal assis-tant who will help in every way to get you to yourfinal destination. Emergency Valet service willhelp you locate a rental car or taxi agency, hotelor even help procure airline reservations. In theevent of an emergency, this service will assistyouin getting information out to the proper partywhether it is business or personal. If we areunable to contact one of yor party, the messagerelay service will document the information, andwill make reasonable efforts to deliver the mes-sage to the message recipient.

Personal Trip Routing. Leave the planning tous. Simply give one of our Roadside Assistance

service representatives a call, and well provideyou with detailed, easy to read, computerized tripitinerary and companion map package. Pleaseallow up to two weeks to process your request.

The cost for parts and fuel, when used on-site,are the responsibility of the owner/driver. TheNew Vehicle Limited Warranty does not cover anyof the above on-site services.

Lock-Out

Your BMW is equipped with an advanced entrysystem, which cannot be bypassed by traditionallocksmith methods without significant damage toyour vehicle. BMW encourages you to alwayscarry your spare wallet key separately from yourother keys. However, in the event that you findyourself locked out, a simple telephone call toRoadside Assistance will help you get back onthe road. A representative will help you findtransportation or arrange towing service to thenearest BMW center. Related towing costs will becompensated up to $100 per incident. You, orthe person driving your vehicle, are responsiblefor any expenses related to replacement keys.

Towing Service

In the event of a mechanical breakdown normallycovered under the New Vehicle Limited Warranty,your vehicle will be transported (at no cost) to thenearest authorized BMW center. Your vehicle isalso covered in the event of an accident orcollision.

If a breakdown occurs after normal businesshours, your vehicle will be transported to a securelocation and transported to the nearest autho-rized BMW center on the next business day.

If you request that the vehicle be taken to a loca-

tion other than the nearest authorized BMW cen-ter, any additional expense will be yourresponsibility.

However, you may request (at no cost) to betaken to a different BMW center as long as it iswithin 50 additional miles of the nearest BMWcenter.

Towing requests for vehicles disabled because of casualty, fire, act of God, or violation of law (fed-eral, state or local) are provided at the expense of the owner/driver.

If it is necessary for you to have your vehicletowed through your own arrangements, youmust contact BMW Roadside Assistance for

Sign-and-Drive

Typically, if you are within the terms of your war-ranty, the services you receive under the BMWRoadside Assistance program will not requirepayment. In most cases, you will simply sign areceipt from the provider of services.

Trip Interruption Benefits

Trip interruption benefits are provided formechanical breakdowns as follows:

– Breakdowns that are warranty related, and;

– Must occur in excess of 100 miles from thedrivers residence, and;

– Repairs cannot be completed during normalbusiness hours on the same day of breakdown.

Reimbursements will be made for meals, lodging,car rentals, and alternate transportation to bringthe driver and the BMW automobile togetherafter the vehicle has been repaired by an autho-rized BMW center. Original receipts must accom-pany all reimbursement requests.

Trip interruption coverage is limited to $750.00per incident, for a maximum of five days perincident.

Always contact BMW Roadside Assistance fortrip interruption benefits. They will assist in mak-ing all the necessary arrangements.

Car Rental Discounts

Discounts are available from Hertz and Enter-prise car rental companies. Benefits may varywith each company and location, and are subjectto change without notice.

Warrantor

BMW NA warrants 2007 U.S. specification vehi-cles distributed by BMW NA or sold through theBMW NA European Delivery Program againstdefects in materials or workmanship to the firstretail purchaser, and each subsequent purchaser.

Warranty Period

The warranty period is 48 months or 50,000miles, whichever occurs first.

Warranty Begins

This warranty begins on the date of first retailsale, or the date the vehicle is first placed inservice as a demonstrator or company vehi-cle, whichever is earlier.

Warranty Coverage

To obtain service under this warranty, the vehiclemust be brought, upon discovery of a defect inmaterial or workmanship, to the workshop of anyauthorized BMW center, during normal businesshours. The BMW center will, without charge for

parts or labor, either repair or replace the defec-tive part(s) using new or authorized remanufac-tured parts. The decision to repair or replace saidpart(s) is solely the prerogative of BMW NA. Partsfor which replacements are made become theproperty of BMW NA.

Safety Belt Warranty - Kansas

Safety belts are covered under the BMW NewVehicle Limited Warranty for defects in materialor workmanship for a period of 10 years, unlim-

ited mileage from the date of purchase. In orderto be eligible for this coverage, the vehicle mustbe a new car retailed in the State of Kansas andthe repair performed by an authorized BMW cen-ter in Kansas.

This warranty does not apply to the following:

Damage which results from negligence, improperoperation of the vehicle, improper repair, lack of or improper maintenance, environmental influ-

ences, flood, accident or fire damage, road saltcorrosion, or use of improper or contaminatedfuel.

Damage to the engine, transmission or anyrelated component caused by improper shiftingof the transmission.

Maintenance services and parts when replacedduring maintenance such as spark plugs, lubri-cants, fluids, engine tuneup parts, replacementof filters, coolant, and refrigerant.

Failure to maintain the vehicle properly in accor-dance with the instructions in the Owners Man-ual or the Service section of this Statement, that

results in the failure of any part of the vehicle.Modification of the vehicle or installation of anyperformance accessories or componentsattached to the vehicle which alters the originalengineering and/or operating specifications or

Should you experiencedifficulty in obtaining warranty service from a tiremanufacturer, your authorized BMW center willassist you in resolving the difficulty.

Non-BMW Parts - While you may elect to usenon-genuine BMW parts for maintenance orrepair services, BMW NA is not obligated to payfor repairs that include non-genuine BMW parts

or for any damage resulting from the use of non-genuine parts.

BMW will not accept any liabilityfor any partsand accessories not approved by BMW.

REQUIRED MAINTENANCE:

In order to keep this warranty in effect, the vehi-cle must be inspected at least every two years.Any areas requiring preventative maintenancemust be repaired.

The Inspection/Maintenance consists of:a. Washing the chassis before inspection, if nec-

essary, due to dirt accumulation.

b. Repairing any damages to undercoating orpaint due to stone chips, gravel erosion,scratches, or other external influences.

Federal Emissions System Defect

Warranty (Valid only in the U.S.A.and Puerto Rico)

This warranty applies only to U.S. specificationvehicles distributed by BMW of North America(BMW NA) or sold through the BMW NA Euro-pean Delivery Program.

In accordance with the defect warranty provi-sions of section 207(b) of the Clean Air Act,BMW NA warrants to the first retail purchaser,and each subsequent purchaser, that the car (a)was designed, built and equipped so as to con-form, at the time of sale, with all regulations of the U.S. Environmental Protection Agency appli-cable at the time of manufacture and (b) is freefrom defects in materials and workmanshipwhich would cause it to fail to conform with appli-cable regulations for a period of 2 years or24,000 miles, whichever occurs first, except forspecific emission control components (as listedon page 36), for which the warranty period is 8years or 80,000 miles, whichever occurs first.

This warranty begins on the date of first retailsale, or the date the vehicle is first placed in ser-vice as a demonstrator or company vehicle,whichever is earlier.

Warranty claims must be made as soon as rea-sonably possible after a defect is discovered. Tomake a claim, the car must be brought to any

authorized BMW center during normal businesshours.

The BMW center will, without charge for parts orlabor (including diagnosis), either repair orreplace the defective part, if any. The decisionwhether to repair or replace said parts is solelythe prerogative of BMW NA and must beexpected to correct the failure of the warrantedpart. Parts for which replacements are madebecome the property of BMW NA. In all cases, areasonable time must be allowed for warrantyrepairs to be completed after the car is receivedby the BMW center.

For assistance in determining which specific

parts or components of your vehicle are coveredunder this warranty, please contact your BMWcenter.

It is the owners responsibility to have all sched-uled inspection and maintenance services per-formed (at the owners expense), as prescribed inthe maintenance schedule for the BMW Emis-sion Control System. Service intervals are com-puted by the onboard BMW service intervalindicator and displayed on the instrument panel.The instructions for proper maintenance and usecan be found in the Owners Manual. It is stronglyrecommended that any replacement parts usedfor maintenance, repair or replacement of emis-

sion control systems be certified BMW ServiceParts or BMW Authorized Remanufactured Parts.Without invalidating this warranty, the owner mayelect to have maintenance, repair or replacementof the emission control systems performed byany automotive repair establishment, or elect touse parts other than certified BMW ServiceParts. However, the cost of such service or partswill not be covered under this warranty, except inemergency situations. In an emergency situation,where an authorized BMW center or a warrantyreplacement part is not reasonably available(within 30 days), repairs may be performed at anyavailable service establishment using any equiva-lent part. BMW NA will reimburse the owner for

such emergency repairs (including labor, partsand diagnosis not to exceed BMW NA rates forlabor, parts, and diagnosis in said area) that arecovered under this warranty. Replaced parts andpaid invoices must be presented at a BMW cen-ter as a condition of reimbursement for emer-gency repairs not performed by a BMW center.

The use of replacement parts, which are not of equivalent quality, may impair the effectivenessof the emission control system. If other than cer-tified BMW Service Parts or Authorized Remanu-factured Parts are used for maintenance, repairor replacement of components affecting emis-sion control, the owner should obtain assurances

that such parts are warranted by their manufac-turer to be equivalent to genuine BMW parts inperformance and durability. BMW NA assumesno liability under this warranty with respect toparts other than genuine BMW parts.

However, the use of non-BMW replacement

parts or non-EPA certified parts does not invali-date the warranty on other components, unlessnon-BMW parts or non-EPA certified parts causedamage to warranted parts.

What is not covered

This warranty does not cover malfunctionscaused by any of the following: accident, flood,misuse, improper adjustment, modification, alter-ation, tampering, disconnection, improper orinadequate maintenance, use of leaded fuel orfuels containing more than 10% ethanol, or otheroxygenates with more than 2.8% oxygen byweight (i.e., more than 15% MTBE or more than3% methanol plus an equivalent amount of co-solvent).

The replacement of maintenance parts, such asspark plugs, filters and similar items used inrequired maintenance services, the repair orreplacement of maintenance parts beyond thefirst required inspection/maintenance, or if thepart has been replaced earlier for reasons otherthan it being defective.

The car or any part of the car unless a failurecauses the car to fail to conform to applicableemission regulations.

Any car on which the odometer has beenreplaced or altered and the true mileage cannot

be determined.The car, if the vehicle identification number isaltered or cannot be read, or if the car has beendeclared a total loss or sold for salvage purposes.

General

Federal Emissions PerformanceWarranty (Valid only in the U.S.A.and Puerto Rico)

In those states and jurisdictions that have estab-lished periodic vehicle emissions tests to encour-age proper vehicle maintenance and require thecar to pass an emissions test approved by theU.S. Environmental Protection Agency and:

1. The car was distributed by BMW of North

America (BMW NA), or sold through theBMW NA European Delivery Program; and

2. The car has been maintained and operated inaccordance with the instructions for propermaintenance and use set forth in the OwnersManual supplied with the car; and

3. The car fails to conform to the applicableemissions standards of the EPA as judged byan EPA approved emissions test; and

4. The failure to conform results or will result inthe owner of the car having to bear a penaltyor other sanction (including the denial of theright to use the car) under local state or fed-eral law if the non-conformity is not remediedwithin a specified period of time.

Then, in accordance with the provisions of sec-tion 207(b) of the Clean Air Act, BMW NA war-

rants that if the car is eligible for coverage under

this warranty, any non-conformities in the car,which cause it to fail an EPA-approved emissionstest will, without charge for parts or labor (includ-ing diagnosis), be adjusted, repaired, or replaced,at the option of BMW NA to proper specifica-tions, in order to make the car comply with appli-cable emissions standards. The decision toadjust, repair or replace parts is solely the pre-rogative of BMW NA and must reasonably beexpected to correct the failure of the warrantedpart.

This warranty begins on the date of first retailsale, or the date the vehicle is first placed in ser-vice as a demonstrator or company vehicle,whichever is earlier. This warranty continues for a

period of 2 years or 24,000 miles, whicheveroccurs first, except for specific emissions controlcomponents (as listed on page 36), for which thewarranty period is 8 years or 80,000 miles which-ever occurs first.

This warranty is made subject to the terms andconditions that apply to the Emission ControlSystem Warranty and the New Vehicle LimitedWarranty.

No claim under this warranty will be denied onthe basis of use of a properly installed EPA certi-fied emission part for maintenance and repair.

A vehicle manufacturer may deny an emissionperformance warranty claim on the basis of anuncertified replacement part used in the mainte-nance or repair of a vehicle only if the vehiclemanufacturer presents evidence that the uncerti-fied replacement part is either defective in mate-rials or workmanship or not equivalent from anemission standpoint to the original equipmentpart.

Maintenance, replacement, or repair of emis-sion control devices and systems may be per-formed by any automotive repairestablishment or individual using any certi-fied part.

Immediately after the car has failed an EPAapproved emission short test, your claim can be

made at any authorized BMW center. The BMWcenter will honor or deny your claim within thetime period specified by local or state laws (not toexceed 30 days), to avoid further penalties orsanctions. lf the claim is denied, the BMW center

The California Air Resources Board and BMW of North America (BMW NA) are pleased to explainthe emission control system warranty on your2007 vehicle. In California, new motor vehiclesmust be designed, built and equipped to meetthe States stringent anti-smog standards. BMWNA must warrant the emission control system onyour vehicle for the periods of time listed belowprovided there has been no abuse, neglect orimproper maintenance of your vehicle.

Your emission control system may include parts

such as the fuel injection system, the ignitionsystem, catalytic converter, and engine com-puter. Also included may be hoses, belts, con-nectors and other emission-related assemblies.

Where a warrantable condition exists, BMW NAwill repair your vehicle at no cost to you includingdiagnosis, parts and labor.

Manufacturers Warranty Coverage:

– For 3 years or 50,000 miles whichever occursfirst:

1. If your vehicle fails a Smog Check inspection,all necessary repairs and adjustments will bemade by BMW NA to ensure that your vehiclepasses the inspection. This is your emissioncontrol system PERFORMANCEWARRANTY.

2. If any emission-related part on your vehicle isdefective, the part will be repaired or replacedby BMW NA. This is your short-term emis-sion control system DEFECTS WARRANTY.

– For 7 years or 70,000 miles whichever occursfirst:

If an emission-related part specially noted onpage 40 as having coverage for 7 years or

70,000 miles is defective, the part will berepaired or replaced by BMW NA. This is yourlong-term emission control system DEFECTSWARRANTY.

Owners Warranty Responsibilities:

– As the vehicle owner, you are responsible forthe performance of the required maintenancelisted in your Owners Manual. BMW NA recom-mends that you retain all receipts coveringmaintenance on your vehicle, but BMW NAcannot deny warranty solely for the lack of receipts or for your failure to ensure the perfor-mance of all scheduled maintenance.

parts used for maintenance, repair or replace-ment of emission control systems be genuineBMW Service Parts or BMW AuthorizedRemanufactured Parts. Without invalidating thiswarranty, the owner may elect to have mainte-nance, repair or replacement of the emissioncontrol systems performed by any automotiverepair establishment, or elect to use parts otherthan BMW Authorized Remanufactured or genu-ine BMW Service Parts. However, the cost of such service or parts will not be covered underthis warranty, except in emergency situations. Inan emergency situation, where an authorizedBMW center is not reasonably available or a war-ranty replacement part is not available within 30

days, repairs may be performed at any availableservice establishment or by any individual usingany replacement part.

A repair not completed within 30 days consti-tutes an emergency. BMW NA will reimburse theowner for such emergency repairs (includinglabor, parts and diagnosis not to exceed BMWsuggested retail price for all warranted partsreplaced and labor charges based on the manu-facturers recommended time allowance for thewarranty repair and the geographically appropri-ate hourly labor rate) that are covered under thiswarranty. Replaced parts and paid invoices mustbe presented to a BMW center as a condition of 

reimbursement for emergency repairs not per-formed by a BMW center.

The use of replacement parts, which are not of equivalent quality, may impair the effectivenessof emission control systems. If other than genu-ine BMW Service Parts or Authorized Remanu-factured Parts are used for maintenance, repairor replacement of components affecting emis-sion control, the owner should obtain assurancesthat such parts are warranted by their manufac-turer to be equivalent to genuine BMW parts inperformance and durability. BMW NA assumesno liability under this warranty with respect toparts other than genuine BMW parts.

However, the use of non-BMW replacementparts does not invalidate the warranty on othercomponents, unless non-BMW parts causedamage to warranted parts.

What is not covered

This warranty does not cover malfunctionscaused by any of the following: accident, flood,misuse, modification, alteration, tampering, dis-connection, improper or inadequate mainte-nance, except if performed by an authorizedBMW center doing warranty repair work, use of leaded fuel or fuel other than as specified in theOwners Manual.

The replacement of maintenance parts, such asspark plugs, filters and similar items used inrequired maintenance services or the repair orreplacement of maintenance parts beyond thefirst replacement interval.

Any car on which the odometer has been

replaced or altered and the true mileage cannotbe determined.

The car, if the vehicle identification number isaltered or cannot be determined, or if the car hasbeen declared a total loss or sold for salvagepurposes.

General

The warranty gives you specific legal rights, andyou may also have other rights which vary fromstate to state.

In addition to very low tailpipe and zero-evaporative emissions, this PZEV certificationincludes a unique warranty when the vehicle isregistered in California, Massachusetts, Maine,

New York, Connecticut, Rhode Island or Vermont.SULEV(PZEV) models registered in Oregon andWashington are covered by the California Emis-sions Warranty; this coverage is described begin-ning on page 37.

Warranty Statement SULEV(PZEV)*Your Warranty Rights andObligations

The California Air Resources Board and BMW of North America (BMW NA) are pleased to explainthe emission control system warranty on your2007 vehicle. In California, new motor vehiclesmust be designed, built and equipped to meetthe States stringent anti-smog standards. BMWNA must warrant the emission control system onyour vehicle for the periods of time listed belowprovided there has been no abuse, neglect orimproper maintenance of your vehicle.

Your emission control system may include partssuch as the fuel injection system, the ignitionsystem, catalytic converter, and engine com-puter. Also included may be hoses, belts, con-nectors and other emission-related assemblies.

Where a warrantable condition exists, BMW NAwill repair your vehicle at no cost to you includingdiagnosis, parts and labor.

Manufacturers Warranty Coverage:

– For 15 years or 150,000 miles whicheveroccurs first:

1. If your vehicle fails a Smog Check inspection,all necessary repairs and adjustments will bemade by BMW NA to ensure that your vehiclepasses the inspection. This is your emissioncontrol system PERFORMANCEWARRANTY.

2. If any emission-related part on your vehicle isdefective, the part will be repaired or replacedby BMW NA. This is your emission controlsystem DEFECTS WARRANTY.

Owners Warranty Responsibilities:

– As the vehicle owner, you are responsible forthe performance of the required maintenancelisted in your Owners Manual. BMW NA recom-mends that you retain all receipts coveringmaintenance on your vehicle, but BMW NAcannot deny warranty solely for the lack of receipts or for your failure to ensure the perfor-mance of all scheduled maintenance.

– You are responsible for presenting your vehicleto an authorized BMW center as soon as aproblem exists. The warranty repairs should becompleted in a reasonable amount of time, notto exceed 30 days.

– As the vehicle owner, you should also be awarethat BMW NA may deny your warranty cover-age if your vehicle or part has failed due toabuse, neglect, improper maintenance or unap-proved modifications.

California Emission Control

System Limited Warranty SULEV(PZEV)*

This warranty applies to California certified vehi-cles distributed by BMW of North America (BMWNA) or sold through the BMW NA EuropeanDelivery Program, registered and operated pri-marily in California.

BMW NA warrants to the original purchaser andeach subsequent owner that the vehicle is:

a. designed, built and equipped so as to con-form with the applicable California AirResources Board emission standards.

b. free from defects in materials and workman-ship which cause any part that can affectemissions to fail to conform with applicablerequirements or to fail a California SmogCheck test or EPA approved short test for aperiod of 15 years or 150,000, whicheveroccurs first.

c. free from defects in materials and workman-ship in emission related parts for a period of 15 years or 150,000, whichever occurs first.

This warranty begins on the date of first retailsale, or the date the vehicle is first placed in ser-vice as a demonstrator or company vehicle,whichever is earlier.

To obtain service under this warranty, the vehiclemust be brought, upon failure of a Smog Checktest or upon discovery of the defect, to the work-shop of any authorized BMW center, during nor-mal business hours. The BMW center will honoror deny your claim within 30 days. If the claim isdenied, the BMW center will notify you in writingof the reason(s). The BMW center is required bylaw to honor the claim if notice is not given to theowner within 30 days.

The BMW center will, without charge for parts orlabor (including diagnosis), either adjust, repair orreplace the defective part and other parts

affected by the failure of the warranted part, if any. If your vehicle failed the California SmogCheck test or an EPA approved short test, thenBMW NA will repair your vehicle so that it willpass this test. Items that require scheduled

replacement are warranted up to the replace-

ment interval specified in the Service section of this Statement. BMW NA may repair a part in lieuof replacing it when performing warranty repairs.Parts for which replacements are made becomethe property of BMW NA.

A repair performed as the result of a smog checktest failure due to a defect in a part, which is war-ranted for 15 years/150,000, is covered.

In all cases, a reasonable time, not to exceed 30days, must be allowed for a warranty repair to becompleted, after the car is received by the BMWcenter.

It is the owners responsibility to have all requiredmaintenance services performed (at the owners

expense), as prescribed in the maintenanceschedule for the BMW Emission Control System.Service intervals are computed by the serviceinterval indicator and displayed on the instrumentpanel.

However, BMW NA will not deny your warrantyrepair claims solely because you do not havemaintenance records or you did not perform therequired maintenance unless BMW NA demon-strates that such lack of required maintenance isa direct cause of the emission control systemfailure. The instructions for required maintenanceand use can be found in the Owners Manual andin the Service section of this Statement.
