Mitt syfte:

• Gå igenom vad som menas med demokrati och rättsstaten

• Beskriva några hjälpmedel som kan användas vid ett ställningstagande

• Resonera omkring frågeställningen

Demokrati – Sverige som exempel

• “All offentlig makt i Sverige utgår från folket.” (Regeringsformen 1:1)

• “Riksdagen utses genom fria, hemliga och direkta val.” (Regeringsformen 3:1)

• The will of the people shall be the basis of the authority of government; this will

shall be expressed in periodic and genuine elections which shall be by universal

and equal suffrage and shall be held by secret vote or by equivalent free voting

procedures. (Article 21.3)

Rättsstaten

• Den offentliga makten utövas under lagarna

• Gäller alla myndigheter: Statschefen, Parlamentet, Regeringen, Domstols-väsendet

och offentliga myndigheter

• Lagen måste uppfylla internationell standard för skydd av mänskliga rättigheter

• Rättsstaten kan i princip bara förekomma i en demokrati

Rättsstaten – fyra särskilda krav

• Demokrati – lagstiftaren legitim!

• Ordentlig lagstiftning som respekterar folkrätten, isht mänskliga rättigheter

• De institutioner som krävs för att tillämpa denna lagstiftning, särskilt oberoende

och opartiska domstolar

• Och det svåraste av allt: de individer som har tillräcklig kunskap och integritet för

att sköta dessa institutioner

We reaffirm that human rights, the rule of law and democracy are interlinked and mutually

reinforcing and that they belong to the universal and indivisible core values and principles of

the United Nations. (para. 5)
