Agreement between the Government of the Republic of Cyprus and the

Government of the Stnte oflsracl on the Delimitaiioo of the Exclusive Economic

Zone

Tltc Govemmcnt of the Republic of Cyprus and the Govemn1cnt of the State of Israel (hereinafter, ench, individually, a ''Party"; jointly, Lhe "two Parties")

Desiring to strengthen flJr1her the ties of good-ne1ghborliness and cooperation between the two countries;

Recog.ruztng the tmporiancc of the delimitation of the Exclusive Econormc Zone for the purpose of development in both countries;

Recalling the provisions o[ the United Nations Convention on t11e Llw of the Sea of 10 December 1982, relating to the Exclusive Economic lone;

Basing themselves on lhc rules and principles of intemation3l law of tJ1e sea applicable 1o the matter;

Have agreed as follows: Article 1

(a) The delim11.ation of 1he Exdus1ve Econom1c Zone between the two Parties is

effected by the median I me, as such term is defined in paragraph (b) below.

(b) The median line between the two Pmiics and 1ts limits are defined by pOintS l to

12, in accordance with the hst of geogrnphical coordinates attached hereto as Anne"X

L which conslitutes an integra! pmi of this Agreement.

(c) The median line, as detem1ined, appears graphically on the Offlcial Hydrographic

Chart published by the Bntish Admiralty No. 183 (Ra':;; at Tin to lskenden.1n), scale

l/1,100,000 (Attached hereto as Annex II, which COllstirutes an integral pari of U1is

Agreement).

(d) n1c coordinate values of the agreed points l to 12 on the medi3.n lme lake

precedence over the chnli noted in paragr::~ph (c) above, and over any other map or

chart that reOccts the location of the median !me between the· Parties.

(e) Taking into consideration the pnncip\es of customary mtemationallaw relating to

the delimitation of the Exclusive Economic Zone between States, lhe geographical

coordinates of poinls l or 12 could be reviewed and/or modified as necessary in l1ght

of a f11ture :Jgreement regarding the delimitation of the Exclusive Economic Zone to

be reached by the thn:.c States concemed with respect to each of the said points.

In case there rue natural resources, including hydrocarbons reservons, exte.nding from the Exclusive Economic Zone of one Party to the Exclustue Economtc Zone of the oiher, the two P(lrtie~ shall cooperate ·1n order to reach a framework unitiz.ation agreement on the modalities of the joint development and exploitation of such resources.

Without prejudrcc to the provisions of Article l (e). if either of the tv.'o Parties is engaged m negoliatlons aimed at the dc!Jmitation of its Exclusive Economic Zone with another Stllte. that Pruiy, before reachmg final agreement \.vith tl1e other State, shall notify and consult the other Party, if such delimitation is in connection with coordinates I or 12.

Article 4

(a) Any dispute aris1ng from the interpretntion or implementation of this Agreement shall be settled through diplomatic channels in a spirit of understandi.ng and coopc-ratton

(b) ln the eve-nt tha! the two Parties do not settle the dispute within a reasonable period of time through diplomatic channels in accordance with paragraph (a) above, the dispute will be referred to arbitration. The tenns of reference and the procedure of the arbitration shall be determined by the Parties, by mutual agreement, prior to the conuncncement of the arbitration.

(3) This Ag_reement is subject to ratification according to the constitutional procedures in each country.

(b) This Agreement shall enter tmo force upon the exchange of the instruments of ratification.

DONE at Ntcosia on the l th of Dec.ember 2010, which cmTesponds to the l01h day of

Tevet 5771, in two originz!ls in the Greek, Hebrew and English languages, all texts bemg equally authcnlic_ In case of divergence of interpretatton of the texts, the English version shall preva1l.
