Sources of European Union Environmental law

• There are two sources of European Union environmental law: primary law, secondary law.

• Sources of primary law - Primary sources, or primary law, come mainly from the founding Treaties, namely the Treaty on the EU and the Treaty on the Functioning of the EU.

• Sources of secondary law - Secondary law comprises unilateral acts (i.e. regulations, directives, decisions, opinions and recommendations) and agreements (i.e. international agreements, agreements between Member States and inter-institutional agreements).

Sources of EU supplementary law

• Supplementary law - supplementary law includes international law and the general principles of law. It has enabled the Court to bridge the gaps left by primary and/or secondary law.

• EC Environmental Directive: According to art 249 of the EC Treaty, a measure adopted by the ‘European Parliament acting jointly with the Council and the Commission’, which is ‘binding as to the result to be achieved, upon each member state to which it is addressed, but shall leave to the national authorities the choice of form and methods.’

• EC Environmental Regulation: According to art 249 of the EC Treaty (ex art 189), a measure adopted by the European Parliament acting jointly with the Council and the Commission, which ‘shall have general application. It shall be binding in its entirety and directly applicable in all Member States.’
