I. The M ilitary Judge may close all or a port ion of Commiss ion proceed ings upon appropriateFindings in accordance with 10 U.S.c. 949d(c) and R.M .C. 806(b)(2).2. The Prosecut ion not ified the Commiss ion of its intent to disclose class ified informat ion in theFiling at AE092, pursuant to M.C.RE . 505(h).3. The Defense prov ided not ice (AE I24) of its in tent to disclose class if ied informat ion inlit iga ting the issue. The Prosecut ion moved (AE I28), pursuant to M.C.R.E. 505(h), for a he aringto detennine the use, relevance and admissib ili ty of c lass ified informat ion sought to be di sclo sed.4. The Commission conducted M.C.R.E. 505(h) hearings on II and 12 June 20 13 w ith allcou nsel present. All persons present during the ill camera hearing had the appropriate securityclearances and access. The he aring, recorded and transcribed, involved di scuss ions of classifiedin format ion.

5. The Commission ruled on the record with rega rd to closure of the Commission to lit igateAE092 only and exclus ion of the accused for the purpose of lit igat ing AE092 only on 13 June20 13, in accordance with this wr itten order. This wr itten order memorializes the Commiss ion 's13 June 20 13 find ings.5. Findings:

a. The classified in format ion both part ies seek to di sclose is relevant and necessary for afair determination of the issue before the Comm iss ion.

b. This is an int erlocutory legal proceed ing and does not relate to ev idence theProsecution in te nd s to introduce on the merits of the case.

c. Closure of a port ion of these proceed ings and exclus ion of the accused for the purposeof li t igat ing AE092 only is necessary to protect infoI111at ion the di sclosure of wh ich cou ld

reasonably be expected to damage nat ional security, inc luding inte lligence or law enforcementsou rces, methods, or act ivit ies .

d. After reviewing the ex parte declarations conta ined in AEO 13, Attachn1ent B; AE022,Attachment A; and AE09 1, Attachment B, the Commiss ion find s a compelling governmentalinterest, in that publjc disclosure of the informat ion ide ntified by the Prosec ution cou ld resu lt ingrave danger to nat ional security.

e. The c losure of the proceed ings ordered herein is narrowly ta ilored to protectinformat ion that, if pub ljc1y disclosed , wou ld pose a g rave danger to nat ional security.

(I) Only the port ion of the proceed ings directly pertaining to the class if iedinformat ion id ent ified by the part ies w ill be closed to the public; and

(2) A redacted transcr ipt of the c losed session, excis ing only class ified nat ionalsecurity informat ion, w ill be prov ided in accordance with the Regulation for Tr ial by M ili taryComm iss ion and the Tr ial Jud ic iary Ru les of Court.

f. The clo sure of a port ion of the proceed ings effect ively w ill protect the c lass if iedinformat ion at issue by not disclos ing the in format ion to indi v id ua ls who do not hold therequis ite security c learance and a "need to know. "

g. Pursuant to the M.e. R.E. 505(h) hearing conducted on AE092 on I I and 12 June20 13, there are no less restrictive lneans or reasonable alternat ives, other than closure ofalim ited port ion of the proceed ings, that wou ld adequately protect the compe mng in terest inprotect ing th is nat ional security in format ion.

h. The government's interest in nat ional security realized by protect ing certain c lass ifiedinformat ion outwe ighs both the accused's and the pub lic's in terests and right of access to th ismater ial and to th is proceed ing.6. The Commiss ion hereby Orders:

a. The Comm iss ion w ill hear argument in a closed session on AE092 only;b. The accused shall be excluded iTom the c losed session for the purpose of li t iga ting

AE092 onl y;c. The c losed sess ion on AE092 shaU be Ij mited to ev idence and argument perta ining to

the class ified informat ion described in AE092;d. A redacted, unclass ified transcript of the closed session shall be prepared

exped itious ly and prov ided to the public in a sim ilar ma nn er as the unauthenticatedtranscr ipts of open sessions; and

e. All filin gs related to AE092 and the unredacted transcript shall be SEALED untilfurther order of this Comm ission or another court of competent jur isdiction.SO ORDERED this 14th day of June, 2013 .
