T he Minister of Sport and Recreation Fikile Mbalula officially unveiled the 2013 Nelson Mandela Sports and Culture Day at Sandton Convention Centre on Thursday aimed to cel- ebrate former President Nel- son Mandela’s legacy. “Four event will be taking place on 17 August at FNB Stadium under the theme “Celebrating Madiba Leg- acy through Sport and Cul- ture” where the Italian Foot- ball Masters will take on SA Football Legends, Spring- bok and Agentina will play against each other while Bafana Bafana will be bat- tling it with Burkina Faso. A festival will then take place later,” said the Chief Director of Communication in Sport and Recreation SA, Monageng Mokgojwa. Mokgojwa said the main ob- jective behind this big event is to fundraise towards the Nelson Mandela Foundation for the construction of the Nelson Mandela Children’s Hospital, adding: “A week after the event, we will then present to the Foundation, a cheque of the takings from the event.” However, Minis- ter Mbalula said: “We wish for the event to grow from strength to strength and even bigger and better. Spoliation, or the man-dament van spolie, is a

common law remedy avail-able to any person wherehe or she has been unlaw-fully deprived of possessionof movable or immovableproperty and is of great im-portance in our law.Spoliation refers to the in-stance where a person hasfree and undisturbed posses-sion of a thing and anotherperson unlawfully takes thething away.In this instance the Courtcan intervene and restorepossession of the thing tothe deprived person.This will apply even wherethe person taking the thingaway is the true owner ofthe thing.By way of example: A ownsa house and rents it to B. Bfails to pay the rent for 3months.A then changes the locks tothe house to prevent B fromentering the premises.B can then approach theCourt for a spoliation orderto force A to grant access toB to the house until the issueof rent has been resolved.All that must be establishedin law is that B was in pos-session of the house by hav-ing access to it and that Bno longer has access to the

house as a result of A hav-ing changed the locks andthereby unlawfully depriv-ing B of access to the house.The onus will be on B toprove that he had possession(that is, he used the house,he was living in the house,he had access to the houseand he could come and go ashe pleased) and further thatA, by his conduct, took thataway.It is a defence to A to sub-mit that B voluntarily partedwith the property, by way offurther example, that B leftand deserted the house andhas not lived there for thepast six months.In this case B no longer hadpossession of the house andhe would accordingly not beentitled to the remedy.The purpose or rationale ofthis remedy is the fact thatno one is entitled to takethe law into his or her ownhands. Furthermore the mer-its of a case as to whom theproperty truly belongs areirrelevant and provide nodefence to an application fora mandament van spolie.(That is, A cannot take thelaw into his own hands bychanging the locks to thehouse because B did not payrent, even if A is indeed thetrue owner of the house.)The remedy is meant to bespeedy and robust in thatit immediately restores thestatus quo.

The spoliation applicationmay be brought in the Mag-istrate’s Court or the HighCourt by the affected party(B) without giving notice tothe other party (A).The spoliation order grantedby the Court is a final deter-mination of the immediateright to possession.However it does not resolvethe ultimate rights of theparties regarding true own-ership, which rightsmust bedealt with in separate pro-ceedings.The remedy is aimed atprotecting the use and pro-tection of the property andnot the right to the propertyitself and therefore is notappropriate where a partyseeks to enforce his or hercontractual rights.The Courts have found thatthis remedy will also applyto the use of electricity andto the use of water, as theseare considered to be an inci-dent of possession.Therefore in an instancewhere a person loses ac-cess to his house as per theexample provided above, orwhere a person’s electricityor water supply is cut off,the mandament van spolieprovides a significant andspeedy remedy to restoreaccess to the house or to thesupply of electricity and wa-ter or any other property thatthe affected person has beendeprived of.

Altrek Hall in Eastbankwhere they invited AR-MTSA,ATA, SAPS, andOfficials from MEC’soffice of CommunitySafety, aimed to re-solve the conflict amongASTO,ATA&ARMSTA.According to EABCAPresident, Aaron Seboy-ane, ARMSTA and ATAallegedly lied to the policeofficials when they wereasked if they resolved theirdispute with ASTO, add-ing: “That means the taxiindustry is really under-mining us.”During the meeting, con-cerned parents pleadedwith ATA and ARMSTA

representatives to stop ha-rassing their children, andnot to jeopar-

dize their e d u c a -tion. “The police must inter-vene immediately, because ifit persists when the schoolsreopen, they will never stopus as we will fight for ourchildren” said Seboyane.“I am sorry for everythingthat happened, and I wouldlike to make it known that

we don’t have any grudgewith ASTO, people who arebig headed are our taxi op-erators. We told them thismust come to an end but theydidn’t listen” said ATA repre-sentative, Daniel Mpao.Government officials wereshocked when they dis-covered that there has notbeen a meeting among thethree parties concerned.However, they say the law
