• 「保留部份權利」；著作的其他權利，授權給公眾使用。

• 通常授權方式：不限區域、無權利金、非專屬、不會撤回。

• 授權人明示授權的標的與限制，被授權人同意後即可使用。

• “Some Rights Reserved”; Other rights to use the work aregranted to the public with a license.

• The license is worldwide, royalty-free, non-exclusive, andperpetual (for the duration of the copyright of the work).

• The licensor makes clear what work is licensed and underwhat license. A licensee is any person who agrees to thelicense, and uses the work.

• 多人協力共同創作單一或一組作品；

• 流動性、多樣性的參與和協力方式；

• 創作多取材自協力者所提供之素材或作品；

• 共同之產出具有普遍的價值。

• Works created and used by multiple members;• Fluid in the member composition; indefinite in the

time span of a member’s participation;• Materials are contributed by the collaborators

and/or taken from other sources;• The joint output is of social or utilitarian value.

• 如何接取流動性參與下的協同創作產出？

• 原議題：誰的著作？誰有權利？

• 新思維：誰可以用？如何使用？

• How is the output of a collaboration to beused when participations are fluid andindefinite?

• Old mindset: Who are the authors, and whohave the rights?

• New thinking: Who can use the works, andunder what conditions?

協同創作＋公眾授權Collaborative Works + Public Licenses

• 參與者所提供的素材，能被其他參與者所使用；

• 「允許衍生著作」與「相同方式分享」之必要；

• 參與者共同採用具以上條件的特定公眾授權條款；

• 認同此公眾授權條款的眾人即可成為參與者。

• Each participant makes available some of their worksto the other participants;

• Wanted: The right to make modifications, and theobligation to share the results likewise;

• All participants agree to a particular public license forthe output of their collaboration;

• Whoever agrees to the license can participate!
