LIBERDADE DE EXPRESSÃO

“é livre a manifestação do

pensamento, sendo vedado o

anonimato” (art. 5º, IV, CFRB)

a CF estabelece a

PRESUNÇÃO de que todas as

hipóteses de anonimato são

danosas

“Nada impede (...) que o Poder

Público, provocado por delação

anônima (...) adote medidas

informais destinadas a apurar,

previamente, em averiguação

sumária, (...) a possível ocorrência

de eventual situação de ilicitude

penal” (STF - HC 106664 MC/SP )

Não proíbem o anonimato:
