Somerelief for frustrated landlordsOn Tuesday 14 April, the Western CapeHigh Court ruled in favour of a landlordwho was owed in excess of R300 000 by atenantasresultof thenon–paymentofelec-tricity bills.

The Court’s order, to the surprise of most,was to disconnect the electricity supply to thetenant. TPNRegisteredCreditBureauweighsin on the judgment.The case in question is that of Anva Proper-

ties CC and one of its tenants. Anva, the land-lord, owns a building in Cape Town, and paystheCityofCapeTowndirectly for theelectrici-ty supply to the building. The landlord thenrecoversthecostsrelatingtothesupplyofelec-tricity from its tenants, at a pro-rata amount.Thetenantinquestionhadnotpaiditselectric-itybill inmonths,andassuchthelandlordwasessentially subsidising the tenant’s business.The problem the landlord faced was that if

it didnotkeepup todatewith the full electrici-ty account, the City of Cape Town would dis-connect the supply to the entire building,therebyprejudicingtherightsof theotherpay-

ing tenants.Thejudgeintheendheld

that the landlord was au-thorised to terminate thesupply of electricity to thepremises occupied by thetenant and that the tenantcould, under no circum-stances, reconnect thesup-ply.Sowhatexactlydoesthis

mean for landlords andrental agents? Can younowfinally take the lawin-to your own hands andpunish those frustrating,non-paying tenants byflicking the switch andkeeping them in the dark?“The answer is still a resounding no,” con-

firmed Michelle Dickens, MD of TPN CreditBureau. “You cannot disconnect a delinquenttenant’s electricity of your own volition – un-der any circumstances. You need to approachthe Courts and obtain a Court order first, as

the landlord successfully did in thiscase.“However, importantly, what this

judgment has shown us is that theCourtsareinfactbeginningtoconsiderthe economic implications of non-pay-ing tenants and the plight of landlordsaffected by suchnon-payment. The factthat the judgment isaHighCourtJudg-ment makes it all the more powerful.With all of the legislation out there fa-vouring the tenant, it’s comforting toknow that should you, as a landlord,need to approach the Courts for relief,there is now a chance that the judgemay find in your favour.”Anevenbetteroption is foryou topo-

tentiallysaveyourselfthefinancialandemotional implications of having to go

to court by vetting your tenants prior to sign-ing any lease agreement. “The foundation ofany investment in real estate is a quality ten-ant – without this your property can land upcosting you far more than it’s worth,” con-cludes Dickens.

Tax deductions on rental properties

This week, the Property Poser panel considers aquery from a landlord about which expenses canbe deducted from rental income.

According to Schalk van der Merwe from Rawson

Properties in Somerset West, Cape Town, there

are twomain provisions of the IncomeTaxAct that

deal with such deductions.

“These two provisions are useful in attempting to

clarifywhich expenses can indeed be deducted.”Van der Merwe says the so-called “general

deduction” provides for “expenditure and losses

actually incurred in the production of the income,

provided such expenditure and losses are not of a

capital nature”.

“This would include expenses such as rates and

levies, advertising, agent's commission and rent

collection fees, the interest on the loan raised to

purchase the property as well as insurance,

security expenses,water and electricity.”

Van der Merwe says another section of the Act

refers to expenditure actually incurred in repairing

a property occupied for the purpose of trade.

“This includes expenditure incurred on treatment

against attack by beetles of any timber forming

part of such property.”

The reference to “for the purpose of trade” does

not mean that the property is to be used for

commercial purposes, saysVanderMerwe.

“In this instance, the renting out of the property

constitutes a commercial activity as would be the

case in a buy-to-rent scenario.”

Grant Hill of Miller Bosman Le Roux Attorneys in

Somerset West says a repair is different from an

improvement or renewal and the guidelines laid

down in the 70-year-old case of CIR v African

ProductsManufacturingCo still stand.

“A repair is a restoration by either a renewal or

replacement of a subsidiary party of the whole;

the materials used need not be the same as the

originalmaterial.”

Hill says it follows then that renewal is a reconstruction

of the entirety or substantially the entirety, whereas

improvement is the creation of a better asset.

“When an asset is improved the result is a better asset

that possibly has an improved income-earning

capacity.”

However, the distinction between “repair” and

“improvement” is sometimes vague, saysHill.

“For an asset to be repaired, there must be damage or

deterioration to a part of the original asset or structure

and the intention of the taxpayer must be to restore the

asset or structure to its original condition.”

Hill says some examples of such deductible costs

include the costs of scraping off old paint and stripping

woodwork, filling cracks inwalls and repaintingwalls.

“The cost of installing a sprinkler system will be of a

capital nature, but should any part of an existing

sprinkler system be repaired or replaced when it

becomes faulty, such costs will be deductible expenses

in terms of this provision.”

From these examples it is clear that no expenditure of a

capital nature is allowed under the general deductions,

saysHill.

“It is not excluded under the provision relating to repairs

but it does follow that whatever repairs you are not able

to deduct under that provision will not be deductible

under general deductions either.”

Youngowners revitaliseoldStellenbosch suburbAs years pass, some suburbswaxand wane, while others simplyreinvent themselves. Such is thesmall residential area of LaColline in Stellenbosch in theheart of the Cape Winelands.

Excluding a handful of securecomplexes and sectional titleblocks,LaCollinecomprisesonly75residential properties in total, allfull title semi-detached homes builtmainly around the 1940s, and withno vacant stands available.

Louise Varga, PamGolding Prop-erties’ (PGP) area manager in Stel-lenbosch, says situated on a smallhill withmountain views all round,this suburb, which has been gener-ally regarded as being on thewrongside of town, is fast becoming a hipand happening location.

She says elevated in more waysthan one, the area is undergoing arevivalandtransformationasanewgeneration of younger buyers andinvestors move in, many withyoung families.

OverlookingStellenboschandtheuniversity campus, which is only1,5 km away, La Colline is conve-nientlysituatedclose tomain feederroutes such as the R44 to Paarl andSomerset West, Hellshoogte Pass toFranschhoek and Ryneveld, Streetwhich leads through to Dorp Streetin the centre of Stellenbosch.

Fourie says stands vary from300 m² to 900 m² in size, averagingaround 450 m² to 550 m². She saysthere are two types of homes; singlelevel or double storey, and all aresemi-detached. In their originalform, without extensions or add-ons, all these properties would cov-er a surface of 105 m² to 110 m² andcomprisethreebedroomsandoneortwo bathrooms.

LaCollinewas built in 1948 by theNational Housing Commission aspart of an economical housingscheme. Since then,most of the areahas been privatised.

With Stellenbosch expanding inall directions and traffic becomingan issue, Fourie says it is inevitablethat the first-time buyer or investorwill buy into and ultimately upliftan area this close to the CBD, espe-cially considering the low pricesand potential capital growth and re-turn on investment over the longerterm.

“The homes in La Colline are af-fordable when compared to the restof Stellenbosch. A three-bedroom,two-bathroom single or double sto-

rey home that hasn’t been renovat-ed can sell for anything betweenR1,1 million and R1,58 million, de-pending on stand size and state ofthe property.”

Just below the La Colline hill isa suburb called Kromrivier, com-prising another 72 full title proper-ties, where last year a property soldfor R2,54 million. Both developersand investors are showing an inter-est inKromrivier, where homes areaverage single storey properties,she says.

At present, Fourie says there is arenovated five-bedroom propertyon themarket for R2,6 million, witha potential rental yield of R237 000per annum if the owner leases allfive bedrooms at R3 950 per room.

She says currently, one would befortunatetofindahomeforR1,2 mil-

lion, however, there have been oneor two sales in the past two yearsunder R1,2 million. Buyers are in-vesting between R300 000 andR600 000minimum,addingroomstothe property or building flatlets forextra income.

With the original shape of theproperties being rectangularblocks, owners are breaking awaybyadding rooms to the front or backand thereby changing the “box” ap-pearance of the original semi-de-tached, she says.

Modern perimeter walls with at-tractive gates are being built, whilecare and pride in ownership is evi-dent in the attractive gardens andsidewalks in front of the properties.

“The last five properties I sold inLa Colline since 2013 were all ac-quired by buyers in the 27 to 35 yearage group, all ofwhomundertook toimproveor change thehomeseitherforthemselvesorinordertoachievebetter rental income.”

Fourie says a home can be leasedfor R7 500 to R11 500 per month fora three-bedroom, two-bathroomproperty, and from R3 500 to R4 000per month for a separate bachelorflatlet with bathroom and kitchen-ette.

She saysoverandabove this, theyare also seeing parents acquiringproperties for their children to usewhile attending university in Stel-lenbosch. While there are well-maintained properties, there arefew on the market, she says.

She says currently on the marketisabeautifullyrenovatedthree-bed-room, two-bathroom home with arental income of R11 500 permonth,available for purchase at R1,69 mil-lion.

Shouldyou let short-termor long-term?Short-termrentaldemandisnolongeron-ly common in popular holiday and tour-ism destinations, but also increasing rap-idly in business districts, student zonesand the areas aroundairports and confer-ence centres.

“One reason is thatmanymore skilled peo-ple around theworld nowwork on a contractrather than a full-time basis, and prefer torent a flat wherever they are working for afew weeks or months, instead of staying ina hotel or a guesthouse,” says Greg Harris,CEO of Chas Everitt Property Rentals.However,property investorsshouldweigh-

up the pros and cons very carefully beforethey decide to go into this market, and makesure they work with a managing agent whoreally understands it, he says.“Of course everyone who buys an invest-

ment property wants to make the best possi-ble returns, andby letting short-termat adai-ly, weekly or monthly rate, owners stand tomake considerably more money than if theyrent long-term.“What is more, short-term letting makes it

easier for landlords to raise the rent to copewithanyincreasesininterestratesorsection-al title levies,” he says.“However, investors need to look beyond

these numbers and take other factors into ac-count, such as the consistency of short-termdemand in the area where the property is lo-cated, and what competition they might facefrom hospitality establishments in the samearea – or even local homeownerswith a roomor two to let.”Harris says additional positives associated

with short-term letting include:) Better condition. Short-term tenants

drove recently, themighty impress-ive 1.4 turbo-diesel Prestige. I’ve gotto be honest, when Wesbank re-vealed the list of SA Car of the Yearfinalists for 2015, I was sceptical astowhat theCorollawas doing in thelineup.Surely,whensurroundedbybrilliant Subaru’s, Porsches andBMW’s, thehumbleCorolla is out ofits depth. That is until I spent an en-tire weekend driving the diesel Co-rolla around the Western Cape.From a looks perspective, my

friends and family shared mixedfeelings. The previous generationCorolla had smoother lines andtended to be a bit dull. Designers inJapan sharpened their pencils andwent for a more daring and edgylook. At the front they’ve used thesame grille as you’ll find on the Au-ris. Angular headlights and thelarge emblem complete the look.At the rear, however, things are

more subdued. Proportionally,they’ve stretched it in the right di-rections. Lowered by 5mm, length-ened by 75mm and widened by15mm, the Corolla has more of a

ground-hugging stance.Step inside, and you’rewelcomed

to a much improved interior. It’sbeen years since the latest Corollaupgrade, and these days, even bud-get city cars have wonderful ergo-nomically designed cabins.ThislatestCorollaisnoexception,

and the look and feel of the interioris a step in the right direction. Com-fortableblack leather seats (in somemodels), amodern leather-cladmul-tifunctionsteeringwheelandainfo-tainment system with all the bellsand whistles. The multimediascreenisprettyeasytolivewith,and

is the same as onewould find in theFortuner and Hilux. Bluetooth con-nectivity,preloadablesatellitenavi-gation and a great aircon unit, aresome of the cabin highlights.Interior space is ample. The

wheelbase has been extended by100mm which gives rear-seat pas-sengers massive leg room, whileheadroom is never a problem. Theboottoo, isprettyenormousat452 L,and can swallow a weekend geta-ways luggage with some ease.Driving the Corolla is simply a

pleasure. No harsh ride or bumpysuspension setup, the Corolla com-

forts you with relaxed driving. Thecabin is well insulated and suffi-cient sound deadening helps keepeverything quiet. Do not expect asporty drive or something you canthrash around your nearest moun-tain pass.The star of the show, theunprece-

dented trump card, is however thesmallturbochargeddieselmillfittedto this Corolla. At just 1 400 cc in ca-pacity, power figures are nothingspecial. With 66 kW/205 Nm, thetraffic-light racing is the last placeyou will find the Corolla. However,pair those figures with a slick-shift-

ing 6-speed manual gearbox, andthingsstart to lookmorepromising.When you pull away from a stopstreet or traffic light, the first twogearsareshortandneeds tobeshift-ed quickly. Once you’ve reachedcruising speed, this Corolla comesinto its own. The torque spread isuseful when passing or cruisingwhile the Toyota hates using fuel.NeverinthreedaysoftestingdidtheCorolla use more than 17 km/F.That’s on average, withmy best fig-ures of 21 km/F returned whilecruising at 95 km/h on a flat stretchof highway. Theoretically, with the55 F tank filled, you can drive a1 000 kmbeforerefuelling.Thesefig-ures are mightily impressive if youconsider that the diesel-Corolla re-tails for around R250 000.Main rivals in this category in-

clude the likes of the VolkswagenJetta, Ford Focus and ChevroletCruze.Only the Jetta offers a diesel-variant, so I will be focusing on theGerman specifically.The Jetta has a slightly bigger

1.6 F turbo diesel engine, while itdoes havemore power, its price-tagis much higher.The fancy-pants German is

R40 000 dearer, without selectingany of the yummy extras. (Chooseone extra, and the difference ofR50 000 is easily reached.) There isno denying then, the Corolla is anexceptionally goodvalue offering. Ifyouoptforthe1.4Esteemmodel,youcan save even more money.The latest Corolla then is worthy

of all its praise. It stood proud in aspectacular SACar of the Year line-up, and it is sure to sell even betterthan itspredecessor.Don’tbe fooledby the tinydiesel engineor the car’slarge body – Toyota did their home-work and delivered a car that’s cer-tainly worth the gossip aroundbraais and rugby matches.

Ford Motor Company today announcedthat theall-newFordMustangwilldeliver0-100 km/h (0-62 mph) acceleration in un-der 5 seconds – making it the fastest accel-erating high-volume Ford model ever of-fered in Europe.

The company also revealed that more than2 200 customers have ordered an all-new FordMustang since the iconic car became availa-ble to order across Europe earlier this year.

The Ford Mustang – on sale in Europe forthe first time in the car’s 50-year history – isavailable with Ford’s 5.0-litre V8 engine deliv-ering 313kW and 530 Nm of torque, or the morefuel-efficient 2.3-litre EcoBoost engine deliv-ering 235kW and 432 Nm of torque.

The 5.0-litre V8 fastback model with six-speed manual transmission reaches 100 km/h(62 mph) from a standing start in 4,8 seconds– faster than any Ford in the Europe since thelow-volume Ford GT supercar launched in2005. The Ford Mustang 2.3-litre EcoBoostfastback manual reaches the marker in 5,8seconds.

Ford Mustang drivers can optimise thecar’s performance to suit their mood and driv-ing conditions using Selectable Drive Modes,and away from the public highway can useTrack Apps to monitor driving performance.Ford Mustang 5.0-litre V8 drivers also canachieve the fastest possible acceleration offthe line on the track assisted by Launch Con-trol technology. Mustang also delivers up to0,97 g-force when cornering.

Equipped with Ford’s 2.3-litre EcoBoost en-gine the new Ford Mustang also delivers up

to 7.0 L/100 km fuel efficiency and 179 g/kmCO2 emissions.*

The all-new Ford Mustang’s high perform-ance engines are supported by a standard Per-formance Pack in Europe that delivers uprat-ed brakes and cooling for high-speed driving.A sophisticated chassis and body structure,and advanced technology, also help optimisedriving dynamics to deliver the sporty experi-ence Ford Mustang customers demand.

Selectable Drive Modes are controlled us-ing toggle switches in the centre console andadjust the AdvanceTrac electronic stabilitycontrol, throttle response, automatic gear-shift patterns, and steering to match Normal,Sport+, Track or Snow/Wet settings. Selecta-bleEffortElectricPowerAssistedSteeringen-

ables drivers to choose a Normal, Comfort orSport steering weight and feel.

To help drivers get the most from the carat the track, the Ford Mustang also deliversTrack Apps that can be controlled via thesteering wheel and viewed in the instrumentpanel, including accelerometer, accelerationtimer and brake performance, which meas-ures braking time and distance from a setspeed.

Available for the 5.0-litre V8 with manualtransmission, the Launch control systemholds the engine at a pre-set value between3 000 rpm and 4 500 rpm with the acceleratorfully depressed. When the clutch is released,torque delivery to the rear wheels is con-trolled for maximum traction and consistent

standing starts. An electronic line lock sys-tem also available for the 5.0-litre V8 appliesonly the front brakes, allowing drivers to thewarm the rear tyres.

The Ford Mustang uses fully independentsuspension front and rear for sporty dynam-ics and comfort, including integral-link rearsuspension that optimises ride comfort andmechanical grip, and double-ball-joint frontMacPherson struts that enable large, power-ful brakes without affecting steering feel.

The body structure is 28% stiffer than theprevious generation Mustang. Weight distri-bution of 54% at the front for the 5.0-litre V8and 53% at the front for the 2.3 litre EcoBoostcontributes to responsive and precise han-dling.

Lightweight materials include aluminiumused for the bonnet, front wings, suspension,transmission and brakes. High-strengthsteels, laser welding and hydro-forming tech-niques contribute to the stiffer body for an en-hanced driving experience and safety.

The new Ford Mustang is available in fast-back and convertible bodystyles with six-speed manual and automatic transmissions,and features classic design elements includ-ing three-dimensional, tri-bar taillamps, sig-nature trapezoidal grille and shark-bite frontfascia.

Ford has started production of the first Eu-ropeanspecificationFordMustangsat itsFlatRock facility, Michigan, USA, in 10 exteriorcolours and equipped as standard with 19-inch wheels, automatic HID headlamps, dual-zone climate control, LED tail lamps, and arear diffuser.

Further standard equipment includes anine-speaker sound system, and SYNC 2 voicecontrol connectivity with 8-inch colour touchscreen. Ford Mustang is exclusively availableto order in Europe at new FordStore locationsopening across the region primarily in metro-politan areas. The first vehicles are set toreach dealerships continental Europe fromJuly and the UK from October.

It was carefullyhoned as part of the model refresh, withchanges made to the Singleframe grille, theheadlights, air inlets, bumpers, side sills,rear lights and tailpipes. duced locally in July 2015, followed by the2.0 TDI S tronic towards the end of the year.All multitronic CVT transmissions whichwere available previously have now been re-placed by S tronic transmission.The new Audi S6 is quite simply a sports

car for everyday. The 4.0 TFSI, a bi-turbo V8producinganuprated331kW,accelerates theSedan from 0 to 100 km/ in 4.4 seconds. Aver-age fuel consumption is just 9.2 litres per 100

with the equivalent of 214 g/km of CO2. Thisefficiency is due in large part to the cylinderon demand (COD) system, which only acti-vates four of the eight cylinders when underpartial load.Standard equipment in the new Audi S6 in-
