2 RAP Purposes, Terminologies & Definitions

This Resettlement Action Plan (RAP) is prepared in accordance with the national and local laws and regulations of the People’s Republic of China (PRC), and the World Bank Resettlement Guidelines (i.e., Operational Directive for Involuntary Resettlement of OP 4.12). The purpose is to set out an action plan for the resettlement and restoration of the Affected Persons (APs) to ensure that those affected will be benefited from the project, and their living standards be improved or at least restored to the pre-project situations after the project implementation.

Acquisition of a land and the associated properties to enable project implementation would adversely affect the residents and other persons living or working on the land as acquired. The term of APs is defined as those whose income or livelihoods are to be adversely affected by the land acquisition activities of the Project. APs may be any of the following categories:

1) those whose land (including housing land, utilities land, and land for agricultural, forestry, livestock breeding, fishery and sidelines), structures (including private buildings and attachment, enterprise buildings and public buildings, etc.), entitlement or any other properties that will be acquired or occupied, in full or in part, permanently or temporarily;

2) those that use the above structures, lands or properties; or those whose business, vocations, working, residences or habitat will be adversely affected; or

3) those whose living standards are to be adversely affected due to the land acquisition and/or resettlement activities.

2.1 Definition of APs

“Affected Persons” means those that, because of the project execution, are to be suffered in living standards are or otherwise adversely affected; or those whose building ownership, the entitlement or interest, lands (including house lands, agricultural and grazing lands) or any other fixed or movable assets thereof that are to be acquired or possessed, temporarily or permanently; or those whose business, occupation, working or residences or habitats that are to be adversely affected.

“Affected Persons” imply either individual person(s) or such legal persons as enterprises or public organizations. The definition of APs does not limit or restrict the associated legal registration or permission to live or conduct business in the affected location, nor does it limit the compensation for the property. Thus, they are to include:

4) all affected persons regardless of their legal entitlement or absence thereof to the assets being taken; and

5) persons without residential permit to live in a defined area.


Therefore, all such persons who are affected will need to be considered and recorded as the APs, regardless of their legal relationship to the assets, land or location.

For a land or property to be acquired, if it is used by or to be compensated for one and more individuals or households, the associated compensation and restoration will be based on their losses, their entitlements, and the impacts on their living standards. Disregarding the legal entitlement or interest, definition of the APs will be directly related to the adverse impacts of the project.

All APs shall be compensated to improve or, at least, restore their standards of living, including compensation for their property losses. The compensation to the loss of properties shall be based on the replacement values with no deduction or discount on account of depreciation or other reason(s). The APs shall have entitlements for what they suffer due to the project impacts. Not only should they be provided with compensation for property losses, they should also receive economic subsidy as well for restoration of their living standard. For those affected who run business, cultivated land or conduct construction with no property ownership, entitlement, or legal residential permission, they are eligible for restoration of their livelihoods and compensation for their lost properties on an equal footing with those owning lawful properties, entitlements or permissions.

2.2 Definition of “Resettlement”

“Resettlement” is arrangement for the APs on production and living, so that they will be benefited from the Project. Resettlement activities usually include,

1) relocation of living quarters;

2) provision of new and acceptable employment for people whose working engagement is affected;

3) restoration of (or compensation to) the affected productive resources such as land, working places, trees and infrastructures;

4) restoration of those affected whose living standards (qualities of life) are adversely affected due to land acquisition and/or relocation;

5) restoration of or compensation to the affected private and public enterprises;

6) restoration of cultural or common properties that are adversely affected.

2.3 Definition of “Restoration”

“Restoration” implies to reinstate the APs in their capacity and capability so that they can continue their production activities, and/or to reinstate their living standards to at least those of the pre-relocation status, or higher levels.

The purpose of this RAP is to provide an action plan for the potential resettlement and restoration activities so that the APs will be compensated for their losses and their living standards will be improved or at least restored to the pre-project levels. In order to attain Yibin Urban Riverside Loop Line Road Project RAP7

these objectives, restoration measures are included in the RAP to enable income restoration for the APs for sustainable livelihoods. Similarly, business and production resources (including shops, enterprises), public properties, infrastructures, and cultural properties as affected will also be improved or at least restored to the pre-project status and levels.


Description on Preparation of

Resettlement Action Plan for Yibin Urban Riverside Loop Line Road Project

Resettlement Action Plan is of great significance for the successful implementation of Yibin Urban Riverside Loop Line Road Project, particularly for people within the scope of Yibin Urban Riverside Loop Line Road Project, who will be affected by the land requisition and demolition work. Since March 2004, the design of the Project has been optimized from time to time, with a view of alleviating the adverse impact upon the local residents. The Plan is prepared by Yibin Urban Construction and Investment Co., Ltd. under the support of Yibin Municipal Government and relevant departments.

1 Description of Yibin Urban Riverside Loop Line Road Project

1.1 Overview of Yibin Urban Riverside Loop Line Road Project

In the downtown of Yibin City, the complicated landform, formed by convergence of and partition by three rivers, i.e., Jinsha River, Minjiang River and Changjiang River, and separation by mountains, divides the urban area into several geological zones which are relatively independent with each other, forming a particular “group-type” urban structure which takes the old city as the center. By the end of year 2003, the permanent population of Yibin City had reached 450,000, and the urban built-up area reached 32.3 km2.

According to the Master City Plan of Yibin City set forth in year 1997, it is estimated that during the period from year 2005 to 2010, the permanent population of Yibin City will reach over 500,000, and Yibin City will then become a big city. According to long-term Planning of Yibin City, the population scale will be over 1,000, 000, and that of land use will exceed 100km2. In the future, the city pattern of Yibin City will consist of 11 groups with different functions and characteristics, including:

Old City Group mainly focusing on traditional commerce and protection of historical culture;

Zhongba Group where transport center of railway passenger will be formed for space evacuation for the Old City Group;

Caiba Group mainly focusing on living, tourism, vacation, leisure and entertainment, with proper development of high-tech research and development projects;

Tianbai Group with the main functions of energy industry, water-power base, railway traffic terminal;

East District Group on the South Bank mainly focusing on municipal administration, commerce, finance, service, culture, sports and entertainment;

West District Group on the South Bank mainly focusing on education, scientific research, high-tech industry and residence.

Zhaochang Group as the logistics base reserved for development of Panxi-Liupanshui;

Quyanpingba Group with heavy industry as its feature; Lizhuang Group mainly focusing on development of industry, tourism and logistic

industry, accompanied with residence function; Jiuzhou Group which is of a comprehensive type, integrating production, logistics,

living, administration, culture, science and education, commerce and other relevant functions;

Baisha Group which is a comprehensive district, mainly focusing on category I and II industries and relevant logistics and living.

The construction of Yibin Urban Riverside Loop Line Road Project will accelerate the rapid connection among the city groups, ensure smooth and orderly pedestrian flow, material flow and traffic flow, bring along adjustment of urban structure through optimization of city road network, and provide guarantee of necessary foundation for the expansion of urban space and consummation of city functions (e.g., flood control, urban landscape, etc.). The Project is divided into two parts:

Part one (Section A): the section of Riverside Road from the Minjiang North Bridgehead to Tianyuan, is the only traffic road linking Old City Group, Jiuzhou Group and Baisha Group. Among them, Jiuzhou Group, which is a city group


focusing on production, logistics, living, administration and culture, is planned to cover an area of 16.07km2 and to reach a population of 120,000, and has a built-up area of about 8km2. Logistics, especially that of Wuliangye Group is of huge quantity. Baisha Group, which is a comprehensive district mainly focusing on category I and II industries and relevant logistics and living, is planned to cover an area of 12.8km2 and reach a population of 121,000. Moreover, Old City Group, which is the nuclear group of Yibin City, is planned to cover an area of 12.8km2, and at present has a population of 160,000.The connections of the three groups above are very important. According to the current population and development tendency, there will be a huge traffic flow on the Riverside Road.

Part two (Section B): the section of Riverside Road from Nanan Culture Plaza to the 4th Water Plant links such important city groups as East District Group on South Bank, West District Group on South Bank, Zhaochang Group and Tianbai Group. Among them, Tianbai Group is planned to cover an area of 12.21km2 and reach a population of 147,000; East District Group on South Bank is planned to cover an area of 7.3 km2 and reach a population of 105,000; West District Group on South Bank is planned to cover an area of 8.72 km2 and reach a population of 85,000; and Zhaochang Group is planned to cover an area of 15 km2 and reach a population of 100,000. At present, East District Group on South Bank and Tianbai Group are basically built up, and West District Group on South Ban is under construction; therefore, this section of Riverside Road is also an important road for traffic communication among various city groups, with huge potential of increase of traffic volume.

1.2 Related Project General Situation and Resettlement Effects

The sewer lines will be laid under the Yibin Urban Riverside Loop Line Road. Sewage pipe network for Road Section A will lead the sewage in this region to Yangwan Wastewater Treatment Plant, which is under design and expected to be commenced from October 2005 and completed in the end of year 2006. The Plant above, whose owner is Yibin Qingyuan Waterworks Co. Ltd., covers an area of 69.1mu, and to be constructed in two phases. Its handling capacity is 60,000 ton/day for Phase I and Phase II respectively, and after completion the total capacity will be 120,000 ton/day. Land acquisition and relocation for Yangwan WWTP has been completed. The number of people affected by land requisition and demolishment works is 87 in total. The compensation standard for land requisition is based on the rates set forth in the Document of “YFF [2004] No 50” (see Table 23 under Section 5.1.2.12), that for demolition is 510Yuan/m2 for brick-concrete structure and 420Yuan/m2 for brick-wood structure. The area of rural house buildings to be demolished in the Project is 1,635.05 m2, among which 746.85 m2 are of brick-concrete structure and the rest are of brick-wood structure. All the project-affected people will receive cash compensation according to replacement price or be resettled by building houses for them.

Section B, during construction, will be connected with a 4km long sewage interception pipeline, which leads to Nanan Wastewater Treatment Plant in the East District. Construction of the 4km long sewage interception pipeline and Nanan Wastewater Treatment Plant were commenced on December 26, 2001, and are expected to be completed in the end of year 2005. Nanan Wastewater Treatment Plant, whose owner is Yibin Qingyuan Waterworks Co. Ltd., covers an area of 43mu, and is expected to have a handling capacity of 50,000 ton/day after completion. Its commencement time was December 2001. Land acquisition and relocation for Nanan WWTP has been completed. The project-affected people were mainly farmers, and over 50 people were affected by the land requisition and house demolition. Forward delivery housing was implemented for the project-affected people. After 18 months, during which a transitional compensation was paid, all the project-affected people moved into the new houses. The organization responsible for implementation of resettlement was Land and Resources Bureau of Yibin City. The project-affected people have been resettled in accordance with relevant policies of compensation for land requisition and demolition in Yibin City. The policies which the resettlement work was based on are the same as that for Yangwan Wastewater Treatment Plant. The resettlement work was carried out successfully, without any disputes and problems left behind.

1.3 Content of Yibin Urban Riverside Loop Line Road Project

Yibin Urban Riverside Loop Line Road Project is divided into Section A and Section B. The details of Graph of Relation of District Location of the Project are as shown in Fig. 2.

Work content of Section A of the Project: Section A starts from Minjiang North Bridgehead, along the left bank of Minjiang River and Changjiang River, passes Jiangbei Park, Cuiping Glass Factory, Liangmeigou, The 11th Construction Engineering Company


of Sichuan Province, Erlangzui, State-owned 799 Plant, Changjiang Bridge, Yibin Power Generating Co. Ltd., Changjiang Paper Making Co. Ltd, and ends at Tianyuan Co. Ltd. The total length of road is 6,888.51m. The standard cross-section is of single-width road with a total width of 15-20m.It is recommended that the carriageway should adopt asphalt concrete pavement. The whole line has one detached flyover, 4 medium and minor bridges, 2 culverts, and 2.9km of riverbank protection.4-lane scheme is adopted, in which section 0+000~5+160 is of four lanes, and section 5+160~6+688.51 is of two lanes.

Work content of Section B of the Project: the line will be arranged along the south bank of Jinsha River, in east-west direction. It starts from Nanan Culture Plaza and ends at the 4th Water Plant, with a total length of 3,521.21m.The standard cross-section is of single-width road. The full width of section 0+000~0+772.60 is 24m (sidewalk 5m+ carriageway 9m + sidewalk 10m), and that of section 0+772.60~3+521.213 is 20m (sidewalk 5m+ carriageway 10m + sidewalk 5m). It is recommended that the carriageway should adopt asphalt concrete pavement. The whole line has 1 medium and minor bridge, 9 culverts, and 3.5km of riverbank protection.

The content of the Project includes road engineering, bridge and culvert engineering, flood control engineering, sewage and rain water engineering, works of municipal auxiliary facilities, landscape and planting engineering, illuminating engineering, traffic engineering, etc. Laying of sewage pipe network along Section A and Section B is also included.

Section A will be designed as per planned flow direction of wastewater, and the sewage pipe for the whole loop line will be arranged in three regions. Subsection A1, part of sewer pipe on which in Jiuzhou District is the trunk sewer, delivers wastewater from such districts as Zhongba, the Old City and Jiuzhou to Yangwan Wastewater Treatment Plant; Subsection A2 will not be provided with sewer line for no wastewater will be brought in the connecting area between Jiuzhou District and Baisha District; the sewer line on Subsection A3 in Baisha District is also the trunk sewer which delivers wastewater in this area to the planned downstream wastewater treatment plant. Yangwan Wastewater Treatment Plant is built in the lower reaches of Jiuzhou along Riverside Road, the sewer pipeline on Section A in Jiuzhou is the trunk sewer which delivers the urban sewage from Jiuzhou, the Old City and Zhongba on the north bank to Yangwan Wastewater Treatment Plant. Section A is designed as per planned flow direction of wastewater, and the sewage pipe will be arranged in three regions in accordance with the planning on both sides of the road and the topographic conditions.

Sewer pipe on Subsection A3, taking Yibin Power Plant as the divide, has two reverse direction of sewage drainage: sewage in the sewer pipe in front of the power plant will flow to Baishawan under gravity in a direction opposite to the wastewater plant; sewage in the sewer pipe behind the power plant will directly flow to the planned wastewater treatment plant under gravity. A wastewater pumping station will be built in Baishawan, where after been pumped and delivered under pressure to the said power plant, the wastewater will be sent to gravity flow sewer pipe behind the power plant. The Baishawan wastewater pumping station has been included in this Project. There is another branch pipe on Subsection A3, which is located in the district of Changjiang Paper Making Co. Ltd, the wastewater from which are collected through pumping in wastewater pumping station. However, only reserved interface(s) will be provided at this place in the design, and the wastewater pumping station will not be include in the scope


of the Project. The wastewater pumping station in Baishawan will have a handling capacity of 9,000m3/d, and will cover an area of 2000m2.

As to sewage pipe network for Section B, according to the design data for interceptor sewer of Riverside Road as provided by the Employer, it has been confirmed that there is a wastewater pumping station near 0+115 of the section of road which has been designed. The pumping station above has a scale of 1.0X104m3/d; therefore, it is designed that wastewater from the section of road will flow to this pumping station. One wastewater pumping station near the starting section of Section B is also designed, thus the wastewater from the section of road will enter such wastewater pumping station.

2 Impact of Yibin Urban Riverside Loop Line Road Project

2.1 Land Requisition for the Project

The scope of land requisition for Yibin Urban Riverside Loop Line Road Project involves 2 sections, i.e., Section A and Section B. The total area of land use of Section A is 272.15mu, among which 242.12 mu are state-owned land and 30.03mu are collective-owned land requested. Among the 30.03mu of collective-owned land requested, the area of cultivated land is only 0.92mu, accounting for 3.06% of the total area of requested land. The scope of land requisition involves three township units in Cuiping District of Yibin City, i.e., Anfu, Baishawan and Nanan; 6 villages and community units, i.e., Liubeichi, Wuqiao, Baita, Shiziping, Huangjueping, Shangdukou; and 9 groups, i.e., Yangwan Group of Liubeichi Community of Anfu Office, the 4 th, 5th and 6th groups of Baita Community, the 1st and 2nd groups of Wuqiao Village, the 3rd Group of Huangjueping Village, the 1st and 4th group of Shiziping Village.

The total area of land use of Section B is 128.34mu, among which 94.18mu are state-owned land and 34.16mu are collective-owned land requested. Collective-owned land involves the group of Qiaowan Village of Shangdukou Community on the south bank of Cuiping District of Yibin City. The total land requested includes dry land 1.49m, commodity vegetable plot 0.44mu, garden plot 1.64mu, woodland 11.74mu, wasteland 4.57mu, and other land 14.31mu.The total cultivated land requested is 1.93mu, accounting for 5.65% of the total area of land requested, which, compared with the total cultivated land of the said village group, i.e., 256.1mu, accounts for only a small proportion (less than 1%). Meanwhile, the per-capita cultivated land of this village group is comparatively high among the outskirt areas (1.02mu/person). The basic conditions of rural collective economy and land requisition for the Project involved in Section B are as shown in Table 1.

A total of 1,028 households are affected by relocations in the two sections involved in the Project, among which 97 are rural households and 931 are urban households. In the same time, 133 enterprises and institutions and 234 shops are also under the influence of relocation. The total population affected in the Project is 8745.

Due to wide range of involvement in the Project and variety of resettlement, buildings affected are also of various types. According to statistics, a total of 158,290.7m2 of various buildings are required to be relocated for the Project, among which 9,529.105m2

are frame-structure buildings, 94,762.94m2 brick-concrete structure buildings, 38,188.86m2 half-timber structure buildings, earth-timber structure buildings565.23m2, mixed-structure buildings 10,816.28 m2, simple buildings 224.04m2, buildings of other structures 426.559m2, at the same time 3,291.674m2 illegal structure and 486.02m2

temporary buildings. See Table 3 for details of buildings affected by relocation.

2.3 Measures in the Planning and Design Stage to Avoid and Reduce Workload of Land Requisition and DemolitionIn order to reduce land requisition and demolition, the route shall be selected carefully during the period of feasibility study for the Project. In addition to such factors as landform, geology and investment, etc. that shall be taken into consideration in the scheme design, the quantity of land requisition and demolition shall, as far as possible, be avoided and reduced. Detailed measures are as follows:

Earth/stone works: use excavated soil for filling, borrow less soil, occupy less land and dispose less soil as far as possible; occupy less cultivated land and fertile land as far as possible for earth filling of all the roadbeds, stations and yards, and borrow soil primarily from earth mounds, wasteland and river bends in the distance; use spoil from bridge and culvert construction to repair riverbank and dyke, thus occupying less land.

Route: existing road, open spaces, areas without buildings shall be utilized as far as possible in the design. At the same time, consideration shall be given to minimizing land requisition and house demolition when designing rights of way.

Road type: unified width will not be provided in design of riverside sidewalk; minimum width will be controlled to ensure smooth passing. When building rest facilities such as stools, etc., the construction shall be adjusted to the local conditions so as to reduce land requisition and demolition as far as possible.

When selecting public transportation stations and points, land requisition and demolition shall be reduced as far as possible and their positions may be shifted to forward or backward when necessary to minimize impacts. For example, elimination of the need to relocate one workshop relocation can be realized through shifting of flag stops outside Yibin Boiler Plant.

The route type, cross section, structure, etc. of the road will be assessed in accordance with the initial investigation findings above, and will be adjusted during the feasibility study and preliminary design to optimize the design with regard to reducing the need for relocation or adjustment of shops, enterprises, residents and institutions.

The employer shall, during the preliminary-stage design of the project, take the suggestions of experts, the public and the project-affected people on avoidance and reduction of land use, optimize and modify design, and determine optimal scope for land requisition and demolition for the Project after presentation of alternatives by the planning and design department.


3. Targets of Land Requisition, Demolition and Resettlement in the

Project

3.1 Avoidance and Reduction of Involuntary Resettlement as Far as

Possible

Construction of Yibin Urban Riverside Loop Line Road Project will be carried out in the downtown of Yibin City and densely populated suburbs and rural areas; therefore, the primary target for construction of the Project is to avoid and reduce relocation of residents as far as possible.

3.2 Preparation of Resettlement Plan of Sustainable Development, Resumption and Improvement of the Production and Living Standard of Project-affected PeopleConstruing of Yibin Urban Riverside Loop Line Road Project will be carried out along densely populated urban riverbank and suburbs, which will inevitably result in relocation of certain urban and rural residents and affect their daily production and living. During the construction of the Project, measures will be taken in accordance with the needs and situations of the project-affected people; a resettlement plan designed to promote sustainable development will be implemented among the project-affected people; and sufficient funds will be provided to resume and improve the production and living standards of the project-affected people to the level equal to or higher than that before resettlement or before implementation of the Project.

3.3 Improving the Housing Condition of the Project-affected People, Improving Infrastructures and Service Facilities in the Surrounding Areas, and Providing Better Employment Opportunity and Development Opportunity to the Affected Population Combining the Long-term Target of Social DevelopmentDuring the construction of Yibin Urban Riverside Loop Line Road Project, land requisition, demolition and resettlement of the project-affected people will be closely linked with the Planning of Urban Space Development of Yibin City, to improve the living environment, improve urban infrastructure and service facilities, and provide better employment and development opportunities to the project-affected people by taking advantage of the opportunities provided by urban economic development. Combining the long-term target of social development, the housing conditions of the affected population will be improved, and the infrastructure and service facilities in the surrounding area will also be improved through relocation; the affected population will be provided with better employment opportunity and development opportunity through land requisition.

3.4 Other Relevant TargetsThrough the construction of Yibin Urban Riverside Loop Line Road Project, the following targets will also be realized.

Improving linkages to provide access among city groups, increasing density of road network, decreasing density of population, vehicles and goods transportation,


alleviating traffic pressure and reducing traffic pollution. Providing conditions for pipeline laying and improvement of environment and

landscape along the river, effectively improving people’s living and working environment through rebuilding of municipal roads, thus improving living quality and urban standard.

Along with the creation of new urban space, the existing urban space will be fully utilized and effectively managed; pollution will be largely reduced as well.

Improving the existing living environment, ensuring the sustainable development of economic development, and leaving more development space and resources for future generations.


4 Investigation of Social Economy

4.1 Social and Economic Condition in the Project Location

Yibin City lies between 103°39′ ～ 105′20 east longitude and 27°49′ ～ 29°16′ north

latitude, covering a length, from west to east, of 153km, and a width, from north to south,

of 150.4lm. Jinshajiang River and Mingjiang River converge at Yibin City, into

Changjiang (Yangtze) River, so there is the beautiful name of “The First City along

the 10,000 li (0.5 km) Changjiang River (Yangtze)”. Sitting at the south edge of

Sichuan Basin and at the junction of 3 provinces of Sichuan, Yunnan and Guizhou, Yibin

City is adjacent to Luzhou City in the east, connecting with Zhaotong City of Yunnan

Province, Liangshan Yi Nationality Autonomous Prefecture in the west and Zigong City

in the north. It is the communication hub and commercial center at the junction of the 3

provinces and the most important location of resource development and ecological

protection on the upper reaches of the Yantze River. The GZ40 trunk line of National

Highway passes longitudinally from south to north, S206 and S307 Provincial Highway,

Neijiang~Kunming Railway connects with the adjacent cities. The area of Yibin City

proper is 13,283 sq. km, covering one district and 9 counties of Cuiping District, Yibin,

Jiang’an, Changning, Gaoxian, Junlian, Gongxian, Xinwen and Pingshan counties. There

are a total of 97 villages, 106 towns and 2,969 administrative villages. The Total

population of the whole city in 2003 was 5.15 million.

GDP of Yibin City in 2003 was 29.102 billion Yuan, with economic aggregate ranking 4th

in the whole province. In terms of regional economic development, Yibin is projected to

develop into a central city in the region with energy, food and chemical industries as

dominant sectors, and featuring the brewing of alcoholic products. Yibin is situated at

the juncture of Panxi-Liupanshui resource-rich area and Changjiang River economic

strip. It is the “Bridge Head” of the Panxi-Liupanshui resource area and Changjiang

River economic strip, lying in the geographical center of the 4 most important

economic cities in southwest area: Chongqing, Chengdu, Kunming and Guiyang (all

within a distance of 200~500km), which is a “Growth Point” of the central zone in

Sichuan, Yunnan and Guizhou provinces. In a special study on overall city planning

and compact town group district in south Sichuan, Yibin City is appraised, on a

comprehensive index ，as the city with the maximum development potential among

town groups of south Sichuan; and in a special subject research of national “11th Five-


years Planning”--- Sichuan Chongqing Economic District, Yibin City is regarded as

the sub-growth pole of Sichuan Chongqing Economic District, being the “Third Pole”

next to Chengdu and Chongqing. It possesses the potentials to become a larger and

more economically important city.

The external traffic of the city is quite convenient. A comprehensive communication

network for Yibin City consists of road, railway, water transportation and civil aviation.

Road network of Yibin City is formed by taking Yibin as the center, with 2 National

Highways (GZ40 and G213) and 4 provincial highways (S206, S307, S308, and S309) as

the basic framework, as well as county and town highways as connection lines. Yibin is

rich in energy and mineral resources, possessing the basis and predominant position

in industries such as food (with alcohol brewage as a feature), chemical engineering,

chemical fiber, paper making, energy and building material etc. Tourism resources

include unique characteristics, such as the national-level scenic spots “Bamboo Sea of

South Sichuan” and “Stone Forest and Cave Town”, national key cultural relic

protection unit, Xijiashan Ancient Folk Houses, age-old Zhenwushan Taoism building

group, suspended Coffin of K-People, as well as numerous provincial level scenic

spots.

Yibin City has worked out a development objective and strategy for future city social and

economic development. The development objective is to become:

An economic center at junction of Sichuan, Yunnan and Guizhou provinces, traffic

hub and commercial center;

An important central city along Changjiang River economic belt;

A modernized industrial city in terms of resource exploitation and a garden city with

ecological mountains and rivers.

For the purpose of realizing its social development objective, the overall development

strategy of Yibin City is to take the opportunity of implementing the urban master plan of

the new century, to analyze and combine with its local conditions, advantages and

features for social, cultural and natural development, as well as to insist on sustainable

development strategy by paying equal attention to “Fairness” and “Benefits”.

Yibin is approaching development in the first 20 years in this century in three phases

by using “the first five years to consolidate the foundation, another five years to break

through, and the final ten years to realize a tripling of GDP. From 1999 to 2005, GDP

for the whole city will be doubled and by 2010 the city will be built into a class one


central city in the upper stream area of the Yantze River, a comprehensive

communication hub in the junction of Sichuan, Yunnan and Guizhou provinces, the hub

of hydropower development on the Jinshajiang River, an important constituent of

ecological protection for the upper stream of Yantze River. By 2020 GDP will reach the

national average and will have tripled from the base year of 2000, with GDP per

capita exceeding 3000 dollars,

4.2 Population Census

4.2.1 Population affected within the scope of the Project

From July 17 to 30, 2004, an inventory survey was launched primarily by Yibin

Urban Construction and Investment Co., Ltd. in conjunction with Yibin City Xinyu

Demolition Company and Yibin Urban and Rural Planning, Survey & Design Institute

for land requisition, demolition and resettlement of the project-affected people

involved in Yibin Urban Riverside Loop Line Road Project. The method of

investigation is to make a universal investigation among all kinds of project-affected

people. Yibin National Land Resources Bureau was responsible for the investigation

data of rural collective land and attached facilities. The purpose of performing the

inventory survey among the project-affected people is to determine the quantity and

quality of assets of the affected people within the scope of the project, calculate the

physical loss of the project-affected people due to land requisition and demolition,

and provide essential data for the social economic appraisal of the project, and for

studying the impact of the project upon regional society and economy and for

resettlement implementation as well as internal and external resettlement monitoring

and evaluation.

The survey shows that the project-affected people to be impacted by the construction

of Yibin Urban Riverside Loop Line Road Project number 8,745 persons, among

whom are 931 urban households including 2,878 persons, 97 rural households with

349 persons, 113 enterprises and institutions with 4,438 persons and 234 shops with

1,080 persons. See Annex 2 for the detailed listing of affected enterprises, institutions

and shops. The actual quantity of affected people and assets will be reviewed and a

base-line survey will be undertaken before resettlement implementation in the field

which will be in one or two years after preparation of this plan in 1.5 yars.


4.2.2 Basic information of land requisition and demolition affected people

Table 4 reflects the distribution of urban families of project-affected people. In

general, project-affected people of urban families are mainly 3-4 persons/per

household, among which, 60% population of the project-affected people concentrates

in Section A area.

Community that exceed one mu per capita, the cultivated land per capita for the

remaining groups is less, especially the cultivated land per capita for Wuqiao Group 1

and Liuhuai Community Yangwan group are the least. Wuqiao group 1 has almost no

cultivated land. The farmers in these village groups rely on non-agricultural income

for living source. Just as this, the annual income per capita for villagers of 30

households in Wuqiao Group 1 is less than 800yuan. Meanwhile, the annual income

per capita for most villagers in Shangdukou Community Qiaowan Group is less than

1500yuan.

4.2.3 Disadvantageous groups, including impoverished population, one-parent

family with women as householder, the solitary and widowed, the old, the deformity

lacking of labor capacity and the minorities.

The investigation within the project-affected area shows that there are no

concentrated vulnerable groups. All the farmers living in suburb can obtain non-

agricultural revenue through renting their houses or working locally in the city or

other places in the country or trading. However, there are 45 households whose

annual average income is less than Y800/year/person. Among the 45 households in

the rural areas, 10 have handicapped and seriously sick members at home. Four of

them are at Qiaowan VG, five at the 1 st VG of Wuqiao and one lives in the 3 rd VG of

Huangqiaoping. It is found out from the investigation that within project-affected

people for urban families, there are 107 households who have members unemployed.

No ethnic minorities are identified in the project area.

4.2.4 Determination of Category of All Project Affected People

Taking Table 3 as a reference, the project-affected people within the Project can be

categorized as the following:


The rural residents living in the outskirt of Yibin City are distributed in 10

villager groups.

The urban residents living in Yibin City along the river bank.

Enterprises and institution unit within the project area

And the small shops distributed within the project area.

4.2.5 Method of Periodically Improving Database for Production Capability and

Livelihood of the Project Affected People

The Employer will establish current production and living levels through

comprehensive investigation before land requisition and demolition, establish a

management information system for data on project-affected people, and follow up on

changes in the production and living level data of project-affected people through

periodic internal monitoring and research during project implementation.

4.3 Inventory Survey

4.3.1 Losses of Project Affected People

4.3.1.1 Land requisition

Table 11 and Table 12 show the land requisition involved in Yibin Urban Riverside Loop Line Road Project. In the project area, 83.97% of land is state land that will be provided through direct transfer. These state owned lands are currently occupied or utilized by urban roads, affected enterprises, affected shops and urban residential sites which must be moved out of current sites due to the construction of the project and relative impacts have been illustrated in the related sections; The project will also acquire a total of 64.17 mu land from villagers’ collectivities ，among which, there are 19.33 mu forest land taking 30.12% of total land requisitioned from the collective in the rural area.

4.3.1.2 Demolition of Houses of Urban Residents

There are total 931 households of urban residents to be affected, among which, there

are 566 households in Section A and 365 households in Section B. The data in Table

13 indicate that there are 62,574.48 m2 of urban residential structure areas, and

46,910.61m2 utilization areas in Yibin Urban Riverside Loop Line Road Project,

averaging 16.3 m2/person. Meanwhile, there are 77 illegal houses of urban residents

with a total of 1762.814m2 , mostly in Section A. These houses are used as

storehouses and no people are living in. There are 621.653m2 of shops areas of urban

residents, mainly used for rent or small shops.

4.3.1.3 Demolition of Houses of Rural Residents

Totally 20,646.07m2 of houses for 97 households in 10 villager groups in urban

suburbs for the construction of Yibin Urban Riverside Loop Line Road Project have

to be demolished or relocated, among which, 2,413.928 m2 are frame structure,

13,621.04m2 brick and concrete structure, 4,045.88m2 brick and wood structure and

565.23 m2 earth and wood structure. No one live in the earth-wood houses, but fowls

or personal belongings. See Table 15 for details.

Loop Line Road Project will affect 97 households of rural family, totally 206,460.07

m2 houses affected, averaging 59.2 m2/person. Most affected houses are in Section A.

Generally, the area distribution of rural residents more than 180m 2/household

occupies higher. Section A and Section B reach respectively 43.86% and 28.12%.

Totally 54,963.86m2 houses of 113 enterprise and institutional units (including all


kinds of enterprises, schools etc. institutions and governmental organs etc.) will be

demolished due to the construction of Yibin Urban Riverside Loop Line Road Project.

Among which, 21,993.35m2 brick and concrete structure, 4921.46 m2 frame structure,

9882.74m2 mixture structures (all kinds of houses affected within the unit are not

clearly calculated in separate), 17,998.51m2 brick and wood structure. See Table 17

for details.

institutions. Except the properties of part enterprises and institutions being not

marked clearly in inquiry, 2 stock-holding, 39 private enterprises, 34 state-owned

enterprises, 17 collective-owned enterprises, 15 institutions and 6 governmental

organs fall in the property-marked enterprises and institutions. See Table 18 for

details.

4.3.2 Illegal, Temporary and Overtime Temporary Structures

Most of the illegal houses for the urban residents were built in the 1970s and 1980s. During the field investigation, no one was found living in the illegal houses. In addition, many shops facing the streets were found to be built by enterprises behind the shops without approval by the urban master plan. See Table 20 for details.

5 Legal Framework

5.1 All state and local rules and regulations related to requisition of

land and demolition as well as main contents thereof5.1.1 Documents Regarding Construction, Requisition of Land, Demolition and

On the basis of relevant requisition and demolition policies, rules and regulations issued by various authorities of the People’s Republic of China, preparation for the plan of land requisition and demolition activities is made for Yibin Urban Riverside Loop Line Road Project. 5.1.2 Compensation, Land Acquisition and House Demolition Policies for Impacts of

Different Types of Assets

5.1.2.1 Permanent requisition of collective land

The Loan Implementation Institution will, according to the rules and regulations of the People’s Republic of China, entrust Yibin Unified Land Requisition Department with the responsibilities to pay the project-affected villages and villager groups the land compensation fee.

Methods employed to determine the land compensation fee are: On condition that all lands of the rural collective economic organizations have been requested and all the villagers need to be resettled, all land compensation fee, calculated in accordance with the land laws and policies, and all resettlement subsidies shall be used to resettle the villagers who have become urban residents as a results of land requisition. While parts of the lands of the rural collective economic organizations have been requested, 70% land compensation fee and all resettlement subsidies shall be used to resettle the villagers who have become urban residents and the rest 30% land compensation fee shall be given to the collective economic organization for rehabilitation and development of production. Compensation for requested land should be calculated as 6 to 10 times of the average annual value of production of this land in 3 years prior to requisition. See Table 22 for criteria of annual value of production. Compensation fee for other types of land shall be half of that of the crops-plowland. For those villagers with more than 0.8 mu plowland per capita after requisition, the land compensation fee shall be 6 times of the annual value of production; for those with 0.6 mu to 0.8 mu, it shall be 6 to 8 times; for those with 0.4 mu to 0.6 mu (excluding 0.4 mu among which 0.3 mu is vegetable plot), it shall be 8 to 9 times; for those with less than 0.4 mu (among which 0.3 mu is vegetable plot), it shall be 10 times. See Table 23-26 for criteria of compensation for requested land in Yibin City

The village groups who have acquired land compensation fee shall determine on their own the distribution and use of the money. Methods employed by villager groups to use land include making use of the compensation fee to develop agricultural and nonagricultural fields to enhance their economy.

5.1.2.2 Temporarily leased land in construction period

For those lands temporarily leased and with a leasing period as 6 months, the Loan Implementation Institution shall, based on the value of agricultural production on land, compensate the overall annul output value for fish ponds and crops planted one time a year, and semiannual output value for crops planted two times a year or more times. If period exceeds 6 months, output value of a whole year shall be compensated. In case that the period is over one year, compensation shall be made for 100% of the corresponding output value from the second year. After the expiry of the leasing period, land use units will organize or entrust the restoration of cultivation. On condition that the land capability has decreased and crops fail, compensation will be properly made. Cost for restoring cultivation is paid in advance while going through the temporary land-use formalities.

5.1.2.3 State owned land

Among the total area of used land in the project, 83.97% is state owned land and is directly allocated.

5.1.2.4 Loss in houses

All the residents affected by house demolition will be relocated in ares under the urban master plan. Detailed resettlement measures are:

(i) For houses of the project-affected urban residents, two compensation methods are applied:

First , cash compensation. The demolition unit makes compensation according to the market price determined by the evaluation organization for the affected houses.

Second , replacement of house property rights along with compensation for price difference. After working out the compensation sum for the demolished house and the replaced house based on market price, the price difference brought by the transaction needs to be settled.


Those projected affected urban residents, who move into houses (for example, second-hand houses) of the same standard with their original ones or communities (in which houses are usually new) better than the originals, will not be compensated in cash. In case that there are changes in floor areas or house structures, such as the floor areas of the houses for replacement are bigger or smaller than that of the originals, price difference will be settled based on the cost prices.

(ii) Those project-affected rural residents in suburb of the city will not be allocated with land for house construction on their own since they have entered into the urban planning area. Two methods will be adopted to resettle these people. They are entitled to choose:

First, cash compensation. Those projected affected rural residents will be compensated in money once-and-for-all and for all value of their houses, so they will not be distributed with houses or allocated with lands for house construction. See Table 24 for the compensation criteria.Second, resettlement by distributing houses, that is, replacement of house property rights along with compensation of price differences. The Project Resettlement Organization will select a land to construct houses collectively as the house resource of replacement. Replacement of property rights: The demolishing party will distribute houses to the project-affected people based on their original houses. On condition that the floor area of the distributed house exceeds that of the original, settlement will be made in accordance with the market price. In case that the floor area of the demolished house is less than 20m2, the resettlement unit will resettle the house owners according to the lowest standard of resettlement floor area, that is 20m2 per person.

5.1.2.5 Partial impact on structures

The Loan Implementation Institution will carry out a full compensation according to the substitutional value. See Table 25 for the criteria of compensation fee.

5.1.2.6 Impact on enterprises

After negotiation with the local government, the Land Requisition, Demolition and Resettlement Department of Yibin Urban Riverside Loop Line Road Project will allocate another land in Baisha Industry Park to projected affected enterprises of production type to rebuild their force. In terms of procedure, allocation of land and construction of factories will be first so as to reduce losses due to stop of production. The Employer of the Project will compensate the enterprises for the project-affected buildings, structures, other fixed assets and furniture in the form of the replacement cost, for all expenditures on move and workers’ allowances due to stoppage of production until they restore the production in the new factories. Allowances for work stoppage will be equal to the workers’ monthly wages. Yibin Urban Binjing Loop Line Road Project will compensate the project-affected township enterprises and private enterprises for the net loss of production during stoppage period.


Policies for enterprises of different type are as follows.

For those productive enterprises that have already ceased to operate for more than one year prior to the enterprise survey cash compensation will be paid for the fixed assets of the enterprises and vocational training, free of charge, will be provided to the workers if there are any remaining in the non-operative enterprises. For those enterprises of production type which can operate normally, resettlement will be made in Baisha group according to the urban planning. Details will be determined after negotiation with the demolished enterprises. For those enterprises of non-production type, cash compensation will be made in principle, supplemented with free employment training, etc. For those with special conditions, it can be considered to resettle them in the newly built commercial areas in the city.

5.1.2.7 Stores and small shops

After negotiation with the local government, Resettlement Department agrees to assist these shops to find a business location or façade of shop in the city approximately equal to the original floor areas and of the same grade to continue their business. Difference in floor areas will be settled by compensating price difference on the basis of the construction cost. The Resettlement Department will compensate these shops for the net loss of business during closing period.

5.1.2.8 Temporary impact on enterprises and institutions

The Resettlement Department will compensate these enterprises and institutions according to the replacement cost of their assets. This will be considered along with the nature of the materials used in construction of the original building. In this Project, we will make full compensation as providing sites for affected enterprises and institutions to select and compensating employee’s loss on wages and production.

5.1.2.9 Impact on public infrastructures and other attached facilities

The construction of Yibin Urban Riverside Loop Line Road Project will affect the road surface in the urban road system. The Resettlement Department will, making use of engineering technology, try its best to reduce impact on urban residents and the public infrastructures. On condition that the impact cannot be avoided, it will make full compensation for all municipal infrastructures based on the substitutional values. Yibin Urban Construction and Investment Co. Ltd. will be responsible for rebuilding and rehabilitating the infrastructures.

For those facilities attached to the ground, the Resettlement Department will carry out compensation in conformity with laws and according to the actual situations. See Table 26 for the compensation criteria.


5.1.2.10 Loss in young crops

Project-affected rural residents will be directly paid the compensation fee for loss on young crops by the Yibin Urban Riverside Loop Line Road Project according to annual output value during the affected period. For those crops planted one time a year, compensation will be made for the output value of a whole year. For those planted two times a year, compensation will be made for a half-year output value. If the lands are not planted with young crops, no compensation will be made.

5.1.2.11 Payment of fee

Land acquisition and replacement cost for house demolition will be paid in the Project

plus compensation for transition, move and others. For the residential households, the

moving compensation is Y250/household and the transitional compensation is

Y350/month/household for houses with the floor space less than 50 m2. The transitional

compensation for houses with the floor space large than 50 m2, a Y4 will be added on

every additional square meter. Those who want to take cash compensation will receive a

transitional compensation for 45 days as well. For the non-residential units, the moving

compensation and transitional compensation will be negotiated and determined prior the

time of relocation based on the actual compensation needed. For the renting houses, the

Resettlement Department will compensate the house owner and the tenant if the house

owner is to cancel the renting contract or if the house owner is to relocate the tenant. The

moving compensation and transitional compensation will be paid to the house owner

and/or the tenant as well.

5.1.2.12 Compensation criteria for requisition of land and demolition

The confirmed criteria of compensation for requested land of all types have been discussed with all implementation units of the Project, Land and Resource Bureau, House Administration Bureau, leaders of projected affected towns, subdistrict offices, villages and groups. The compensation standards are the same with the Yibin city policy. These policies include Enforcement Regulations of Yibin City on Requisition of Land, Compensation and Resettlement in Urban Planning Area (YFBF [2001] 31, issued on Apr. 5, 2001), Provisional Regulations of Yibin City on Compensation and Resettlement of Villagers Who Have Become Urban Residents as a Result of Requisition of Land (YFF [2004] 50).

Among the 10 affected village groups, none of them will lose all the land. While part of the land of the rural collective economic organizations will be expropriated 70% of land compensation fee and all resettlement subsidies shall be used to resettle the villagers who have become urban residents and the rest 30% land compensation fee shall be given to the collective economic organization for rehabilitation and development of production. Compensation for land compensation fee is calculated as about 30% of the 10 times of


the annual average production value of this land in 3 years prior to requisition. Therefore, 3 times of the annual average production value listed in Table 22 are adopted. Based on a government regulation, the bamboo trees will be subsidized as Y7000/mu. See Table 23, Table 24, Table 25 and Table 26 for the detailed rate standard.

5.2 Differences between local statute and involuntary resettlement

policy of the World Bank as well as departments responsible for

reducing these differences arising in the Project

Over the question whether to compensate for the illegal structures or not and how during the land requisition and demolition process of the Project, there are differences between the policies of the local government and that of the World Bank concerning involuntary resettlement.

It is stipulated in Article 27 of Provisional Control Regulations of Yibin City on Demolition of Urban Houses (No. YFF [2003] 10, issued on March 5, 2003) that “No compensation shall be made for demolition of illegal structures and temporary constructions due of approved expiring date; however, those temporary constructions within the approved expiring date shall be properly compensated. Those temporary constructions of which the instrument of ratification indicates that it shall be unconditional demolished if the urban construction needs will not be compensated for


demolition.” However, the OP4.12 of the World Bank regarding involuntary resettlement requires the PAPs to be compensated quickly and effectively based on full resettlement cost to offset their direct property loss caused by the Project.”

Method adopted to dissolve this policy difference is to fully compensate all the illegal structures. The unit responsible for this task is the leading group of Yibin City for environmental protection project. For the urban residential houses, the illegal structures are used as storehouses. No people are living inside. A compensation of Y100-400/m2

will be paid to the house owner. For the households whose average floor space per person is less than 20 m2 in a household (that’s why they built illegal structures to solve the shortage of housing before purchasing a new house), they will receive replaced houses wih a floor space of 20 m2/person free of charge. For the illegal shops owned by the adjacent enterprises, the shop user or the tenant will receive moving compensation and continue the business in another appropriate place. The shop owner or the enterprise concerned will receive a compensation of max.Y400/m2 for the houses although the investment of the illegal structures has been recovered since construction of these houses in the 1970s and 1980s.


6 Framework of Institutions

6.1 Institutions Associated with Resettlement Work and their

Responsibilities

6.1.1 Establishment of Institutions

To ensure that the Project can be carried out smoothly, Yibin People’s Government and the construction party, Yibin Urban Construction and Investment Co., Ltd., establish the necessary resettlement institutions to organize, coordinate and monitor the resettlement work. The Employer of the Project is Yibin Municipal Government. Institutions established for requisition of land, demolition and resettlement of the Project are:

In accordance with the requirements of the WB founded Project, determination is made to establish a special processing organization ， the Construction Management Office of WB Founded Yibin Urban Riverside Loop Line Road Project (hereinafter shortened as WB Founded Project Office). It will be responsible for the Project’s plan, founds, resettlement, construction, etc. Nie Wenxue will hold plural offices as Office Director, Li Zheng, Tan Kun and Deng Rongsheng as vice directors.

Implementation party of the Project, Yibin Urban Construction and Investment Co., Ltd., also establishes internal working group for land requisition, demolition and resettlement. Group leader: He Bo Group members: Luo Gang, Zhang Can, Xu Kebin, Pan Suchuan. See the chart for resettlement institutions of the Project.


6.1.2 Responsibilities of institutions

Leading group for resettlement of the Project

It is mainly responsible for overseeing the implementation and monitoring of all resettlement-related activities of the Project. Under the leadership of the Sichuan Leading Group for Urban Environment Work, it is in charge of making policies for the resettlement work, organizing and coordinating the relations between resettlement institutions at various levels.Office is established under the Leading Group to deal with daily affairs.

Project Resettlement Office

a. It entrusts design units with the task of determining the project-affected area and all local resettlement institutions with task of carrying out social and economic investigation and statistic so as to record these data.

b. It is responsible for providing vocational training to staff of resettlement institutions at various levels.

c. It organizes and coordinates the editing and implementation of the Resettlement Action Plan (RAP).

d. It organizes the public to negotiate and publicize the resettlement policies.

e. It is in charge of the management of resettlement cost and allocation and use of founds.

f It guides, coordinates and monitors the resettlement actions performed by local resettlement institutions at all levels and the processes.

g. It also organizes internal monitoring activities and writes internal monitoring reports.

h. It assists the external monitoring activities.

i. It prepares process reports.

During the implementation of land requisition and demolition among the rural and urban PAPs, the Land and Resource Bureau is of great importance. It is held responsible for the following tasks.

External monitoring and evaluation institution for resettlement

As the Employer of the Project, Yibin Municipal Government has entrusted the Research Institute for Introduction and Utilization of Foreign Capital under Southwest Jiaotong University as the independent external monitoring and evaluation institution.The external monitoring and evaluation institution will perform all basic monitoring works by providing technologies to Project Resettlement Office and carrying out investigations in resettlement and in the PAPs living standard according to regulations. Main


responsibilities are:

a. Monitoring Resettlement Action Plan and all aspects of implementation as the independent monitoring institution, and providing the Employer and the World Bank with the monitoring and evaluation reports on resettlement.

b. Providing technical advice to the Employer and relevant departments on processing of investigation data.

6.2 Institutions’ Capabilities and Measures to Enhance the Capabilities

of Institutions

Personnel in the institutions involved in the construction, land requisition, demolition and resettlement work of the Project are all elites from the local operating departments; however, this is the first time that they take part in the resettlement work of a project founded by World Bank. To enhance the capabilities of the institutions, it is proposed to adopt measures as providing conditions, strengthening implementation procedure and increasing trainings, etc. Measures also include:

A Staff of institutions at all levels consist of technical staff of various professions and administrative managerial staff, who must have professional qualifications at certain level and managerial qualities.

B Main staff member of institutions at all levels will be organized to participate in vocational trainings so as to understand our resettlement policies and relevant requirements of the World Bank and enhance vocational quality and abilities to manage policy problems. Yibin Urban Construction and Investment Co., Ltd has sent staff to join in the trainings held by resettlement experts from the World Bank on April 2004 in Chengdu. Personnel concerned in the Project also participated trainings on resettlement OP4.12 policy of the World Bank and its operation carried out by experts from the professional resettlement monitoring institution, Research Institute for Introduction and Utilization of Foreign Capital under Southwest Jiaotong UniversityDuring the implementation period of the Project, staff member from Sichuan Provincial Project Office will organize at least two symposiums based upon training of land requisition and demolition. Resettlement training schedule determined specially for the Project by Sichuan Provincial Project Office and Yibin Municipal Office includes:

a. Before the beginning of the formal implementation of land requisition and demolition work of the Project, concerned working staff will be trained with laws, polices and procedures, which include resettlement policy of the World Bank, China’s relevant rules and regulations, relevant policies of Yibin City for the Project and implementation procedures, etc.

b .During the implementation of land requisition and demolition work, employment training will be carried out for the PAPs, which includes the employment situations in local and other cities of China, relevant


employment skills, etc.

C All these works will be provided with full funds and equipment guarantees.

D Data base will be established to facilitate information feedback which also guarantees smooth communications from the high level to the low level and from low level to the high level. Major problems will be determined and solved by leading groups.

E Reporting system will be intensified as well as the internal monitoring so as to solve problems immediately after finding them.

F External monitoring and evaluation mechanism will be formed along with early warning system.

6.3 Establishment of a Mechanism for Coordination and

Cooperation between all Institutions

The coordination and cooperation between all institutions involved in construction, land requisition, demolition and resettlement of the Project are realized through the leadership of Leading Group of the Project specially established by Yibin Municipal Government. Therefore, a participatory coordination and cooperation mechanism has formed with Leading Group as the decision-making institution and Project Office under the Leading Group as implementation institution.

7 Qualifications for Compensation

7.1 Compensation Policies and Principles

[1] Land compensation fee, resettlement subsidies and compensation fee for young crops will be calculated and determined according to the relevant regulations in Enforcement Measures of Yibin City for The Law of Land Administration of the People's Republic of China.

[2] Compensation for houses and attached facilities will be carried out according to Document {No.YFF[2003]10} of People’s Government of Yibin City and Document {No.YFB[2001]30}of Office of People’s Government of Yibin City.

[3] Compensation and resettlement of villagers who have become urban residents as a result of acquisition of land will be carried out according to Document {No.YFF[2004]50} of People’s Government of Yibin City.


[4] Compensation standard of odd trees will be determined according to the actual value or actual cost for replanting.

If new documents regarding requisition of land and demolition are issued in Yibin City before the implementation of Project and the compensation standard is higher than that in resettlement plan, compensation standards in the new documents will be exercised during the implementation of Project.

7.2 Definition of Resettlement Personnel or Project-Affected People and Conditions and Qualifications Needed for Compensation and Aids

Definition of “Project-affected people”

“Project-affected people” refers to those, till the announcement of move notice of requisition of land and demolition according to laws, whose living standard is affected or will be affected unfavorably, or whose house property right, rights or interests, lands(including house sites, farmland) or other personal properties or estate will be requested or occupied, or whose business, vocation, work or habitation and habits will be unfavorably affected due to the implementation of the Yibin Urban Riverside Loop Line Road Project.

“Project-affected people” can be individuals as well as legal entities as enterprises and public institutions. The meaning of “project-affected people” does not define their legal registration, living admission or engaged businesses in the project-affected areas, or limit compensation for their properties. Therefore, it includes:

⑴ all project-affected people regardless of the legal rights and interests or whether they are attendant or not;

⑵people without residence permission in specific areas.

Thus, all these people, without consideration of the property right, land or location, will be regarded and recorded as project-affected people.

All project-affected people shall be compensated so as to improve or at least resume their living standard. Moreover, compensation shall be carried out for property losses suffered by these people. Property losses shall be compensated according to replacement price. There will be no reduction or discount on compensation amount for depreciation as or other reasons. All project-affected people shall be entitled to rights and interests for impact suffered. Apart from the compensation for property loss, they should also be given allowance for rehabilitation. Those project-affected people who do business, open up land or carry out construction but without property rights and interests and legal residence permission, should be treated the same as those with formal legal properties, rights and interests or residence permission. They are qualified to restore their life and be compensated for properties.


Definition of “resettlement”

“Resettlement” refers to the arrangement of production and living for the PAPs so as to make them gain interests from the Project. It mainly includes:

⑴ Remove living areas;

⑵ Look for new employment for the PAPs;

⑶ Restore or compensate the project-affected land, working places, woods and infrastructures, etc;

⑷ Rehabilitate those whose living standards or living qualities are unfavorably affected due to requisition of land and demolition, such as polluted poisonous gas;

⑸ Rehabilitate or compensate project-affected individuals or enterprises and public institutions;

⑹ Rehabilitate the cultures or public properties unfavorably impacted.

Definition of “rehabilitation”

The meaning of “rehabilitation” refers to rehabilitating the productive activities of the PAPs, or improving their living standard or at least maintaining the standard the same before the implementation of the Project. Rehabilitation includes activities in addition to compensation designed to ensure the restoration of living standards prior to the project implementation.

7.3 Qualifications for Resettlement and Compensation

There are three categories of project-affected people who are qualified for compensation and resettlement.

Category 1: Those who have formal legal rights to land and properties within the land requisition and house demolition area.

Category 2: Those who do not have legal rights to land and properties at the time the census begins but have a claim to such land or properties (These requirements are ratified by the state laws and come into being due to illegal occupation and continuous occupation without recovery by the state, that is, public lands with the government’s acquiescence, or due to traditional or conventional usages). For example, tenants can gain compensation during the valid period of his rent contract.


Category 3, those who have no recognizable legal right or claim to the land they are occupying. If they occupy the land after the cut-off date, they will not be qualified for land compensation..

7.4 Table of Legal Rights

8. Resettlement Measures

To ensure that resettlement of all types of the PAPs can be realized according to the resettlement policies, a series of resettlement measures and plans will be adopted. These measures and plans should not only be in finance and technology but also comply with the PAPs cultures and customs and be fully discussed with the PAPs.

8.1 Resettlement Policies and Principles

The resettlement planning will be carried out based on physical indicators of land requisition and demolition and in accordance with the standards of compensation and allowances for land requisition and demolition.

Resettlement should be connected with construction of regions, development of resources and economy and protection of environment. Practical measures will be worked out for rehabilitating and developing project-affected people’s production and living based on the actual situations and local conditions.

Planning and layout will be worked out in accordance with the principle of “Favor production and facilitate living”.

The scale and standard of the resettlement house construction will take the principle of combing Yibin urban space planning and the original scale and standard of houses of the PAPs.

All things shall be taken into consideration so as to properly handle the relations among state, collective and individual.

Construction will be first of demolition.

Full compensation will be made in time based on replacement price.

Special treatment will be given to disadvantageous groups.

8.2 Demolition and Relocation for Rural Residents in the Suburban

Areas and for Urban Residents

The 931 urban families who are affected by the Project will be compensated in cash based on the replacement price for their demolished houses or be resettled in other houses. The 97 rural families who are affected by the Project will be compensated in cash based on the replacement cost for their demolished houses or be resettled in other houses. Construction of resettlement houses will be planned as a whole in the urban area and the rural and urban PAPs will be resettled nearby.


Construction planning of resettlement houses: Construction of resettlement houses will be grouped in Jiuzhou and Baisha in Yibin City. Six lands for construction will be requested in west district of south bank in Yibin City, covering an area of 79495m2, of 56464 m2, of 77574m2, of 40112 m2, of 112100 m2 and of 132000m2 respectively. It will be the Land and Resources Bureau of Yibin City together with the House Administration Bureau of the city who organizes the construction of six resettlement communities with a floor area of 149917m2, of 101640 m2, of 112800 m2, of 72202 m2, of 134520 m2, and of 264000 m2 respectively. Construction of resettlement houses on three lands in Jiuzhou group has begun in December 2004. The first installment of resettlement houses has been completed in December 2005, and the construction of second installment will begin in October 2005 and complete in October 2006. See Table 29 for details. However, the PAPs can also purchase commercial houses in the local market with compensated cash.

Yibin City, as a town of industrial and commercial importance in south Sichuan Province, has a large population and developed commercial and trade industries. In recent years, there is a rapid development in the residential real estate market. Real estate developers in Yibin City, including Qiangjiang, Zhengxiang, Yinlong, Yuchuan, Chengzhong and Zhenghe, have constructed 4463 commercial residential buildings. Construction of 8 new buildings has begun with commercial residential buildings reaching a floor area of 383957.1m2. These commercial residential buildings are divided into ordinary commercial residential housing and economically affordable housing.

The price of ordinary commercial residential housing is determined based on the present situation of the urban development of Yibin City, people’s income situation and the location of the residential communities in the city. After the determination of the price, the construction site will be publicly auctioned. This is to increase the land benefit so as to reduce cost in construction by means of market competition. Cost of public infrastructures in communities will be integrated into the construction cost of the residential buildings in line with the relevant state regulations. Land of economically affordable housing will be allocated at a preferential price, the administrative and management fees for these houses during construction and maintenance will be reduced by 50%. In development and construction of this type of housing, the price of lands will be limited and Developer, the Employer, will be selected publicly based on the offered house prices. This will effectively reduce the price of the houses by means of market competition. Government bears the cost of infrastructures outside of the communities, while the infrastructures and public facilities inside of communities will be integrated into the construction cost of the residential housing. At the same time, Yibin City has completely opened the real estate market and the second-hand house market is very active, too. If the PAPs are not satisfied with the resettlement houses provided by the resettlement department, they can choose cash compensation and purchase their houses in the second-hand house market and market of commercial residential buildings with the help of the resettlement department.

2. For those productive enterprises which can operate normally, relocation will be made in Baisha group according to the urban master plan. Details will be determined after negotiation with the affected enterprises.

3. For those enterprises of non-production type, cash compensation will be made for loss of the assets and relocation. Support of relocation in the commercial area and free employment training will be provided.

4. For those business shops, cash compensation will be made for loss of the assets and relocation. Support of relocation in the residential areas and free employment training will be provided. 5. The structure of the resettlement houses is of brick-concrete. The house design is 2-room plus 2-hall apartment, 3-room plus 2-hall apartment and 4-room plus 2-hall apartment, which can be adjusted in design according to the requirements of users.


8.3 Social Insurance

According to the Provisional Regulations of Yibin City on Compensation and Resettlement of Villagers Who Have Become Urban Residents as a Result of Acquisition of Land (YFF [2004] 50), rural residents should be covered with social insurance. In the document, it is said that compensation and resettlement should comply with the principle of encouraging and improving re-employment and gradually extending the social security system. Start-up allowance and living subsidies will be granted, or, basic pension insurance together with unemployment insurance will be covered. ”

In accordance with Article 9 and Article 10 in No. 50 document, the resettlement department will pay to the social issurance department, within 60 days after the completion of compensation and resettlement, a lump-sum of Unemployment Insurance of 10 years for the villagers, who become urban residents and who are between the age of 18 and 59 for male and of 18 and 54 for female,. In addition, the able-bodied people are encouraged to participate in the urban pension insurance. Those at the age of 18-45 for men and 18-40 for women shall pay for 5 years of basic pension insurance; those at the age of 46-55 for men and 41-50 for women shall pay for 6 years, and 6 plus 1 more year for 1 year older, of basic pension insurance. With payment of the basic pension insurance, an Employment Support Fee will be arranged according to Table 30.

Cuiping District has realized overall coverage of minimum society security, that is, all people who meet the conditions can enjoy the minimum social security. The minimium living allowance was Y130 per person in 2005, and Y150 per person in 2006.

Project-affected people over 60 years old will be given RMB 6,000 Yuan living subsidies

once and for all after the completion of land requisition, compensation and resettlement,

and will be entitled to receive the urban minimium living allowance from the next month

in accordance with the living allowances for the urban poor.

Premiums of basic pension insurance and employment insurance for the PAPs will be

directly allocated to institutions with operation of social insurance by the department of

land requisition.

8.4 Self-Employed Personnel, Urban Labor, and Rural Residents

that are transferred to Urban Residents

Since the project area is located within the urban planning area and with limited

cultivated land for the villagers, there is no possibility of implementing a land-for-land

resettlement strategy and redistributing the land remained after land acquisition. What

will be implemented is a conversion of rural population to urban population based on the

cultivated area per capita in the rural areas; and an allocation of resettlement

compensation of Y320,000 including payment of the social insurance for each affected

person.

Villagers that become urban residents refer to people that are members of rural collective

economic organization and are transferred to urban population as a result of land

requisition of land under the collective ownership of peasants. Population that transfers

from rural residents into urban residents shall be calculated as per the quotient of the

quantity of requisitioned plowland and the plowland taken per capita by villagers of the

rural collective economic organization within the requisitioned area before land

requisition. The population of project-affected people are 349, among which 197 belong

to the 9 village groups under Section A and 152 belong to the one village group under

Section B.

Where the transfer from rural residents into urban residents is caused by legal requisition

of part of the land from rural collective economic organization, the people for transfer

shall be confirmed according to labor force as well as the proportion of the aged and the


young, which shall be proclaimed by means of notice for supervision, reported to

people’s government of township (town) and street committee for approval, and reported

to municipal departments of land administration within a month for the record, then the

transfer procedure shall be transacted by the public security organ. Family with land

requisitioned or relocated family shall firstly be arranged during confirmation of people

for transfer. Where all those of labor force age within a family are to be transferred, all

aged and young members of this family shall also be transferred. People that are not

transferred can continue with farming.

For labor force that converted from rural residents into urban residents (for male peasants

between 18 and 55 years old and female peasants between 18 and 50 years old), the land

user or other units will recruit them directly based on the willingness of the affected

people. Others will be provided with free vocational training for re-employment. The

resettlement department is in charge of recommending job opportunities until the person

accepts his first new job. The transitional period is maximium 24 months, during which

the affected person may receive subsisdence from the Unemployment Insurance. Some

people prefer to find jobs by themselves, so that they can make use of the Employment

Support Fee to open a small shop or a production workshop, etc.

8.5 Assistance Measures for Vulnerable Groups

The 10 households with seriously ill or handicapped family members are entitled to all

the compensation and resettlement assistance including relocation subsidy, labor force

employment subsidy, social insurance for farmers who lose their land. Special moving

assistance will be provided for households lacking members of labor force age during the

moving process or that have handicapped members, such as providing vehicles or paying

for employing removal services.

The 107 urban households with the out of work family members (currently referred to as

off-work unemployed staff) can participate in the free employment training and job-

hunting programs for the ex-farmers organized by the resettlement department in addition

to the basic compensation stipulated in the Municipal policy documents. At the same

time, the off-work unemployed staff can enjoy the following support for their

reemployment in accordance with the stipulations in the Yibin’s labor and social

insurance documents, and in compliance with the guidelines from the central and

provincial governments:


Fee reduction and exemption policy Exemption of three charging categories, namely administration fee, certification & license fee and registration fee, for qualified off-work unemployed staff operating private business and community employment units.

Tax reduction and exemption policy Exemption from four taxation categories, namely operating tax, urban construction maintenance fee, education additional tax and income tax, for qualified off-work unemployed staff operating private business and community employment units with a total maxium amount of Y8000/person /year. Reduction or exemption of 3-years income tax for qualified existing service enterprises that employ off-work unemployed staff and for big and middle sized enterprises who establish economic units to settle the surplus personnel.

Social insurance subsidy policy Grant of social insurance subsidies for qualified service enterprises employing off-work unemployed staff and social communities developing commonweal posts to arrange employment for elder-aged staff of original state-owned enterprises that are difficult to be employed.

Post subsidy policy Grant a certain amount of post subsidy for enterprises employing elder-aged staff of original state-owned enterprises that are difficult to be employed.

Small credit policy Provide small loan for off-work unemployed staff being employed or self-employed.

Free employment training policy One time free employment training for every off-work unemployed staff with labor ability and will to work.

Free employment reference policy Free employment reference for every off-work unemployment staff until he/she finds his/her first new job.

Other supporting policies Such as ： ① support finding of sites for off-work unemployed staff to open enterprises or shops by themselves;②Implementing one-stop employment service, i.e. to complete the administrative employment process from various departments concerned in one place and at one time;③continuing social insurance connection;④putting great efforts in help the vulnerable groups, the elder-aged staff who are difficult to place in jobs and “zero employment” households (including off-work unemployment members, unemployed off-land farmers ) in particular.

Urban minimium living allowances

All the urban poor, including the unemployed people, will receive the minimium living allowance if the average income is less than Y150/person/month in the household in 2006.

Besides, the off-work unemployed staff and off-land unemployed farmers under this

project will have the first priority in employment compared with the unemployed people

in the city. Yibin government will also organize qualified off-work unemployed staff and


off-land unemployed farmers to work in the national key projects, such as the

construction of the Xiangjiaba Hydropower Station.

8.6 Rehabilitaiton of People Affected by Renting Illegal Houses

The owner of the illegal houses will receive house compensation and the user will

receive the following assistance for the purpose of keeping the livelihood not adversely

affected:

Those who rent the illegal houses for shops may rent other houses for the shops in the

commercial areas of the new resettlement district or other places of the city. The moving

cost and loss of business due to relocation will either be paid by the house owner or the

project owner depending on the terms in the house renting agreement.

Those who had housing difficulties and built the illegal houses for their daily life may

move into the new apartments with an average floor space of 20 m2 per person in the

resettlement residential area. Otherwise they may purchase second-hand houses in the

city with the cash compensation for the old houses.

8.7 Respective Ways of Resettlement for Enterprises, Institutions

and Shops

Rehabilitation strategy of affected enterprises and institutions will be followed for

various cases described below. See Attachment 2 for detailed resettlement methods and

the corresponding reasons.

A Enterprises used to be productive, but stopped production for at least a year before the socioeconomic survey. Cash compensation wil be paid for the houses and strutures still remaining at the site. Free vocational training for reemployment will be arranged for workers if they are staying behind and taking care of things in the enterprises.

B Productive enterprises under normal production Among 113 enterprises and

institutions of the Project, about 20 are productive enterprises, which are

mainly centralized along Section A. According to urban planning, the

economic & technological development zone within Baisha Group shall be

the centralized development zone of industrial productive enterprises.

Productive enterprises affected by the Project shall be resettled and

reconstructed in Baisha Industrial Park, which is located at the end of the road


Section A for the Project, and is a new industrial park in development. The

road Section A provides the development of the industrial park with good

traffic conditions.

C Non-productive enterprises or institutions Among 113 enterprises and institutions affected, 70% of them are categorized in this group. Most of the institutions provide business service including business and office work and storage. A small part of them provide services such as medical treatment and education. Relocaiton options are available for these institutions due to the establishment of the business service network along with the development of real estate in Yibin City in recent years. The Nan’an Primary School will be partly affected. The affected part will be rebuilt at the enlarged site of the school. About 20% of the institutions are government offices and institutes. They will be relocated in the urban districts after negotiation with the resettlement department. The remaining institutions will move into the 6 new resettlement districts mentioned in Section 8.2.

D Shops that are affected by the Project mainly deal in subsidiary foodstuffs

(29), catering trade (22), retail (15), culture & entertainment (15),

maintenance (14), medicine & medical treatment, which are related closely to

daily resident life, and various kinds of small shops. Selection of relocation

options shall be linked with the livelihood of the local residents. The business

facilities in the business communities of the 6 new resettlement residential

areas shall be the main choice. About 70% of shops will be relocated into the

available shops or vendors’ stands in the Resettlement Residential Areas of

Jiuzhou Group and West District on South Bank of the River. In addition to

the relocation compensation and loss compensation for the business, the shops

will be replaced under the same conditions. A few shops prefer to take the

cash compensation and find new sites for business with the information

provided by the resettlement department. The commercial network with a

couple of central markets has been formed within the area where the affected

shops are located, e.g. the central market at the north side of the downstream

(Section A), the central market at the north side of the upstream (SectionA),

the central market within west district on the south bank of the river, the

central market of Baisha Group resettlement district. All the affected shops,

including the ones who rented the illegal structures, can choose at their own

will to rent a shop and continue business at the new sites.


8.8 Close-down, Operation Suspension, Mergence with Others or

Shifting to Different Line of Production for Enterprises and

Shops and Rehabilitation of the Employees

For people of enterprises and shops affected by construction of the Project, which have to

be closed down, suspended, merged and shifted, the resettlement department shall

provide those who will lose jobs with free training for re-employment. For employees

who will resume their jobs later, shall receive living compensation at a level of full salary

and maximium for three months.

8.9 Selection and Preparation of Resettlement Site, Relocation of

Project-Affected People

8.9.1 Combination of productive potential, locational advantages, and other factors in

the relocated area shall be at least equivalent to the advantages of the place taken.

The resettlement department shall select the relocation zone locally according to the

desires of the project-affected people (see Table 29). The detailed centralized

resettlement district for project-affected people includes Jiuzhou Group, Baisha Group

and the west district on south bank of Yibin city. The 6 resettlement districts shall be

under detailed plan of Yibin City, configured with infrastructure facilities according to

standard urban planning and managed as a standard community. People affected by rural

resettlement at upstream for the north side of the river, downstream for the north side of

the river (together Section A), and the south bank (Section B), which are involved in the

construction of Yibin Urban Riverside Loop Line Road Project, shall be resettled

respectively. Among the 6 resettlement districts confirmed, plots A-02-01b and A-20-01a

of Jiuzhou Group, which are only 2 km away from the country of origin, shall be used

respectively for resettlement of the affected villagers and urban residents within the

affected upstream of the north river, and plots ⅠA-b-01-01, Ⅰ.A-a-02-02, which is only 0.5

km away from the country of origin for the project-affected people, shall be used

respectively for resettlement of the affected villagers and urban residents within the

affected downstream of the north river. Plots D16 and B-05 of the south bank section

(Section B), which are within 1 km of the country of origin for the project-affected


people, shall be used respectively for resettlement of the affected villagers and urban

residents of Section B. Housing models of 2 rooms 2 halls, 3 rooms 2 halls, 4 rooms 2

halls shall be intentionally set for project-affected people within these resettlement

districts. All the resettlement houses are built as economically affordable housing and the

total floor space are sufficient for the project-affected people to make their own choices.

The new housing area shall be close to that of the original for project-affected people,

which shall not affect the original social and cultural structure of the project-affected

people. For rural residents, especially for whom part of farmland shall be kept within

short term, their new location shall be within a relatively short distance to the farmland.

Resettlement location of affected enterprises will be arranged in the new development

zone, and they shall be relocated according to management plan of the development

zone.

Yibin Leading Group, together with Land Resource Bureau, Yibin Urban Construction

and Investment Company, Urban Planning Bureau, shall confirm resettlement locations

for affected families. Land Resource Bureau, Housing Management Bureau, and Yibin

Management Commission for Economic and Technological Development Area shall be

responsible for house building. Yibin Urban Construction and Investment Company and

Land & Resource Bureau shall be responsible for resettlement of project-affected people.

Leading Group, together with organizations like Urban Planning Bureau, Urban Land &

Resource Bureau, and enterprises and shops to be resettled, shall confirm resettlement

location for enterprises and shops, and Yibin Urban Construction and Investment

Company shall be responsible for implementation of resettlement. Yibin Urban

Development Project Office shall coordinate.

Through organizational and technical arrangements made by the resettlement department,

the comprehensive factors of potential productivity, geographical advantage and other

conditions of the selected rural and urban resettlement district shall not be lower than the

original conditions.

8.9.2 Provision of multi choices and comparison schemes

Since the detailed masterl plan of Yibin City has not been completed, the planning

department does not encourage construction of one’s own houses. As a result, the second


relocation which will be caused by new construction items based on the urban master

plan in the future, can be avoided. The rural people affected by the project may move into

the new houses in the resettlement residential area. If he is unsatisfied with the housing

conditions, he may select cash compensation and look for suitable houses at the house

market. The resettlement department may collect information for him on the second-hand

housing and any other commercially available housing in the city.

8.9.3 Detailed procedures and time schedule for relocation

Almost half of the houses for resettlement shall be under construction by the end of 2004,

and all houses shall be under construction before the end of October, 2005. The time limit

for house construction shall be 1 year. When construction of the project starts, land

requisition and demolition within the corresponding section shall have been completed.

New enterprises and facilities necessary for production shall firstly be built and installed

for resettlement of productive enterprise before demolition, hence the completion of new

housing ahead of demolition.

8.9.4 Provision of relocation assistance and processing of legal procedure for

resettlers

The resettlement department shall provide moving cost and undertake all the relocation

procedures including certificate of house ownership and registration of urban residency.

In case a transitional period is needed, the transitional compensation and second time

moving cost shall be provided to the affected people.

8.9.5 Timely and effective provision of compensation at replacement cost

Before demolition of project-affected people’s original houses, the resettlement

department shall pay them the full compensation fee for corresponding land, house and

so on based on replacement cost.

8.9.6 Aid to be provided after demolition and before restoration of living standard

For enterprises and shops where replaced houses couldn’t be completed before

demolition, losses caused by stop of production and business during resettlement shall be

calculated and compensated in cash to the enterprises and shops. During the transition


period after demolition and before restoration of production for the enterprises and shops,

the resettlement department shall provide the affected employee with full salaries for

three months maximium.


8.10 House Building, Infrastructure Facilities, and Social Service

Organization

8.10.1 House building, infrastructure facilities, and social service organization

Resettlement location shall be constructed jointly according to detailed urban control

planning of city, and under the unified administration for urban community. Construction

of community shall be equipped with corresponding infrastructure facilities and service

facilities, including sewerage disposal system, power, telecommunication, school,

hospital, shop and so on. These facilities and infrastructure shall be completed before

housing demolition occurs in the case of self-built housing and shall be completed along

with the housing itself in the case of project built housing. For self-built housing the

affected people shall have the right to use whatever materials they choose from their

original housing and those materials will be transported to the site of the new housing

free of charge.

8.10.2 Ensure the use of corresponding facilities for residents within resettlement

district

Resettlement district for residents affected by demolition and confirmed by the Project

shall be newly built resettlement community, for which community management

organization shall also be organized during the process of demolition. Project-affected

people that move into resettlement district shall be under the management of community

and share all rights for residents of urban community, including usage of infrastructure

facilities and service facilities within the community (resettlement district).


9 Community Participation

During the establishment planning and implementation of resettlement policy, community participation and negotiation shall be encouraged, and opinion from social organizations, government departments, community and project-affected people shall be solicited and incorporated in the resettlement process.. There will be ongoing participation of each side in resettlement and reconstruction work. During design of feasibility study for the project of the preparatory stage, the project office and project design unit broadly listened to suggestions and opinions of related local department, congress, Political Consultative Conference, mass body, township (town) government and mass representative for issues of design and right of way of Bin River Ring Road, means of resettlement, and so on. During the preparatory stage of resettlement work, resettlement office of the project asked for opinions from local government at various levels on resettlement and compensation policy, and completed preparation of this Resettlement Action Plan (RAP) with the help of the local government. During the implementation of the resettlement activities, resettlement organization at each level shall further prompt participation of all stakeholders into works of resettlement, restoration of production and reconstruction.

9.1 Strategy of Consultation and Participation with Resettlers and Residents within Resettlement District during Preparation and Implementation Stage The confirmed resettlement district is a newly built residents resettlement district and

designed industrial zone, where residents’ community shall be organized according to

urban community management measures and managed by corresponding urban

community organization. All community residents shall be of the equal power with

regard to participation in the planning and building of the community. Construction and

planning for the resettlement district shall broadly solicit the opinions of community

residents.

To establish communication to the project-affected public and understand their opinions

and suggestions with respect to resettlement design and strategies, in line with the

Working Program for Symposium on Public Participation in World Bank Funded

Sichuan Urban Environment Project, and with the cooperation with the Urban Land &

Resource Bureau, Urban Housing Management Bureau, Xinyu House Demolition

Company, and Urban Planning Institute, Yibin Urban Construction and Investment Co.,

Ltd. held 7 public participation meetings between August 16 and August 25, 2004. There

were 156 representatives participating, including representatives of villagers (residents),

township (community) cadres, enterprises and institutions, and shops, which represented

13.1% of the project-affected people in total. For a summary of public opinion refer to


Annex 1. This consultation process shall be continued during resettlement

implementation.

9.2 Summary of various opinions and establishment of resettlement

plan

During the negotiation with project-affected people, detailed opinion and suggestions

were raised for the resettlement process, which shall be considered as much as possible

by the resettlement department.

The rural residents affected by land requisition put forward the following: Peasants

with land lost shall enjoy the same treatment as for bankruptcy of state-owned

enterprise, e.g. basic living assurance for the old (social insurance and medical

insurance). The young shall enjoy the same policy treatment as for laid-off workers,

especially at employment training and preference.

For these opinions, the resettlement department suggests in the resettlement scheme

that free training for employment shall be provided to peasants with land lost, and

with the assistance of the labor service export department, project-affected people

shall be transferred to Yibin City and other districts where labor force is needed by

the department and enterprises. At the same time, the municipal government has

settled the policy for people with land and transferred from rural residents into urban

residents to participate into employment insurance and endowment insurance.

The affected enterprises asked for relocation and reconstruction: Tianyuan Group,

799 Factory, Weifeng Trading Co., Ltd., Daduhe Afforestation Bureau and so on, ask

for relocation and reconstruction at other allocated places. Some enterprises that

have stopped operation for long periods (e.g. the Sand Mix Plant) requested cash

compensation and self-employment of its employee.

For this opinion, the resettlement department suggests that the effected enterprises

shall move into Baisha Group, which is under the management of Yibin Economical

& Technological Development Zone. At the same time, those enterprises that have

already stopped production will be provided a cash payment..

Geographical location with the same advantages are requested for new sites of

resettlement housing for the dormitory of the urban construction committee,

dormitory of Yibin Chemical Fiber Factory and Dafangzi dormitory. Otherwise, the


value of its present geographical location shall be fully considered during house

evaluation; all the urban and rural residents affected by house demolition requested

relocation at adjacent sites and construction of the houses in good quality before

demolition.

For requests mentioned above, the resettlement department explained that the house

evaluation shall have the location of the houses been considered and the house

compensation will have the location value of houses of urban residents that affected

by demolition been included. At the same time, the resettlement residential area will

be built at places with the least distance to the affected area. The construct will be

started early enough to meet the request of completion of the new houses before

demolition of the old houses.

9.3 Other schemes put forward by resettlers for selection

During the negotiation with project-affected people, they put forward resettlement

requests. Suggestions were made by Qiaowan villagers group of Section B (i.e. the south

bank of Yibin City) and Yangwan villagers group of upstream of north river: Land of the

whole group (including land outside the red line of requisitioned land for the Project)

shall be requisitioned at one time by the resettlement department, to solve the problem of

united demolition and resettlement, and to solve the problem of farming inconvenience,

which is caused by the further distance to plowland of part of villagers after resettlement.

The resettlement department has agreed to submit their opinions to the land requisition

department for consideration of and for prompt action.

At the same time, most people affected by demolition raised their own request for

resettlement locations, of which the detail is shown in Table 30 below.

project-affected people, but what is in common is the request for nearby resettlement.

9.4 Public Participation and Publicity of Policy

According to requirements of the World Bank and the principle of making information

10 Appeal Procedures

10.1 Channel, Means and Approach of Grievances, Time Limit for

Each Level to Give Reply to Such Grievances

Participation of project-affected people shall always be encouraged during

establishment and implementation of Resettlement Action Plan of the Project, and it

is to be expected that some problems will emerge during implementation. In addition

to the present complaint and appeal channels of local government at each level, clear

and effective grievance channels shall be established for PAPs during the process of

resettlement, for solving problems effectively and in a timely manner when they

occur, to ensure steady progress of project construction, land requisition and

demolition.

I. If any people affected think their rights and interests were abused, he can

appeal to any departments below in either written or verbal form.

1) People’s government of township and town

2) Land Resource Bureau of the District where the person in question is

living;

3) PMO of Yibin Urban Project

4) Land Resource Bureau of Yibin City

If appeal in person is done, the relevant institution that accepts the appeal

shall put it into written form. The land management department shall be

responsible for the solution to the problem within 15 days.

II If the appealer is not satisfied with the decision made by the land resources

bureau of the district, he can go to the land resource bureau of Yibin City for

a solution within 1 month after receiving the reply from the land resource

bureau of the district.

III If the appealer is not satisfied with the reply made by the land management

department of Yibin City or the reply doesn’t come in 15 days, he can appeal


to special institutions of People’s Government of Sichuan Province. Sichuan

Province Land and Resource Bureau. And the appeal shall be made within 3

months after the original appeal. The appeal shall be recorded and a reply

shall be given to the project-affected people within a month.

IV. If the appealer or the appeal unit is still not satisfied with the reply made by

Sichuan Province Land and Resource Bureau, or if he does not receive a reply

from the Sichuan Province Land and Resource Bureau within a month of

submitting his appeal, he can appeal to People’s Court according to Code of

Civil Law within 15 days after receiving decision made by Sichuan Province

Land and Resource Bureau.

The appealers can skip the subordinate departments as they choose.

The appeal has the following content: The project-affected people and affected units

could appeal for any question related to land requisition and demolition, including

the level of compensation for their loss.

The detailed process of appeal for compensation, and data and information for

appealing procedure shall be broadly passed around for perusal among the affected

township, group and people. This can be achieved by handing out pamphlets about

land requisition and demolition for Yibin Urban Riverside Loop Line Road Project.

Such instructions for the appeal process shall also be posted prominently in both the

original and relocated communities of project affected people.

The project-affected people shall be informed of appeal channels above to ensure

they fully understand their rights for appeal. Information shall also be provided

through various media. Opinions and suggestions about resettlement that come from

every segment of the society shall be sorted into information articles, which shall be

studied and processed by resettlement department of each level in a timely manner.

Institutions that accept appeals of resettlement-related issues from project affected

people shall not charge any fees to project affected people,, and any other charges

generated out of appeal shall be paid to the engineering reserve fund by project

office.


10.2 Appeal Channels for Vulnerable Groups

Appeals by vulnerable groups affected by the project are the same as the normal

appeal channel, and other channels including Woman Connection Network, Urban

Project Office (No. of special telephone: 0831-2379635), and Mayor’s public

telephone: 0831-2339116.

10.3 Channel of Bringing a Lawsuit at Civil Court

If the appealer or the appeal unit is still not satisfied with the reply made by Sichuan

Province Land and Resource Bureau, he can appeal to People’s Court according to

Code of Civil Law within 15 days after receiving a decision made by Sichuan

Province Land and Resource Bureau or if no reply is received within one month of

the submission of the appeal.

The appealers can skip subordinate departments and express their opinion to the

superior departments as they choose.


11. Time Schedule of Implementation

11.1 Procedure and process of the work

11.1.1 Land requisition and compensation

Land requisition and compensation shall be done with the cooperation of the relevant

institution. The detailed procedures are as follows:

a. Urban planning departments of Yibin City shall provide detailed drawings of

land requisition, which is to make clear the requisition range and quantity.

b Requisition shall be applied by project office to relevant land management

department.

c. PMO receives the initial clearance of land acquisition Reply of requisition

application,

d. PMO consults The project office shall negotiate with the land management

departments on matters of land acrequisition, including entrusting the land

management department to negotiate land compensation and go through land

approval procedures.

e. The land and resource bureau of the district shall confirm requisition range and

quantity at site with each relevant township (town), street committee, village

organization, and community.

f. The land resource bureau of the district government or the township (town)

government will sign the land agreement with the street committee or the

villager’s committee or the village group depending on the land ownership. .

g. Payment of land compensation fee by PMO through the land management

department,

h. Completion of land approval by the land management department

i. Contractor uses the land

Further, land requisition fee (compensation fee and resettlement subsidy) shall be

used as follows: For township with compensation resettlement in cash, the


resettlement subsidy for requisitioned land shall be dispatched directly to each

family affected by requisition and this shall be done prior to actual resettlement.

Means of distribution and usage for land compensation fee and requisition cost of

collective motive land shall be discussed by Villager Group Congress.

11.1.2 Restoration of production

Resettlement and restoration of rural production shall be implemented by village

committee, the work procedure shall be as follows:

a. Convene meeting of village representative, and study and establish schemes of

land accretion, land adjustment, and distribution.

b. Publicize schemes of land accretion, land adjustment, and distribution, and

collect opinions of all villagers.

c. Adjust and distribute land.

d. Farming on the cultivated land .

Production resettlement and restoration of enterprises shall be implemented in detail

by the affected enterprises.

11.1.3 Demolition and reconstruction of houses

The procedures of demolition, construction and resettlement for houses of projected

affected people shall be as follows:

a The houses to be affected by demolition caused by the Project shall be provided

by Urban planning departments of Yibin City.

b Quantity and quality of house shall be investigated by the project owner together

with affected district, township (town), street committee, village, and community.

c Yibin Urban Riverside Loop Line Road Project Office, together with resettlement

work group of township (town), street committee, village, and community, shall

post and publicize quantity, compensation standard and time of demolition and

reconstruction in order to solicit opinions from resettlement families.

d Yibin Urban Riverside Loop Line Road Project Office, together with affected

family, enterprise, institution, shop of affected township (town), street

committee, village and community, shall discuss compensation standard of house


and attachments, and sign agreement of compensation for house demolition.

e Project-affected people receive compensation fee from the project owner through

the resettlement implementing agencies.

f Yibin Urban Riverside Loop Line Road Project Office organizes construction of

resettlement community. The resettlement community shall be constructed

before demolition of the original housing.

g Project-affected people build house and move into new house.

h Projected affected people demolish their old houses.

11.1.4 Reconstruction of special items

a. Affected area of each special facility shall be identified by design unit of the project.

b. Resettlement office of the Project and each department in charge of the special item

shall investigate quantity and degree of affected special facilities.

c. Resettlement office of the Project shall entrust each special item department to bring

forward planning scheme of reconstruction for each facility of special item according

to layout of resettlement.

d. Resettlement office of the Project shall negotiate with each special item department

and confirm compensation standard, then sign “Agreement of Compensation for

Reconstruction of Facility for Special Item”.

e. Each special item department shall reconstruct special item facility.

f. Each special item facility shall then be put into operation.

11.2 Time schedule of resettlement work

Table 32 shows detailed procedures and time arrangement of each works related to

land requisition, demolition and resettlement of Yibin Urban Riverside Loop Line

Road Project.

11.3 Implementation of demolition and payment of costThe basic principle to be implemented during construction of Yibin Urban Riverside

Loop Line Road Project is: No demolition will be carried out before implementation

of necessary resettlement measures, and land compensation fee shall be paid and the

affected people resettled before construction commences.


12 Cost and Budget

12.1 Budgetary Estimate of All Cost Necessary for Land Acquisition

and Resettlement

Costs incurred during implementation of resettlement caused by land requisition and

demolition shall be part of the total budget for Yibin Urban Riverside Loop Line Road

Project, which shall be contained in the annual investment plan of Sichuan Province

Urban Environmental Protection Project. The plan shall clarify in detail the annual cost

of resettlement activities for land requisition and demolition. The cost for land requisition

and demolition shall come from domestic matching funds. The provincial and municipal

governments and implementation institutions shall be responsible for the cost of land

requisition and demolition.

At present discussion and calculation of basic cost for land requisition and demolition are

made with the provincial, municipal and local government. According to primary

estimation and based on the price of 2005, the total cost of land requisition and

demolition shall be 245,483,900 Yuan, including section A 145,442,400 yuan, section B

100,041,500yuan. Among which direct cost (cost directly paid to project-affected people)

shall reach 208,205,800 Yuan (RMB),including 123,948,900 yuan in section A and

84,256,900 yuan in section B. (see Table 33).

The implementation institution shall pay the land management administration

department, which shall be responsible for negotiation and implementation, or provide

assistance to implementation of land requisition and demolition, including a management

cost of about 3% of the total compensation fee budget.

Cost estimation shall be adjusted each year according to the national rate of inflation of

the last year. Each implementation institution shall be responsible for provision of proper

funds for implementation of movement plan for land requisition and demolition. Each

project owner shall take responsibility for cost overruns.

Demolition compensation and charge attachment, including compensation of wood and

young crop on requisitioned land, shall be paid directly to project-affected people. The

local land management department and financial department shall be responsible for

payment of compensation fee.


12.2 Itemized cost of all activities for land requisition and demolition

12.2.1 Cost of land requisition

Land requisition cost of Yibin Urban Riverside Loop Line Road Project includes land

compensation fee, resettlement compensation fee, attachment compensation fee and

young crop charge. The estimated compensation fee for rural compensation shall be

9,436,400 Yuan in total. For calculation of land requisition cost see Table 33.

12.2.2 Demolition cost

Estimated total cost for project demolition shall be 198,769,400 Yuan. Among which,

compensation fee of demolition for house of rural residents shall be 10,097,500 yuan, the

total cost of demolition for urban residents shall be 60,698,700 yuan, the total cost of

demolition for enterprises, institutions and organizations shall be 69,116,300 yuan, and

the total cost of demolition for shops shall be 58,856,800 yuan.

12.2.3 Resettlement cost

According resettlement scheme confirmed by the resettlement department, construction

of resettlement community confirmed for reconstruction of house for project demolition

and its matching facility shall be brought into unify budget of urban construction

planning, and shall not be calculated in the budget of the Project.

12.2.4 Various taxes and fees

Tax related to resettlement of the project shall be 12,200,600 in total. Which including

tax of rural land requisition takes 2,246,700 yuan, management cost of rural demolition

takes 586,000 yuan, management cost of urban demolition takes 7,546,900 yuan, cost of

water, electricity and gas, and license handling cost takes 1,821,000 yuan.

12.3 Time of payment for every item of cost

All works of land requisition and demolition shall be completed before construction

phase of the project commences,, compensation fee for land requisition and demolition of

project-affected people shall be paid to project-affected people according to planned

program before actual taking of land and demolition of housing. For detail see Table 34.

12.4 Annual Payment Plan

All compensation fees related to land requisition and demolition shall be paid before year

2005 and year 2006. Considering the phase for implementation of the Project, the first

phase (2004~2005) shall be for fund preparation of the project and signing of agreement

for land requisition and demolition, the second phase shall be mainly for implementation

of land requisition and demolition. It is planned that 50% of the cost estimation shall be

paid respectively at each stage, the payment proportion of which can be adjusted

according to practical requirements during implementation.

12.5 Source of Fund

Source of outlay for land requisition, demolition and resettlement shall be domestic

matching fund, including matching fund of local finance (122 million yuan), maintenance

fee of urban construction (24 million yuan), and Transfer of Land Tenure Fee

(123,690,800 yuan). During the initial stage (year 2005~2006) of the construction for the

Project about half of the fund shall be put into construction of the Project, with

resettlement cost being its main use.

12.6 Flow Direction of Fund

According to compensation policy and standard confirmed by resettlement plan, the


employer of the Project shall sign contract of Agreement on House Demolition and Relocation and Agreement on Requisition of Land with project-affected people.The employer of the Project shall pay compensation fund to project-affected people

through the bank according to the content, quantity and time of compensation fee

specified in Agreement on House Demolition, The employer of the Project shall pay

land compensation fee and resettlement subsidy to Land & Resource Bureau of Yibin

City according to policy specification, then the land compensation fee shall be

directly paid to village committee by Land & Resource Bureau of Yibin City.

12.7 Management and audit of fund

Management and usage of all funds for land requisition and demolition of the Project

shall follow specification of financial fund management of Chinese government, and

accept strict audit and inspection of audit organization of Chinese government. Yibin City

shall manage the project fund strictly according to management method of construction

item of the project and management system national finance,

The employer of the Project shall keep various kinds of record, account and evidence that


reflect relevant operation, fund and expense condition of implementation for each part of

the Project, for inspection of management department at each level and audit of audit

department.

Strengthening the budget program of annual fund planning. Annual expenditure plans

should be based on item of general planning and budgetary estimate and adjusted yearly

to insure continuous supply of funds. Implementation should be in a timely manner

according to the annual plan using plan made by the province and the city and publicized

to insure steady progress implementation of the item.


13 Monitoring and Evaluation

13.1 Internal Monitoring

The project implement organization shall be responsible for the internal monitoring of the Yibin Urban Riverside Loop Line Road Project. The monitoring group of the Sichuan Provincial Project Office shall coordinate the collection and analysis of materials, and prepare a report on internal monitoring once every three months. The provincial and urban leading groups for demolition and land requisition shall be responsible for the periodic audit of the internal monitoring report on demolition and land requisition. The monitoring shall be executed according to the demolition and land requisition implement plan.

The basic format for monitoring has been prepared. Starting from the latter half of the year 2006, the internal monitoring report shall be submitted to the Word Bank by Yibin Urban Riverside Loop Line Road Project every quarter. The same report shall be also submitted to the provincial leading group of demolition and land requisition by Sichuan Provincial Project Office for the discussion in the next meeting. The leading groups shall examine the progress of Sichuan Province in policy and some other aspects, and present corrective actions for future adoption. Sichuan Provincial Project Office shall submit to the municipal leading groups a report related to the project respectively by the Yibin Urban Riverside Loop Line Road Project Office. The leading group shall also present the detailed and accurate progress reports of the demolition and land requisition implemented according to the plan.

13.1.1 Monitoring Index

The main index of regular monitoring is: The compensation amount shall be paid to project-affected people and enterprises of

different types in a timely manner according to the compensation criteria described in the demolition and land requisition implement plan.

The allocation of houses shall be carried according to the selection of project-


affected people. The number of people to whom houses will be allocated at the set time, the distance between the new-built house and the previous house, the photos taken for the project-affected house and buildings shall be kept in the file for the project-affected family;

The rehabilitation of the project-affected public facilities and basic facilities; Payment of pension and some other appropriate special measures for the economic

recovery of relevant PAPs. Cash payment for the self-employed people; Rehabilitation of the enterprise production and commercial activities influenced by

land requisition permanently and temporarily The timely selection of site for the enterprise relocation (one month before the

scheduled construction). Compensatory payment for the project-affected workers’ salary. Payment for the net loss of shutdown caused by the relocation and temporary influence

13.1.2 Staff of Internal Monitoring

The staff of the demolition and land requisition implementation unit (??) of Sichuan Provincial Project Office shall be responsible for the coordination of the internal monitoring and collection of the material from the key related departments and Yibin City Project Office every quarter according to the given format. And those organizations shall collect the material from the implementing unit, district town (township) government and the related land and resources bureaus. The database of monitoring material of land requisition and demolition shall be established by the Yibin Urban Riverside Loop Line Road Project office, and updated once every quarter. The government of each district, town (township) and sub-district office shall assist the Yibin City Project Office in the data collection and analyses.

13.1.3 Monitoring Report

The internal monitoring report shall be discussed by the implement unit of Yibin Urban Riverside Loop Line Road Project, and submitted to the Sichuan Provincial Project Office by Yibin City Project Office. The full time personnel for land requisition and demolition of Sichuan Provincial Project Office shall be responsible for the data verification and making final check on the quality. Then, the report of land requisition and demolition shall be prepared, and submitted to the provincial and urban leading group of land requisition and demolition for review. If necessary, the essential action shall be taken. Considering the demolition progress, the leading group shall take the necessary procedure, and clarify the main issues and problems, particularly as related to lack of timely implementation. Yibin City Project Office of Sichuan Provincial Project Office shall assist the implementation unit and corresponding department to carry out and put into effect the corrective measures.

13.1.4 Fund Raising for Internal Monitoring

The cost of internal monitoring shall be obtained from the cost for land requisition,


demolition and resettlement work.

13.2 External Monitoring

The land requisition and demolition; resettlement and external monitoring are carried out by Research Institute for Introduction and Utilization of Foreign Capital under Southwest Jiaotong UniversityThe main work undertaken by the external independent monitoring and evaluation organization are: A monitoring and evaluation plan that reflects the achievement of the index of land

requisition and demolition implementation plan of Yibin Urban Riverside Loop Line Road Project shall be prepared.

The baseline investigation of Yibin Urban Riverside Loop Line Road Project shall be designed and completed with the coordination of the local organization. A subsequent follow-up investigation shall be conducted in order to make a comparison of the income and living standard before and after the land requisition.

The database of the tracked families affected by the land requisition and demolition in the Yibin Urban Riverside Loop Line Road Project shall be kept, and shall be enriched and updated periodically.

The suitability of the land requisition and demolition scheme and understanding of the project-affected people shall be investigated and reported. Actions will be recommended in order to solve the implementation problems.

The internal monitoring report shall be evaluated periodically and recommendations made to improve the data on the basis of the investigation and quick site evaluation.

The monitoring visit of Yibin Urban Riverside Loop Line Road Project shall be taken periodically accompanied with the officer of the Work Bank.

One monitoring evaluation report shall be prepared every half a year, where the progress obtained in the index defined in the land requisition and demolition of Yibin Urban Riverside Loop Line Road Project shall be discussed. And the detailed recommended comments shall be put forward in the report in order to solve any problems arising. The external monitoring will be undertaken once a year starting from the 2nd year if the Bank is satisfied with the resettlement implementation in the 1st year.

13.2.1 Work Arrangement

Sichuan Provincial Project Office shall offer facilities for the external independent monitoring organization, and assist them to finish the needed work.

ReportThe independent monitoring evaluation organization shall supply a monitoring evaluation report to the Sichuan Provincial Project Office every half a year from the latter half of the year 2006, until all the sub-items are finished. The report shall be supplied both in Chinese and English. Sichuan Provincial Project Office shall transmit the report to the provincial leading group of land requisition and demolition and World Bank every six months.The aptness of the implementation method and the attitude of project-affected people shall be reviewed in the report. Main issues and problems in the implementation shall also be defined in the report, and the advice shall be given in order to improve the efficiency of the resettlement work. The resettlement progress shall be consistent with


various monitoring reports prepared by Sichuan Provincial Project Office and the project owners in each city.

13.2.2 Method and System of External Monitoring and Evaluation

The methods and systems of the external monitoring and evaluation used are as follows:A. Preparation stage The land requisition and demolition shall be reviewed and taken as the basis of the

monitoring and evaluation. And the main policy index and principle to be evaluated shall be confirmed.

The detailed working plan used for implementation arrangements of monitoring and evaluation of the related policy and principle shall be established, and the monitoring indicators shall be attached.

B. Basic investigation of the project-affected familyAfter the baseline investigation is finished by the professional organization of land requisition and demolition consigned by the local Employer, the external monitoring organization shall make a sample survey of 10-25% for all the points of Yibin Urban Riverside Loop Line Road Project. The data with comparable factors reflecting the before and after situation with respect to the land requisition shall be provided by the framework of the questionnaire design and sample. The following data shall be collected for each household by the survey: Composition and structure of a household Ethnic composition Residential registration of all the family members The profession of the family-working members Income sources and income level of the all the household residents Agricultural output data of the farmer in the household Details of land requisition and demolition of housing of affected household Property gross value loss of the affected household due to the land requisition and

demolition Details of entitlements to compensation, relocation, job supply, subsidy and pension

and other resettlement and rehabilitation assistance. All the social service assets, including health; education; water supply; sanitation;

power and etc. Details of the consultation process and of the participation of project affected people

in planning and implementation of the land requisition, house demolition and resettlement process,

Extent to which project affected people understand the mechanisms for grievances and appeal.

C. DatabaseA database shall be kept by the monitoring and evaluation organization in the form of electronic files for the households affected by the land requisition and demolition. If the household is included in the basic investigation, the data shall be also incorporated and included in the database. The document shall be updated periodically by the evaluation unit, and the conditions of the affected region shall be described based on field visits. The charts and photos of the affected property; copy contract; payment and evaluation documents of land requisition and demolition and related conditions shall also be included in the database.D Evaluation and quick visit of the siteThe evaluation staff shall make a quick evaluation and investigation of the site every six


months preparing for the monitoring and evaluation report once every six months. The facility visit may create an opportunity for the personnel to consult directly with the project-affected people, and identify some practical problems in the implementation of land requisition and demolition. The visit should include consultation with: Key associated departments and personnel of the implementation unit The local government officer in the implementing site of land requisition and

demolition, including the officer of district; township; village and group Project-affected peopleAn important opportunity shall be provided for the evaluation personnel during the site visit. The personnel can evaluate the extent to which implementation is proceeding satisfactorily and the level of participation of all stakeholders in the implementation of land requisition and demolition, the report of which shall be kept in the database.Every external monitoring report shall be discussed in the meeting after its delivery by the provincial and urban leading group of land requisition and demolition.

13.2.3 Monitoring and Evaluation Index

The following index shall be evaluated not only by the internal monitoring and evaluation organization but also the external. The monitoring shall be decomposed into the following features of the project-affected people: Location Occupation Age Conditions of resident license Sex National Minority status Payment for compensation

1) Whether or not the compensation is paid to the project-affected people; enterprises and shops at the appropriate time?

2) Whether or not pay enough for the affected property? Relation between the land requisition and demolition and construction

2) Whether or not the place for relocation of the enterprise is selected at least six months ahead of construction?

3) Whether or not the production facilities have been moved in and installed before the targetted construction date?

Rehabilitation of the public basic facility1) Whether or not the necessary basic facility in the relocation place is at least

rehabilitated to the same level as that of the original location?2) Whether or not the compensation paid for the basic facility is sufficient for

reconstruction of the said facility in equal quality? Enterprise relocation

13.3 Resettlement Evaluation and Completion Report after all Work

Finish

According to the requirement of the World Bank, a last evaluation report of the resettlement work shall be provided by the external monitoring organization before the completion of project construction in order to assess the entire process of land requisition and demolition, and whether or not the resettlement work meets the standards of the RAP. . A last evaluation report of the relocation of the PAPs and general report of resettlement work shall be provided by the external monitoring organization of the Project two years after the completion of project construction of the resettlement work.


14 Annex

Annex 1

Brief Introduction of Symposium on Public Participation of Yibin Urban Riverside Loop Line Road Project

In order to establish communication with the project-affected public, acquaint with their ideas and suggestions for the land requisition and demolition and resettlement, from August 16 to 25, 2004 seven symposia on public participation are held successively by Yibin Urban Construction and Investment Co., Ltd. in the coordination with Land and Resources Bureaus; Real Estate Management Bureau; Xinyu Company and Projection Institute of the urban, in accordance with the “Working Program for Symposium on Public Participation in World Bank Funded Sichuan Urban Environment Project”. There are 156 villagers (residents); village (community) cadres, representatives of the enterprises and institutions and shops, which is 13.1% of the total number of project-affected people. The brief introduction is as follows:

II All the attendance representatives consistently think that:

1) Approval of the project constructionAll the representatives unanimously agreed that: geographic position of Yibin requests the city to be built in groups. At present, the construction of Yibin is falling behind the construction in the surrounding cities. The urban space shall be extended largely by the project construction. And the urban appearance; urban feature and investment environment shall be improved. 84% of the participants have learned something about the project, 97% of them supported construction of the project, and 83% understood that the project is benefited to the State, the collective and the individuals. 2) Approval of the relocation according to the urban projection construction of Yibin CityAll the attendance representatives consistently think that: it is a historical obligation and glorious mission for every Yibin citizens to “build a nice Yibin”. The resettlement house construction of villagers (residents) for the project is approved. The demolition and construction of enterprises and institutions in other place shall be strictly in accordance with the urban projection and construction of Yibin City, to make sure of the improvement of urban function and appearance.


III Specific Ideas and Suggestions

In the precondition of the approval of the project construction according to urban projection and resettlement, representatives raise some ideas and suggestions from their own aspects. Although some of them did not conform to the policy and without reasons; the followings are analyzed for our respects, and as reference only:

1) Improvement of the policy and treatment for the PAPsThe villagers put forward that farmers that loss their land shall enjoy the treatment the same as the bankrupt national enterprise, i.e. the young and the aged shall enjoy the guarantee minimum standard of basic living, including the social insurance and medical insurance. The young shall enjoy the policy and treatment as the laid-off workers, especially in the aspects of job training and re-job favor.2) Some of the communes with land requested and shall be given a piece of land used for self-construction in the commune.The villagers put forward that: they suggest that the government can consider mark off a piece of land to them in the scope of the basic commune, so that they can demolish the original housing and build new ones by themselves. The problem of inconvenient cultivation after apart away from their primary homestead and adaptability in the new environment are solved. And free from the community property management fee. (Remarks: all the projects are in the range of the urban projection, excluding the self-construction and land division)3) The whole land of the group in the village is requisitionedQiaowan Community on the south bank, Yangwan Community in the upper reaches of Jinshajiang River give the following suggestions: all the land of the groups in the village shall be expropriated for the project at one time, as those two communes will be replaced into the extension of urban planned area, which can solve the problem of removal and resettlement together; inconvenient cultivation after apart away from their primary homestead; and inconvenient resettlement caused by multiple land requisition. (Remarks: of course, they did not consider the problem of land reservation and land idling after requisition)

4) Enterprise re-construction and relocation

Tianyuan Group and No. 799 Factory (Partly demolished) request that the land shall be divided for the demolished part and re-construction in the relocating place. Weifeng Trading Co., Ltd. and Daduhe Afforestation Bureau request that a piece of land shall be divided for relocation and re-construction. Yibin management station of Yunan Shaotong Foreign Trade and Huangjueping Integrated Shop approve of re-construction and relocation, but they ask for a geological position with an environment in comply with their operation, if not they request that solve the problem of endowment insurance of all the present staff. (Remarks: the staff of Huangjueping Integrated Shop is free from endowment insurance. The endowment insurance of Yibin management station of Yunan Shaotong Foreign Trade is in Yunan Shaotong.)

5) Enterprise currency resettlement The employees of some enterprise in production stop and production without potential, such as Moulding Sand Factory, have been self-employed and asked for currency resettlement.6) Some residents prefer resettlement with the same area without money to be paid for surplus area


The residents of Dukou Community on the south bank, and Beiliuchi Community on the upper reaches of Jinshajiang River, residents living in dormitory of pots and pans factory (bankrupted) in Baita Community demand resettlement with the same areas, and without money paid for surplus area due to economic difficulty.

7) Sufficient consideration of the primary geological position value

Primary dormitory of the Urban Construction Committee, chemical fiber factory dormitory; Big House dormitory near the culture square on the south bank request the position of resettlement house is equivalent to the primary predominant geological position. If not, the predominant value of the current geological position shall be adequately considered during the evaluation.

8) Resettlement at the nearest place; construction first and removal second to

ensure quality

The other villagers and residents are willing to resettle, in a unified manner, in the three districts on the upper and lower reaches of Jinshajiang River as well as the south bank. But they suggest to build the resettlement house first before removal, ensure the project quality; and any project with inferior quality will be rejected.

9) Suggestion of modification of part of the lines in order to decrease the

demolition

The residents in the two sides of the Changjiang Paper Factory gate suggest that it is better to move the road a little to the north, which can decrease the demolition of 72 houses of 6 units 2 blocks and demolition of about 10 shops (Certainly, in the opposite, a line of dormitories with one floor which has not been investigated shall be demolished). A block of accommodation buildings resettled during the land requisition by Wuqiao Building Material Company shall be in the line modification avoiding of demolition. (Certainly, the construction cost shall increase after the line modification.) Yibin Boiler Factory suggests that the bus station in front of the gate shall be adjusted, which can reduce the demolition of one workshop (totally there are two). (Remarks: this part shall be studied in the feasibility study at the beginning of design)

IV Introduction of the Further Research

1) The number of the PAP’s shall be cut down according to the resettlement requirement of the World Bank. The line shape; cross-section and structure of the road etc shall be studied in accordance with the above primary investigation achievement, and optimized further in the feasibility study. So some adjustments for the above demolition of residents; shops; enterprise and institution shall be made.2) At the same time, the construction bulletin (freezing bulletin) has not been issued because of being in the stage of investigation and groping. The formal construction bulletin shall be issued after the completion of exploitation design; foundation construction plan; construction fund; and license of land requisition and demolition according to national project procedure, which is a long time to wait. So it is likely to have some small change in the residents; shops; enterprises and institutions, which have been in the place of demolition.3) Some resettlement wills of the residents; shops; enterprises and institutions demolished on investigation shall be altered by any possibility during the formal land requisition and demolition.4) The above items are only the present ideas and suggestions of 13%


representatives, which cannot represent all members. During resettlement implementation and project construction, consultation and participation will be continued in questionnaire, group meetings, interviews, etc.

a. Hu Dingguo: where shall we move to is we are concerned about most, including condition of the new place and its suitability for us etc. It is hard for us to discuss moving if these aspects haven’t been determined. Everyone doesn’t want to move out from heart, if not for the need of national reconstruction. We will move without any compensation if new place is suitable. What we want is just to live into a good house.

b. Xu Bin: we have got used to the original house and don’t want to move. If we have to do so, my old age and sickliness shall be taken into consideration, and house’s environment and floor to be resettled shall fit my health condition. What I suggest is that the Government would better not to demolish our houses where we lived now.

c. Chen Zhisong: the house I purchased is not transferred in ownership due to some reasons; therefore I want to know whether it will be affected or not during demolition.

d. Wang Shengqun: I would like to move out to support municipal construction if compensation is reasonable.

Jiang Jiarong, director of Shangdukou Community makes a speech and indicates that the Public in this community is required to support construction of the project and cooperate with demolition to improve the city’s environment project funded by the World Bank loan.

2. The Public’s speech

Chen Hanxin: I support the demolition due to project construction, but require that house shall be resettled at a standard of 20m2/person and hope that new house will be located on the south bank; it is necessary for us to know about resettlement cost and policy. What’s more, can we know the delivery time of new house right now;

Xu Kaihua: When the demolition will start? I hope demolition policy could be made clearer to the Public and how long after moving could we get new house? We will give full support to the demolition, and my families can also be persuaded into agreeing with it. In a word, we hope we could live in a better conditions after resettlement;

Xu Kaijian: My house is privately owned, so I require dwelling space to be returned should be the same as that of my present house. I was jobless and have no source of finance; I hope resettlement place shall be within Shangdukou community and all issues resolve one time;

Liu Weicheng: I am a teacher of Nanan Primary School, we are all very happy after getting the news of building Riverside Road and we support the project greatly. However, demolition for the project construction must be legal and reasonable, we all hope a teaching building could be rebuilt within school area after the old one is demolished, and land-use area of the school shall be increased if possible, and boundary wall built in the form of open manner after the old one is demolished;


Zhou Shurong: I support the Government’s project; require house to be delivered on the south bank later for my old one, and I have no ability to make up a deficiency for surplus house area at a regular rate;

Li Xianglan: The quality of resettlement house shall be guaranteed and inferior house is not acceptable. We support demolition for the project, but land-use right of resettlement house shall not be lower than fifty years;

Xiang Nanchuan:The project does well to the city’s beautification, so we support it. The ownership of the house we are living in belongs to agency of Nanan sub-district, we hope resettlement could be carried out at one time, and resettlement house area shall be about 70m2 with two rooms and one hall; in addition, we hope the area exceeding resettlement area could be made up for at a favorable price;

Yang Fangping: How will the remaining land be disposed of if land couldn’t be requisitioned totally, so I hope land will be taken over completely;

Hua Siming: If land is occupied, the remaining land after resettlement is not easy for cultivation, so I hope land will be taken over totally; what’s more, resettlement cost should be used for social insurance and thus our life could be guaranteed later;

Wang Mingchao: I support the project construction, but require that land should be taken over totally and compensation for land requisition shall be open, impartial and fair;

Chen Kaizhi: The construction of Riverside Road would do well to us and our posterities, so we will greatly support the project. However, lands within the project area are all of good soil, if houses and buildings here are demolished and moved to a distant place, it is not easy to handle the remaining land, so I think the best way is to build houses at local area for resettlement. Xu Kebin: Yibin Urban Construction and Investment Company of Yibin city was founded in March, 2000 and is of a state-owned proprietorship enterprise subordinate to the government. For the construction of road with the World Bank loan, Yibin Urban Construction and Investment Company is the primary planning department.

Today, our main purpose is to listen to your views and suggestions about demolition, and we will make plan and ask the World Bank for a loan according to everyone’s suggestions.

Xue Bencheng: It is the fifth meeting for the project. The project is the first one for which Yibin City asks for the World Bank loan, and it certainly involves demolition in road construction. Last year, the State Council issued an emergency notice, indicting that demolition should be carried out in an open, impartial and fair manner. What is involved by Real Estate Management Bureau are houses belonging to government property, so any question related to demolition of houses belonging to government property might be consulted with the Demolition Office of Real Estate Management Bureau.

No. 2 Group of Wuqiao Community: We support national reconstruction very much, but details of demolition shall make mass satisfied in every aspect.

Luo Zaihua from Jar Works: Our company has bankrupted, demolition might also be acceptable to me due to municipal construction, but my house must be returned at the same size, and I have no ability for compensation, my total income is only over six hundreds Yuan per year;

Cao Zejun from Jar Works: I have ever consulted the director general of Economic and Trade Bureau of Cuiping district, and he said in a meeting that the house your company allocates to you should be maintained, protected and treated by yourself, and house problem should be solved yourself after demolition;

Song Daiwen from Jar Works: If our house should be returned in the same size, it is not sufficient for us to live in, so we require calculating house size as per capita;

Ma Ji from Sanjiang Entertainment City: Firstly, we hope we might be resettled within Wuliangye development district because the traffic is very convenient there, of course, the best place is on Guta Road; the second suggestion is that you would better not to demolish our house”;

Six households in building of credit cooperative: We have been living here for four years, paid one thousand Yuan four years before, and made a riffle regularly on our own initiative thereafter. Our leaders have assured us that we can live in the houses at ease, so now we just want to know what we shall do after demolition;

Weifeng Trading Company Limited: The houses to be demolished belongs to Lianda Printing Company Limited and later handed over to us as paying debt in kind due to owing our company. Primary requirement is to reserve a space around Diaohuanglou for reconstruction;

Yulin Material Company Limited: Our company is a state-owned enterprise and changed to joint-stock company limited later. For this demolition, an over 470m2 warehouse of


our company will be involved. Our land is allocated.. We suggest to return us over 470m2

warehouse or return us the same size of houses;
