Agenda Item No.1. Confirmation of minutes of 201st meeting of Executive Committee held on 15.10.2014 at

New Delhi.

It was noted that 201st meeting of Executive Committee was held on 15.10.2014 at

New Delhi. The minutes of the same were placed before the Central council at the

time of the consideration of the Agenda Item the Central council ratified the same.

Therefore the minutes of the same may be treated as confirmed.

Agenda Item No.2. Action Taken Report of 200th meeting of EC held

on 24.09.2014 at New Delhi.

It was noted that the meeting of 200th Executive Committee was held on 24.09.2014

at New Delhi.

Agenda Item No.3. Extension of tenure of Ayurved

Senior/Junior Experts on contract/consolidated salary.

It was noted that following Ayurved Senior/Junior Experts have been engaged by the

Council on purely contract basis on consolidated salary on the dates as mentioned against their names to look after the work of CCIM in Ayurved Sections.

The terms of these Ayurved Senior/Junior Experts was going to be expired on the dates as per details given below. The matter of further extension of these Ayurved

Senior/Junior Experts was placed before President, CCIM and President, CCIM agreed

to extend the tenure of following Ayurved Senior/Junior Experts for further 6 months owing to their satisfactory services:-

Agenda Item No.4. Inclusion/Recognition of Kamil-e-Tib-o- Jarahat

degree awarded by University of Kashmir in the

2nd Schedule to IMCC Act, 1970.

It was noted that the Govt. of India vide letter No. V.12013/01/2012-EP-IM-2 dated

15.03.2012, 24.01.2013, 13.06.2013 & 03.02.2014 had forwarded the request of the

University of Karnataka for comments of the CCIM as required under Section 14(2) of

IMCC Act, 1970 regarding inclusion of Kamil-e-Tibb-o-Jarahat in IInd Schedule to

IMCC Act, 1970.

After examination of the application and further information obtained from the

University thereafter, the following observations are made:-

1. University is following the Syllabus of the CCIM for conducting the course. 2. University is following the Curriculum of the CCIM.

3. University is following the nomenclature of degree as prescribed by CCIM.

As University is fulfilling the requirement of the Act and Regulations,

recommendations may be sent to the Govt. of India for inclusion in Second

Schedule to IMCC Act, 1970 which may be read as under:-

Executive Committee approved the same and agreed to sent the

Agenda Item No.5. Information and ratification regarding reply sent

to Govt. of India in respect of Extension and

inclusion of Diplomas given by various Institutions

in the IInd Schedule of IMCC Act, 1970.

It was noted that the meeting of legal affairs committee was held on 15.10.2014 in

the office of CCIM to consider the matter regarding extension/recognition of the

Diploma Qualifications given by various Institutions in the 2nd Schedule to the IMCC

Act, 1970. The Committee decided as under:-

“Such Qualifications cannot be included in the IInd Schedule of IMCC Act, 1970.

However, Committee agreed to the provisions of Schedule (Section 27,28,29 and 30)

of United (Ayurvedic and Unani Tibb Systems of Medicine) Act 1939 UP and concluded

that it is a State subject (State Govt. /Board) to decide their provision of practice.

The Committee also decided to communicate this decision to GOI and respective

Institutions.”

The minutes of Legal Affair Committee were agreed by the Executive committee in its

201st meeting held on 15.10.2014 and subsequently ratified by the Central Council.

Therefore, in compliance of the decision, a reply has been sent Govt. of India, Deptt.

of AYUSH with a copy to concerned State Govt. (U.P.) and Registrar, Ayurvedic &

Unani Tibbi Chikitsa Padhiti Board, U.P. with the approval of President, CCIM.

Agenda Item No.6. Reporting of decision of Govt. of India in respect

of Ayurved, Unani & Siddha Colleges permitted/not permitted by Govt. of India for

the session 2014-15.

It was noted that Government of India has conveyed the decision in respect of

Ayurved, Unani & Siddha Colleges permitted/not permitted for the session 2014-15 so

far in response of the recommendations of the CCIM. The list of Colleges are as

Agenda Item No.9. Minutes of Sub-committee in respect of matter

related to copied thesis in reference to Addl. Agenda Item No.14 of 197th EC -regarding.

It was noted that a representation alongwith its enclosures from Dr. Azeem Ahmad Syeed, Asstt. Prof. Govt. Nizamia Tibbia College, Hyd. in respect of case filed against

the Vice-Chancellor Dr. NTR University of Health Sciences, Vijaywada and Dr. Mohd.

Ali Haider, Lecturer - Govt. Nizamia Tibbia College, Hyd. was placed before 197th EC

under Addl. Agenda Item No.14.

Executive Committee had decided to wait for order of Lokayukta and accordingly for

further action. EC also decided to constitute a Sub-Committee comprising of head of

the Deptt. of Tahafuzi wa Samaji Tib subject of reputed institutes. The number of

member‟s alongwith their names will be suggested by Vice-President (Unani).

Accordingly a meeting of sub-committee was convened on 08.09.2014 and

subsequently final meeting on 01.11.2014 under the Chairmanship of Vice-President

(Unani) with the Dr. Abdul Mobin Khan (AMU), Dr. M. Junaid Siddiqui (Jamia

Hamdard) and Dr. Arish Sherwani (NIUM, Bangalore).

“The Sub-committee discussed the matter of authenticity of thesis of Mr. Mohammed

Ali Hyder of year 2011 at large and found that it cannot be considered as original

work”

In this regard it was noted that the decision of sub-committee is to be forwarded to

Lokayukta before 11.11.2014 therefore same has been forwarded to Lokayukta on

Agenda Item No.10. To engage the legal agency for legal work of

It was noted that as per decision of 200th EC under Addl. Agenda Item No.4 the notice

to hire Legal Agencies was uploaded on the website of CCIM on 01.10.2014 for

inviting tender with profile alongwith financial Bid and it was requested to submit the same by 20.10.2014. In this regard, it was noted that three tenders were received as

per details given below :-

After going through the rates quoted by all the above said agencies it was observed

that two agencies Legal Axis and Sai Legal Associates are quoted Government rates but the Legal Assist rate are higher than two agencies and further on comparing Legal

Axis and Sai Legal Associates, the second one has quoted 10% of clerkage which

seems to the high side.”

In view of the above, it was observed that rate of legal Axis are less than others.

Therefore, the work has been entrusted to Legal Axis.

Executive Committee while approving the same noted that there are some

typographical errors in the guidelines uploaded by the CCIM therefore, the

same may be revised by the President, CCIM and thereafter may be sent to

the Legal Axis for adoption.

Agenda Item No.11. The minutes of Sub-Committee constituted by

CCIM in its meeting held on 16.10.2014 – regarding.

It was noted that Central Council in its meeting held on 16.10.2014 constituted a

Sub-Committee to examine the matter in respect of notification issued by CCIM with

regard to practice of Modern Medicine by the ASU Graduate.

In this regard, it was noted that a committee was constitutes of following members

to consider the matter:-

The meeting of Sub-committee was convened on 27.10.2014.

Executive Committee noted the contents of the decision of the meeting held

on 27.10.2014 and 05.11.2014. The EC approved the draft notification

prepared by the Sub-Committee on 05.11.2014.

Agenda Item No.12. Extension of cutoff date of admissions of

students in the Ayurveda, Unani, Siddha and Homoeopathy (ASU&H) Medical Colleges who

have been granted conditional permission by

the Central Government for the academic session 2014-15.

It was noted hat Govt. of India vide letter No.R.11011/10/2013-EP (IM-1) dated

28.10.2014 has extended the cutoff date of admission of students in Ayurved, Unani

and Siddha medical colleges for the session 2014-15 upto 30.11.2014. The same has

been circulated to all concerned by E-mail and uploaded on the website of CCIM.

During the discussion, a letter issued by MHUS, Nashik (Letter

No.MUHS/XL/8317/2014 dated 30.10.2014) was brought to the notice of EC by Dr.

Bhrigupati Pandey, Member, EC in which University has clarified that “all concerned

that, though the cut off date has been extended till 30th Nov 2014 by the AYUSH, yet

it will not affect the provisions of Notification referred above, i.e. the students

admitted after 31st October, 2014 will not be considered eligible to appear for

Summer- 2015 Examination. All such students shall be considered eligible to appear

for winter-2015 Examination.

After observing that there is no provision under the concerned Regulation in

respect of such type of restriction. Further, it is not adopted by any

University of India or by GOI. Therefore, it is not acceptable to CCIM and

letter be written to University as well as all concerned in the matter by

clarifying the stand of the CCIM.

Agenda Item No.13. Consideration of representation of

Dr. Shamshad Bano, Asstt. Registrar (Unani) in

respect of her health- regarding.

It was noted that AR (Unani) who is discharging additional duty of Secretary, CCIM

cum DDO has submitted the representation dated 22.10.2014 in respect of ill health

and has requested to relieve her from additional charge of Secretary, CCIM.

The contents of representation are as under:-

“In continuation of her previous representation dated 05.2.2014, she is once again

requesting to consider the matter sympathetically and relieve her from the additional

charge of Secretary, CCIM as her health status is not improving instead getting worse.

In this connection, it was noted Dr. Shamshad Bano, Asstt. Registrar (Unani) is

discharging the duties of the Registrar-cum-Secretary/D.D.O. vide O.O. No.13-

9/2013-Estt.(O.O.) dated 23.10.2013.”

In this regard, it is also submitted that previous representation was placed before EC

and after consideration EC decided that she will continue to hold the charge of the

seat of Secretary till further order.

Executive Committee decided that she will continue to hold the charge of

Sceretary, CCIM till the Secretary, CCIM is reinstated.

Agenda Item No.14. Instruction in the matter of filling up the post of Assistant Secretary (Admn.)

It was noted that a letter No.12-1/2012-Ett.(A.S. Admn.) dated 15.4.2013 was sent to Govt. of India, Ministry of Health & Family, Deptt. of AYUSH regarding meeting of

DPC to be held on 22.4.2013 to consider the candidature for the post of Asstt.

Secretary (Admn.) in CCIM as per RR sanctioned by Govt. of India in respect of

nominee (JS). But nomination was not received despite repeated reminders and postponing the DPC meeting thrice.

However, in response of Council‟s letter dated 30.9.2013, a letter

No.V.27016/01/2012-EP(IM-2) dated 18.10.2013 was received from Govt. of India,

Ministry of Health & Family, Deptt. of AYUSH requesting to fix the date in

consultation with President, CCIM as per his convenience and intimate the

date to this Department.”

Further, it was noted that 186th Executive Committee in its meeting held on

04.2.2014 under Agenda Item No.2 while considering the representation dated

23.12.2013 of Sh. Rajesh Jain, Acting Asstt. Secretary (Admn.) decided to fill up the

post of Assistant Secretary (Admn.) for 01 year on deputation which has been

exhausted by CCIM and reported to the 199th Executive Committee in its meeting held

on 09.9.2014 under Agenda Item No.4.

Again, a letter No.12-1//2014-Estt.(A.S. Admn.) dated 27.8.2014 and 05.9.2014

was sent to Govt. of India, Ministry of Health & Family, Deptt. of AYUSH regarding to

depute a nominee {of the rank of Joint Secretary (AYUSH)} for the DPC for the post

of Asstt. Secretar (Admn.) in CCIM. In reference of the same, a letter

No.V.27016/02/2012-EP (IM-2) dated 17.10.2014 has been received from Govt. of

India, Ministry of Health & Family stating that nomination of a member of DPC of

JS level for the post of Assistant Secretary (Admn.) does not appear to be

appropriate.

In this connection, following facts are placed below for consideration :-

1) 201st Executive Committee in its meeting of held on 15.10.2014 under Addl. Agenda Item No.4 decided to revise the Recruitment Rules (Method of

Recruitment) in the sanctioned Recruitment Rules by Govt. of India (vide letter

No.V.27016/9/2007-Ay.Desk dated 02.3.2009).

2) Further, CCIM has asked to furnish copies of R.R. from different institutions

for various posts. Morarji Desai National Institute of Yoga, N.D. has forwarded

the sanctioned R.R. of Deptt. of Ayush for the post of Administrative Officer seems to be similar as Assistant Secretary(Admn.) of the CCIM in all respect.

Hence, on the same ground, it has been observed that some more important

amendments are required in draft R.R. besides the amendment agreed by 201st

Executive Committee i.e. Method of Recruitment.

3) Accordingly, draft Recruitment Rules for the post of Assistant Secretary (Admn.) by incorporating some more important changes has been prepared

by the office. A copy of draft Recruitment Rules for the post of Assistant

Secretary (Admn.) .

In view of the above, it was noted for consideration please whether (1) the

process to fill up the post of Assistant Secretary (Admn.) may be taken up at

first by asking the nominee of Govt. of India not below the rank of Deputy

Secretary as has been done by the Government of India in the R.R. of Group

„A‟ Technical post (i.e. Asstt. Registrar (Ay./Unani/Siddha) which is in the

similar Pay Band and Grade Pay (i.e. PB-3 Rs.15600-39100+Rs.5400/- Grade

Pay)

or

2) Proposal may be sent to Government of India for amendment as per

decision of the 201st Executive Committee held on 15.10.2014 alongwith

amendment of rank of Govt. of India nominee from existing i.e. JS (AYUSH)

to Deputy Secretary (proposed) and process may be initiated to fill up the

post thereafter.

Executive Committee decided to exhaust the first option of the RR i.e. by

promotion at the earliest. It was also decided to ask the GOI to nominate the

one nominee of GOI not below the level of Deputy Secretary in place of Joint

Secreatry.

Agenda Item No.15. Instructions on matter to fill up the post of Registration Officer

It was noted that Executive Committee in its meeting held on 15.10.2014 has decided

to fill up the post of Registration Officer through Direct Recruitment as it was

inadvertently reported in the Addl. Agenda Item No.17 that none of the official of

CCIM is eligible for promotion to the post of Registration Officer whereas as per R.R.

sanctioned by Govt. of India, only Sh. Rajesh Jain, Accountant fulfils the criteria

for consideration of his candidature for the post of Registration Officer who

is holding the charge of Assistant Secretary (Admn.).

However, in this regard, following facts in chronological order are placed

below for re-consideration and suitable decision in the matter:-

1. The post of Assistant Registrar (Regn.) was sanctioned by the Government of India

vide their letter No.V.26025/24/86-AE dated 12.3.86 and No.V.26025/4/87-AE dated

25.6.1987 in the pay scale of Rs.650-1200 (as per 03rd CPC) & Rs.2000-3500/- (as

per 04th CPC) initially. Replacement scale is PB-2 9300-34,800+Rs.4600/- Grade

Pay (as per 6th pay Commission).

2. The CCIM changed the designation as Assistant Secretary (Regn) and upgraded

the pay scale as Rs.8000-13500/- (as per 05th CPC) at its own without the sanction of

the Government of India. But later on, Government of India did not sanctioned the

upgradation of scale alongwith designation as proposed by CCIM as Assistant

Secretary (Registration).

3. The post was filled up time to time by CCIM as per framed Recruitment Rules of the

CCIM. Sh. Rajesh Jain was promoted on 29.6.2011 from the post of Accountant to

the post of Assistant Registrar (Regn.) and reverted to Accountant on 25.2.2013 as

per decision of the 176th meeting of Executive Committee dated 22.2.2013.

4. The Ministry of Health & Family Welfare, Department of AYUSH, EP(IM-2), N.D.

vide their letter No.V.27016/11/2010-Ay.Desk/EP(IM-2) dated 23.1.2012 has

forwarded the RR by changing the designation/nomenclature of the post i.e.

Registration Officer, General Central Service Group „B‟ – Non-Technical in the pay

scale of PB-2 Rs.9300-34800+Rs.4600 Grade Pay.

5. Consequent upon reversion of Shri Rajesh Jain, Assistant Registrar (Regn.) to the

post of Accountant vide decision of the 176th Executive Committee in its meeting held

on 22.2.2013, the post has fallen vacant w.e.f. 25.2.2013 after his reversion, the

post of Assistant Registrar (Regn.) was renamed as Registration Officer

6. The matter of adoption of the RR sanctioned by the Government of India for the

post of Assistant Registrar (Registration) renamed as Registration Officer was placed

before the Executive Committee of CCIM at its 168th meeting held on 05th & 06th

March, 2012 for adoption. The Executive Committee decided that the

Government of India may be requested to sanction the RR in the pay scale as

well as designation as proposed by CCIM.

7. Accordingly, a letter dated 23.4.2012 and a reminder dated 01.3.2013 was sent to

the Govt. of India to convey the sanction of the Recruitment Rules in the pay scale as

proposed by CCIM as well as designation already sanctioned by Government of India

vide their letter No.V.26025/24/86-AE dated 12.3.86 and No.V.26025/4/87-AE dated

25.6.1987 but no reply has been received from the Government of India so far.

8. The matter was placed before the Executive Committee of CCIM at its 178th

meeting held on 09.5.2013. The Executive Committee decided to fill up the post

as per R.R. approved by Govt. of India. However, no necessary action could

be taken place due to one or any other reason.

9. In the meantime, two representations dated 12.11.2013 and 13.11.2013 were

received from Sh. B.K. Basavaraju, Regn. I/c and Sh. Nihal Miyan, UDC requesting

to provide the relaxation of education qualification for the post of Regn. Officer in

CCIM in case of promotion and request for granting relaxation in the Recruitment

Rules sanctioned by Govt. of India for the post of Regn. Officer respectively.

10. Both the representations were placed before the 185th meeting of Executive

Committee held on 07.12.2013 (under Agenda Item No.7) . The Executive Committee

decided to forward the representation of both the employees to Govt. of India to take

appropriate action at their level and intimate to the Council at the earliest.

11. Accordingly, a letter No.12-4/2011-Estt.(R.O.) dated 07.2.2014 was sent to

Govt. of India regarding relaxation in the Recruitment Rules for the post of

Registration Officer in CCIM. In response of the Council‟s letter, the Government of

India vide their letter No.V.27016/11/2010-Ay.Desk/EP(IM-2) dated 06.5.2014 has

asked that CCIM “to intimate whether this is a recommendation for

amendment of RRs or you have just forwarded the applications of the

applicants for consideration to enable this office to process the case further.”

12. In response of Ministry letter No.V.27016/11/2010-Ay.Desk/EP(IM-2) dated

06.5.2014, the Central Council has again sent a letter No.12-4/2011-Estt.(R.O.)

dated 17.7.2014 with the approval of then President, I/c and informed that

the both the representation were placed before Executive Committee and the

Executive Committee decided to forward the same to the Government of

India to take appropriate action at their level and intimate to the Central

Council at the earliest. Accordingly, both the representations were

forwarded to consider the same and intimate the decision to the Council at

the earliest.

13. In the meantime, in its 186th EC meeting held on 04.2.2014 (under Agenda

Item No.2), decided to fill up the post of Registration Officer immediately as per

approved RR of Govt. of India initially for a period of one year (on deputation basis)

and it was decided that the concerned in-charge will look after the current work till

the post is filled by deputation.

14. As per decision of 186th meeting of Executive Committee, a vacancy circular on

deputation basis for the post of Registration Officer for a period of one year was

circulated to the Central Govt./State Governments/Public Undertakings/Statutory/

Autonomous Bodies and simultaneously, the same was published in the

Employment News also.

15. After receipt of two applications, the matter was placed before the 194th meeting

of Executive Committee held on 25.6.2014 and the Executive Committee decided

that the Sub-Committee constituted at Agenda Item No.3 will look into this matter

and give suggestions on the issue.

The Sub-Committee meeting was held on 07.7.2014 and the Committee was of the

opinion that none of the applicants appears suitable to be considered for deputation

to the post of Reg. Officer. The recommendations of the Sub-Committee was placed

before the 195th meeting of Executive Committee held on 07.7.2014. The Executive

Committee agreed to the recommendation of Sub-Committee.

16. Further, it was noted that the 201st meeting of Executive Committee held on

15.10.2014 (Addl. Agenda Item No.17) decided to fill up the post of Regn. Officer

through direct Recruitment.

In this connection, it was noted that as per approved R.R. Method of recruitment is

as under - “Promotion from the post of Office Superintendent/ Accountant

with 05 years experience and with Grade Pay of Rs.4200/- or UDC with 11

years experience and with G.P. Rs.2800/-, failing which by deputation and

failing both, by direct recruitment”.

17. Moreover, the relevant provision of mode of recruitment are as under (as per

sanctioned R.R. by the Govt. of India).

Sh. Rajesh Jain, Accountant fulfils the criteria for consideration of his candidature for

the post of Registration Officer.

19. It is also submitted that it is mandatory to exhaust first method of Recruitment

Rule i.e. Promotion before exercising the next option.

Executive Committee noted that first option of recruitment was not

exhausted inadvertently and instructed office to follow the procedure as per rule. EC also noted that no response, from Govt. of India in reference of two

representations of the employee of the CCIM sent to GOI for consideration,

has been received so far even after lapse of four (04) months of second

letter of CCIM and post cannot be kept vacant for uncertain period as work of the CCIM is hampering badly therefore decided to fillup the post by

promotion to exhaust the first option of the RRs.

Agenda Item No.16. To manage the working of Account Section – reg.

It was noted that it has been brought to the notice of the President, CCIM (through

Note) by the Acting AS (Admn.) that Cash Book of all the Bank Accounts of the CCIM are not being put up to DDO regularly which is very essential for checking, verification

and smooth functioning of the office as well as to avoid the irregularities. As

management of Accounts in respect of expenditure etc are integral and indispensable parts of each and every office. In response of the same Mr. S.K. Upadhyay working as

Cashier alongwith additional charge of Accountant since 01.05.2013 has submitted

that “I have an additional charge of acting Accountant in addition to post of cashier since last 18 months approx”.

I have requested many times to Secretary & President, CCIM to relieve me for one

seat, but no action has been taken in this regard to till date. I have heavy pressure of

work, I tried my best but a lot of work is getting pending time to time. Actually, the post of Mr. Rajesh Kumar Jain is Accountant but he is looking after the

work of Acting Assistant Secretary (Administration) as per order, and his duty as an

Accountant has been assigned to me, in addition to my actual work of Cashier. Technically it is not correct and Accountant by same employee.

In view of above, it is better to allot the work of Accountant to Mr. Rajesh Jain, as he

is designated Accountant and drawing the salary for the same post, and relieve me

from the post of Accountant, so that I do the my actual work of Cashier smoothly and without getting unnecessary delay.

On the comments of Cashier, Acting AS (Admn.) has remark as under:-

“The work of accountant may be given to the undersigned and the work of seat of

Assistant Secretary (Administration) may be given to another officer/employee of the Council in order to complete the work of seat of Accountant for smooth working.”

Executive Committee decided that decision in the matter will be taken after

holding the DPC as decided under Agenda Item No. 14 & 15.

Agenda Item No.19. Approval of Draft Recruitment Rules for the post of

Registrar-cum-Secretary.

It was noted that R.R. for the post of Registrar-cum-Secretary was sanctioned by Government of India vide letter No.A.14019/4/96-P&C dated-8th August, 1997.

However, the incumbent (i.e. Registrar-cum-Secretary) is going to be retire on

31.7.2016.

In this regard, it was noted that as per instructions of the Government of India vide

O.M.No.26011/1/2014-NI(RAV) dated 13.2.2014 received from Ministry of Health &

Family Welfare, Department of AYUSH, (NI Desk), New Delhi, the process of filling up of the posts of Director/Head of Autonomous Bodies under the D/o AYUSH be initiated

at least one year prior to the occurrence of the vacancy in future. The same was

acknowledged by the 193rd Executive Committee in its meeting held on 28.5.2014.

Therefore, it is necessary to initiate the action well in time in the matter. In this

regard, it is also submitted that Recruitment Rules are not a static document, it requires amendment to incorporate the present development and instruction of the

Government of India issued time to time.

As the R.R. for the post of Registrar-cum-Secretary were sanctioned by Govt. of India in 1997. Near about 17 years have been passed therefore, it is necessary to

review the R.R. to incorporate present development like instructions of DOPT and

recommendations of the pay commission time to time.

Executive Committee approved the draft RR and agreed to sent the same to

GOI for sanction.

Agenda Item No.20. Minutes of Meeting on Preparation of training

module on syllabus and development of

competency skills-Regarding.

In pursuance of the 199th Executive Committee decision and as per directions

of President CCIM, a meeting in respect of Preparation of Training modules according to syllabus for Ayurved, Unani & Siddha was held on 29.10.2014 at

11:00 a.m. at the CCIM, New Delhi.

In this regard it was noted that most of the ASU experts suggested for calling one more meeting to finalise the training modules. The matter was brought to

the notice of President, CCIM and President directed to place the matter before

Executive Committee for information and to schedule the final meeting in

November last week.

Executive Committee will review the same. Before that one more meeting of

this committee be convened to finalize the same.

Addl. Agenda Item No.1. Satpal Khatri Vs Central Council of Indian

Medicine (Bhartiya Chikitsa Kendra Parishad),

before Office of Labour Commissioner (West),

Karampura – regarding.

It was noted that above mentioned matter is filed by Mr. Satpal Khatri (ex-employee

of Central Council of Indian Medicine) who was terminated for his unsatisfactory

services. The matter was fixed for hearing on 27.10.2014. Further, it is informed that

the whole matter was reported in 201st EC under Agenda Item No.3. The Legal

Consultant Md Zahid Rayeen had attended the hearing on behalf of the Central

Council. Presiding Officer had asked about the stand of the Council regarding the

claim of awardee (Satpal Khatri). It was submitted by Legal Consultant that the

Council needs more time as the matter is not a general one/routine one. Legal Axis is

preparing application for restoration of the case in Delhi High Court. Now the next

date of hearing is fixed for 10.11.2014.

Executive Committee noted the same and asked to depute one Legal

Consultant to take up the matter with the Legal Axis to file the application for

restoration of the case in the court.

It was noted that Technical and Financial Bid were invited from interested agencies for

digital solution as per decision of the EC by uploading the advertisement on the

website of the CCIM on 08.10.2014 and subsequently on 17.10.2014 with some

amendments.

The following three companies have submitted their bid along with pre – requisites in

response of the same.

2. Tata Consultancy Services, PTI Building, 4 Parliament Street, New Delhi-110001.

In view of the above, it is observed that, as the Tata Consultancy Services is fulfilling

technical eligibility (Technical score 83) along with lowest financial bid, therefore it is

eligible for award of the work of Digital Solutions for the office of CCIM as per the terms

and conditions stipulated in the Tender/ Bid.”

After approval of the minutes of Sub-Committee from the President, CCIM, An offer

letter has been issued to TCS Company on 03.11.2014 with the approval of

competent authority and on acceptance the offer, the work will be enthrusted to the

TCS.


Addl. Agenda Item No. 3. Sanction of Expenditure to be incurred for

participation of the CCIM in world Ayurved

Congress to be held on 06.11.2014-

regarding.

It was noted that as participation of 6th World Ayurved Congress of Central Council of

Indian Medicine has been accepted by Competent Authority as reported to EC in its

meeting held on 15.10.2014. In this regard a bill of Rs.10,29,265 was received from

WAC and 50% payment Rs.5 Lakh has been released in the matter with the sanction

of President, CCIM. Remaining amount will to be paid later on.

This excludes the venue rental (ITPO), audio visuals, lights, fixtures and other

furnishings to the tune of an additional Rs.10 Lakhs, which will be borne by WAC. It

has been requested in letter for a financial assistance to the tune of Rs.10 Lakhs

(Rupees ten lakh only), which would greatly help in mitigating our overall expenses.

Executive Committee sanctioned the amount as asked and directed office to

make payment of the remaining amount to WAC.

Bhopal regarding to issue guidelines for further study of Dr. Shailendra Singh Senger

M.D. Scholar Ayurveda Siddhant Department in Rani Dullaiya Smriti Ayurvedic PG

College and Hospital, Bhopal. The Content of the letter are as under:-

“Dr. Shailendra Singh Senger is studying in M.D. Ayurveda final year course in

Samhita-Siddhant Department in Rani Dullaiya Smriti Ayurvedic PG College and

Hospital, Bhopal. STF Madhya Pradesh have informed college vide their office letter

Executive Committee was of the opinion that as matter relates with the

CRPC/CPC (Criminal proceedings) therefore, colleges may be informed to

take the decision in the matter as per instructions of the STF.

Conclusion:-Sub-committee arrived at the conclusion that the Curriculum, Degree,

Duration of Course followed by two countries are same, the only difference is Degree awarded by India is Ayurvedacharya and Degree awarded by Nepal is Ayurved

Shastri.

However, in view of above observation committee agreed to notify the BAMS Degree

of Tribhuvan University of Kathmandu, Nepal in fourth Schedule of IMCC Act 1970.

Executive Committee approved the same and agreed to send the

recommendation to GOI for its inclusion in IVth Schedule under the provision

of Section 16 of the IMCC Act, 1970. EC also decided to send one more

reminder to Allianz University of Malaysia in respect starting Ayurveda/Unani

Course in Malaysia.

Addl. Agenda Item No.7. Recommendation of Screening Committee in

respect of SMVVS, Smt. Rajeshwari Karpurmath Memorial, Ayurved Medical

College & Research Centre Bijapur, Karnataka,

visited under Section13A for LOI-regarding.

It was noted that the Visitation Report of SMVVS, Smt. Rajeshwari Karpurmath

Memorial, Ayurved Medical College & Research Centre Bijapur, Karnataka, visited

under Section13A for LOI along with all the relevant documents including compliance

submitted by the college and assessment done by office was placed before Screening

Committee consisting of Dr. Amitabh Kumar (V.P. Ayurved), Dr. Bhrigupati Pandey,

Dr. V.G. Udaya Kumar and Dr. Srinivas K. Bannigol EC Members, CCIM on 04/11/2014

to scrutinize the same. The Screening Committee after examination decided as under:

Agenda taken with the permission of the chair:-

Agenda:- Resignation of Dr. Stanley Jones from the post of Vice President

(Siddha) received.

It was noted that Vice President (Siddha) has submitted a resignation letter to the

President, CCIM and a copy to Secretary, CCIM during the meeting of 202nd

EC

held on 05.11.2014. The contents are as under-

“ Due to my personal reasons, I wish to resign from the post of Vice President-

Siddha while holding the CCIM-Member (Siddha), Kerala post. This resignation

shall become effective from the Forenoon on the day of election of Vice President

(Siddha). Election to the Post of Vice President-Siddha and EC member post –

(anticipated consequential vacancy, if arises) may be conducted by second week of

November 2014.”

EC discussed the issue in detail and decided that as vacancy will arise only after

the acceptance of resignation and only then election may be conducted for the

post of V.P. (Siddha). Hence, it cannot be effective from the Forenoon on the

day of election of Vice President (Siddha).

Therefore, EC accepted the resignation of Dr. Stanley Jones from the Post of

Vice-President (Siddha) with immediate effect.
