Agenda Item No. 1. Confirmation of minutes of the 192nd meeting of

Executive Committee held on 25.04.2014 at New

Delhi.

It was noted that 192nd meeting of Executive Committee & its adjourned meeting

was held on 25.04.2014 & 16.05.2014 respectively at New Delhi. The minutes of the

same were circulated to all the members of the Executive Committee on 20.05.2014

by email and by speed post vide letter No. 5-1/2014 (192nd EC) dated 21.05.2014 to

suggest addition/deletion in respect of correctness of the minutes. However, the

minutes, were also placed before the EC at the time of consideration of the same.

Executive Committee confirmed the same.

Agenda Item No. 2. Letter of GOI in respect of Legal Opinion from

the Ministry of Law & Justice regarding

representation of Deemed Universities in the Statutory Bodies and further notification by

GOI in view of Legal Opinion- regarding.

It was noted that a legal opinion has been received from the GOI, Ministry of Health

& Family Welfare, Deptt. of AYUSH regarding representation of Deemed Universities

in the Statutory Bodies vide their letter No. A.11019/7/14-EC/CCIM (University Election) dated 01.05.2014. Contents of the letter are as under:-

(a) “ The referring Department seeks to be advised on the issue as to whether all

„Deemed Universities‟ are entitled to elect a member from their faculty to represent in CCIM under Section 3(1)(b) of IMCC Act.

(b) Similarly, Section 2(f) of UGC Act,1956 defines „University‟ as under: “ University means a University established or incorporated by or under

a Central Act, a Provincial Act or a State Act, and includes any such

institution as may, in consultation with the University concerned, be recognized by the Commission in accordance with the regulations made

in this behalf under this Act.”

(c) As regards to „Deemed University‟, Section 3 of the UGC Act, 1956 read as under:

“The Central Government may, on the advice of the Commission, declare

by notification in the official Gazette, that any institution for higher education, other than a University, shall be deemed to be a university

for the purposes of this Act, and on such a declaration being made, all

the provision of this Act, and on such a declaration being made, all the provisions of this Act, shall apply to such institution as if it were a

University within the meaning of clause(f) of section 2.”

(d) According to Section 2(k) of the IMCC Act, „University‟ for the purpose of IMCC

Act is a University, which has been established by a law made by the competent

legislature. Whereas Deemed Universities are the institutions which have been notified under Section 3 of the UGC Act as Deemed University, and there is no

condition that those institutions should have been established by law. Since

Deemed Universities are not the Universities established by any law, they cannot

be recognized as University for the purpose of “University” under Section 2(k) of IMCC Act.

Hence, no further election shall be conducted from any Deemed University for

Central Councils (Statutory Bodies) in the light of opinion rendered by Legal

Affairs Department of Ministry of Law & Justice.”

Further, Govt. of India vide Notification No. S.O. 1087(E) dated 15.04.2014 has

rescinded the following three Notifications by which Vd. Deodatta S.Bhadlikar (University representative of Padamshree Dr. D.Y. Patil Deemed University, Navi

Mumbai), Dr. C. Nagarajan (University representative of Amrita Vishwa

Vidyapeetham University, T.N.) and Dr. B. Sreenivasa Prasad (University representative of KLE University, Belgaum, Karnataka) had become the members of

CCIM:-

1. S.O. 1757 (E), dated the 13th July, 2009 published in the Gazette of India,

Extraordinary, Part II, Section 3, Sub-section (ii), dated the 16th July, 2009.

2. S.O. 2816 (E), dated the 29th November, 2012 published in the Gazette of

India, Extraordinary, Part II, Section 3, Sub-section (ii), dated the 4th December, 2012; and

3. S.O. 188 (E), dated the 16th January, 2013 published in the Gazette of India,

Extraordinary, Part II, Section 3, Sub-section (ii), dated the 17th January, 2013.

Since the rescinding of all the three Notifications have come into force at once i.e.

with immediate effect from Notification No. 1087 published on 15.04.2014, therefore, all the above three members representing Deemed Universities, may no

longer be treated as the members of CCIM.

Executive Committee noted and decided that a letter be written to all the

concerned.

Agenda Item No. 3. Visitation of Rama Krishna Ayurvedic Medical College and Research Centre, Bangalore,

Karnataka under Section 13C for the session

2014-2015 – regarding.

It was noted that Rama Krishna Ayurvedic Medical College and Research Centre,

Bangalore, Karnataka was visited on 27-28.01.2014 by Dr. Jageshwar Prasad

Chaurasia and Dr. Basavaraj S. Hiremath. After going through the report it has

been observed that part I has not been submitted along with the visitation report.

Executive Committee noted that Part- I has already been received and

assessed accordingly with approval of President I/c, CCIM as informed by

the office.

Agenda Item No. 4. Regarding visitation to Dharma Ayurveda

Medical College, Sriperumbudur (T.N.).

It was noted that an email letter was received dated 21.01.2014 by Dr. Goudar

Amaregouda Mahantagouda, Dr. Rajashekhar Ganiger and Dr. Amit Kumar Sharma

regarding Visitation of Dharma Ayurveda College, Sriperumbudur, Tamil Nadu for

session 2014-15 under Section 13C in respect of denial of college authorities to get

the visitation done. The matter alongwith letter of visitors was reported in 187th EC

held on 17.02.2014 under Agenda Item No. 8. The decision of EC was as under:

“Executive Committee agreed to consider the letter of visitors as report of the

College”

Accordingly, the matter of Dharma Ayuvedic College was placed before Screening

Committee held on 08.05.2014 and Screening Committee decided not to

recommend to GOI for granting permission for the session 2014-15 as college has

denied visitation.

Executive Committee agreed to the recommendation of Screening

Committee and decided to send the recommendation to Govt. of India.

Agenda Item No. 5. Regarding recommendation of Govt. Ayurved

College Dhanwantri Nagar, Taluk Kanayannur, Tripunithura, Kerala under Section 13C.

It was noted that the Screening Committee had given the following recommendation

in respect of Govt. Ayurvedic College, Tripunithura, Kerala for academic session

2014-15 :-

Recommended for UG 50 seats & PG in 06 subjects namely:-

6. Rasashastra & Bhaisajyakalpna-04 seats

However, due to typographical error the seats in respect of Rasahastra & Bhaisajyakalpna has been wrongly informed to the 192nd Executive Committee as

06 (instead of 04) seats. Hence, number of seats in the said subject be read as

04 seats.

Executive Committee noted the same.

Agenda Item No. 6. Regarding recommendation of S.R.M Govt.

Ayurvedic College, Bansmandi, Bareilly, Uttar

Pardesh and Govt. Ayurvedic College, Jalukbari,

Gawahi under Section 13C.

It was noted that due to typographical error in the minutes of Screening Committee,

visitation reports of S.R.M. Govt. Ayurvedic College, Bansmandi, Bareilly, U.P. and Government Ayurvedic College, Jalukbari, Guwahati under Section 13C, the number

of seats recommended for UG was mentioned as 50 and 60 respectively instead of

40 and 50 seats as sanctioned by GOI.

Therefore, the seats as reported to 189th EC in respect of these two colleges be read as 40 seats (in case of S.R.M. Govt. Ayurvedic College, Bansmandi, Bareilly, U.P.)

and 50 seats (in case of Government Ayurvedic College, Jalukbari, Guwahati)

respectively.

Further, it was informed that the recommendations of these two colleges as per

actual sanctioned seats by GOI have been sent with the approval of President I/c, CCIM.

Executive Committee noted the same.

Agenda Item No. 7. Regarding recommendation received from

Director, AYUSH, Bangalore to carry over

system to BAMS Students.

It was noted that a letter No. AYUSH/61/DEV (2)/2013-14 dated 22.02.2014 from

the Director of AYUSH, Bangalore, Karnataka regarding recommendation to carry

over system to BAMS students and forwarding therewith a letter of Registrar, Rajiv Gandhi University Health Sciences, Karnataka, Bangalore dated 17.02.2014. As per

the letter, the above said University conducted the Ist BAMS professional

examination as per the new guidelines. As the percentage was very less, the students submitted a requisition to the Hon’ble vice-chancellor requesting for

carryover to second BAMS. As per the new guidelines, it was not possible but

keeping in view the above request of the students a joint meeting of CCIM members of Karnataka & Chairman, Board of Studies & members (UG-Ayu) was held on

27.12.2013. In the meeting the matter was discussed in detail and it was resolved

unanimously to recommend to CCIM to revise the 2012 Regulation as follows:

1. The candidates of Ist BAMS are permitted to carryover all the failed subjects to 2nd BAMS & appear for 2nd BAMS examination concurrently along with the

failed subjects of Ist BAMS. However these candidates have to pass all the

failed subjects of Ist BAMS to become eligible to proceed to 3rd BAMS. 2. Similarly candidate of 2nd BAMS who have completely passed all the subjects

of Ist BAMS but have failed in the 2nd BAMS are permitted to carryover all the

failed subjects of 2nd BAMS to 3rd BAMS. However these candidates have to

pass all the failed subjects of 2nd BAMS to become eligible to proceed to 4th BAMS.

3. The candidate of 3rd BAMS who have completely passed all the subjects of 2nd

BAMS but have failed in the 3rd BAMS are permitted to carryover all the failed subjects of 3rd BAMS to final year. However these candidates have to pass all

the failed subjects of 3rd BAMS to become eligible for appearing final year

examination.

It was also unanimously resolved to recommend the extension of benefit of

carryover system as per the present guidelines of revised BAMS regulation as

notified in Govt. of India gazette dated 25th April 2012 to the previous batch of

BAMS students admitted prior to 2012.

Hence, the applicant requested to look in the matter and do the needful.

Executive Committee decided to send a reply to University stating that the

matter has been placed in EC & EC decided to refer the matter to Regulation

Committee, till then University has to follow the concerned Regulations in

toto.

Agenda Item No. 8. Recognition of Ayurvedacharya (BAMS)

Degree awarded by Bhagat Phool Singh Mahila Vishwavidyalya, Khanpur Kalan,

Sonipat, Haryana in the Second Schedule to

the IMCC Act, 1970- reg.

It was noted that a letter V.12013/03/2012-EP(IM-2) dated 13.02.2014 has received

from Govt. of India regarding recognition of Ayurvedacharya (BAMS) Degree

awarded by Bhagat Phool Singh Mahila Vishwavidyalya, Khanpur Kalan, Sonipat,

Haryana in the Second Schedule to the IMCC Act, 1970 alongwith the name of the beneficiary colleges.

Accordingly, on the basis of following information furnished by University, the

students passing out are of regular batch and they were admitted in the session

2007-08, 2008-09, 2009-10, 2010-11, 2011-12, 2012-13 and 2013-14. As per record available in the office of CCIM, the status of beneficiary college is as

under:

As per information, the recommendation of Council to include the Ayurvedacharya

Degree of the University has been sent to GOI vide letter No. 27-20/2012-Univ. dated 20.05.2014.

Executive Committee noted and approved the same.

Agenda Item No. 9. Consideration of policy regarding eligibility of

teachers (reference: 184th to 187th EC) alongwith withdrawal of decision of Screening

Committee regarding eligibility of teachers

(reference: 189th EC) – regarding.

It was noted that as per order of President, I/c, CCIM, Point No. 3,12 & 15 (out of

28 points placed before EC) decisions of EC duly ratified by General Body (on

19.3.2014) may again be placed before EC with full facts for consideration.

Accordingly, the facts in the matter (in chronological order) are placed below-

A. Consideration of Point No. 3, 12 & 15 (Out of 28 points placed before EC)

regarding policy of eligibility of teachers (reference: 184th to 187th EC)

i) The policy for eligibility of teachers prepared by Screening Committee

(consisting of Dr. Prasanna N Rao, Dr. V.G. Udaykumar, Dr. BP Pandey, Dr. Ragini Patil and Dr. Srinivas K. Bannigol) in its meeting held on

31.10.2013 & 01.11.2013 was placed before 184th EC held on 18.11.2013

under Addl. Agenda Item No.6. The EC decided as under:-

“(i) Executive Committee approved the policy except in respect of point No. 20 decision on which is as under:-

(iii) The relevant points of the policy be adopted in clearing eligibility issues of Unani/ Siddha teachers if there is any.

(iv) Executive Committee further agreed to consider the teachers eligible whose eligibility has been cleared on the basis of above policy.”

ii) The Executive Committee in 185th EC (held on 07.12.2013), confirmed the

minutes of 184th EC except Addl. Agenda Item No.6 which was again

adjourned for next date of EC. iii) The 185th Executive committee in its adjourned meeting held on

09.01.2014, decided to defer the matter i.e. Addl. Agenda Item No.6 to

next (186th) meeting in view of order dated 04.01.2014 in HC of Uttarakhand at Nainital

iv) Executive Committee at its meeting 186th (held on 04.02.2013), decided on

the deferred agenda as under-

Executive Committee decided that all the issues will be categorized by the

screening committee as per applicability under concerned regulations and those issues which are not covered under the concerned Regulations are

deferred to regulation amendment committee. Thereafter, the

recommendations will be placed before Executive Committee.

v) The Executive Committee while confirming the minutes of 186th Meeting in

187th Meeting (held on 17.02.2014) noticed that while confirming the minutes of 184th Meeting in 185th Meeting held on 17.12.2013 & its

Adjourned Meeting held on 09.01.2014, the decision of Additional Agenda

Item No. 6 of 184th Meeting was inadvertently noted as “EC confirmed the minutes of 184th EC except Additional Agenda Item No. 6 is again deferred

for next Executive Committee” instead of except point No. 20 of Additional

Agenda Item No.6 which is again deferred for next EC. Hence, EC decided in 187th Meeting that the said omission must be

corrected. In view of the said observation of EC, the corrected minutes of

184th meeting which are confirmed are as under:-

”Executive Committee confirmed the minutes of 184th EC except point No. 20 of Addl. Agenda Item No.6 which is again deferred for next EC.”

In accordance with the above corrections of Agenda Item No.1 of 185th

Meeting, EC modified the decision on Additional Agenda Item No.6 of 186th

Meeting as under:-

Executive Committee decided that all the issues will

be categorized by the screening committee as per applicability under concerned regulations and those issues which are not covered under the concerned Regulations are deferred to regulation amendment committee. Thereafter, the recommendations will be placed before Executive Committee.

EC decided that all the issues will be

categorized by the Screening Committee on the basis of decision of Additional Agenda Item No.6 of 184th Meeting except point no. 20. Thereafter, the recommendation of screening committee will be placed before EC.

Thereafter, Executive Committee confirmed the minutes.

vi) The minutes of above EC have been ratified by the General Body in its

meeting held on 19.03.2014. vii) Now, President I/c, CCIM directed to place the matter relating to the Point

No. 3, 12 & 15 before EC for consideration.

B. Consideration of decision of Screening Committee regarding eligibility of

teachers (reference: 189th EC).

It was noted that as per order of President, I/c, CCIM, decisions of 189th EC held on

19.03.2014 under Addl. Agenda Item No. 14 duly ratified by General Body (on 19.3.2014) is to be placed before EC for consideration.

Audit Report on the accounts of CCIM for the year 2011-12 to 2012-13 in which it

After getting replies from all the concerned sections, a comparative statement of

Audit observation and Reply on the Internal Audit for the year 2011-12 to 2012-13

The visitation report along with all the relevant documents and assessment done by

office was considered and examined by Scrutiny Committee held on 12.03.2014 to

14.03.2014 and EC decided to recommend for UG 60 seats and PG in 07 subjects

namely Rasashastra & Bhaishajya Kalpana -07 seats, Dravyaguna-04seats, Shalya

tantra-05seats, Shalakya Tantra-04 seats, Prasuti Tantra-04 seats, Kayachikitsa-04

seats, Panchakarma – 04 seats (instead of 05) due deficit in faculty to Govt. of India

for granting permission for the session 2014-15.

Further, it was noted that at the time of reassessment of said college, the members

of screening committee noticed that there is shortage of additional teaching faculty

in Department of Prasuti tantra. Therefore the committee decided not to recommend

for PG course in Prasuti tantra due to unavailability of additional teaching faculty.

It was noted that Swami Kalyandev Government Ayurved College, Rampur,

Muzaffarnagar, (Uttar Pradesh) was visited on 24-25.01.2014 for the session 2014-

15 under section 13C & while examining the report only Part I was found with the

report. Further, in this regard as per decision of 190th EC (on 04.04.2014), the

clarification has been asked from the visitor. In response to the same, one visitor

named Dr. V.K.Pandey has sent the copy of Part II of the visitation report of the said

college.

However, with the approval of President I/c, CCIM the report has been considered

and assessed accordingly.

Addl. Agenda Item No.9. Representation received regarding application of aggregate passing (40:50 rule) for Post graduate students (MD, MS Ayurved) appearing for examination.

It was noted that a letter has been received from Dr. Shailesh. S. Nikam, General

Secretary, N.I.M.A regarding aggregate passing (40:50 rule) for Post graduate

students (MD, MS Ayurved) appearing for examination referring the Dental Council

of India Norm as under DCI revised MDS course regulation, 2007. As per the

applicant, the students undergoing the Postgraduate (MD, MS Ayurveda) course

have the passing criteria of obtaining 50% marks in respective subjects at present.

In the modified structure, a candidate appearing for the exam would need to obtain

aggregate 50% marks in his exams including Theory (I+II+II+IV) & Practicals

individually. The minimum passing criteria for each paper in theory would be 40%

only. This revision has been brought into force by many Councils, Universities & will

save the suffering of candidates disqualifying by minimal difference in the exam.

Further, it was noted that a similar matter {Representation received from students

of MUHS, Nashik regarding assessment of final year exam of MD/MS (Ayurved) course} was discussed in 190th EC meeting held on 04.04.2014 and the decision of

the Executive Committee is as under:

“Executive Committee decided that in the final year examination of PG the candidate

is required to obtained minimum 50% marks in aggregate in theory instead of 50% marks in individual papers.”

Executive Committee decided to forward the matter to Regulation

Committee.

Addl. Agenda Item No.10. Visitation report of Ganga Education Society’s

Ayurvedic Medical College, Kolhapur,

Maharashtra under Section 13 C of the IMCC

Act, 1970. It was noted that Ganga Education Society’s Ayurvedic Medical College, Kolhapur,

Maharashtra was visited by Dr. Satya Dev Khichariya and Dr. Sudarshan Behera on

27th & 28th January, 2014. After going through the visitation report, it had been

found that only Part-II was submitted by the visitors. Therefore, as per decision of

the EC clarification had been asked from the visitors.

It is further submitted that in response to the same, the clarification received from

one visitor named Dr. Satya Dev Khichariya is as under:

“at the time of the visitation of Ganga Education Society’s Ayurvedic Medical College,

Kolhapur, Maharashtra dated 27th & 28th January, 2014, after reaching there we

found the institute and their Associated Hospital was locked since last few months as

quarry collected from their neighbor residents by us. The profarma Part-I has been

provided by the college only. Due to the locked institute we couldn’t found that

Proforma Part-I.”

Executive Committee noted the same.

Addl. Agenda Item No.11. Declaration of property details of the employees

and members of CCIM.

It was noted that as per the direction of the President I/c, CCIM, the property details of

the employees of CCIM and members of CCIM is required to be declared to the Council.

Executive Committee approved the same for office employees only.

Addl. Agenda Item No.12. Newspaper Report regarding arrest of

Dr. Surendra Patel, Member, CCIM.

It was noted that as per reports published in various English & Hindi newspapers,

among other persons, Dr. Surendra Patel, member of CCIM has also been reported

to have been arrested by the State Police of Madhya Pradesh in mal-practice in the examination for the appointments in State Government.

In this connections, it was noted that Dr. Surendra Patel is an elected member of the CCIM under Section 3(1)(a) of the IMCC Act, 1970 from the State of Madhya

Pradesh since 13th September, 2011.

Executive Committee decided that as the matter is of serious nature, hence

the member in question will not be assigned any work of the Central

Council of Indian Medicine till the final outcome of the investigation.

Further, a letter is to be sent to concerned Police Station, M.P. to obtain

relevant documents and statement of the said member.

It was also decided that the recommendations in respect of colleges which

have been visited by the said member will not be sent to Govt. of India

unless the Visitation Reports are again verified by the Council. If any recommendations of such colleges have been sent to Govt. of India, they

will be recalled and will be sent again after verification of the report.

It was noted that Madras High Court, Madurai Bench has passed the orders dated

26/3/14, 03/4/14, 7/4/14, 16/4/14 in WP No.4713/2014 titled as T. Retnapandian V/s

UOI & ors. whereby the said court has stayed the declaration of result of election to the

post of President, CCIM held on 20/3/14. Aggrieved from the above said orders, CCIM

filed the SLP before the Supreme Court seeking quashing of the said orders of Madras

High Court, Madurai Bench. The SLP was listed on 22.05.2014 and the Court issued

Prakash Tyagi & Ors. before Supreme Court

of India, at New Delhi.

It was noted that an order dt.13/5/14 has been passed by Nainitaal High Court, Division

Bench in Special Appeal No.70/14 filed by Ved Prakash Tyagi assailing the order

dt.10/3/14 of Single Judge, Nainitaal High Court in WP No.1754/13. Vide order dated

13/5/14, the DB has remanded the WP No.1754/13 to the single Judge, Nainitaal High

Court for disposal. The CCIM was not heard by DB before passing the order dt.13/5/14.

Aggrieved by the order dated 13/5/14 of Division Bench of Nainital High Court, CCIM filed

the SLP challenging the order dt.13/5/14.

Addl. Agenda Item No.16. Regarding final syllabus of 3rd and 4th

professional year for BAMS.

It was noted that a meeting to finalize the syllabus of the 3rd and 4th professional

year for BAMS was conducted in the office of CCIM, New Delhi on 12-13.05.2014.

The final syllabus submitted by concerned subject experts in the meeting was

considered by the Committee.

Regulations in the Gazette of India.

It was noted that the EC in its meeting held on 22.10.2013 decided to withdraw its

decision of revocation of suspension of Dr. P.R. Sharma, Registrar-cum-Secretary

(taken on 23.08.2013 in 181st meeting of EC) with immediate effect pending

enquiry proceedings. Accordingly, Dr. P.R. Sharma, Registrar-cum-Secretary was suspended w.e.f. 22.10.2013 (A.N.).

In this connection, Dr. P. R. Sharma, approached to the Central Administrative

Tribunal, Principal Bench at New Delhi and got his suspension stayed vide order

passed in O.A. No.3904/2013 filed by Dr. P. R. Sharma V/s UOI & Ors. Accordingly,

Dr. P. R. Sharma, Registrar-cum-Secretary was allowed to attend the office vide Office Order No. 30-5/2013-CC (42) dated 04.11.2013 alongwith the said order

dated 01.11.2013. He joined his duty w.e.f. 08.11.2013.

In this connection, it is further submitted that Dr. P. R. Sharma was allowed to join

the office in view of order of CAT but no work was allotted to him. Since, Dr. P. R. Sharma being the Registrar-cum-Secretary of this Council was the DDO but no work

was allotted to him due to which the obligatory work and duties envisaged in him

could not has been discharged and all financial matters were stagnated and even

normal routine work was hampering. It was, therefore, decided that in the present circumstance, it would be appropriate, if a senior officer of the Council is authorized

to discharge the powers and duties of the Registrar-cum-Secretary/DDO. Executive

committee after detailed discussion and taking the present situation decided that Dr. Shamshad Bano, Assistant Registrar (Unani) may be authorized to discharge the

duties of the DDO till further orders.

Accordingly, an Office Order was issued for Dr. Shamshad Bano, Asstt. Registrar

(Unani) to discharge the duties of Registrar-cum-Secretary/DDO etc. and since then

all Bank Accounts of the Council are being operated with the signature of Dr. Shamshad Bano, Asstt. Registrar (Unani) in the capacity of Registrar-cum-

Secretary/DDO which is the vested power in Registrar-cum-Secretary.

In this connection, it is further submitted that as per Section 23(1) of the IMCC Act,

1970, the Central Council shall cause to be maintained the Central Register of Indian

Medicine containing the names of all persons who possess any of the recognised

medical qualifications. As per section 23(2) of the said Act, it is the duty of the Registrar of the Council to keep and maintain the Central Register of Indian Medicine

in accordance with the provisions of the said Act and orders made by the Central

Council from time to time and publish the same in the Gazette of India in the manner as may be prescribed. Also, as per provision made under Section 25 of the

said Act, it is for the Registrar to grant registration on the application made by any

person and enter his name in the Central Register of Indian Medicine in the prescribed manner.

The Central Register is prepared and got published in the Gazette of India in the

manner already prescribed by the Central Council and Enrolment Certificate/Direct Registration Certificate is accordingly issued to all the concerned. To execute these

functions, the name of Asstt. Registrar (Unani) is being used as Registrar-cum-

Secretary and she has been putting her signature on it.

But it has now been pointed out that in the present situation, when Dr. P. R. Sharma

is in office, how statutory functions like operating Bank Accounts in the capacity of

DDO would be discharged by some other officer and Gazette Notifications including

various Regulations/Enrolment Certificates/Direct Registration Certificates/I.Cards

etc. will be issued whereas such powers are vested in Registrar-cum-Secretary.

Since, the above work of publishing the Central Register of Indian Medicine including

regulations, issuing the Enrolment Certificate/Direct Registration Certificate have to be performed in the prescribed manner by the Central Council, but the Central

Council has not allotted any work to the existing Registrar as per its own decision

due to finding him to have been indulged in some illegalities, it would, therefore, be

in order and in public interest that the works of mandatory nature may not suffer

further and Dr. Shamshad Bano, Asstt. Registrar (Unani) who has already been

authorized to perform as DDO, and who is already discharging the functions as mentioned above, may further be authorized to get the Central Register of Indian

Medicine published in the Gazette of India and to issue the Enrolment

Certificate/Direct Registration Certificates/I.Cards etc. in the capacity of Asstt.

Registrar (Unani) itself henceforth and such works done/being done may be treated for and on behalf of the CCIM with full competency as that of Registrar, CCIM.

Executive Committee decided that only Registrar be printed and the

officer/person who is discharging the duties of Registrar at that particular

time will sign over the Enrolment Certificate/Direct Registration Certificate/ I-Cards /the Gazette Notifications.

Addl. Agenda Item No.19. Regarding extreme corruption by AYUSH

Deptt. Councils.

It was noted that a letter has been received from Govt. of India, Deptt. of AYUSH

vide no. Z.28015/02/2014-EP(IM-2) dated 23.04.2014, forwarding a copy of letter

dated 10.01.2014 from PMO enclosing therewith a representation dated 03.01.2014

of Dr. Satpathi on the subject cited above to examine the matter.

The contents of the representation of Dr. Satpathi are as under

“I am well wisher of congress. AYUSH Dept. Council‟s namely is Central Council

Homeopathy, New Delhi & Central Council of Indian Medicine, New Delhi defaming

current Govt. by illegal activities in name of ruling party. They are conduction

inspection in short duration (like 10 month-1years) as against rule of one inspection

every 3 years for established colleges. During inspection, inspectors and Council

office bearer are demanding very very high sums in Lakhs as gifts to make the

correct report or else they are ready to create pseudo negative report and defame

college also. If college managements revolt they threaten them in name of Central

ruling congress party & show fear to withdrawn permission. Under these conditions,

when 2014 election are proposed this activities puts a very bad impression of

congress in college owners/staff/students & relatives too as each time there is

inspections all of them are over burdened with hectic work & leaves stand cancelled.

So they all speak ill about ruling party. Atleast till elections, councils & AYUSH Dept.

should be strictly warned to stop illegal activities & corruption. In Central Council of

Homeopathy, New Delhi there is monopoly of President Dr Ramjee Singh and his

favorites Vice President Dr. Arun Bhasme is still continuing is post after 4 years of

completing his turn but no one can dare to give any different opinion.

Expecting the appropriate response.”

Executive Committee took the matter seriously and decided to take stern

action, if anything brought to the notice of the Council.

Addl. Agenda Item No.22. Discussion on the functioning of CCIM officers

regarding.

With the permission of the Chair, a discussion was held with regard to the

functioning of CCIM officers and it was noted that although Dr. Shamshad Bano,

Asstt. Registrar (Unani) who is presently looking after and discharging the duties of

the Registrar-cum-Secretary is performing promptly but there is a lot to improve her

functionality and working behaviour.

The EC noted it and directed the Asstt. Registrar (Unani) to be cautious and

responsive in future.
