Agenda Item No. 1. Confirmation of minutes of the 180th meeting of
Executive Committee held on 26.06.2013 and adjourned meeting held on 06.8.2013 at New
Delhi.
It was noted that 180th meeting of Executive Committee was held on 26.06.2013
and adjourned meeting held on 06.08.2013 at New Delhi. The minutes of the same
have been circulated to all the members of the Executive Committee by post vide letter No. 5-1/2013 (180th EC) dated 14.08.2013 to suggest addition/deletion if
any within 21 days from the issuance of the minutes. Executive Committee confirmed the same.
Special Agenda Item No. 1. Seat vacated as a member of CCIM in respect
of Dr. Vanitha Muralikumar - regarding.
Council is in receipt of a copy of letter on the subject mentioned above vide No.
A.11019/24/2013-EC (CCIM Elections) dated 07.08.2013 from Govt. of India,
Department of AYUSH addressed to Registrar, the Tamil Nadu Dr. MGR Medical University, Chennai for necessary action. In the above mentioned letter, Govt. of
India has requested Registrar of University to take necessary action to conduct the
election among the members of the Faculty of Ayurveda of the aforesaid University

in pursuance of Section 3 (1)(b) of IMCC Act, 1970 to elect a member for filling up
one vacancy in CCIM as Dr. Vanitha Muralikumar (representative to CCIM from The Tamil Nadu Dr. MGR University representative) has ceased to be a member of the
Faculty of Ayurveda w.e.f. 19.03.2013 and in terms of Section 7(2) of IMCC Act,
1970, she is deemed to have vacated her seat as a member as well as the Vice-
President (Ayurveda) in CCIM. In this regard, it was noted that the copy of the letter has been circulated to all members of CCIM and other concerned by the
office vide letter No. 16-01/2013 Act (1) Part-II dated 14.08.2013.
Executive Committee noted the same. Dr. Prasanna N. Rao and Dr. B.P.
Pandey requested President, CCIM to conduct the election of
Vice-President (Ayurveda). The President, CCIM referred the matter to General Body, CCIM.
Agenda Item No. 2. Meeting of Review Committee to consider the appeal of Dr. PR Sharma, Secretary, CCIM and Ms. Kiran, O.S., CCIM.
It was noted that Dr. P.R. Sharma, Secretary, CCIM and Ms. Kiran, Office
Superintendent were placed under suspension by the then President, CCIM
through two separate Orders dated 17th April, 2013 on the ground that a criminal complaint having been filed against them with the Police for investigation and that
a disciplinary proceeding against them is contemplated.
The period of 90 days of suspension of these officials was expired on 15th July, 2013. As per sub rule (6) of Rule 10 of CCS (CC&A) Rules, 1965, an order of
suspension made shall be reviewed by the authority competent to modify or
revoke the suspension, before expiry of 90 days from the effective date of suspension, on the recommendation of the Review Committee constituted for the
purpose and pass orders either extending or revoking the suspension. It is further
provided that subsequent review shall be made before expiry of the extended period of suspension. Extension of suspension shall not be for a period exceeding
180 days at a time.
As per DOPT instructions contained in their OM dated 07.01.2004, the Review
Committee may comprise the disciplinary authority, the appellate authority and
another officer of the level of disciplinary/appellate authority from the same office or from another Central Government office (in case another officer of same level
is not available in the same office), in a case where the President is not the
disciplinary authority or the appellate authority.
Accordingly following Review Committee was constituted by Ex-President, CCIM.

The Meeting of Review Committee was convened on 11.07.2013 and committee
recommended the suspension of both the officers to be continued further for a period of 180 days beyond 15.07.2013. Accordingly on Order No.12-1/92-Estt
(Part-III) Enquiry dated 11.07.2013 was issued to the concerned officers.
It was further noted that an appeal from both officers were received by the President, CCIM requesting to revoke the suspension. The President directed to
place the matter before Review Committee consisting of Dr. Prasanna N. Rao,
Member, Executive Committee, Dr. B.P. Pandey, Member, Executive Committee and Dr. H.M Chandola, Director, Chaudhary Brahm Prakash Ayurvedic Medical
College, Govt. of NCT of Delhi.
The meeting of Review Committee was held on 21.8.2013 at 11.00 AM in the office
of CCIM, New Delhi. The report of the meeting of Review Committee is suggested
that CCIM should depute a responsible person to followup the case and get the
report of said matter from the Police Deptt. at the earliest so that same may be placed before the Review Committee. It was further suggested to place the
developments regarding the case before the Executive Committee for information
and appropriate action. The minutes of both the review committee were seen by the members of the meeting.
It was further noted that as per information of AR (Siddha), the Notesheet in question in the matter is in possession of Dr.VP Tyagi, Ex-President, CCIM.
Executive Committee decided to set aside the suspension order dated
17.04.2013 and directed Dr. P.R. Sharma, Secretary and Ms. Kiran, O.S. to join the office with immediate effect pending the departmental enquiry
and criminal complaint.
EC further objected to the fact that official documents have been taken
away by the then President with him and decided that a letter be written
to Dr. Ved Prakash Tyagi to handover all the official document(s) in his possession to the office.
Agenda Item No. 3. Policy Decision for processing of the cases of ASU Colleges for grant/denial of permission for the
academic session 2013-14 in view of the new MSR
Regulations.
Government of India has forwarded a Policy decision vide letter No.
R.11011/10/2013-EP(IM-1) dated 19.08.2013 regarding relaxations as follows
while processing the recommendation of ISM Ayurved, Unani and Siddha Colleges.
1. The condition of maintaining the computerized records of patients in OPD/IPD as specified in sub-regulation (3) of regulation 7 of MSRs will be
exempted. However, the colleges will be asked to fulfill this requirement by
31st December, 2013. 2. Availability of requisite number of equipment and instruments as specified in
Schedule VII of MSRs will be relaxed by 50% of the total requirement.

However, the colleges will be asked to fulfill 90% of the total requirement of
equipment by 31st December, 2013. 3. Availability of part time teachers/consultants of Modern Medicine as
specified in the note of Schedules V of MSRs will be exempted.
4. Availability of Higher Faculties as specified in the Schedule V of MSRs will be
relaxed as follows: i. The colleges having intake capacity upto sixty seats shall have at
least 11 Higher faculty in Ayurveda & Siddha colleges and 09 Higher
Faculty in Unani colleges instead of 12 Higher Faculty (as specified in MSRs ) and stipulation regarding distribution of Higher faculty in
departments will be exempted.
ii. The colleges having intake capacity from sixty-one to hundred seats shall have at least 17 in Ayurveda & Siddha colleges and 15 Higher
Faculty in Unani colleges instead of 19 Higher Faculty (as specified in
MSRs ) and stipulation regarding distribution of Higher Faculty in
departments will be exempted. The CCIM is requested to take into consideration the above-mentioned policy
decision of the Central Government on these requirements while forwarding their
remaining recommendations and reports in respect of the ASU Colleges for grant/denial of permission for the academic session 2013-14. All other
requirements are to be taken into consideration as per the concerned MSRs and
UG/PG regulations for ASU colleges. The CCIM is further requested to finish their recommendations and reports of all ASU Colleges by 31st August, 2013 positively
so that the further processing of the cases for grant/denial of permission to the
ASU Colleges may be completed by the Department well in time”.
In this regard, it was noted that the remaining college(s) who were earlier
considered by Executive Committee on 06.08.2013 but have not been sent to
Govt. of India were re-assessed and the recommendation of some colleges are found to be changed on below:-

Agenda Item No. 4. To Issue letters in respect of Eligibility
of teachers
It was noted that a number of teachers in Ayurveda had been considered Ineligible
in the past due to various reasons. The matter was placed before the EC on its 171st meeting held on 19.07.2012 to decide policy and thereafter was placed
before 175th meeting of EC. The EC in its 175th meeting decided to authorize the

Vice-President (Ayurveda) to screen the list of teachers in respect of false teaching
experience. Therefore as per decision of EC the matter was placed before Vice-President
(Ayurveda), who screened the controversial teachers and gave recommendation in
respect of following teachers eventually approved by President, CCIM. Therefore as
per direction of President, CCIM the letters have been issued to the following teachers as under –

Agenda Item No. 5. Proposal for contribution of one day honorarium
from Members, for attending the meeting of CCIM, to the Relief Fund of Uttarakhand floods.
It was noted that the I/C President, CCIM has desired that an amount of one day
honorarium from members of CCIM for attending the meeting of Council be contributed in Relied Fund of Uttarakhand floods.

Executive Committee decided that one day honorarium from the members,
CCIM for attending forthcoming General Body meeting be contributed for Uttarakhand floods Relied Fund.
Agenda Item No. 6. Illegal action to help Shri Dhanwantri Ayurvedic
College at Chandigarh by Dr. Ved Prakesh Tyagi, President, CCIM, New Delhi.
It was noted that a letter has been received from Govt. of India, Deptt. of AYUSH in respect of illegal action to help Shri Dhanwantari Ayurvedic College at
Chandigarh by Dr. Ved Prakash Tyagi, President, CCIM and forwarding therewith
the copy of complaint received in Deptt. of AYUSH.
Further, Govt. has requested to carry out an enquiry in this regard and furnish the
comments to this Deptt. at the earliest.
The matter was placed before President I/C, CCIM. The President constituted a
Committee of following members to enquire the matter:-
1. Dr. Ashutosh Kulkarni Sumantro, Member, CCIM.
2. Dr. S.K. Sharma, Member, CCIM. 3. Dr. N.S. Tyagi, Member, CCIM.
Executive Committee noted the same and decided that in future no action
to be taken on any anonymous complaint. Agenda Item No. 7. To surrender the Guest House of CCIM at Flat No.
238, Sector-18B, Block- B, Dwarka New Delhi.
It was noted that Central Council has hired a guest house for the President, & Vice-
Presidents of CCIM in August, 2010 on a rent of Rs.32,000/- pm with 10% increase
of rent every year. It was further noted that as per rent agreement, one month prior notice is required to vacate the guest house. The guest house was in
possession of Central Council. However, the present President, CCIM directed not
to continue the guest house as he lives in Delhi itself and none of the Vice- Presidents ever stayed in the guest house. Therefore, the extra burden of
Rs.42,592/- pm on rent besides other expenditure of guest house is not desirable.
Accordingly as per his direction, one month notice vide letter No.15-03/13-
Accommodation dated 14.08.2013 has been issued to the owner of the guest house to surrender guest house.
Executive Committee ratified the action of the President, CCIM.
Agenda Item No. 8. Visitation Report is not received in respect of
Kalidas Ayurved College, Bademi.
It was noted that the report of Kalidas Ayurved College, Bademi is not received/not
traceable in the office of CCIM. Only album was submitted by hand by Dr. Hari
Ram Bhadoria, Member, CCIM is available. The college was visited by Dr. Hari Ram
Bhadoria, Dr. D. S. Bhadikar and Dr. Rakesh Goyal on dated 19-20.06.2013.

Executive Committee directed that the visitation report should be
searched once again thoroughly in the office of CCIM.
It was also decided that all the visitation reports should be received in the
office of Secretary, CCIM and the same day, inward report should be
entered in the respective register of the Diary/Dispatch Section of CCIM so that proper record of visitation reports could be maintained.
Agenda Item No. 9. Representations from various associations and
college administrations regarding ineligibility of
teachers assessed by the CCIM for denial of
permission to the ASU Colleges for the academic year 2013-14.
Government of India has forwarded a letter No. R.11011/07/2012-EP(IM-1) dated 21.08.2013 regarding Representations from various colleges:-
1. “These representations allege that the CCIM has adopted arbitrary
procedure in assessing the eligibility of teachers in ASU colleges resulting a large number of teachers being declared ineligibility who have been found
eligible during previous academic years by the CCIM and the Department.
2. It has also been observed in the initial recommendations received from the
CCIM that the Council has adopted many criteria for assessing the eligibility of teachers and most of these criteria are not included in any of the notified
Regulations of the CCIM like Minimum Standard Requirements Regulations
and Minimum Standard of Education Regulations for ASU Colleges. Further, the CCIM has neither discussed nor intimated to the Department about
these criteria in any discussions/meetings held with the Officials of the
Department and has also not mentioned in any communication sent to the Department.
3. It may also be noted that it has come to the notice of the Department that
the CCIM has issued a letter vide F. No. 26-74/2012 (Common matters)
dated 28.09.2012 to the ASU Colleges regarding submission of declaration form and approval of eligibility of teaching staff for the academic session
2013-14 wherein the CCIM has intimated to issue letter specifying eligibility
of teachers to the Colleges before inspection but the Council has reportedly not informed the Colleges about the list of eligible and non-eligible teachers
so far.
4. In view of the above, the CCIM is requested to look into the matter urgently
and intimate the decision of the Council regarding the criteria followed for eligibility/ ineligibility of the teachers for the academic session 2013-14 so
that the processing of the recommendations of the CCIM may be done
accordingly well in time”.
“In this regard, it was noted that a meeting was convened under the Chairmanship
of JS (AKG) on 14.08.2013 at 4:00 PM in the Department of AYUSH. Following officials from CCIM have attended the meeting-

The meeting was focused only on one Agenda i.e. issues related to
eligibility/ineligibility of Ayurved/Unani/Siddha teachers. JS (AKG) informed that a delegation of AYURVEDA colleges had met with
Secretary, Dept. of AYUSH and also given a representation to HFM on the issue
related to eligibility/ineligibility of teachers by CCIM. The Secretary, Deptt. of AYUSH took the matter seriously and directed to convene an urgent meeting to
discuss the issue with CCIM.
JS (AKG) then asked the details about the officials of CCIM behind this issue of
making teachers ineligible on various grounds and whether Central Council had discussed this issue with Govt. of India before making a large number of teachers
ineligible and creating fresh issues for Govt. of India.
On knowing the details that it was never consulted with Govt. of India and no clear cut policy was ever made before taking up this issue, JS (AKG) strongly objected
the criteria adopted by CCIM of considering the teachers ineligible without prior
consultation with Govt. of India as well as without any approved policy in the matter.
JS (AKG) also raised the issue of making even those teachers ineligible in the
current year who were earlier considered eligible by the CCIM for the post of
Prof./Reader/Lecturer as per their experience. JS (AKG) also showed his displeasure of checking the name of teachers in teaching
staff list in thereon records and making the teacher ineligible in current year
(2013-14). He also questioned the authenticity of records available in CCIM office before 2006 as it is not available with GOI. He further questioned the authenticity
of exercise done by CCIM in respect of “teachers’’ name not found in previous
college”. As in many cases, Teachers’ names were found in the records available with Dept. of AYUSH. Therefore the ground of not finding a name in teaching staff
list in a college is not well taken to make the teachers ineligible/eligible.
JS (AKG) also explained the problems faced by Dept. of AYUSH due to CCIM by
keeping the teachers eligibility pending and not clearing the issue of teachers’ ineligibility despite having hearing done of such teachers in the CCIM as well as
asking the declaration form of teachers from all colleges.
JS also asked CCIM why declaration forms have been called from all colleges when CCIM was not in a position to issue eligibility certificate to all teachers before
visitation.
JS (AKG) further directed to CCIM to relook the matter of teacher eligibility on top priority as this issue is creating a lot of problem from Department of AYUSH for
processing the recommendation of CCIM in respect of Colleges. He strongly took a
note in the matter and advised not to take any such step in future without prior
consultation of Department of AYUSH. He suggested CCIM to immediately resolve the issue by taking necessary steps such as:-

1. Teachers who had been considered eligible in the previous academic session
may be considered eligible for 2013-14 session unless strong evidence / reason found against him/her”.
2. The rank of the teacher can be lowered (from Professor to Reader to
Lecturer ) as per the teaching experience.
It was further noted that Central Council has made around 900 plus teachers
ineligible during past 4-5 years on various grounds. However, the matter was
placed before different meeting of Executive Committee on various occasion. Executive Committee authorized Vice-President (Ayurved) to decide the matter of
eligible/ineligible. Matter of few teachers had been examined by Vice-
President(Ay.)and approved by President, CCIM but later on many files were found in the office of President, I/C, CCIM. After going through these files, it has been
observed that President, CCIM had constituted two committees to screening the
teachers. One Committee consisted of Dr. Prasanna N. Rao and Dr. B.P. Pandey
and another committee consisted of Dr. Ragini Patil and Dr. Vishwajeet Singh. The details as found from these files are as below:-

Agenda Item No. 11. Regarding Retainer on Contract Basis
It was noted that for looking after the legal work regarding court cases and other
miscellaneous legal work of CCIM, 2 legal consultants/practicing advocate have
been engaged on contract basis for Rs. 35,000/ per month. In various High Courts various advocates are appointed to look after day to day proceedings before the
concerned courts with the remuneration of Rs. 12,000/per case. Besides, Mr.
Joseph was appointed as retainer for CCIM. The retainer ship amount paid to him monthly is Rs.25,000/-. Along with it he is being paid Rs. 500/- for drafting
Counter affidavit Rs. 5500/-+ T.A, D.A and other allowances are being provided to
retainer for outstation visits.
In this regard it was noted that the advocates appointed by the CCIM at the post of
Legal Consultants are fully qualified and are competent to handle the legal work of
the office of CCIM including drafting Counter Affidavits etc. Further both Legal Consultants can appear before Courts to represent CCIM. Hence at present there is
no need to hire a Retainer as it is not cost effective. In future also a post of
retainer is not required in the office, since advocates are already being appointed on full time basis as Legal Consultants.
Executive committee decided not to retain Mr. Joseph anymore and to call
off his contract with immediate effect.
Additional Agenda Item No. 1. Regarding payment of Medical bill of
Dr.Shuhabuddin, EC Member
It was noted that, as per decision of the EC on its 180th meeting, a cheque of Rs.
50,000 from the President, CCIM’s Relief Fund was sent to Dr.Shuhabuddin in

reference of his representation towards the medical expenses occurred during his
visit to attend the meeting at CCIM in the month of May, 2013.
Executive committee decided to give Rs.2 lakhs in total to Dr.Shuhabuddin
in installments depending on the availability of amount in the President,
CCIM’s Relief Fund.
At the end, President, CCIM informed all the members of Executive Committee that, he will claim only travel allowance not honorarium / sitting fee for attending
office of CCIM for day to day work unless there is a meeting in the Council for
which he will claim the honorarium alongwith travel allowance.
