    Regulations which is known as Occupational Safety andHealth (Control of Industrial Major Accident Hazards)

    Regulations 1996 is enforced on 1 February 1996.

    These Regulations apply to all industrial activities except :

    a nuclear installation

    an installation under the armed forces

    a vehicle or vessel transporting hazardous substance to or

    from the site of an industrial activity

    an industrial activity where quantity of hazardous

    substance equal or less than 10% of threshold

    quantity of hazardous substance(s).

    Competent Person an employee or person appointed by the manufacturer and who has

    been approved by the Director General to prepare a written report ;

    Further Relevant Information

    for the purpose of Schedule 3 means information which isnecessary for the assessment of the potential effects of a major

    accident and which, in the circumstances of the case :

    is reasonably required by the inquirer to assess the risks to his

    health and safety created by such an industrial accident and to

    know and understand what action he should take in the event of anaccident; and

    where the information is to be disclosed by a manufacturer, the

    information is such as it is reasonable for him to disclose having

    regard to the requirements of law and his commercial interests;

    Hazardous substance

    any substance which is within any criteria laid down in Schedule 1

    any substance listed in Part 1 of Schedule 2

    Industrial activity -

    an operation carried out in an industrial installation referred to in

    Schedule 4 involving one or more hazardous substances, andincludes on-site storage and on-site transport which are associatedwith the operation

    a storage of hazardous substances

    Local Authority any city council, municipal council, district council, town council,

    town board local council, rural board or other similar local authorityestablished by any written law and includes any authority in chargeof a Federal Territory established by any written law;

    Major Accident

    an occurrence including a major emission, fire or explosion resultingfrom uncontrolled development in the course of an industrial

    activity, which leads to serious danger to persons, whetherimmediate or delayed, inside or outside an installation, or to theenvironment, and involving one or more hazardous substance;

    Major Hazard Installation

    an industrial activity which produces, processes, handles, uses,disposes of or stores, permanently or temporarily, one ormore hazardous substances equal or exceed the thresholdquantity;

    Manufacturer

    an employer or occupier having control of an industrialactivity;

    Officer

    occupational safety and health officer appointed;

    Port Authority

    any port authority established under any written law;

    Preparation

    a mixture or solution of two or more substances;

    Site

    the whole of an area of land under the control of a manufacturerand includes a pier, jetty or similar structure, whether floating ornot; or

    a structure, whether floating on water or not, which is under thecontrol of a manufacturer;

    Threshold Quantity in relation to a given hazardous substance or a category(s) of

    hazardous substances, means the quantity(s) which is or are equal tothe amount set out in Schedule 2.

    Every manufacturer who undertakes an industrial activity shall: comply with the requirements of these Regulations;

    as soon as he becomes aware of an imminent danger, takeimmediate action to rectify the situation; and

    establish and maintain a good management system for

    controlling any major accident.

    Every employee shall:

    co-operate with the manufacturer in complying with therequirements of these Regulations;

    act to endanger himself or to cause bodily injury to himself orother persons or damage to life and property; and

    notify the manufacturer as soon as he becomes aware of anypotential hazard that is capable of generating a major accident andshall notify an officer of the potential hazard.

    Every manufacturer needs to identify an industrial activity

    within his control and submit to the Director General the

    Notification of Industrial Activity Form specified in the

    Schedule 5: within three months after the commencement of these

    Regulations in respect of an existing installation or an

    installation which is under construction; or

    in respect of a new installation after the commencementof these Regulations, within a month before the

    construction thereof.

    The authority will determine whether the installation:

    is a major hazard installation even though quantity of

    hazardous substance less than threshold quantity, if

    the authority feels that installation may cause a majoraccident.

    is not a major hazard installation even though equal

    or exceed threshold quantity, if the authority feels that

    installation is incapable of causing a major accident.

    **Any change of the status of installation shall benotified to the authority.

    This part shall apply to : an industrial activity in which there is involved, or is liable to

    be involved :-

    for a hazardous substance listed in Part 1 of Schedule 2,a quantity of the hazardous substance which is less thanthe threshold quantity specified therein; or

    for substances and preparations falling within acategory or categories specified in Part 2 of Schedule 2,a total quantity of the substances and preparations in

    the category or categories which is less thanthethreshold quantity specified therein and which is notdeterminedas a major hazard installation; and

    an installation which is determined as non-major hazardinstallation by the Director General.

    Need to do the following :

    identify possible major accident hazards

    show adequate steps taken to :

    prevent any major accident or minimize its consequences

    to people and the environment;

    provide people working on site with information,training and equipment necessary to ensure their

    safety; and

    prepare and keep up to date an adequate on-site emergency

    plan.

    ** The authority may request additional information or

    whatever required to demonstrate that installation is safeoperation.

    This part shall apply to :

    an industrial activity in which there is involved, or likely to beinvolved :

    for a hazardous substance listed in Part 1 of Schedule 2, a

    quantity of the hazardous substance which is equal to orexceed the threshold quantity specified therein; or

    for substances and preparations falling within acategory(s) specified in Part 2 of Schedule 2, a totalquantity of the substances and preparations in category(s)which is equal to or exceed the threshold quantityspecified therein and which is not determined as a non-major hazard installation;

    an industrial activity which is determined as a major hazard

    installation by the Director General.

    Require preparation of safety report by Competent Person.

    The manufacturer shall not undertake any industrial activity towhich this Part applies, unless he has consulted a Competent

    Person to prepare a written report containing the information

    specified in Schedule 6 and has sent a copy of the report at least

    three months before commencing that activity.

    Where the manufacturer has commenced an industrial activity

    before the commencement of these Regulations or has

    commenced construction of an industrial installation for the

    purpose of an industrial activity six months beforecommencement of these Regulations, the manufacturer shall

    send a copy of the report within twelve months of the date of

    the determination.

    Modification

    Any modification to the industrial activity to which the report

    relates which can materially affect the particulars in the report, a

    Competent Person must prepare a further written report and has

    sent a copy of the report to the Director General who will review

    it and direct the manufacturer to submit further information

    within such time as he may specify.

    The manufacturer shall be entitled to take urgent and remedial

    action with respect to an industrial activity in order to put an end

    to or prevent imminent danger to life or property.

    On-site Emergency Plan

    Required to submit an on-site and off-site emergency plan

    The manufacturer shall prepare and keep an up-to-date andadequate on-site emergency plan and include the name of theperson who is responsible for safety and the names of those

    who are authorized to take action in the event of anemergency.

    The manufacturer shall ensure that the on-site emergency planprepared is constantly updated and that every person on thesite who is affected by the plan is informed of its relevantprovisions.

    The manufacturer shall prepare and submit the on-siteemergency to the Director General at least three monthsbeforethe commencement of the industrial activity or withinthree months from the date of the determination for anindustrial activity which has been determined as a major

    hazard installation.

    Updating Review of an On-site Emergency

    Plan

    Where the manufacturer has prepared an on-site

    emergency plan and the industrial activity concerned is

    continuing, the manufacturer shall update the on-site

    emergency plan as part of the report.

    The Director General may review the on-site emergency

    plan submitted to him, and shall, if he is of the opinion

    that the plan submitted is not satisfactory, direct themanufacturer in writing to improve the emergency plan

    within such time as he may specify.

    Off-site Emergency Plan

    The manufacturer shall inform the local authority or port authority

    of that area that his industrial activity is considered capable ofproducing a major accident hazard and of the need for thepreparation of an off-site emergency plan for the area surroundinghis site.

    The manufacturer shall-

    inform the authorities within three months of thecommencement, or within three months of the date of thedetermination for an industrial activity which has beendetermined as a major hazard installation;

    provide the authorities with the information relating to the

    industrial activity under his control; and afford to the localauthority or port authority upon request all reasonable facilitiesneeded.

    The authorities may upon receiving the information prepare andkeep an up-to-date and adequate off-site emergency plan.

    Inform the Public

    The manufacturer has to ensure that persons outside the site who are

    likely to to be affected by a major accident occurring at the site, aresupplied with at least the information specified in Schedule 3.

    The manufacturer shall endeavour to enter into an agreement with

    the authorities to disseminate the information specified in Schedule 3 to

    the persons concerned but the manufacturer shall remain responsible

    for the accuracy, completeness and form of the information supplied. The manufacturer shall ensure that the information supplied is

    updated and re-supplied at appropriate intervals.

    The manufacturer shall take all necessary steps before commencingthe industrial activity except for an industrial activity which has

    already commenced before the commencement of these Regulations orwhich has been determined as a major hazard installation, it shall be a

    sufficient compliance if the manufacturer takes the necessary steps

    within six months after the commencement of the Regulations or fromthe date of the determination.

    Where a major accident occurs on a site, the manufacturer shallnotify the nearest occupational safety and health office of theaccident quickly shall provide :

    the following information relating to the accident as soon as itbecomes available :

    the circumstances of the accident;

    the hazardous substances involved;

    the date available for assessing the effects of the accident onpersons and the environment; and

    the emergency measures taken; and

    a statement of the steps envisaged to alleviate medium or longterm effects of the accident, and prevent the recurrence of such anaccident.

    The manufacturer who commits an offence against any of

    the provisions of these Regulations for which no

    corresponding penalty is provided by the Act shall, on

    conviction, be liable to a fine not exceeding RM50,000 orto an imprisonment of not more than two years or to both.

    Any employee who commits an offence against any of the

    provisions of these Regulations for which no corresponding

    penalty is provided by the Act shall, on conviction, be liable

    to a fine not exceeding RM1,000 or to an imprisonment of

    not more than three months or to both.

    Flammable Substances

    Flammable gases

    substances which in the gaseous state at normal pressureand mixed with air become flammable and the boiling

    point of which at normal pressure is 20 C or below;

    Highly flammable liquids

    substances which have a flash point lower than 21Cand the boiling point of which at normal pressure is

    above 20 C and;

    Flammable liquids

    substances which have a flash point lower than 5.5 Cand which remain liquid under pressure and whereunder particular processing conditions such as high

    pressure and high temperature, may create major

    accident hazards.

    Explosive Substances

    substances which may explode under the effect of flame or whichare more sensitive to shocks or friction than dinitrobenzene.

    Oxidizing Substances

    substances which give rise to highly exothermic reaction when incontact with other substances particularly flammable substances.

    For the purpose of this schedule:

    LD50 (oral) - a dose of a substance in mg/kg of body weight thatproduces death in 50% of a given experimental animal population;

    LD50 (cutaneous) - a dose of a substance in mg/kg of body weight

    that produces death in 50% of a given animal population; and

    LC50 - a concentration of a substance in air that is estimated toproduce death after inhalation for four hours in 50% of a givenexperimental animal population.

    Adequate information on the actions the population concernedshould take and on the behaviour they should adopt in the event ofan accident.

    Confirmation that the manufacturer is required to make adequatearrangements on site, including liaison with the emergency services,to deal with accidents and to minimise their effects.

    A reference to the off-site emergency plan drawn up if any tocope with any off-site effects from a major accident. This shallinclude advice to co-operate with any instruction or request fromthe emergency services at the time of a major accident.

    Information relating to every hazardous substance involved in theindustrial activity and its relevant quantity as listed in Schedule 2,namely :

    the name of the hazardous substance as given in Schedule 2 or, for ahazardous substance included under a general designation, the namecorresponding to the chemical formula of the hazardous substance;

    a general description of the analytical method available to themanufacturer in determining the presence of the hazardous substance or

    references to such methods in the scientific literature;

    a brief description of the hazards which may be created by the hazardoussubstance; and

    the degree of purity of the hazardous substance and the names of itsmain impurities and their percentages;

    a description of the measures taken to prevent, control orminimise the consequences of a major accident;

    information about the prevailing meteorological conditions inthe vicinity of the site;

    an estimate of the number of people on-site and off-site whomay be exposed to the hazards considered in the report; and

    the consequences to the surrounding areas in the form ofappropriate risk measures where possible.
