    2. This pertains to the conduct of CY 2016 Regular Promotion Program for

    Level Police Commissioned Officers (PC0s) and Police Non-Commissioned Officers (PNC0s)

    that shall be conducted in two cycles.

    3. The simplified requirements and process on promotion as a concept of the PNP

    Patrol Plan 2030 will be implemented in this promotion program. The Personnel

    Accounting and Information System (PAIS) record of the applicants in the Records

    Management Division (RMD), DPRM and PROs/NSUs shall be considered as the primary

    source of data for promotion and all other documentary requirements traditionally being

    required from the applicants should be updated in their PAIS PDS.

    4. The minimum Qualification Standards (QS) for each rank shall be based on

    NAPOLCOM Resolution No. 2013-501 as confirmed by CSC Resolution No. 1401222.

    2. PURPOSE:

    This Command Memorandum Circular (CMC) sets the policies, guidelines,

    and procedures governing the promotion of 2

    Level PCOs (PINSP to PSUPT) and

    PNCOs (P02 to SPO4) who satisfy the minimum qualification standards based on

    NAPOLCOM Resolution No. 2013-501 dated October 23, 2013 entitled: "Prescribing the

    Qualification Standards for Appointment to PNP Ranks" as confirmed by CSC

    Resolution No. 1401222 dated August 18, 2014.

    3. SITUATION:

    Consistent with the provisions of RA No. 6975, as amended by RA No. 8551

    and other pertinent laws, the PNP will enhance professionalism in its ranks through the

    institution of a promotion system giving equal opportunity to all qualified personnel using

    merit and fitness as the primary consideration.

    The simplified requirements and process on promotion as a concept of the

    PNP P.A.T.R.O.L. Plan 2030 will be implemented in this promotion program. The

    updated Personnel Accounting and Information System (PAIS) record of an applicant in

    the Records Management Division (RMD), DPRM and PROs/NSUs shall be considered

    as the primary source of data for promotion. All other unnecessary requirements have

    been eliminated.

    The promotional quota shall be based on the variance of approved vacancies

    per rank in order to maintain the pyramidal structure of the organization and to allow the

    upward movement of the personnel in the rank structure. For

    PCOs, there are 4,916

    available vacant positions, while for

    PNCOs, there are 38,848

    slots left with the total of

    43,764

    remaining vacancies to be distributed to various offices/units of the PNP that

    have negative variance in their rank structure.

    4. MISSION:

    The PNP shall implement a promotion program as a tool to enhance the

    efficiency and effectiveness of the organization by promoting only the best qualified

    personnel to various positions. The program will also enhance professionalism in ranks

    and improve their morale and welfare.

    5. OBJECTIVES:

    This CMC aims to achieve the following specific objectives:

    a.

    To enhance organizational efficiency and effectiveness;

    b.

    To promote the best qualified personnel;

    c.

    To provide transparency in the selection process;

    d.

    To enhance the morale and welfare of PNP personnel;

    e.

    To provide equal opportunity;

    f.

    To implement a competency based promotion;

    g.

    To empower the lower units (PROs, PPOs) to determine the best qualified

    personnel for promotion; and

    h.

    Provide a uniform standard in the selection and screening of candidates

    for promotion.

    6. GENERAL GUIDELINES AND POLICIES

    a. Computation of Promotional Vacancies/Quota.

    1) The promotional quota distribution for D-Staff and NSUs shall be

    based on the actual number of personnel of the offices/units vis-a-vis

    the rank identified in the DPL approved staffing pattern;

    2) The promotional quota distribution for PROs shall be based on the

    following:

    a)

    Police to Population Ratio;

    b)

    Personnel Filled-up based on percentage distribution in

    NAPOLCOM MC No. 2003-013;

    c)

    A 70% fill-up of personnel in all Public Safety Forces (PSF) (SAF,

    RPSB, PPSC, and others);

    d)

    70% of the total promotable PO1s to PO2s and PO2s to PO3s in all

    PSFs shall be promoted and 100% of the total promotable SPO1-

    SPO4 and PINSP- PCINSP in all PSF shall also be promoted for

    this year two promotional cycles ;

    e)

    Vacancies after the promotion; and

    f)

    Use of the following mathematical formula:

    P (Percentage) = B (Base) x R (Rate)

    Note: Percentage Total number of promotional vacancy

    Base Actual number of personnel

    Rate Percentage distribution per rank per NMC No. 2003-013

    3) The consideration in the distribution of promotion quota for the rank of

    P02 and P03 shall be determined by the following factors:

    a) Actual number of personnel on the said ranks;

    b)

    Authorized number of personnel per unit;

    c)

    The number of qualified candidates; and

    d)

    Other prevailing rules, policies, and guidelines.

    4) Once the promotion quota distribution is approved by the C,

    PNP,

    there shall be no additional quota allocation unless it is authorized and

    approved by the C,

    PNP.

    b. Processing of Promotion:

    The promotion boards and committees shall only process the

    promotion of those who satisfy the minimum qualification standards for

    appointment to

    PNP

    ranks based on

    CSC Resolution No. 1401222 and

    NAPOLCOM Resolution No. 2013-501.

    1)

    PINSP to PSU PT

    The initial processing and evaluation shall be done

    by the different PCO Promotion Committees at the PROs/NSUs. These

    Committees will then submit their recommendees to the appropriate

    NHQ PCO Promotion Board for confirmation. Applicants to the rank of

    PINSP who are based at NHQ, PNP shall apply directly to the

    PINSP Promotion Board provided that they shall be endorsed by their

    respective Director/Chief of Office; and

    2)

    P02 to SPO4

    The promotion of PNCOs shall be processed and

    evaluated by the PNCO Promotion Boards at their respective units to

    wit:

    NHQ PNCO Promotion Board

    for those based at NHQ,

    PNP,

    NSU PNCO Promotion Board

    for those assigned in the different

    NSUs,

    PRO PNCO Promotion Boards

    for those assigned in the

    different PROs, and

    District PNCO Promotion Committee

    for those

    assigned in the NCR Districts.

    3)

    The cut-off of counting of Time-In- Grade and effective date of

    appointment for this promotion program for first cycle will be on

    June

    30, 2016.

    4)

    The

    Calendar of Activities

    is attached and referred to as

    Annex "A".

    c. Creation of Promotion Board/Committee/Secretariat:

    The Promotion Board and Committee shall be activated in this

    promotion program. The following is the composition of the

    Board/Committee.

    1)

    Promotion Board and Committee Composition: (Refer to Annex

    1373)

    2)

    Power/Authority of the Board/Committee

    a)

    The Board/Committee exercising administrative and quasi-judicial

    functions is clothed with the power and authority to dispose its

    duties and responsibilities within the bounds and limits provided by

    the rules;

    b)

    The Board/Committee shall not be deprived of its power and

    authority conferred by law and in the exercise of its sound

    discretion unless it unlawfully exceeds thereof and/or such is being

    exercised arbitrarily or in hostility and/or for grave abuse of

    discretion amounting to lack or excess of jurisdiction; and

    c) In case of tie after the result of the interview and deliberation, the

    Board/Committee shall give priority to the most senior qualified

    candidates for promotion, based on the Seniority Lineal List from

    the Records Management Division, DPRM.

    3) Functions

    The Promotion Board shall have the following functions:

    a)

    Review and deliberate the resolutions and worksheets submitted by

    the PRO/NSU Promotion Committees;

    b)

    Re-evaluate the qualifications of the candidates. When deemed

    necessary, the board may conduct verifications or direct

    subordinate units to conduct discreet investigation of candidates;

    c)

    Approval/Sign of Final Promotion Resolution and Worksheet

    presented by the secretariat; and

    d)

    After review, screening and deliberation, the NHQ Promotion Board

    shall thereafter recommend to the CPNP the approval of the

    Resolution and the issuance of orders to the recommended

    candidates for promotion.

    4) Secretariat

    A Secretariat shall be created at the NHQ, PROs and NSUs. The

    DPRM, Chief, RPHRDD and Chief, ARMD shall issue orders on the

    designation of the chairperson/members of the secretariat at the start

    of every promotion cycle with the following functions:

    a)

    Accepts, review, scrutinize, screen all submitted folders and

    evaluates the qualifications of candidates based on established

    CSC/NAPOLCOM/PNP guidelines and issuances; and

    b)

    Prepares worksheet and resolutions which shall be presented to

    the Promotion Committee/Board for their approval and signature.

    d. Procedures

    The following is the step by step procedures that shall be strictly observed

    in the processing of promotion:

    1) Phase 1. Preparation

    a) Step 1

    The Directorate for Personnel and Records Management (DPRM)

    shall cause the preparation and approval of the following:

    a.1) Determination of promotional vacancies;

    a.2) Authority to fill-up vacancies for approval of the CPNP and

    NAPOLCOM;

    a.3) Request for Promotion Funds;

    a.4)

    Publication of promotional vacancies to CSC;

    a.5) Distribution of Promotion Quota per unit;

    a.6) Activation of Promotion Board and Committees;

    a.7) Annual calendar of activities; and

    a.8) Other related preparations and activities.

    b) Step 2

    After completing the general preparation, the RSD, DPRM shall

    issue the Notice of Promotion, which shall contain the following:

    b.1) Guidelines on Promotion;

    b.2)

    Calendar of Activities;

    b.3)

    Promotion Quota Distribution (Annex "C");

    and

    b.4)

    Other related administrative announcements.

    c) Step 3

    c.1)

    For PROs, NSUs and IAS

    The RPHRDD/ARMD shall activate the Promotion Board,

    Committee, and Secretariat at their respective office/unit.

    The Secretariat shall generate the initial list of promotable

    personnel from their PAIS record based on the following

    criteria:

    c.1.a) Time-in-grade;

    c.1. b) Education;

    c.1.c) Training;

    c.1.d) Eligibility;

    c.1.e) Records of criminal case/s; and

    c.1.f) Other related criteria.

    c.2) For the NHQ

    The DPRM shall activate the

    NHQ

    Promotion Boards and

    secretariats. RSD, DPRM shall generate the initial list of

    promotable personnel assigned at NHQ from the RMD, PAIS

    record based on the following criteria:

    c.2.a) Time-in-grade;

    c.2.b) Education;

    c.2.c) Training;

    c.2.d) Eligibility;

    c.2.e) Records of criminal case/s; and

    c.2.f) Other related criteria.

    d) Step 4

    The Secretariat through the Administrative Officers shall compile

    the PAIS Generated PDS of all identified qualified candidates. They

    shall forward the PDS together with the Affidavit of Undertaking

    Forms to be accomplished and signed by the applicants. They shall

    also advise the candidates to attach/submit records of criminal

    case/s if applicable.

    2) Phase 2. Screening

    a) Step 1

    a.1)

    The screening, assessment, and evaluation of application for

    promotion shall be done continuously by the Promotion

    Committee and Promotion Board at the NHQ, PROs, NSUs,

    and IAS (refer to Annex "D"-

    Assessment Criteria).

    a.2)

    The adjustment of scheduled timeline and/or change of

    deadline in the submission of minimum mandatory and

    collateral requirements shall not in any way affect the cut-off

    or reckoning date of minimum mandatory qualification

    standards (four QS) and other collateral requirements for

    promotion already set by the DPRM.

    a.3)

    The designated Secretariat at the NHQ, PROs, NSUs, and

    IAS shall be in charge in the preparation, acceptance,

    screening, assessment, and evaluation of all promotion

    applications. It shall strictly scrutinize the following

    mandatory qualifications and collateral requirements of

    candidates for promotion. Application folders of applicants

    should contain an updated PAIS PDS with the following:

    a.3.a) Minimum Mandatory Qualification

    Requirements:

    a.3.a.1) TIG/Experience;

    a.3.a.2) Education;

    a.3.a.3) Mandatory Training; and

    a.3.a.4) Eligibility;

    a.3.b) Collateral Requirements:

    a.3. b. 1 ) Rank Seniority;

    a.3.b.2) Awards on Present Rank;

    a.3.b.3) IPER;

    a.3. b.4) Interview;

    a.3.b.5) Tenure in T.O. Position;

    a.3.b.6) Drug Test;

    a.3.b.7) PPE;

    a.3.b.8) E-Learning;

    a.3.b.9) NBI;

    a.3.b.10) Specialized training/experience for personnel

    assigned to Public Safety Forces as indicated

    in para 7(i) on the disqualification for

    promotion;

    a.3.b.11) For applicants from Public Safety Forces,

    execute an affidavit of undertaking of

    willingness to stay for a minimum of two years

    before seeking for transfer/reassignment/detail

    to other unit after the promotion; and

    a.3.b.12) Other requirements set by the Board.

    a.4)

    For SPO4 applying for promotion to PINSP, the following

    Collateral Requirements

    shall be strictly complied:

    a.4.a) Must have been designated in a supervisory position

    for a period of at least six months, such as ESPO, Chief

    Clerk, or Team Leader among others (i.e. for

    administrative, operational and investigation functions

    such as Detachment, Outpost/PCP, Traffic Section

    etc.); and

    a.4.b) There shall be a mandatory interview for promotion in

    order to physically account the applicant and ascertain

    his/her competence and aptitude to communicate his

    views and ideas as expected of a Police Commissioned

    Officer (PCO).

    The Board/Committee may require other requirements

    like SLL which it deems necessary to break the

    deadlock and support its evaluation and deliberation of

    the qualified candidates to be promoted to the next

    rank.

    a.5)

    Interview of NSU promotion applicants assigned in PROs,

    shall be accommodated by the PCO Promotion

    Committee/PNCO Promotion Board in the area to avoid

    expenses on travel on the part of the applicants. Further,

    Interview Evaluation Ratings shall be transmitted to the

    respective NSU PCO Promotion Committee and PNCO

    Promotion Board for consolidation and preparation of

    worksheets and resolution.

    a.6)

    The Admin personnel of the Command Group, D-Staff, and

    P-Staff at the NHQ shall be in charge in the preparation,

    screening, and evaluation of all promotion applications prior

    to the signature of their respective Head of Office. The list of

    the qualified promotees shall be submitted to the NHQ

    Secretariat (Attn: C, Promotion Section, RSD, DPRM) for

    endorsement to the Board for final deliberation and approval.

    a.7)

    The Promotion Secretariat at the PROs, NSUs, IAS, and

    Admin Officers at the NHQ (Command Group, D-Staff, and

    P-Staff) shall only require from the applicants the following

    documentary requirements (Folder A for PNP copy and

    Folder B for CSC attestation).

    a.7.a) PNP Requirements for Promotion (Folder A):

    a.7.a.1) Checklist of requirements for promotion (see

    Annex "E");

    a.7.a.2) Application for Promotion and Affidavit of

    Undertaking;

    a.7.a.2) Updated PNP PAIS Generated PDS;

    a.7.a.3) Certification from the Court and Quasi-

    Judicial Body. (For those with pending

    criminal/administrative case/s only); and

    a.7.a.4) NBI.

    a.7.b) CSC Requirements for Attestation (Folder B):

    a.7.b.1) CSC PDS (Revised 2005);

    a.7.b.2) Authenticated Proof of Eligibility;

    a.7.b.3) Authenticated Proof of Mandatory Training

    from PPSC (Certificate of Completion,

    Declaration of Graduates and Final Order of

    Merit); and

    a.7.b.4) Authenticated KSS/Attested Appointment of

    Present Rank.

    a.8) The notarized affidavit of undertaking for promotion shall be

    duly certified, signed, and acknowledged by the candidates

    as to the validity, correctness, and truthfulness of the entries

    therein and in his/her PAIS Generated PDS. Any violation

    thereof shall constitute a ground for the automatic

    nullification of promotion and KSS attestation of applicant

    and the institution of corresponding administrative and

    criminal action.

    a.9) Once the generated list of qualified candidates at the NHQ,

    PROs, NSUs, and IAS shall have been properly assessed,

    the following personnel action shall be observed:

    a.9.a) The worksheets, resolution, and other allied

    documents shall be endorsed for signature of the

    members of the Promotion Committee or of the Board

    as the case maybe prior to the approval of the

    appropriate appointing authority;

    a.9.b) For the promotion of PNCOs at the PROs, NSUs, and

    IAS, the documents required shall be endorsed by the

    Secretariat to the PROs/NSUs Promotion Committee

    for signature prior to approval of the appointing

    authority; and

    a.9.c) For PCOs, the Promotion Committees at the PROs,

    NSUs, and IAS shall endorse the documents required

    to the appropriate appointing authority for action.

    b)

    Step 2

    The C, RPHRDD/ARMD and RSD, DPRM shall advise all

    candidates to undergo PPE and Drug Test. They shall also advise

    HS and CLG to prepare for the activities. HS and CLG shall forward

    the PPE and Drug Test results to the appropriate promotion

    secretariats.

    c) Step 3

    The Promotion Secretariats shall prepare the Promotion

    Worksheets. They shall accomplish two separate worksheets, one

    for the candidates without criminal case/s and a separate

    worksheet for candidates with criminal case/s following the

    prescribed format (DPRM Form RSD-03-B).

    d)

    Step 4

    The Promotion Committees at the PROs, NSUs, IAS, and

    secretariat at NHQ shall conduct the initial evaluation/screening of

    all identified candidates for promotion. A representative from the

    NAPOLCOM shall be invited as member of the board/committee.

    The following activities shall be conducted:

    d.1)

    Examination/review of the results of PPE and Drug Test;

    d.2)

    Examination and review of Qualification Standards;

    d.3) Examination and review of records of criminal case/s;

    d.4)

    Interview of candidates if necessary (Interview is mandatory

    for all candidates for promotion to PINSP and PSUPT);

    d.5)

    Preparation and signing of Promotion Worksheets and

    Resolution;

    d.6)

    Preparation of the Certificate of Due Diligence (DPRM Form

    RSD-03-C (

    Annex "F"

    ); and

    d.7)

    Forward Resolution and Worksheet to the promotion

    board/committee for deliberation and confirmation.

    d.8) Drug Test and Work Behavior and Performance Appraisal

    (WBPA) (May to June 2016).

    3) Phase 3. Board Deliberation

    a) Step 1

    The Secretariat shall convene the NHQ Promotion Board

    and the following activities shall be conducted:

    a.1) Final Examination/review of the results of PPE and Drug

    Test;

    a.2)

    Final Examination and review of Qualification Standards;

    a.3) Final Examination and review of records of criminal case/s;

    a.4) Final Interview of candidates if necessary (Interview is

    mandatory for all candidates for promotion to PINSP and

    PSUPT); and

    a.5)

    Preparation and signing of Promotion Worksheet and

    Resolution.

    4) Phase 4. Promotion Orders, Appointment and Attestation

    a)

    STEP 1

    The Secretariat shall prepare the final recommendation for

    promotion to the appointing authority through TDPRM, C,

    RPHRDD, and C, ARMD.

    b)

    STEP 2

    The Appointing Authority shall approve or disapprove the

    recommendation for promotion submitted by the different promotion

    boards. If the Appointing Authority disapproves the

    recommendation, he/she should cite clearly and convincingly the

    errors, mistakes, and the grounds relied therefrom.

    c)

    STEP 3

    DPRM, RPHRDD, ARMD, and Admin Office of IAS shall

    issue and publish the appointment orders. They shall also forward

    the Attestation Folders to the appropriate CSC Field Office.

    The Admin Officers shall ensure that the promotional folder

    for appointment and attestation will be forwarded to the Civil

    Service Commission within 30 days from the signing of the

    promotion orders by the appointing authority.

    d)

    STEP 4

    DPRM, RPHRDD, ARMD shall initiate the conduct of the

    Mass Oath Taking and Donning of ranks.

    e. Timelines

    The specific timelines in this promotion program in accordance with

    the foregoing phases of promotion are as follows:

    1) General Preparation and Dissemination (First Semester, March 2016

    to June 2016) (Second Semester, July 2016 to December 2016).

    a) The Initial List of PCOs and PNCOs Qualified for Promotion shall

    be generated by the Personnel Accounting and Information System

    (PAIS) of the Records Management Division, DPRM/PAIS Section

    of PROs and NSUs using available data;

    b)

    C, RPHRDD/ARMD/Admin/Personnel Officers shall inform and

    require all personnel listed in the initial list to fill-up application form

    and undertaking;

    c)

    PROs and NSUs shall conduct their own inventory of promotable

    2n d

    Level PCOs and PNCOs and render report of inventory to

    DPRM (Attn: C, RSD) NLT March of 2016 for First Semester; and

    d)

    The DPRM, through the CSC, shall cause the publication of

    promotional vacancies as required under Republic Act No. 7041

    (Publication Law) within ten working days.

    2) Activation of Promotion Boards/Committees and Secretariats,

    Submission of Requirements/Acceptance of Applicants, Screening and

    Evaluation of Qualification Standards, Interview, and Other

    Requirements (First semester, April 2016- June 2016 and Second

    Semester, September to December 2016).

    a)

    The NHQ, PRO and NSU Promotion Boards and Committees for

    2n d level PCOs and PNCOs shall be activated

    upon approval of

    the CY 2016 Quota.

    The Chairman shall immediately convene their

    respective Boards or Committees upon receipt of designation

    orders;

    b)

    The DPRM/RPHRDD/ARMD shall generate the Initial List of

    Candidates for Promotion. Applicants who have satisfied the

    minimum qualification standards but are not included in the list shall

    submit relevant documents to their respective Admin Office in order

    to update their PAIS record;

    c)

    The Secretariat shall check the accuracy and authenticity of the

    documents submitted and confirm the entries contained in the

    Service Record, PDS/General Information Sheet of PCOs/PNCOs

    included in the Initial List of Candidates for Promotion;

    d)

    The Secretariat shall prepare the corrected list of candidates for

    promotion for evaluation by the Board/Committee. Once approved

    by the Board, the Updated List of Candidates for Promotion shall be

    published;

    e)

    During this period, the Secretariat shall prepare the promotion

    worksheet of the candidates. The standard format of worksheet for

    evaluation and screening of applicants is shown in

    Annex "G"-

    Promotion Worksheet;

    f)

    Technical PCOs and PNCOs who are on detail with other office/unit

    shall be processed by their respective mother unit. They shall not

    be allowed to be promoted in the office where they are detailed;

    g)

    The new Affidavit of Undertaking for Promotion

    (DPRM Form RSD-

    03-A Revised 2015- Annex "H")

    shall be adopted in this

    promotion program. Any alteration, modification or amendments in

    the content of the affidavit is not allowed. Any personnel who

    violates thereof shall be disqualified. It is mandatory for candidates

    with pending criminal/administrative case/s to attach the

    certification on the status of their case/s;

    h)

    Candidates for PSUPT are prohibited for transfer six months after

    promotion except when he/she has served the T.O. position for

    PSUPT for not less than six months prior to the effectivity of

    promotion which shall retroact to similarly situated cases;

    i)

    Police Non-Commissioned Officers personnel on detail outside the

    PNP, who meet the minimum qualifications for promotion, shall be

    considered for promotion without being recalled to his/her

    unit of

    appointment. Once promoted, the concerned PNP uniformed

    personnel may continue his/her detailed with the same Office

    provided that his/her designation is commensurate to his/her rank

    and the functions are related to law enforcement. Provided, further,

    that the continuance of detail shall be subject to the discretion of

    the head of mother unit, with its personnel requirement as primary

    consideration;

    PNP uniformed personnel who are on UN missions shall be

    considered for promotion on the condition that they are qualified

    and favorably endorsed by their respective Contingent Head

    through the Directorate for Plans; and

    k) When the PNP personnel with pending appeal/grievance or

    complaint for promotion have filed an application for promotion,

    his/her pending appeal/grievance or complaint, shall be moot and

    academic and it is deemed a waiver of his/her right of action to

    appeal. Any initiatory action relative thereto shall be dismissed.

    1) Computation of Time-In-Grade/Experience

    The following shall be the basis in the computation of

    experience/time-in-grade requirements for promotion of candidates:

    1.1) he computation of TIG/Experience shall be reckoned from

    the date of appointment by the appointing authority of

    Komisyon ng Serbisyong Sibil (KSS) porma bilang 33,

    whether such appointment is

    "permanent" or "temporary";

    1.2)

    he cumulative period of AWOL, DFR and suspension

    incurred by a candidate in his/her present rank shall be

    deducted from his/her TIG; except if the candidate was

    exonerated of the charge/s or was not meted with any

    administrative penalty (i.e. suspension, forfeiture of pay,

    reprimand, among others) expressly provided in the order,

    as a consequence of the AWOL or after being dropped from

    the rolls or any other grounds;

    1.3)

    he TIG of a candidate who was demoted or reverted to

    previous rank shall be reckoned from the date of his/her

    permanent appointment in the effective date of the order of

    such demotion or reversion; and

    1.4)

    he counting of TIG/Experience of applicants who were

    promoted in CY 2004 or earlier shall be reckoned from the

    date of effectivity indicated in the promotion orders.

    However, should the attestation of promotion was complied

    with only after December 31, 2010, the counting of

    TIG/Experience shall be reckoned from the date of

    compliance or the order of approved KSS attestation

    pursuant to NAPOLCOM Resolution No. 2007-540 dated

    December 11, 2007 and NAPOLCOM MC No. 2008-008

    dated May 5, 2008.

    m) Interview Evaluation - (Please refer to

    Annex "I").

    3) Drug Test & Work Behavior & Performance Appraisal (WBPA) (First

    Semester, June 2016 and Second Semester December 2016).

    a)

    Candidates who passed the screening process and were found to

    have possessed the mandatory and collateral requirements shall

    undergo drug test to ensure that they are free from use of any

    prohibited or regulated drugs [Sec.33 (a) RA No. 8551]. Those who

    will be found positive for illegal substances shall be disqualified and

    a corresponding case shall be instituted to determine his/her

    administrative liability; and

    b)

    Candidates who will pass the drug test shall proceed to the Work

    Behavior and Performance Appraisal (WBPA) at the PNP Health

    Service [Sec.33 (a) RA No. 8551]. Any candidate who will have a

    remark of "Not Recommended"

    in the WBPA will be disqualified

    for promotion.

    4) NHQ (D-Staff/P-Staff), PRO, and NSU PNCO Board Deliberation (First

    Semester, June 1-30, 2016 and Second Semester, December 2016).

    a) For PNCOs

    a.1) Upon completion of processing, the Head Secretariat of the

    PNCO Promotion Board shall submit a formal report and

    confer with the concerned Committee/Board for evaluation

    and pre-deliberation conference before the conduct of final

    deliberation. The District PNCO Promotion Committees shall

    do the same to the NCRPO PNCO Promotion Board/PCO

    Promotion Committee;

    a.2)

    The Secretariat shall prepare the final promotion resolution

    and worksheet in two separate lists, (a) the Clean List and (b)

    Personnel who have pending criminal and administrative

    case/s;

    a.3)

    All worksheets and board resolutions must be presented to the

    concerned Board

    en banc

    for final deliberation, approval, and

    signature. These documents must be signed by the Chairman,

    NAPOLCOM representative and majority of the members at

    the end of the Final Deliberation;

    a.4)

    All Promotion Board/Committee shall submit Certificate of Due

    Diligence (DPRM Form RSD-03-C) duly approved by the

    Chairman, Promotion Board/Committee;

    a.5)

    The C, RPHRDD/C, ARMD shall prepare the appointment

    (KSS Porma BIg. 33) of all recommendees, the number of

    which shall not exceed the approved quota for signature of the

    Chairman immediately after approval of the final list and

    signing of the Board Resolution; and

    a.6)

    Final results of deliberation must be submitted to the RSD,

    DPRM

    b) For PCOs

    The final promotion worksheets and resolutions of the PCO

    Promotion Committee in two copies shall be signed by the

    Chairman and all members, approved by the office/unit Director

    and submitted to this Directorate (Attn: RSD) in soft and hard

    copies not later than

    June 30, 2016

    to give ample time for the

    appropriate PCO Promotion Board at the NHQ to review,

    deliberate, and issue confirmatory action.

    5) Final NHQ Promotion Board Deliberation and Issuance of Promotion

    Orders (June 16-30 to July 1-31, 2016).

    a)

    The PCO Promotion Board at the NHQ shall review, evaluate,

    deliberate, and issue confirmatory action through a Board

    Resolution from the recommendation submitted by different

    PRO/NSU PCO Promotion Committee;

    b)

    The Chief, Promotion Section, RSD shall prepare the endorsement

    of the different Board Resolutions recommending the promotion of

    qualified PCOs and NHQ-based PNCOs to the 010, PNP for his

    approval. In the case of PNCOs, the PRO/NSU Promotion Boards

    shall submit their recommendation to their respective Directors;

    c)

    The promotion orders (General/Special Orders) shall be published

    once the appointment papers of the promotees are received and

    officially acknowledged by the CSC; and

    d)

    For this promotion program, the effective date of promotion is

    June

    30, 2016.

    e)

    Simultaneous Mass Oath Taking and Donning of Ranks.

    f)

    The schedule of simultaneous mass oath-taking and donning of

    ranks for all promoted personnel will be held on

    July 25, 2016

    right

    after the Flag Raising Ceremony.

    g)

    Chiefs of Offices/Units are directed to submit After Activity Report

    to DPRM (Attn: C, RSD) on the conduct of the donning of ranks on

    or before July 29, 2016.

    7. DISQUALIFICATIONS FOR PROMOTION:

    a.

    Those who are already 55 years old or has less than one year of police

    service upon the effectivity of promotion order as provided in Sec. 25 of

    R.A. No. 8551 or who has filed an optional or an order of retirement was

    issued under the principle of one year bar rule;

    b.

    Those who have pending criminal cases (with Information) filed in

    Court/Sandiganbayan for less than two years counting from the date it

    was filed in regular court with "crime/s including, but not limited to a

    violation of human rights punishable by reclusion perpetua or life

    imprisonment and the court has determined that the evidence of guilt is

    strong," subject to the provisions of RA No. 9708;

    c.

    Those who are serving penalty of suspension during the promotion

    program (April 1, 2016 to June 30, 2016) Rule 22 section 6 (b) of

    NAPOLCOM MC No. 2007-001;

    d.

    Those who have filed their optional retirement and Total Permanent

    Physical Disability, the effectivity date of which will fall under the one year

    prohibition period. Should such have been uncovered after the personnel

    were already promoted, the promotion order and the KSS attestation shall

    be recalled. The salary paid to the personnel corresponding to the rank

    adjusted shall be deducted from his/her retirement benefits;

    e.

    Those who were detained or incarcerated by virtue of the order of the

    court, regardless of whether or not the resolution would result in

    exoneration and the dismissal of the case is held in favor of the personnel.

    The cumulative period of detention shall be deducted from the

    computation of his/her TIG and his/her leave of absence is without pay.

    However, the period covered by approved leave with pay of personnel

    who are under detention shall be included in the TIG;

    f.

    Those who have ratings lower than Very Satisfactory (VS) in any of the

    past two rating periods, or those who have no IPER as required in Rule VI,

    Section 5 (a) of the Omnibus Rules Implementing Executive Order No.

    292 of the Civil Service Commission;

    9. Those rated Poor in his/her performance evaluation rating (PER) caused

    by excessive Demerits for the period covered (NAPOLCOM

    MEMORANDUM No 2010-003 sec 9 para (a);

    h.

    Those who failed to take or failed to pass the current Physical Fitness

    Tests (PFTs) or Annual Physical Examination (APE) for 40 years old and

    below without valid and acceptable reason supported by medical

    certificate as validated and recommended by the PNP Health Service;

    i.

    Those personnel in PSF who do not have any of the following specialized

    trainings not performing ISO duties/functions (Commando, Scout Ranger,

    Special Forces, PNP Scout and the likes);

    j.

    Those who were restored to full duty status after serving more than 30

    days suspension, unless they are designated to an administrative or

    operational duty for at six months upon effectivity of restoration order;

    k.

    Those who were reinstated to full active duty upon separation from the

    service due to dismissal, DFR or any other grounds, unless they are

    designated to an administrative or operational duties for at least six

    months upon effectivity of the order of reinstatement;

    I. Those technical service PCOs who were originally commissioned and

    detailed outside their unit and/or appointed in the technical service unit but

    presently assigned, designated, and/or occupying positions exclusively for

    the line officers shall only be allowed to apply for promotion, in the

    technical service unit where they were originally commissioned and/or

    appointed. Except, those technical PCOs who were allowed, justified, and

    approved by the C, PNP to occupy line positions;

    8. COMPLAINTS AND GRIEVANCES:

    PNP personnel are encouraged to file a petition for grievance if he/she feels

    that he/she was not given equal opportunity and was not treated fairly in the selection of

    candidates for promotion. The following shall be observed in the filing of promotional

    protests, complaints and the disposition thereof:

    a.

    Composition of Grievance Committee

    The Composition of Grievance Committee shall be the same as the

    composition of the promotion Board/Committee referred in Annex "B" thereof.

    b.

    Procedures in Grievance

    1) All protests and complaints subject of grievance shall be resolved and

    decided in accordance with the provision of PNP Circular No. 2008-

    016 on the Policy Grievance Mechanism for the PNP Uniformed

    Personnel. However, since no specific provision is prescribed for

    complaints/grievance on promotion, said PNP Circular shall be

    suppletory in application to this CMC;

    2) Protest/grievance or complaint shall be submitted by an aggrieved

    candidate to the PROs/NSUs Promotion Committee (for PCOs) and

    PROs/NSUs Promotion Board (for PNCOs). It shall be in writing

    accompanied by formal evidence and filed directly to the Promotion

    Committee/Board at the PROs/NSUs within five days after release of

    the promotion order;

    3) The PROs/NSUs Promotion Board/Committee shall resolve the

    protest/grievance or complaint within ten (10) days from receipt,

    otherwise, the complainant may elevate his complaint to the NHQ

    Promotion Board;

    4) The candidate may appeal the resolution of the PROs/NSUs

    Promotion Board/Committee before the NHQ Promotion Board within

    five (5) days upon receipt of the adverse decision. The NHQ Promotion

    Board shall have fifteen (15) days within which to resolve the

    appeal/complaint;

    5) The protest/grievance or complaint shall not be relegated to the NHQ

    Promotion Board without the final resolution or disposition of the

    PROs/NSUs Promotion Board/Committee unless the ten (10) day

    period as provided in item 3 above has already lapsed without the

    PROs/NSUs Board/Committee having resolved the protest/grievance

    or complaint;

    6) The PROs/NSUs Promotion Board/Committee shall not pass upon the

    merits of the protest/grievance or complaint unless it is based on any

    of the grounds as provided in item 7 below. The complainant has the

    burden of proving that any of the grounds exists;

    7) Protests/complaints shall only be entertained if these pertain and arose

    from the wrongful application and non-implementation and/or violation

    of policies and procedures on promotion which affect the PNP

    uniformed personnel to include other related causes such as the

    following:

    a)

    Conduct of the evaluation and screening of applicants;

    b)

    Application of the rating system in ranks with "limited quota";

    c)

    Actual computation of ratings; and

    d)

    Grave abuse of discretion.

    8) The decision of the PROs/NSUs Promotion Board/Committee shall be

    in the form of a memorandum duly signed by the Chairman Promotion

    Board/Committee and/or in a Resolution form, if it requires matters

    involving the approval of the en banc;

    9) In the event that the PROs/NSUs Promotion Board/Committee or the

    NHQ

    Promotion Board, as the case maybe, finds the protest/grievance

    or complaint in order, the concerned Promotion Board/Committee shall

    immediately inform the appointing authority of its decision and make

    the necessary adjustments in its recommendation for promotion in

    case of favorable decision; and

    10)The protest, grievance, complaint, or appeal must be filed and brought

    before the appropriate body within the reglementary period, otherwise

    it will be dismissed by virtue of laches or for being filed out of time; and

    c. Tasks:

    The following are the tasks of offices/units in the implementation of this

    CMC:

    deliberation and assessment of PCOs recommended for promotion;

    e)

    Issue Special Orders announcing the promotion of PNCOs after the

    endorsement of their appointments (KSS Form 33) to the CSC; and

    f)

    Perform other tasks as directed.

    14)C, RPHRDDs/C, ARMDs and C, Attestation Section DPRM

    a)

    Shall be responsible in the submission of Civil Service

    requirements for attestation of appointments of qualified applicants;

    b)

    For PCOs and PNCOs at the NHQ, the requirements for attestation

    shall be submitted by the C, Attestation Section DPRM to CSC

    Crame Field Office;

    c)

    The Chairman of Promotion Board shall sign the Personnel

    Selection Board portion of the KSS Porma Blg. 33;

    d)

    The Chief, RPHRDDs/Chief, ARMDs/Administrative Officers shall

    see to it that all appointment papers (KSS Porma Blg. 33) of their

    personnel are submitted to the CSC on time; and

    e)

    The promotion orders (General/Special Orders) shall be published

    only after the appointment papers of the promotees are received

    and officially acknowledged by the CSC.

    15)CESPO/RESPOs

    a)

    Designated as member NHQ/PROs/NSUs PNCO Promotion

    Boards; and

    b)

    Perform other tasks as directed.

    9. CRIMINAL AND ADMINISTRATIVE LIABILITY IN CASE OF BREACH:

    a. Any personnel who, through act or omission, commit any violation of this

    circular shall be subjected to a disciplinary action pursuant to NAPOLCOM

    MC No. 2007-001 (Uniform Rules of Procedure before the Administrative

    Disciplinary Authorities and the Internal Affairs Service of the PNP);

    In the nature of proceedings, the provisions of Civil Service Law on

    Administrative Cases in the Civil Service (RRACCS) as well as the Rules

    of Court shall be suppletorily applicable in the disposition of cases for

    violations of this MC; and

    A candidate who misrepresents, perjures, falsifies, tampers, and distorts

    entries/information in his/her Affidavit of Undertaking (DPRM Form RSD-

    03-A Revised 2014) as well as other documents submitted and attached

    to his/her application shall be held liable for

    PERJURY

    and

    DISHONESTY.

    10. EFFECTIVITY:

    This CMC shall take effect immediately.

    a. PROs, NSUs PNCO Promotion Board Functions:

    1)
