    LegislativeDecreeNo.4/2007of August20

    1.InCapeVerde,industrialproperty matters are regulated,essentially,by theIndustrialProperty Code approvedby DecreeNo.30.679ofAugust 24, 1940,extended,mutatismutandis,toCapeVerdebyDecreeNo.17.043of theMinisterforOverseasTerritories,ofFebruary20,1959,publishedintheOfficial JournalofCapeVerdeofMay 14ofthatsameyear.

    2.Subsequently,andinthiscentury,thatistosay,intheOfficialJournal No.14ISeries,ofMay5,2003,DecreeLaw No.7/2003ofApril7was published, referringonly totheupdatingofthefeesshowninthetableinannextothatCode.

    3.Over timethecombination of everincreasing globalizationof theeconomyandits consequentintegration,atthegloballevel,aswell astheemergenceofnewtechnologies andthe riseinnew conceptsandinstrumentsinactivitieslinkedtotrade,industry andserviceshavemadeclear theneed for adaptationof basic legislationrelatingtoindustrial propertyi.e.theIndustrialProperty Codetomeetthenew demandsofmodernlife.

    4.Economic developmentis increasinglybasedon andis sustainedbytechnologicalandscientific development.

    5.Creativeandinventiveactivitiesarefundamentaldriversofscientificandtechnological development,whichinturn,isoneofthemostreliablepillars foreconomicgrowth.Thisisduetothefactthattheyopenupnewpathsandleadtonewsolutionsforobtaining more andbetterresults,inlesstime

    and atlowercost,thereby guaranteeing theefficiency ofthemeans andinstrumentsintheproduction of goods andtheprovisionofservices.

    6. Ontheotherhand,inaneconomy whichonaworldwidelevelis becomingincreasingly open,globalizedandintegrated,competitiontakes on an unprecedenteddimension,eveninasmallarealikeCapeVerde.Theroleandfunctiononindustrial property,as aregulatorofthatconflict,ishighlighted,byensuringthe necessary fair competitionandpromotingthenecessaryprotectionofthevarioustechnicalproductionprocesses andthedevelopmentof wealth.

    7. Inaddition,inordertoenable the freecirculationofnewtechnologies,knowledge,goodsandservices,theforthcomingandinevitableaccession by CapeVerdetotheWorldTradeOrganization(WTO),requirestheeliminationofsomeincompatibilities and restrictionsestablished bycurrentlegislation (orwhichresultfromtheabsenceoflaw),andtheadaptationofexistinglegislationregulatingindustrial propertytothatnewreality.This requirestheadoptionof principles, conceptsandthecreationofinstitutions,todayenshrinedworldwide,andin particular thetaking onofsome rules derived fromthe existingagreements atthelevelofthatInternationalOrganization.

    8. Ontheotherhand,therehas beenanattemptto harmonizecurrentlegislationwithinternationalrules on industrialproperty,namely thetraderelated aspectsofindustrialproperty, commonly knownastheTRIPS Agreement,aswellasthe provisionof internationalconventionswhich regulatethematter,adaptingit

    explicitlyanddirectlytothe mostrelevantprinciplesin order toprovide thecountry withamodern,uptodate,effectiveandinternationallyadaptedlegalinstrument.

    9.Thenewinternational stagehas madecompetiveness an unquestionableelementforsurvivalof companies.Thechangeinworldwidebehaviorhaspromptedmeasurestofacilitate theacceleratedchanges experiencedbysome countries, includingCapeVerde. Inthiscontext,industrialpropertyrepresentsastrategiccompetitive instrument,workingdecisivelyalongsidethe industrialandscientificcommunity.

    10.Inthisway,industrialproperty(IP) may constitute oneofthebasic mechanismsfordrivingthegrowthanddevelopmentof microandsmall companies.

    11.Countlessbusinessopportunities aremissedbecause fewbusinessmen,andinparticularthoseofCapeVerde,arefamiliar withtheindustrialproperty system.Thesecouldbeseizedthroughthecorrectuseof agood internal andexternalpolicylinkedto industrialproperty. A businessman whounderstandsindustrialproperty remainsmorevigilanttoeventsin the market,observinginparticular innovativeproductswhichcould improve hiscompetitiveness.

    12.The IPsystemis the means capableofgrantingtitletotrademarks andpatents,preventingother competitorsfrom usingthem wrongly.Iftheseprocessesarewell planned andadministered,theyaddvalueandcreateadditional business for microandsmallbusinesses.

    13.Industrial propertyencompasses asetof rights,whichincludespatents

    forinventions, utility models,factory,tradeandservices marks,industrial designs,namesandemblems of establishment,logotypes,appellations oforigin andgeographicalindications,awards,etc..

    14.Theworldeconomy is experiencingatimeofdeepcrisis and majorchallenges. Aneconomy whichwishestobemodern,competitive andmarketoriented,mustbeprovidedwithlegal mechanismswhichprotectandguaranteeits citizensprivaterights overcreationsofthe mind(intellectual property),whichwithoutanydoubt,makeupthecultural andscientific heritageonwhichisbasedthe process ofeconomic,social,culturalandtechnological developmentofacountry.

    15.Therefore,therecognitionoftheintellectualandfinancial effortsof othersandtheprotectionoftheir creationsisanobligationofany State,if onlytoprovideanincentivefor creativeactivity,and morethanthat,toguaranteeits permanenceandselfsustainability.

    16.However,recognitionisnotenough,itisalsonecessaryto guaranteematerial stimuli,thatis to saytherightto receive monetary compensationforthe use,bythird parties, of thesubjectof thecreation, beit aliterary work,musical composition,orevenaninvention oratrademark infactallsubjects of intellectualproperty.Thatiswhythe Governmentintends toproceedwiththemodernization andadaptationofthebasiclawwhichregulatesaspects ofindustrialpropertytothe new demandsofdevelopment.

    17.Notwithstandingtheexisting constraints,webelievethatcreators of themind,thatistheowners of

    elementsofintellectualproperty,for thereasonsalready mentioned,donotfindthemselves totally unprotected, sincetheCivilCodegrantsthemsomeprotectioninthedefenseof their rights. Indeed, theveryfundamentallaw,the ConstitutionoftheRepublicofCapeVerde,inArticle68statesclearlythatallprivatepropertyrights,their assignmentinlife or indeath,shallbe guaranteed underthetermsoftheConstitutionandthe law.

    18.Itis,however,ourunderstandingthatitshouldbethecreators themselves,who,throughcorporations formedfor thateffect, oughttopromote thestrugglefortherecognitionoftheprivaterights of intellectual property. Nooneisbetter placedthantheyare,toasserttheir rights.

    19.Ifwepayheedtorecentnewsinourpress of appealslodgedatthecourts for allegedcounterfeitingor infringementofrightsrelatedtointellectual property,wecouldsaythatthisstrugglehas alreadystarted. Inthis,thefullsupportoftheGovernmentcanbecountedon,inparticularas far asguaranteesof faircompetitionareconcerned.

    20.Today,itis universallyrecognizedthatIPplaysadecisiveroleinthedevelopmentofnationalandregional economies.Countries,mainly developedeconomies,recognizefully thecompetitiveadvantages which arisefrom theuseofthepatentsystem toprotectnewtechnologicalprocesses andnew products fromillicituseby competitors,whichiswhytechnical informationis givenoneofthehighest priorities.

    21.Fordevelopingcountries,industrialproperty willbeabletoplay anextremelyimportantrole inthe

    facilitationoftechnology transfer,iftheowners oftechnologiesconcludethatdevelopingcountrieshavesystems of protectionforIPwhichwillprotectthem fromtheillicituseof their technology.Thetechnicalandscientificinformationcontainedinpatentswillalsobeabletoplayanextremelyimportantroleas asourceforresearchwhichisnotnegligible withinthe framework of any research and developmentprogram.

    22.Additionally,industrialproperty performsadisciplinaryroleintrade. Productsaremarketedinnational andoverseas markets,notbytheir technicalorscientific name but mainly by theirtrademark,whichtheconsumerrelatestocertainqualities andcharacteristicsoftheproducts.

    23.Thetrademarkismoreoverastrategic factor forcompanies,since thechoiceofcountrieswhere registration applicationsarefiled shouldcorrespondtothechoiceofmarkets forthelaunchingofsaidproducts.Aregisteredtrademarkis thereforenotjustadecorativeelementofproducts;itplaysakeyeconomic role.

    24.Additionally,adherence tothe maininternationalconventionsrelatingtoIP isavaluablecontributiontotheinternationalintegrationofStates,whichbeyondensuringaprivilegedrelationshipbetweenMemberStates,allowsthemtobenefit,byright,from individual internationalcooperation programs.

    25. Itisimportanttostatethatintodays world,theissueofintellectual propertyanditsprotectionisonewhichaffectsusallinfact,wedeal withitateverymoment.Thatis why wehopethatthislegislativeinitiativewillprovidetheimpetustomake

    intellectual propertytrulyvalued,defendedandproperlyusedinour country.

    26.Thus,inthiscontextthenew Industrial PropertyCodeisapproved.TheCode,herebyapproved,consists of284articles,containedinvarious titlesandchapters,drawinginspirationfromteachingsofcomparativelawandinparticularintheguidelinesderivedfrom agreements and conventions inherentinaccessiontoWTO.The Codetries todevelop widelyallthe subjects relatedtoindustrialproperty,compilingandincludingwithinitsome matters whichareoftypically regulatory nature,insimplelanguage,oftendescriptivewiththeaimof facilitatingitsuseandconsultationby all thosewhointheir scientific,creative andeconomicactivitieshaveneedthereof.

    Thus,

    UnderthelegislativeauthorizationgrantedbyLawNo.8/VII/2007 of March26; and,

    byuseofthepowersconferredby subparagraph (b)ofparagraph2ofArticle203oftheConstitution,the Governmentdecreesthe following:

    Article1

    Approval

    TheIndustrialPropertyCode, whichis publishedasanannextothis legislationofwhichitisanintegral part,isherebyapproved.

    ReferencestothepreviousCodeshall bedeemedexecutedby theIndustrial

    PropertyCodeapprovedbythis legislation.

    Article3

    Transitionalprovision

    1. Aslongasthereis noIndustrial PropertyJournal,bydecisionofthememberofGovernmentresponsible forIndustrialProperty,thepublications referredtoby theCodeapprovedby thislegislation,shallbepublishedinSeriesIIIoftheOfficial Journal.

    2. Aslongasthereis nospecificbody responsible forthemanagementof industrialproperty matters,alltheActs relatingtothis subjectshall be under theremitoftheGeneralDirectoratefor IndustryandEnergy.

    3. All requestspresentedbeforetheentry intoforceofthislegislationmustfollowthenormal proceduresin accordancewiththeruleslaiddownby thelegislationwhichenabledits presentation.

    Article4

    Revocation

    1. TheIndustrialProperty Code,approvedbyDecreeNo.30.679 of August24,1940,and extendedto CapeVerdebyOrdinanceNo. 14.043 ofFebruary20,1959,isrevoked.

    2. DecreeLawNo.7/2003ofApril7is revoked from thedateofentryintoforceofthenew legislationwhichapprovesthefees fortheacts stipulatedintheIndustrial Property Code,herebyadopted.

    TITLEI

    GENERALPROVISIONS

    Article1

    Purposeof thelegislation

    This Codeestablishestheindustrial propertyregimeandtheprinciplesand rulestowhichthesameissubject.

    Article2

    Scopeofindustrialproperty

    Theindustrialproperty systemshall coverindustry,tradeandservices,as wellas naturalor manufacturedproducts.

    Article3

    Personalscopeof application

    1. ThisCodeshallbeapplicabletoindividualpersonsorcorporatebodies, CapeVerdeanorforeign,nationals ofMemberStates ofinternational organizations for industrialpropertytowhichCapeVerdebelongs, irrespectiveofofficial domicileor Formatted: French (France) establishmentwiththeexceptionofspecialprovisionsastocompetenceand procedure.

    2. NationalsofMemberStatesof international organizationsofwhichCapeVerdeis amemberandnationalsofanyother Stateswhohaveadomicile,infactandnotasa matter of form,intheterritory ofoneoftheMemberStates oftheseinternational organizations, shallbeassimilatedfor thepurposes ofthislegislation.

    3. Thesystem of reciprocityshall applytocasesnotcoveredbythe previous paragraphs.

    Article4

    Functionofindustrialproperty

    Industrial property shallhave thesocial functionofguaranteeing fair competition,byconferringprivaterightsinthevarioustechnical processes for productionanddevelopmentofwealth.

    Article5

    Guaranteeofindustrialproperty rights

    1. Industrial property shallenjoytheguaranteesestablishedinthelawon propertyingeneral,andinthose provided forin theinternational conventionstowhich CapeVerdeis a party,inthisCodeandotherlegislation

    inparticular.

    2.Therightsarisingfrom patentsand utility models,aswellas registrations ofsemiconductortopographies,industrialdesignsand oftrademarks andotherdistinctivecommercialsigns shallbesubjecttoattachmentandseizureandmaybegivenassecurity.

    Article6

    Effects

    1.Therightsconferredbyindustrial propertyshallcoverthewholenational territory.

    2.Notwithstandingtheprovisions of thefollowingparagraph,thegrantof industrialpropertyrightsshallimply onlylegal presumptionofthesatisfactionofthe requirementsofthegrant.

    3.Anawardregistrationshall guaranteetheveracityandauthenticity ofthetitlesby whichthey wereconferredandshallassuretheowners oftheirindefinite ownershipandexclusiveusethereof.

    4.Theregistrationoftrademarks,namesandemblemsof establishment,logotypes,appellationsoforiginandgeographicalindications shall constitutearight totheexclusiveuse thereofby therespectiveowner, and,if itisprioritshallbesufficientgrounds forrefusalbythecompetentservices to registerothers which may beconfusedwithit.

    5.Prior registrationshallbesufficient grounds for therefusal,by thecompetentservices,toregisterothers whichmaybeconfusedwithit.

    6. Therighttorequesttheannulmentreferredtointheprecedingparagraphshall expireinamaximumperiodof10yearsstartingfromthedateof applicationoftheannullableactor fromthepublicationin theOfficial Journal,oftheconstitutionor alterationofthetradenameor business name of thelegalperson.

    Article7

    Unfaircompetition

    1. NationalsofCape Verde andofMemberStates ofinternational organizations for industrialproperty,of whichCapeVerdeisamember,shall beguaranteedtherighttoopposeunfaircompetition.

    2. Anycompetitiveactwhichis contrary tothehonestuseofindustrial and tradesubject mattershallbeanactofunfaircompetition,inparticular:

    (a) allactslikely,byanymeans,toestablishconfusionwiththeestablishment,theproductsortheindustrialortradeactivityofacompetitor;

    (b) falsedeclarationsintheexerciseoftradelikelytodiscreditthefirm,theproductsortheindustrialortradeactivityofacompetitor;and

    (c)indicationsor declarationswhoseuseintheexerciseoftrademaybe likely tomisleadthepublicaboutthe nature,methodof manufacture,characteristics,opportunitiesforuseor quantityof the merchandise.

    Article8

    Provisionalprotection

    1.Theapplicationforapatent,utility modelor of registrationshall provisionallygranttheapplicant, from therespectivepublication,protectionwhichisidentical tothataffordedby thegrantingofthe right.

    2.Theprovisionalprotectionreferred tointheprecedingparagraphshallbebinding,even beforepublication,onanyonewhohas beennotifiedofthesubmissionoftheapplicationandreceiveddetailsofthecase.

    3.Courtrulingsrelatingto theprotectionmustbestayeduntilthe finalgrantor refusal of thepatent,utility model or registration.

    Article9

    Proof of therights

    1.Proofoftheindustrialproperty rightsreferredtointhisCodeshallbe bymeansoftitles.

    2.Thetitles mustcontainthedetails necessaryforperfectidentificationof therightto whichthey refer.

    3.Industrialpropertyrightscertificates issuedby international organizations foruseinCapeVerde,shallhavethesamevalueas thetitlesreferredtoin theprecedingparagraphs.

    4.Ownersofindustrialproperty rights may beissuedcertificateswithsimilar contenttothatoftherespectivetitle.

    5.Thefollowing may alsobeissuedat therequestofan applicantor owner:

    (a)applicationcertificates;

    (b)protectioncertificates forindustrial propertyrightsgrantedbyinternational

    organizations for useinCapeVerde.

    Article10

    Restorationofrights

    1. Theapplicantfor orthe owner ofan industrialpropertyrightwho,for reasonswhichcannotbedirectly attributedtohim, has notmetthetime limitfor performinganactwhosebreachimpliesitnotbeing grantedor affectstherespectivevaliditymay,attheirrequest,havetheir rights restored.

    2. Therequest,dulysubstantiated, mustbesubmittedinwriting,withinaperiodoftwomonthsstartingfrom the cessationoftheeventwhichpreventedthemeetingof thetimelimit,only beingpermitted,inanycase,withinone yearoftheend ofthetimelimitmissed.

    3. Theomittedactmustbe performed duringthecourse ofthetwomonthperiod, referredtoin theprecedingparagraph,alongwiththepaymentof afeefortherestorationof rights.

    4. Theprovisionsofthis Articleshall notapplytothetime limitsreferredto inparagraphs2and3ofArticles 231 and 235,ifthereis apendingprocess ofdeclarationoflapse inrelationtothesameindustrialpropertyright.

    5. Applicantsfor orownersof rights that arerestoredmaynotinvokethem throughathirdparty who,ingood faith,duringtheperiodbetweenthelossof rightsgrantedandthepublicationofthenoticeof therestorationoftheserights,beganthe exploitationor commercializationofthesubjectoftherightorcarriedouteffectiveandseriouspreparationsfor itsexploitation orcommercialization.

    6.Third partieswhomayavail themselves ofthe provisioninthepreviousparagraphmayopposethedecision to restorerightsof aregistrationapplicantorownerwithintwomonthsofthedateof publicationofthenoticeofrestorationoftherights.

    Article11

    Subjectmatterofthepatent

    1. New inventions shall bepatentableif they involve an inventive step andare industrially applicable, regardless of the nature of the products and theprocesses used and whatever thetechnological fieldtheyapply to.

    2. New inventions shall bepatentableeven if they involve a productcomposed of biological material, or whichcontains biological material,or aprocess which allows for theproduction, treatment or use of biological material.

    Article12

    Patentability requirements

    1. An invention shall be considered new if itdoes notform partof the state oftheart.

    2. It shall be considered that an invention involves an inventivestep if, for a person skilled in the art, that invention wouldnothave beenobvious fromthestateoftheart.

    3. An invention shall be considered industrially applicableif it can bemade orusedinanykindofindustry.

    Article13

    Stateof theart

    1. The stateof theartshall beheldto comprise everything which, within or outsidethecountry, is available tothe public, before the date of the patent application,by description,useor any other means.

    2. Thecontentof any other patentor utility model application, established prior to the new patent application, with effect in Cape Verde and as yetunpublished, shall equally beconsidered toform partof the stateoftheart.

    Article14

    Nonopposabledisclosures

    1. Thefollowingshallnotprejudicethe novelty of aninvention:

    (a) disclosures to scientific societies, professional technical associations, or for the purpose of competitions, exhibitions and trade fairs in Cape Verde or abroad, which are official or officially recognized in any Member State of international industrial property organizations,of whichCape Verde is amember, if the application for the respective patent is filed in

    CapeVerdewithin12months;

    (b) disclosures resulting from evidentabuse of theinventor or his successor,or if unduly published by the organization responsible for industrial property.

    2. The disclosures to which subparagraph (a) of the precedingparagraph refers shall not prejudice thenovelty of the invention only if theapplicant proves, in three months starting from the date of the patentapplication, that the application was effectively disclosed pursuant to thetermsstipulatedtherein.

    Article15

    Specialcasesofpatentability

    1.Thefollowing may bepatented:

    (a) a substance or compositionincluded in the state of art for the execution of one of the methods mentionedinparagraph2 of Article16,on condition that its use,for whichever method listed there, is not included inthestateoftheart;

    (b) anew invention,whichinvolves aninventive step and is industrially applicable which impacts on any isolated part of the human body or produced by another technical process, including the sequence or partial sequenceof agene,evenifthestructure of thatelementis identical tothat of a natural element, from themoment that it is expressly observedandspecifically exhibited in the patentapplication,the industrial applicationofa sequence or partial sequence of agene;

    (c) an inventionwhichconcernsplants or animals, if thetechnical feasibility of the invention is not confined to a

    particularplantoranimalvariety;

    (d) biological material, which is isolatedfromitsnaturalenvironmentor produced by means of a technical process,even if itpreviously occurred innature;

    (e) an invention which concerns a microbiological process or other technical processes, or products obtainedbytheseprocesses.

    2. Essentially biological process for the production of plants or animals means any process which consists entirely of natural phenomena suchas crossingorselection.

    3. Microbiological process means any process involving or performed upon orresultinginmicrobiologicalmaterial.

    Limitationsof thesubject matter

    1. Thefollowingare notpatentable:

    (a) scientific theories and mathematical methods;

    2. Surgical or therapeutic methods for the treatment of humans or animals andthediagnostic methods appliedto humans or animals, may not bepatented. However, products,substances or compositions used inany of these methods may bepatented.

    3. Theprovisionof paragraph 1 shall only excludepatentability if thesubjectfor which a patent is applied for is confined to the elements mentionedtherein.

    Article17

    Exclusion frompatentability

    1. Inventions, the commercial exploitation of whichwouldbecontrary to law, public order, national security, public health and morality, shall beexcludedfrompatentability,namely:

    (a) theprocesses ofcloningof humanbeings;

    (b) the processes for modifying thegerm line genetic identity of human beings;

    (c) the process of use of humanembryos for industrial or commercial purposes;

    (d) the processes for modifying thegenetic identity of animals which are likely to cause them suffering withoutany substantial medical benefit for man or animal, and also animals resultingfromsuchprocesses.

    2. the following shall also not bepatentable:

    (a) the human body,atvarious stages of its formation or development, as well as the simple discovery of oneof

    itselements,including thesequenceor partial sequence of a gene, without prejudice to that laid down insubparagraph(b) ofparagraph1ofthe followingArticle;

    (b)plantor animal varieties,aswell as theessentially biological processes for the production of plants or animals, withoutprejudice to thatsetout in the international agreements to which CapeVerdehas acceded.

    Article18

    Patentprotection

    1. The protection of an invention which meets the conditions set out in Article 12 may be applied, at the choiceof theapplicant, toapatentor utility model.

    2. The same invention may be the subject matter, simultaneously or successively, of a patent application and autility modelapplication.

    Article19

    Generalruleontheright tothepatent

    1. Therightto thepatentshall belong totheinventor orhissuccessors.

    2. If therearetwo,or more,authors of theinvention,any one of them shall be entitled to apply for the patent in the nameofthemall.

    Article20

    Specialruleson patentownership

    1. If an inventionis discovered during the fulfillment of an employment contract which provides for inventive activity, the right to the patent shall belong to the respective employer

    2. In the case referred to in thepreceding paragraph, if the inventive activity were not especially remunerated, the inventor shall beentitled to remuneration, in keepingwiththerelevance oftheinvention.

    3. Independently of the conditions stipulatedinparagraph1:

    (a) if the invention forms part of its areaofactivity,theemployershallholdtherightof option topatent by means of remuneration in keeping with theimportance of the invention and may takeupsaid ownership,or reservethe right to exclusive working, theacquisition of thepatent or the optiontoapply foror acquire aforeignpatent;

    (b) the inventor must inform his employer company about theinventionhe has made, within three months starting from the date of completionthereof;

    (c) if, during that period, the inventor should fileapatentapplication for thatinvention, the deadline for informingthe employer company shall be onemonthfrom thefiling of the respectiveapplication with the organization responsibleforindustrialproperty;

    (d) noncompliance with the obligations referred to insubparagraphs (b) and (c), by the inventor, shall imply civil andemploymentliability,ingeneralterms;

    (e) the employer company may exercise its right of option, within a period of three months starting from the receipt of notification from theinventor.

    4. If, in the terms laid down insubparagraph (e) of the preceding

    paragraph, the remuneration due to the inventor is notfully paidwithin the deadline established, the employer company shall lose the right topatent referred to in the preceding paragraphs,infavoroftheinventor.

    5. Inventions for which the patent is filedduring the year following the date onwhichthe inventor leftthe company shall be considered to have been made during the performance of the employmentcontract.

    Article21

    Serviceprovisionorcommission

    1. Unless otherwise agreed, the provision of the precedingArticle,shall apply to inventions made to order, or to work carried out during service provision with the necessary adaptations.

    2. Unless otherwise specified, the provision of the precedingArticle,shall apply to the State and other public bodies.

    Article22

    Prohibitionof anticipated waiver

    The rights recognized for the inventor maynotbewaivedinadvance.

    Article23

    Availability ofthepatents

    The patents must be made available andthe rightsinherent inthemenjoyedwithout any discrimination with regard to the place of invention, type oftechnology and the fact that the products are imported or locally produced.

    Article24

    Compulsory indication

    1. If the patent was not filed by theinventor or inhis name,he shall havethe right to bementioned, as such, intheapplication andthepatent title.

    2. The inventor may be notmentioned,as such,inthe publications which arise from the patent application,if hesorequestsinwriting.

    Article25

    Redemption

    The provisions of this Code relatingtopatents, with the necessary adaptations, shall be applicable in all matters which are not expressly laid down for the other private industrial property rights, and which are notcontrarytothecharacter ofeachone.

    SubSectionII

    Patentprocess

    Article26

    Formofapplication

    1. The patentapplication shall be filedwith the requirement that it shall indicateorcontain:

    (a) the applicant's name, tradenameor company name, nationality and/or his domicile or the place where he is based;

    (b) the heading or title whichsummarizes the subject of theinvention;

    (c) the nameandcountry of residence oftheinventor;

    (d) the country where the first application was filed, the date and number of said application, if the applicant intends to claim right ofpriority;

    (e) the mentionof theapplication for a utility model for the same invention, if thatwerethecase;

    (f) signature of the applicant or his representative.

    2. Any imaginary expressions used to designate the invention shall form no partoftheclaim.

    3. Applications may be filed electronically in the terms to be regulated by the member of Government responsible for the industrialpropertysector.

    Article27

    Documentstobesubmitted

    Applicationsshallbe accompaniedby thefollowingelements,induplicate:

    (a) descriptionofthesubjectmatterof theinvention;

    (b)claims ofwhatisconsiderednovel andcharacterizestheinvention;

    (c)thedrawings necessaryforthe perfect understandingofthedescription;

    Article29

    Biotechnologyinventions

    Inthecaseofaninventionrelatingto biologicalsubject matterthatisnotaccessibletothepublicandthatcannotbedescribedinthe patent applicationinsuchamanner asto permititsrealizationbyapersonskilledintheart,ortoinvolvethe useofsubjectmatterofthattype,thedescriptionaloneshall beconsideredenoughforthe purposeofobtaining thepatent, if:

    (a) the biologicalsubjectmatterhas, bythedateofthefilingofthepatent application,beendepositedinaninternationalanddulyrecognizeddepositaryinstitution;

    (b) the patentapplicationincludestherelevantinformationavailabletotheapplicantconcerningthe characteristicsofthedeposited

    biological subjectmatter;

    (c)thepatentapplicationmentions thedepositaryinstitutionandthedeposit number.

    Article30

    Deadlineforthedeliveryofthedescriptionand drawings

    Thedescriptionoftheinventionand thedrawings maybedeliveredtotheorganizationresponsibleforIndustrial Property,withinone monthstartingfromthedatetheapplicationwas filedinCape Verde.

    Article31

    Examinationofform

    1. Oncethepatentapplicationhas beenfiled, an examinationiscarried outwithinonemonth,as toform,to verifyifit meetstherequirements stipulated.

    2. Intheeventthatformal irregularitiesarefoundtoexistintheapplication,theapplicantshallbenotifiedsothattheymaybecorrected withinonemonth.

    3. Ifhedoes not dothiswithinthesetperiod, theapplicationshallberefusedand therespectivenoticepublishedin theIndustrialProperty Gazette.

    Examinationof theinvention

    1.Theorganizationresponsiblefor industrialpropertyshallpromotetheexaminationoftheinvention,taking intoaccountalltheelementscontained inthefile.

    2.Ifthereisnoopposition,thecompetentexaminationreportshallbe

    draftedwithinthreemonths of the publicationoftheapplication.

    3. Ifthereisopposition,the reportshall be draftedwithinthreemonths starting fromthesubmissionofthelast proceduraldocumentreferredtointhearticle.

    4. If,onexamination,itisdecided thatthepatent maybegranted,therespectivenoticeshallbepublished.

    5. If,onexamination,itisdecided thatthepatent maynotbegranted,thereport,withacopyofalltheelements quoted therein,shall besenttothe applicantwiththe notification torespondtotheobservations made withintwo months.

    (a)aninventionlacksnovelty, inventivesteporwerenotindustrially applicable;

    (b)its subjectmatterisincludedintheprovisionsofArticles 16and17;

    (c)theheading ortitle giventotheinventioncoversadifferentsubjectmatter,or thereis adifference betweenthedescriptionanddrawings and therespectiveduplicatecopies;

    Effectsofthepatent

    Article41

    Scopeofprotection

    1.Thescopeofprotectionconferredbythepatentshallbedeterminedby thecontentoftheclaims,andthedescriptionandthedrawingsshallbeusedforinterpretationpurposes.

    2.Ifthesubjectmatterofthepatentconcernsaprocess,therights conferredbythatpatentshallincludetheproductsdirectlyobtainedby thepatentedprocess.

    3.Theprotectionconferredbya patentrelatingtoabiological material endowedbytheinventionwithcertainpropertiesshallextendtoany biological materialobtainedfromsaidbiological materialbyreproductionor multiplication,inidenticalordifferentform,andendowedwiththosesame properties.

    4.Theprotectionconferredbya patentrelatingtoaprocess for producingabiological material endowedbytheinventionwithcertainproperties,shallextendtobiological material directlyobtainedbythatprocessandanyother material obtainedfromthat,by reproductionor

    Article42

    Authorization forthirdparties

    1. Thetransfer,inanyform,bythe holderofthepatent,orwithhis consent,of reproductiveplantmaterial, forthepurposesofagricultural exploitation,shallimply authorizationfortheacquirertousethe productofhisharvest,himself,for reproductionor multiplicationonhis holding.

    2. Theassignment,inany form,bytheholderofthepatent,orwithhis consent,oflivestock orother reproductiveanimal material,shall implyauthorization for theacquirerto usethe protected animals for agriculturalpurposes,saidauthorizationincludingthe making availableoftheanimal,orother reproductiveanimal material,fortheperformanceofhisagriculturalactivity.

    3. Theauthorization referredtoinparagraph2aboveshallnotcoverany sale,whichisintendedforreproductive activityforcommercialpurposeswithin thescopethereof.

    Article46

    Rightsconferredbythepatent

    1.Thepatentshallconfertheexclusive right toworktheinventionanywhereinthenationalterritory.

    2.Thepatentshallalsoconferonits ownertherighttopreventthirdparties from manufacturing,offering,stocking,tradingorusingtheproductwhichis subject of the patentwithouthis consent,andfrom importingor holding itfor anyofthesepurposes.

    3.Incaseswherethesubjectofthepatentisaprocess,thepatentshall alsoconferonits ownerthe rightto prevent thirdparties from manufacturing,using,sellingor offeringforsaleorimportation of the product obtaineddirectly bytheprocesswithouthisconsent,foranyof

    thesepurposes.

    4. Thepatentowner mayoppose any acts whichconstituteaninfringementofhis patent,eveniftheyarebasedonanotherpatentwithalater priority date,withouttheneedtochallengethe titles,ortorequestacancellationofthepatent titlesinquestion.

    5. Therightsconferredbythepatent maynotexceedthescope definedby theclaims.

    6. Thepatenteemayrequestfromtheorganizationresponsibleforindustrial property,alimitationofthescopeofprotectionoftheinventionthroughtheamendmentoftheclaims.

    7. If,onexamination,itisdecided thatthelimitationrequestmeetstheconditionstobegranted,theorganizationresponsibleforindustrial propertyshallpromotethe publicationofthenoticereferringtotheamendmentoftheclaims.Otherwise,therequestshallnot begrantedand thedecisionshallbecommunicatedtotheapplicant.

    Article47

    Limitationon therights conferred bythepatent

    Therightsconferredby thepatent shall notinclude:

    (a) actswhichtakeplacewithinaprivatesphere andwithoutcommercial purposes;

    (b)thepreparationof medicines made upfor individualcasesby dispensingchemistsonamedicalprescription,or acts relativetomedicinesso prepared;

    (c)actsperformedexclusivelyfortestorexperimentalpurposes,including

    (d) the use on boardships ofother MemberStatesoforganizationsof whichCapeVerdeisamember,ofthesubject matter ofthepatented inventioninthebodyoftheship,inthe machinery,inthemasting,equipmentandotheraccessories,whenthey temporarilyoraccidentally enter the watersofthecountry, providedthatsaidinvention isusedexclusivelyfor thepurposesoftheship;

    (e) the use ofthesubjectmatterof the patentedinventionintheconstructionor operationof air orlandtransportvehiclesofother MemberStates of organizations of which CapeVerdeis amember, orofaccessoriesofthosevehicles,whentheytemporarilyor accidentallyenterthe nationalterritory;

    (f)acts specifiedinArticle27oftheConvention ofDecember 7,1944onInternationalCivilAviation,iftheseactsconcernaircraftofanother State,towhichhowever,the provisions ofsaidarticle apply.

    Article48

    Nonopposability

    1.Therightsconferredbythepatent shallnotbebindingonanypersonwhoingoodfaith,in nationalterritory andbeforethe dateofapplication,or thedateofpriority ifthisisclaimed,becameawareoftheinventionthrough hisown means anduseditor made effectiveandseriouspreparations for

    suchuse.

    2. Theprovisionsoftheprecedingparagraphshallnotbeapplicableif the knowledgeresults from illicitacts or acts contrarytomorality,usedagainst thepatentee.

    3. Theburdenofproofshallliewithanyonewhoinvokesthesituations specifiedinparagraph1.

    4. Earlier use,or preparations forthis,basedontheinformationreferredtoin subparagraph(a)ofparagraph 1ofArticle14,shallnotprejudicegoodfaith.

    5. Inthecasesprovided forinparagraph1,thebeneficiaryshallbeentitledtocontinueorinitiateuse of theinvention,totheextentof hisprior knowledge,forthepurposes ofhis ownenterprise,butmayonlyassignitinconjunctionwiththecommercial establishmentwheretheinventionis used.

    SubSectionIV

    Nondiscrimination

    Theenjoymentofpatent rightsshall notbesubjectto anyformof discrimination,basedontheplaceoftheinvention, technological fieldandthefactthattheproductsareproducedlocallyorimportedfrom any Member Stateofinternationalorganizations ofwhichCapeVerdeisamember.

    Article52

    Expropriationforpublicinterest

    Anypatent maybelegallyexpropriated forpublicgood,throughpaymentof faircompensation,iftheneed todisclosetheinvention,ortomakeitavailableforuseby publicbodies,sodemands.

    Article53

    Compulsorylicensing

    1.Compulsorylicensesrelatingtoa specific patentshallbegrantedinany ofthe followingcases:

    (a)nonworkingorinsufficientworkingofthepatentedinvention;

    (b) interdependence of patents;

    (c)existenceofpublic interestgrounds.

    2.Thescopeanddurationofsuchlicensesshallbelimitedtothe

    purposesfor whichtheyaregrantedand theyshallbepredominantlyusedtosupplythedomesticmarket.

    3. Compulsorylicenses shall notbe exclusiveand mayonlybetransmitted withthepartofthecompanyor establishmentthatworksthem.

    4. Compulsorylicensesmayonlybegrantedif theinterestedclaimanthas madeeffortstoobtainacontractual licensefromthepatentholderonacceptablecommercialtermswithinareasonable period.

    Article57

    Dependentlicenses

    1.Ifitisnotpossibletoworkaninventionprotectedby apatentwithoutinfringingtherights conferredbyanearlier patent, andboththeinventions areused fordifferentindustrial purposes,alicensemaybegranted onlyif theessentialnatureof thefirstinventionfortheworkingofthesecondisprovenandtotheextentnecessary therefor;thefirst patentownershall havetherighttofaircompensation.

    2. Ifinventionsprotectedby dependentpatentsareusedfor the sameindustrialpurposesandacompulsorylicenseis grantedinfavor oftheownerofthedependentpatents, theowner oftheearlierpatentmay alsorequestthegrantofacompulsory licenseagainstthelaterpatent.

    3. Ifthesubjectmatterofaninvention isaprocess forthepreparationofachemical,pharmaceuticalorfood productprotectedbyapatentthatis inforceandif thisprocesspatentrepresentsaconsiderabletechnical advanceinrelationtotheearlier patent, boththeowneroftheprocess patentandtheownerof theproductpatentshallhavetherightto request acompulsorylicenseagainstthe patentoftheotherowner.

    4. Ifthepersonobtainingaplantvariety isunabletoobtainor exploita plantvarietyrightwithoutviolatinga previous patent,hemayrequesta compulsorylicenseforthe nonexclusiveexploitationoftheinvention protectedbythepatent,insofar as thatlicenseis necessaryfor the exploitationofthesameplantvariety,inexchange for thepaymentofadequateremuneration.

    Article58

    Publicinterest

    1.Thepatenteemay becompelled tograntalicensefortheworkingoftherespectiveinventionforreasons of publicinterest.

    2.Grounds for publicinterestshallbe deemedto existif atthestart,theincreaseorthespreadofworking of theinvention, ortheimprovementoftheconditionsinwhichsuchworkingtakesplace,areofparamount importancetopublic health or for nationaldefense.

    3.Itshallbeconsideredequallythatthere arepublicinterestreasonswhenthereis nonworkingandinsufficient

    qualityorquantityofworkingwhich maycauseseriousharmtonational economic or technological development.

    4. Thegrantofthelicenseonthe groundsofpublic interestshall fall withintheremitoftheGovernment,throughtheMinistryresponsiblefor that areaofIndustry.

    Article59

    Applicationsforcompulsory licenses

    1. Compulsorylicensesmustbe requested fromtheorganizationresponsible forindustrial property,andtheapplicantmustsubmitthe forms of proofwhichsubstantiatehis application.

    2. Requests forcompulsorylicenses shall be examinedin theorder inwhichtheyarereceivedbytheservices.

    3. Onreceiptoftherequest foracompulsorylicense,theorganizationresponsible forindustrial propertyshall notifythepatenteethat,withintwomonths,heshouldstatewhathesees fitandsubmitthe respectiveproof.

    4. Theorganization responsiblefor industrialpropertyshallevaluatethe statementsofthepartiesandtheexploitationguaranteesoftheinventionofferedby theapplicantfor thecompulsorylicenseandshall decide,withintwo months,if this shouldbegrantedornot.

    5. Ifthedecisionispositive,itshall notifybothpartiessothat,withinone month, bothdesignatedexpertswho,inconjunctionwiththeexpertdesignatedbytheorganizationresponsible forindustrial property,agree,withintwomonths,the

    Notificationofand appealagainst grant or refusalofthelicense

    1.Thegrantorrefusalof thelicenseandthe respectiveconditions oftheworkingshall benotifiedto bothparties.

    2.Thedecisionshallbesubjecttoappealtobelodgedwiththecompetentcourt,inaccordancewiththelaw.

    3.Adecisioninfavorofthegrantmustberecordedwiththe organization responsibleforindustrialproperty.

    4.AnextractfromtheregisterreferredtointheprecedingparagraphshallbepublishedintheIndustrialProperty Gazette.

    SubSection IV

    Invalidityof thepatent

    Article61

    Nullityand annulment

    1.InadditiontotheprovisionsofArticle255,patentsshallbenullandvoidinthe followingcases:

    (a) ifits subjectmatterdoes not meet therequirements ofnovelty,inventive stepandindustrialapplicability;

    (b) ifits subjectmatterisnoteligibleforprotectionunder theprovisions of Articles12, 16 and17;

    (c)ifitshallberecognizedthatthe titleorheading oftheinventioncovers adifferentsubject;

    (d)ifitssubjectmatter was notdescribedinsuchawayastoallow theinventiontobecarriedoutby apersonskilledinthe art;

    2. One or moreclaimsmaybe declarednull andvoid,orannulled,but aclaim maynotbepartiallydeclared nullandvoidorannulled.

    3. Ifthereisdeclarationofnullityor annulment of one or moreclaims,the patentshallcontinueinforcefortheremainder,aslongthismayconstitute anindependentpatent.

    (b)thepatent number,aswellasthe titleof theinvention protectedbythatpatent;

    (c)thenumber andthedateofthefirstauthorizationof theplacementoftheproductonthemarketinCapeVerde,and thenumberanddate ofthat

    Article63

    Examinationandpublicationof theapplication

    1.Ifthecertificateapplicationandthe product whichisthesubjectoftheapplication meettheconditions stipulatedby thisCode,the organizationresponsibleforindustrial propertyshallgrantthecertificate andpromote thepublicationof theapplicationandthenoticeof grant.

    2.Iftheapplicationforacertificatedoesnotmeettheconditions referredtointhepreviousparagraph,theapplicantshall benotified,withintwomonths,tocorrecttheirregularities found.

    3.If, from the applicant'sresponse,it isfoundthatthecertificateapplicationmeetstherequiredconditions,the certificateapplicationandnoticeofits grantshallbepublished.

    4. Theapplicationshallberefusediftheapplicantdoesnotcorrecttheirregularities,andthe applicationandthenoticeof refusal arethenpublished.

    5. Withoutprejudicetothe provisions ofparagraph2,thecertificateshallberefusediftheapplicationortheproducttowhichitrefers donotmeetthe conditionsstipulatedintherespectiveRegulation,or ifthey donotmeettheconditionsestablishedinthis Code,and theapplicationandnoticeofrefusal shallbepublished.

    6. Thepublication mustinclude,atleast,thefollowing:

    2.Intheeventthatirregularities of form arefoundinthe application,theapplicantshall benotifiedsothatthey may becorrected withinonemonth.

    3.Ifhe doesnotdothiswithinthe deadlineset,the applicationshallbe refused andtherespectivenotice publishedintheIndustrialProperty Gazette.

    Article70

    Publication of theapplication

    1.Havingbeenpresentedinthecorrectmanner,orcorrectedundertheprovisions ofparagraph2 of the precedingarticle,theapplicationfor theutilitymodelshallbepublished,withatranscriptofthesummary or theclassificationtablesofinternational organizations forindustrial property,of whichCapeVerdeisamember.

    2.Thepublicationtowhichthe precedingparagraph refersshalltakeplaceuptosix months fromthedateoftheapplication;however,itmaybe earlier attheexpressrequestoftheapplicant.

    3. Thepublication mayalsobedeferred,atthe requestoftheapplicant,fora periodnolongerthan 18monthsstartingfrom thedateoftheutility modelapplicationortheclaimedpriority.

    4. Thedefermentshallceasefromthetime atwhichexaminationis requested,bythirdparties or by theapplicanthimself.

    5. Afterpublication, anyonesowishingmayrequestacopyofthe elements ofthecasefile.

    Article71

    Provisionalgrant

    1. Ifnoexamination hasbeenrequested andthereisnoopposition, theutilitymodel shallbeprovisionally grantedandtheapplicantnotifiedtoproceedwiththepaymentoftherelated feefortemporarygrant.

    2. Thecertificate of temporary grant shall be issuedto theapplicantwithinone monthstartingfrom thedateonwhichthepayment,referredtointhe precedingparagraph,is made.

    3. Thevalidityofthecertificateof temporarygrantshallcease once an examinationoftheinventionhas beenrequested.

    Article72

    Examinationrequest

    1. Theexaminationmayberequestedduringthe applicationphase,or during thevalidityoftheprovisionalutility model.

    2. Iftheholderoftheutility model,whichisprovisionallygranted,intends tobringjudicialproceedingsindefense

    (a) starting from thedateonwhichtheexaminationwasrequested;

    (b)orfollowingthepublication of the application,if the examinationhas beenrequestedduringtheapplicationphase.

    3.Ifthereisopposition,theexaminationshall becarriedoutwithinthree monthsstarting from the submissionofthelastprocedural documentreferredtoinArticle235.

    4.If,onexamination,itisdecidedthattheutilitymodel maybegranted,the noticeofgrantshall bepublished.

    5.If,bycontrast,itis decidedthatthe samemaynotbegranted,thereport, withacopyof allthedocuments quotedtherein,shallbesenttotheapplicantwiththenotificationtorespondto theobservations madewithintwomonths.

    6.If, followingthe applicant's response,objectionstothegrantofthe utility model remain,a new notificationshallbedrawnup toseekclarification onthepointsthatarestillindoubt,withinaperiod of one month.

    7. If,fromtheresponseitisconcluded that theutilitymodel maybegranted,thenoticeof grantshallbepublished.

    8. Iftheresponseto thenotificationshouldnot be consideredsufficient,a noticeof refusal or partialgrantshall bepublished,inaccordancewiththeexamination report.

    9. Iftheapplicantdoesnotrespondtothenotification,theutility modelshall berefused,andthe noticeof refusal shall be published.

    Groundsfor refusal

    1. InadditiontotheprovisionsofArticle242,autility model may berefusedif:

    (a) aninventionlacksnovelty,inventivesteporwerenotindustrially applicable;

    (b)theheadingortitlegiventotheinventioncoversdifferentsubject matter,or thereis adiscrepancy betweenthedescriptionanddrawings and therespectiveduplicatecopies;

    (c)itssubjectmatter wasnotdescribedinsuchawayastoallow theinventiontobecarriedoutby apersonskilledinthe art;

    (d)itwasconsidered adesignthroughitsdescriptionorclaims;

    (e)ifthesubjectwerenotpermitted undertheprovisions ofthisCode;

    3. Ifthesubjectoftheutilitymodelisaprocess,therespectiveownershall have therighttoprohibitthirdparties fromtheuse,as wellastheuseor offer for sale,sale orimportof the productobtained directlybythis process forsuchpurposes.

    4. Theowneroftheutilitymodel may opposeanyactswhichconstitute aviolationofhisinvention,evenifthey arebased on anotherutility modelwithalaterprioritydate,without theneedtochallengethetitles,ortorequestacancellationoftheutilitymodels onwhichthatrightisbased.

    1.Theprotectiongrantedtosemiconductorproducttopographies shallonlyapplytothetopographies themselves,excludinganyidea,process,system,techniqueor encodedinformationincorporatedin them.

    2.Allcreatorsoffinal orintermediate topographies,ofasemiconductor product,shallenjoy theexclusiverighttodispose of the topography,aslong asitmeetslegalprovisions,in particularthoserelatedto registration.

    3.Registration maynot,however,becarriedouteither aftertwoyearshaveelapsedstartingfromthe firstcommercialexploitationof the topographyanywhere,noraftera

    periodof15yearsstartingfromthedateinwhichitwasfixed,orencoded,forthefirsttime,ifitwerenever exploited.

    2. Assessmentof distinctivecharacter shall takeintoaccountthedegreeoffreedomafforded tothecreatorto createthe design.

    Disclosure

    1. Forthepurposeofthetwoprecedingarticles,adesignshallbe consideredtohavebeendisclosedto thepublicifithas beenpublishedfollowingregistration,orin anyother circumstance,presentedatanexhibition,usedintradeor madeknowninanyotherway,exceptif these facts couldnotreasonablyhavecometo the knowledgeof persons operatinginCapeVerdeandskilledintheartinquestionin thecourseof their normalactivity,before thedateofthe registration applicationorpriority claim.

    (b) anindicationoftheproductsin whichthedesignisintendedtobe applied or incorporated;

    (c)thenameandcountryof residence ofthecreator;

    (d)thecountry where the firstapplicationwas filed,andthedateandnumber ofsaidapplication,iftheapplicantintendstoclaimright of priority;

    (e)signatureoftheapplicantorhis representative.

    2. Forthepurposeof paragraph 1ofArticle226,priorityshallbegrantedto theregistrationapplicationfor adesignthat,inadditiontothe particulars requiredinsubparagraph (a)ofArticle1,firstsubmits arepresentation ofthe designinstead,ifpriorityof aprevious applicationisrequested,anindicationofthenumber anddateof theprevious applicationandthebodytowhichitwas submitted.
