RESUMEN

Por omisin suele considerarse a la estatalidad como la capacidad legal del Estado parasuministrar bienes y servicios. Esta forma de entender la estatalidad supone que ella estestructurada por el derecho sancionado. Sin embargo, ejemplos pasados y presentes muestranque dicha capacidad legal suele apoyarse en prcticas que bien pueden definirse como ilegalesy que cualquier medicin de estatalidad debera tomar en cuenta. Tomando como ejemploel caso de la Polica de la Provincia de Buenos Aires propondr la nocin de estatalidadhbrida, esto es, una comprensin de la estatalidad que considera la capacidad del Estado

para operar ilegalmente. Este breve artculo aborda los condicionamientos institucionalesy presupuestarios as como la cuestin sobre el origen de los recursos ilegales en los que sebasa la actuacin policial.
