conditions affecting accommodations and movement of labo!r etc. re1!ired for the satisfactory

eCec!tion of the work contract. (o claim whatsoever on s!ch acco!nt shall be entertained by theDirector ()S")* in any circ!mstances.

73. Earnest money will be forfeited if the contractor fails to commence the work as per letter

of award.

75. ECcept writing rates and amo!nt, the tenderer sho!ld not write any conditions or make

any changes, additions, alterations and modifications in the printed form of tenders. Tenderers

who are desiro!s to offer rebate the same sho!ld be bro!ght o!t separately in the covering letter

and s!bmitted along with the tender eCcept wherever needed after refering the details of thetender and if asked for.

24. The s!ccessf!l tenderer shall be re1!ired to deposit 74 of the ordered val!e as sec!ritydeposit c!m +erformance !arantee by way of demand draft0bank g!arantee #as per nneC!re'

)$ of any sched!led bank in favo!r of Director ()S")* (ew Delhi within ten days from the

date of order, failing which the earnest money shall stand forfeited . The Sec!rity Deposit and+erformance !arantee shall be valid !p to 72 months from the date of commencement of work.

24.7 The proceeds of the performance shall be payable to the p!rchaser as compensation

for any res!lting from the s!ppliers fail!res to complete its obligation !nder thecontract.

24.2 The performance sec!rity shall be in one of the following forms=

24.9 The Earnest money already deposited will be ref!nded after receipt of sec!rity

deposit.

27. The contractors, to whom the work is awarded will have to eCec!te an indemnity bond infavo!r of the Director, ()S")*, indemnifying the a!thorities staff and individ!als of

()S")* against theft, loss of material, damages of any kind to the plant and

installations, damages to b!ildings and app!rtenances d!e to any mishandling0mistakes inoperation and maintenance, as this will be the sole responsibility of the contractor and to

be made good by the contractor at his risk and cost.

22. The contractor is also to declare in the indemnity bond that he0his firm0his partners will beheld f!lly responsible for any damages d!e to fire ca!sed by any mishandling, mis'

operating, or improper maintenance and replacement of materials of air'conditioning

plant and connected installations and that all s!ch damages will be made good by him0his

firm0his partners at his0their own risk and cost.

29. ll proced!res either technical or sec!rity meas!res as followed in ()S")* for allcontractors will be followed in the case of this contract also.

2B. Tenders s!bmitted on forms or sheets #eCcept when the given forms areins!fficient$ other than the tender forms iss!ed by the ()S")* will not be considered.

)n case of ins!fficiency of tender forms also, the forms or sheets s!bmitted as tender
