In compliance to the Clause 6.1 of the MPERC, Bhopal (Guidelines for Reporting Regulatory Compliance) Regulation, 2005, please find enclosed a draft Annual Compliance Report in respect of MPMKVV Co. Ltd, Bhopal for Year ending March‟11. The report has been prepared in the manner that meets the requirements of the compliance systems and reporting. The draft report will be put up to the Board of Directors for approval in next meeting and thereafter
approved report will be submitted to the Hon‟ble Commission.
The enclosed Annual report covers information about all the details
that were required to be furnished for the period specified as above.
The licensee, having made due enquiry, is not aware of any breach of
any of the obligations of license conditions or regulations.

MPERC (Guide lines for Reporting of Regulatory
Compliance)
Regulations, 2005
This Annual report for the period from April‟10 to March‟11 covers
status of compliance on 9 issues of „Guidelines for reporting of Regulatory
compliance Regulations-2005‟ Out of these 9 issues, All 9 issues complied in
full. Brief details of status of compliance against each issue are as below.
I. Directions covered in clause 5.2:- To submit a issue wise
status report on all issues requiring implementation of
directives, status of compliance, partial compliance and non
compliance be reported for the prescribed period. Such report
should also contain justified reasons on the issues where the
directions could not be complied, if any.
i. Status of Compliance
Issue wise report is being submitted on all issues
requiring implementation along with their status for
specified period. Justified reasons are also reported
where issues are partial complied or not complied.

II. Direction covered in clause 5.3:- To ensure internal audit by
ROC. To authenticate information submitted through the
chairperson and managing Director with the knowledge of
Board of Directors of the licensee.

ROC on a regular basis auditing the information being
submitted on regulatory compliance and these reports are
being studied and signed by CMD. Reports are being put up
to Board of Directors for obtaining their approval.

III. Directions covered in clause 6.1:- The licensee shall submit
“Regulatory Compliance Report” to the commission half-

Regulatory compliance reports are regularly being submitted
half-yearly and annually. All the issues as specified in
Annexure A are covered in these reports.

IV. Directions covered under clause 6.2:- The licensee shall be
guided by but not be limited to the items specified in the

reporting are also being covered in compliance report. Status

Regulations and found relevant for reporting are also
covered in reports.

VI. Directions covered under clause 6.4:- Regulatory Compliance
report shall be signed by the Report of Compliance and also
by the chairperson and Managing Director of the licensee.

Managing Director of the licensee.

VII. Directions covered under clause 6.5:- Board of Directors of
the licensee shall approve the “Regulatory Compliance

Regulatory compliance Report is being put up to Board of
Directors and approval is obtained for every report. Some
time when it is likely to be delayed from the due date of
submission, a draft report is submitted to commission with
the signatures of Reporter of Compliance and CMD and
subsequently approval from BOD is conveyed.

M.P. ELECTRICITY SUPPLY CODE – 2004
Introduction: - This Annual report for the period from April' 10 to March‟11
covers status of compliance on 29 identified issues of supply code. Out of
these 29 issues, 20 issues complied in full, while 9 issues have been partially
complied. Brief details of status of compliance against each issue along with
the reasons for partial are as below.
I. Directions given in Clause 4.7 “To prepare ready reckoner for
per unit material cost”.
i) Status of compliance:- Ready Reckoner for HT, LT and sub-
stations etc has been prepared and circulated to field offices for
uniformity and simplification in calculating the actual cost of extension
vide No CMD/MK/Works/147 dt.07/05/10.
ii. CMD's observation on status of compliance:- Per unit cost
schedule is prepared and circulated to all field offices. The direction is
complied in full.
iii Target date proposed for achieving full compliance/ additional remarks, if any: –
II. Directions given in Clause 8.1 "No new connection to be
released without meter".
i. Status of compliance:- During the period under report i.e. from
April' 2010 to March‟11 a total of 368284 new permanent connections are
released. Out of this, 343994 connections are regularized and brought into
billing circuit as they were found using electricity without availing any legal
connection. A special facility for BPL and general domestic connection was
implemented during the year 2010-11. Connections are regularized by giving
facility of installments, due to this such huge no. of connections are
regularized as tabulated below :-

Meters are being installed on these connections, after completion of
formalities. The direction is partially complied.
ii CMD's observation on status of compliance:- Meters will be
provided on these regularized connections.
III. Directions given in Clause 8.8 "All new meters should be
installed in a tamper-proof meter box. The licensee shall
prepare and implement a phased plan to install tamper-proof
metering boxes for all the meters, which are at present
installed without meter boxes".
i. Status of compliance:- All the new meters are being installed in
tamper-proof meter boxes only. The meters are procured with tamper-
proof boxes. Plan to install temper proof meter boxes has been
prepared for the meters, which are at present installed without meter
boxes and boxes are being provided to these meters. The direction is
partially complied.
ii CMD's observation on status of compliance:-
Meter boxes are being installed on meters which are at presently
installed without boxes.
IV. Directions given in clause 8.11 "Sealing of meter to be ensured
by licensee".
i. Status of compliance:- Sealing of all the meters installed for new
connections including replacement against stopped and defective
meters is being done at the time of installation of meters itself. The
work of sealing of meters already installed is also in progress where
seals are broken due to different reasons. Discom is presently
procuring meters fitted in push fit type meter boxes. Once this meter is
installed and box cover is fitted on pushing the cover, the meter is
sealed automatically and there is no need to provide seal on terminal.
These boxes are transparent and each connection is clearly visible all
the times.

V. Directions given in Clause 8.13 "The licensee shall submit a list
of all the types of meters installed in its area of operation, to
the Commission annually. The information shall include the
specification of each type of meter and the total number of
units of each type in use and in stock with the licensee".
i. Status of compliance:-
Details of different types of meters installed have been submitted to
the Hon'ble Commission year ending March‟11 in prescribed format
ESC-7 (attached).
ii. CMD's observation on status of compliance:-
The directive is fully complied.

VI. Directions given in clause 8.14 "It shall be the responsibility of
the licensee to satisfy himself regarding the accuracy of the
meter before it is installed and may test them for this
purpose".
i. Status of compliance:-
Accuracy of the meters before they are installed is ascertained by
following measures:-
(a) The following condition is incorporated in each supply order
placed for meters. “The manufacturer is bound to conduct
routine test as well as functional test on each and every meter
of the offered lot as per IS: 13779/1999”. The test reports of
all meters are checked and obtained from manufacture by
inspecting officer prior to carrying out acceptance test.
(b) The acceptance test of offered lot is carried out at firm's works
as per the latest version of IS.
(c) Random sample testing of meters received is being done for all
the tests as per IS at M/s CPRI Bhopal and in case, material fails
in testing, complete lot is rejected.
The Discom has also placed orders for procurement of 5 No.s
semiautomatic and 2 Nos. fully automatic Test Benches for testing of
electronic Meters. Out of above two Nos. fully automatic and one
semiautomatic tested benches have been received and one (FA) at
Gwalior and one (SA) at Bhopal has been commission recently.
The complaints of meters have now reduced and only 9312
(0.49%) consumers contested the meters & out of only 3342 (0.177%)
meters found beyond permissible limits of accuracy during the period
under report as against 18.87 Lacs installed. Status during the period
under this report remained as under:

VII. Directions given in clause 8.15 "The licensee shall conduct
periodical inspection/testing of the meters as per the
following schedule: (a) Single phase meters: at least once
every five years (b) LT 3 phase meters: at least once every 3
years (c) HT meters including MDI: at least once a year.
Wherever practicable, CT and PT shall also be tested along-
with meters".
i. Status of compliance:-
All the HT meters are tested for their accuracy every year, LT CT
meters are also tested once in every 3 years. Achievement during
period under report has remained as under:

HT meters are tested as per provision in the code. The progress of
single phase and three phase LT meter is however is not matching with
the provision of code. This matter is being given serious attention by
senior management of the company. To enhance the testing capacity
142 Nos Accucheck Meters (RSM) has been procured for testing of
single phase and three phase meters at site. In addition to above
purchase orders for five semiautomatic and two fully automatic Test
benches for testing of electronic machines have been placed. Three
benches have been received and out of these two benches have been
commissioned recently.
This directive is partially complied.
ii. CMD's observation on status of compliance:-
The progress of periodical testing of meters will now be accelerated as
additional accucheck meters have been made available to field staff.
iii. Target date proposed for achieving full compliance/ additional

Better compliance of this directive is expected in next report.

VIII. Directions given in Clause 8.17 "licensee shall test the meter
within 30 days of the receipt of the application from consumer"
i. Status of compliance:-
During the period under report total 9312 consumers applied for
testing of their meters. 9153 meters were tested within 30 days and
balance 159 meters could not be tested in 30 days time limit, because
of consumer's absence on pre-decided date of testing, premises found
locked. Out of these 5811 meters found within permissible limits and
3342 found beyond permissible limits. This directive is fully complied.

convenient locations in one year from the date of notification
of this Code".
i. Status of compliance:-
Hon'ble Commission has approved M/s CPRI, Bhopal for conducting
independent meter testing vide order dated 13th March 2005 and
accordingly company is extending facility of independent meter testing
to consumers. This directive is fully complied.
ii. CMD's observation on status of compliance:-
Publicity of this facility has also been made among consumers.
iii. Target date proposed for achieving full compliance/ additional

X. Clause no. 8 (A).2: The meter to be installed in the Consumers
premises shall be of appropriate capacity and shall confirm to
the relevant ISI specifications.
i. States of compliance:-
Meters of appropriate capacity are being installed in the consumers
premises commensurate with the contract demand. Meters are being
procured as per the specification laid down, by the Central Electricity
Authority under “installation and operation of meters regulation”.
ii. CMD‟s observation on status of compliance:-

XI. Clause no. 8 (A).3:-Licensee shall offer a choice of meters for
domestic connection to the consumers. The Licensee shall

submit the list of meter manufacturing along-with the price of
various types of meters.
i. Status of Compliance:-
Orders to purchase meters are placed to the firm who quotes lowest
rates and therefore meters of one make are procured at a time.
Therefore due to operational constraints, choice of meters is being
provided to consumers from available stock.
Hon‟ble commission has considered the difficulty of DISCOM in case of
choice of meters and has directed to amend the regulation suitably
(Letter No. MPERC/D(RE)/2007/2256dt.01.11.07).

regarding the accuracy class, capacity of meters has been prepared
and is as under:-

13779/1999 is being performed on receipt of every lot of energy
meters.

XIX. Direction given in Clause 9.14 & 9.15 " If for any reason,
meter is not accessible for reading, the licensee shall send a
notice in writing to the consumer to keep the meter available
for reading at the time and date given in the notice. If after
the notice being given as described, the consumer still does
not give access to the meter for reading, the licensee shall be
free to send a provisional bill together with a surcharge. If the
meter remains inaccessible even for the next reading cycle,
the consumer will be served with a notice, to open his
premises for reading of the meter at a fixed time and date. If
the meter is not accessible at the time fixed in the notice, the
supply will be liable to be disconnected after serving a 24 hour
notice under section 163 (3) of the Electricity Act, 2003 (36 of
2003).
i. Status of compliance:-
The procedure is being followed in urban areas. This directive is
partially complied. Status is being reported to Hon‟ble Commission in
format ESC 11. This matter has been discussed at senior level
management of the company and action has been taken to ensure full
compliance.

XX. Direction given in Clause No. 9.16 "Meter reader shall note
down the details of every stopped/defective meter and to file
a report at the end of each working day in prescribed
Performa to the officer in charge of the distribution center in
case of LT consumers and officer in charge of the circle office
in case of HT consumers, who shall be responsible to taken
immediate steps to replace or repair the stopped/defective
meter. In addition to the entry made in the meter-reading
book a separate report shall be required to be given by the
officer in charge of the distribution center to the officer in
charge of the sub-division and division offices, in respect of all
stopped meters and the action taken to replace them."
i. Status of compliance:-
The procedure is being followed for HT consumers and other high
value consumers. Remarks are also recorded for stopped/ defective/
burnt meters on reading diaries by meter readers. However in rural
areas, line staff posted for maintenance work is taking meter readings
and most of them are not capable to prepare reports as per direction
of this clause. Reports are prepared on monthly basis at Distribution
Centers by reviewing meter reading diaries and based on these reports
action to replace stopped / defective meters is taken. Hon‟ble
Commission has also considered this problem and directed that meter

readings books be duly checked at DC level by concerned staff.

describing systems, procedure and accountability regarding
replacement of defective meters."

The OIC is preparing list of such consumers where the meter readings
could not be recorded or the meter has not recorded any consumption
of electricity while reviewing the meter reading diaries on monthly
basis and appropriate action is taken by him. Detailed document

discloses his connection no and address.”

A call center has been established at Bhopal which is working round
the clock on all week days. Complaints are registered at this call center

and payment of energy bill through Account Payee cheques are
accepted. The area of H‟bad, Vidisha, Bhopal and Mandideep Towns is
connected to this call center. This directive is partially complied.

The Company has decided to extend the area of this call center to
other Towns of the Discom. A centralized call center will be established
as provided in R-APDRP Scheme.
XXIII. Clause No 10.2 “Adequate publicity of the address/ locations
and working hours of the collection centers including those
of banks where consumers can make payment to provide a
choice of maximum alternatives modes of payment be made
by the Discom”.

Publicity regarding collection centers their locations and working hours
has been made in their area of jurisdiction. Details of working hours
are also displayed on collection centers. Publicity regarding different
mode of payment has been done through local newspapers, Pamphlets
and arranging media workshops at district Head Quarters. This

XXVII. Clause No. 10.15: "Disputed/Erroneous Bills: To resolve the
dispute within a maximum period of seven days from the date
of receipt of written complaint and OIC of center shall send a
report to the officer in charge of the division giving reasons for
the discrepancy. If on investigation, the Licensee finds the bill
to be erroneous, a revised bill shall be issued with due date
not less than seven days from the date of delivery of revised
bill. Excess amount paid by the consumer, if any, shall be
adjusted in the subsequent bill(s). In case it is established
that the meter reading recorded was incorrect, responsibility
may be fixed and the licensee may take suitable action.
Licensee shall provide quarterly feedback to the Commission
on the analysis of disputed/erroneous bills."

Complaints regarding disputed/erroneous bills are being received at
distribution centers. The in-charge of the distribution center, after due
scrutiny, corrects the bill same day, if verification of records and
checking of installation is not required. In other cases bills are
corrected within seven days after checking of meter and records. The

quarterly basis.

The temporary disconnection of defaulting consumers is being done at
distribution center level. The priority is given for disconnection of
defaulter consumers having more arrears irrespective of the period of
arrears. Government connections and connections of public utility are
also not disconnected as their payments are received subsequently. All

Establishment of Forum and Electricity
Ombudsman Regulations
This Annual report covers status of compliance of the directives on
three identified issues pertaining to MPERC regulation of “Establishment of
Forum and Electricity Ombudsman for Redressal of grievances of the
consumers” (Published in Official Gazette on dated 30.04.2004). All the three
issues have been complied in full.
I. Chapter 1: "Concerned officers of the Licensee shall personally hear
the consumer complaints every Tuesday, which shall be earmarked as
the "Complaint Redressal Day".
i. Status of compliance:-
Field officers are complying this directive. At some places, weekly
market days are earmarked as “Complaint Redressal Day” because it is
convenient to most of the villagers who comes from remote Rural area to
purchase their needs.

This Annual report for the period from April 2010 to March‟11 covers
status of compliance on four identified issues of MPERC Distribution
Performance standards regulation No. 1902 dated 13th July, 2004, published
in official gazette on dated 16th July, 2004. Out of above two issues are
complied in full, two partially complied.
I. Direction given in clause 5.6:- The licensee shall provide a toll
free telephone connection at Central fuse off call centre of the
licensee‟s Head Quarter to receive consumer complaints from
the consumers situated in any area of the company.
i. Status of compliance:-
Call centre at Company‟s Head Quarter has been established
which covers Bhopal, H‟bad, Vidisha and Mandideep, Sehore
Towns. Telephone 12660 is installed in this call center but this
no is presently not toll free.

The call center presently does not cover whole area of Discom.
The company has planned to extend this area to complete area
of Discom and a toll free telephone will be installed for lodging
complaints by consumers.

metering have become defective and action to replace these defective

officers are in process of providing metering on balance 250 feeders and
replacement of 259 defective metering. Availability of meters and MEs is
being ensured at company level at the earliest.

Out of above 14 fatal accidents occurred to departmental employees,
90 accidents to outsiders and 133 to animals. Field staff has been asked to
spread awareness towards safe working on lines and to use safety appliances.
It was gathered from reports that most of the outsiders who met with
accidents were involved in theft of electricity/interference with live wires and
unsafe working with electrical appliances.

Security Deposit Regulations
This Annual report covers status of compliance on two identified issues
of MPERC (Security deposit) regulations 2004 (Gazette Publication No. 2560
dated 22.09.2004 and published in official Gazette on date 01.10.2004. Both
the issues are complied in full.

security deposit w.e.f. 10th June 2004".

This Annual report for the period from April 10 to March‟11 covers
status of compliance on three identified issues of "M.P. Regulation on
treatment of income of other business of license" for implementation – All
three issues are complied in full.
I. Clause No. 3 (1):- Details of other business including nature,
proposed capital investment, nature and extent of the use of
assets and facilities of the Licensed Business for the Other
Business, impact and manner of the use of assets and facilities
for the Other Business on the Licensed Business and on the
ability of the Licensee to carry out the duties and obligations
of the Licensed Business.
i. Status of compliance:-
The Discom is not engaged in any other business. Compliance of these
directions will be observed as and when business other than sub-
Transmission and distribution of power will be started by the DISCOM.

CONDITIONS OF LICENSE
This Annual report for the period from April‟ 2010 to March‟11 covers
status of compliance on 12 identified issues of MPERC conditions of
distribution license for distribution licensee-2004, out of these 11 issues are
complied fully, and one issue partially complied .
I. Directions given in Clause 7. 2 “Profit & Loss account, Balance
sheet, Cash flow statement.
i) Status of Compliance:
The profit and loss account, balance sheet and cash flow statement for
FY 09 were net ready and therefore permission was sought from
“Ministry of Company affairs” Govt. of India for extending last date of
holding of Annual General Meeting. The AGM was held on 18.01.2011,
wherein the financial statements were approved in the meeting.
Interim financial statements are not prepared by the company.
The software presently available with the company for making trial
balance does not allow half yearly closing.
The Annual financial statements for 2010-11 are under
preparation and expected to be finalized within schedule time limit.
ii) CMD's observation on status of compliance:
Annual financial statements for FY-2010-11 are expected to be finalized
within time limits.
iii) Target date proposed for achieving full compliance/additional

Annual financial statements for 2010-11 are expected to finalize by the
end of Sept‟11. The company has implemented system integration
Project (ERP), the work is in progress and after implementation of ERP
