    The terms used and interpreted in the Regulations on the Building Management & Useshall be referred to the attached Agreement. Unless the context otherwise requires, the

    other terms used in The Building Rules and Regulations shall will have the following

    elevators, emergency exits, waste shaft, technical box,

    parking area (except for the parking area owned the

    Investor), power, water, and gas supply systems,communications, radio, television, water drainage,

    septic tanks, lightning arresters, fire protection, and

    other parts in the Building not owned by any

    Apartment Owners nor the Investor.

    operation, and use of the Lman C.T Plaza Building located 117 Nguyen Dinh

    Chieu Street, District 3, Ho Chi Minh City

    Applicable to all Apartment Owners, Apartment users, the Investor or other

    The management of the Building is permanently guaranteed with high-qualityservice provided by the Investor in accordance with the Law on Housing, the

    relevant legal documents and the Building Rules and Regulations.

    The mobilization of funds for the Building management and use shall be conducted

    Owing to the high quality of the Building, including: Parkson high-end shopping

    center, luxury services, 5-star hotel (if any) ... , the Investor shall organize the

    establishment of the professional and senior Building Management Board for

    managing and running the Building operations.

    Performing the management the Building operations. The Building management

    operations covers managing control and maintenance of equipment system

    operations (including elevators, water pumps, back-up power generators,infrastructure system and other equipment) under common ownership or common

    use of the Building; providing services (security, sanitation, waste collection, flower

    and plant garden care, pesticides and other relevant services) to ensure the stable

    and normal operations of the Building.

    Reserving the right to request the utilities companies to suspend power or water

    supply if the user has not made a full and timely contribution to the cost of the

    Building operations management and has failed to remedy any breach of the

    Building Rules and Regulations upon receipt of reminder.

    9. Ban Qun L Ta Nh sban hnh mt Stay hng dn chi tit cc quy tc, th

    tc, tin trnh cn thit i vi Chshu v ngi sdng cn htrong qu trnh

    sinh sng, sdng cc Cng trnh tin ch chung, sa cha cn h, v Stay ny

    sc hiu lc p dng i vi mi Chshu v ngi sdng cn h, min lkhng tri quy nh ti Bn Ni Quy ny v quy nh ca php lut hin hnh.

    The Building Management Board will issue a Handbook detailing necessary rules,

    procedures and processes for Apartment Owners and users in the process of their

    living and use of the Common Facilities Works as well as repairs of the Apartment,

    ... and this Handbook shall take effect to become applicable to all Apartment

    Owners and users, as long as not contrary to the Building Rules and Regulationsand the applicable laws .

    iu 5: TRCH NHIM CA CHU T TA NH LMAN

    Article 5: RESPONSIBILITIES OF THE INVESTOR

    Establishing a professional and senior Building Management Board for operational

    management for the duration of the Building operations.

    2. Thu ph bo tr phn shu chung trong Ta Nh theo quy nh ca php lut.

    Collecting the maintenance fees of the common property of the Building in

    accordance with laws.

    3. Bn giao hthng kt cu htng bn ngoi Ta Nh cho c quan qun l chuyn

    ngnh a phng theo quy nh.

    Handing over the infrastructure systems outside the Building to the local

    specialized management authorities as prescribed by laws.

    4. Hng dn vic sdng hthng htng kthut v trang thit bTa Nh cho

    ngi sdng Ta Nh.

    Guiding the use of technical infrastructure system and the equipment and plant of

    the Building to users.

    of the provisions specified herein.

    upgrading, or repairing in the areas under private property of the Investor on the

    basis of not interfering with the Apartment Owners and users rights of use and

    residence.

    Adjusting the design dossiers, alterating the equipment and materials of theApartment in the construction execution process to differ from the Apartment

    described in the Schedule attached hereto, aiming to increase the value of the

    Apartment and/or make improvements the set design and/or comply with the legal

    requirements of the Project and/or ensure the smooth operations of the Apartment

    Building system without the consent of the Apartment owner or their authorized

    person prior to such implementation. However, the Investor shall not interfere withfull rights and privileges to the Apartment ownership, use, and residence.

    The Investor reserves the right to negotiate and agree with the competent

    The Investor reserves the right to transfer the Building in whole or in part to a third

    party, then each Apartment Owner still reserves full rights and obligations in

    accordance with this Agreement and the applicable laws.

    iu 6: QUYN V NGHA VCA CHSHU V NGI SDNG CN HArticle 6: RIGHTS AND OBLIGATIONS OF APARTMENT OWNERS AND USERS

    Reserving full rights of the area under the common propert of this Building,

    covering the areas prescribed in Article 1, Chapter I hereof.

    Requesting the person in-charge to provide information and publicizing the

    relevant information related to the Building use management.

    Fully complying with any decisions by the Building Management Board.

    Performing the maintenance to the Private Property.

    Chung Ta Nh.

    Fully and promptly contributing to the funding for management, operations, and

    maintenance of the Common Property within the Building.

    Abiding by the rules and regulations on management and use of the Building,complying with the regulations on fire and explosion protection, fire fighting,

    public sanitation, security and order, and detecting and notifying timely of any

    violation within the Building.

    Carrying out the registration of temporary residence and temporary absence as

    Announcing the provisions stated herein to the person legally authorized to use

    the Apartment and the concerned organizations and individuals to use their

    Apartment.

    Restoring the status quo or indemnifying damages caused by the Apartment Owner

    to the Common Property or Private Property of other Building users.

    Rights and obligations of lawful users of the Apartment

    Reserving the lawful right to use the Private Property of the Apartment upon the

    approval by the Apartment Owner and use the areas under the Common

    Property of the Building.

    Article 7: ACTS PROHIBITED IN THE MANAGEMENT AND USE OF THE

    BUILDING

    dhoc lm thay i phn kt cu chu lc, hthng htng kthut, trang thit b

    Extending, appropriating areas, space or causing damage to property under the

    Common Property or the shared areas in any form: demolition, renovation,

    system, shared equipment, and exterior architecture of the Building.

    The apartments are eligible for senior managemen services but to pay the low cost

    according to the general regulations of the Housing Law. During the Building

    operations, if the actual management cost exceeds the cost collected the Building

    Management Board shall conduct a collection of extra cost. However, the extra costincurred (if any) shall not exceed 100% (one hundred percent) of the fee rate as

    prescribed by Housing Act.

    Funds for maintenance of the Common Property: further collection shall only be

    conducted when the funds collected under the Agreement is not sufficient for

    performing the maintenance work. The specific charge shall be approved by the

    Building Management Board after consulting the Apartment Owners on the

    principle that this contribution corresponds to the area of the Private Property

    owned by each Apartment Owner within the Building.

    management company of the Building a deposit as a guarantee regarding not

    causing any damage to works, items or any other apartment within the Building.

    In the absence of any loss or damage whatsoever arising, within 07 (seven) days

    after notified by the Apartment Owner and confirmed by the Management

    Building Board regarding the completion of the repairs or goods transportation,

    such deposit shall be fully refunded to the Apartment Owner by the Building

    Management Board.

    In case the deposit is not sufficient to pay for the loss or damage incurred, the

    documents and invoices provided by the Building Management Board.

    The Investor shall reserve the right to coordinate with Building Management Board

    to apply an appropriate sanction for any Apartment Owner who violates thepayment obligations specified in the Building Rules and Regulations, provided that

    the sanctions shall not affect other Owners in the use of the Apartment and the

    Common Facilities Works, and Building Management Board and the Investor shall

    not be liable for any damage whatsoever incurred to the Apartment Owners as the

    subject-matter to such sanctions.

    Article 9: INSURANCE SERVICES AND EXPENSES

    The Building Management Board shall be obliged and liable to purchase insurance

    against loss or damage which is unexpected or abnormal under the Agreement,

    insuring all risks and insurance coverage in conformity with all other property inthe Building approved by the Investor and/or the Building Management Board.

    The Apartment Owner shall solely purchase public-liability insurance and

    insurance for the property inside his Apartment. The Apartment Owner shall

    purchase liability insurance incurred and arising from the Apartment Owners act

    to any physical damage, death, personal injury of a third party, Apartment

    owners and/or other Apartment lawful users, the Investor and the Investor's staff.

    The insurance premiums that Building Management Board has purchased shall beconsidered the general management expenses. The Apartment Owners shall

    contribute to these premiums in proportion to each Apartment Owners ownership

    in the Common Property.

    iu 10: PH BO TR, PH GIXE, TIN K QU

    Article 10: MAINTENANCE FEE, PARKING FEE, DEPOSIT

    1.

    Ta nh khng th huy ng tvn gp ca cc ChSHu Cn Htng ng vi

    phn din tch shu ring ca tng Chshu.

    Maintenance fees are used to pay for the costs of periodic maintenance or major repairs,

    unexpected repairs, equipment replacement or new equipment purchase serving for the

    Common Property and/or public works for the common interests of the users when the

    Building is damaged. In the case of insufficient fee collection for the Building

    The parking fee rate shall be based on that prescribed by the Government (PeopleCommittee of HCMC) for bicycles and motorcycles of the Apartment Owners or

    authorized persons. For 4-8 seat cars of Party B, parking rates shall be based on that

    prescribed by the Government (People Committee of HCMC) + surcharge, of which

    priority shall be given to the Apartment Owner or authorized persons shall accept higher

    surcharge.

    3.Tin k qu:

    Party B is obliged to pay Party A or the Building Management Board a deposit prior to any

    repairs to the Apartment or carrying goods to and out of the Building or the Apartment.

    This deposit is intended to ensure an indemnification for any damage that may occur to

    Principles of collecting and refunding such deposit are specified herein.

    strictly adhere to the instruction signs.

    Vehicles of the Apartment Owners or lawful users must be parked in the right

    place already registered with the Building Management Board.

    d. Nghim cm bt kvt no khc ti ni xe, u xe ba bi hay u xe

    ti bt kkhu vc no khc ca Phn SHu Chung khng c quy nh lm

    ni xe.

    It is strictly prohibited to leave any other objects in the parking lot, or park their

    vehicles indiscriminately or in any other area of the Common Property not

    defined as a place for parking.

    Visitors of the Apartment Owners and/or lawful users shall have their vehicles

    parked in a separate garage determined by the Building Management Board.

    Visitor parking fee shall be defined by Management Building Board and may be

    adjusted from time to time according to actual conditions.

    complied and strictly implemented, and indemnification are made in case of

    violation as prescribed by law for any occurrences of losses or damage to the

    Investor, Management Building Board or Apartment Owners and/or the lawful

    users of the other apartments.

    information or issues related to the Building, the Apartments, the Common

    Property areas and these Building Rules and Regulations.
