The Drugs and Magic Remedies (ObjectionableAdvertisements) Act is an Act No. 21 of 1954, which camein force on 1st of April 1955.The Drugs and Magic Remedies (ObjectionableAdvertisements) Rules, 1955. 71. Definitionsdrug includes () A medicine for the internal or external use ofhuman beings or animals;( ) Any substance intended to be used for or in thediagnostic, cure, mitigation , treatment or preventionof disease in human beings or animals;[email protected] 72. Definitionsdrug includes () Any article, other than food, intended to affect orinfluence in any way the structure or any organicfunction of the body of human beings or animals;(v)Any article intended for use as a component of anymedicine, substance or article, referred to in sub-clauses(i), (i) and (iii);[email protected] 73. Definitions- D & C actdrug includes(i) all medicines for internal or external use of human beingsor animals and all substances intended to be used for or inthe diagnosis, treatment, mitigation or prevention of anydisease or disorder in human beings or animals, includingpreparations applied on human body for the purpose ofrepelling insects like mosquitoes;(ii) such substances (other than food) intended to affect thestructure or any function of human body or intended to beused for the destruction of vermin or insects which causedisease in human beings or animals, as may be specifiedfrom time to time by the Central Government bynotification in the Official Gazette;][email protected] 74. Definitions- D & C act(iii) all substances intended for use as components of a drugincluding empty gelatin capsules; and(iv) such devices intended for internal or external use in thediagnosis, treatment, mitigation or prevention of diseaseor disorder in human beings or animals, as may bespecified from time to time by the Central Government bynotification in the Official Gazette, after consultation withthe [email protected] 75. Definitionsmagic remedy includesA talisman, mantra, kavacha and any other charm ofany kind which is alleged to possess miraculouspowers for or in the diagnosis, cure, mitigation,treatment or prevention of any disease in humanbeings or animals or for affecting or influencing in anyway the structure or any organic function of the bodyof human beings or animals;[email protected] 76. Definitionsmagic remedy includesA talisman, mantra, kavacha and any other charm of anykind which is alleged to possess miraculous powers for orin the diagnosis, cure, mitigation, treatment or preventionof any disease in human beings or animals or for affectingor influencing in any way the structure or any organicfunction of the body of human beings or animals;[email protected] 77. DefinitionsTaking any part in the publication of anyadvertisement includes -(i) the printing of the advertisement;(ii) the publication of any advertisement outside theterritories to which this Act extends by or at theinstance of a person residing within the saidterritories;[email protected] 78. PROHIBITIONS -Section 3Subject to the provisions of this Act, no person shall takeany part in the publication of any advertisementreferring to any drug in terms which suggest or arecalculated to lead to the use of that drug for (a) the procurement of miscarriage in women orprevention of conception in women; or(b) the maintenance or improvement of the capacity ofhuman beings for sexual pleasure; or(c) the correction of menstrual disorder in women; [email protected] 79. PROHIBITIONS -Section 3(d) the diagnosis, cure, mitigation, treatment orprevention of any disease, disorder or conditionspecified in the Schedule, or any other disease, disorderor condition (by whatsoever name called) which may bespecified in the rules made under this [email protected] 80. PROHIBITION OF MISLEADING ADVERTISEMENTS RELATING TO DRUGSSubject to the provisions of this Act, no person shall take anypart in the publication of any advertisement relating to a drugif the advertisement contains any matter which (a) directly or indirectly gives a false impression regardingthe true character of the drug; or(b) make a false claim for the drug; or(c) is otherwise false or misleading in any [email protected] 81.
