Presentación
El Instituto Nacional de Estadística, Geografía e Informática
(INEGI), a través de la Dirección General de Estadística, presenta la
publicación, Estadísticas de Matrimonios y Divorcios,
1950-1992, que difunde información a nivel nacional y por entidad
federativa sobre los matrimonios y divorcios civiles efectuados en
México, durante ese periodo.
El objetivo fundamental de esta publicación es reunir en un solo
documento, una serie larga de información relativa al proceso de
formación y disolución de familias, que se encuentra dispersa en
otras publicaciones facilitando de esta forma al usuario, la tarea de
su recopilación.
El INEGI agradece por adelantado las observaciones y

INTRODUCCION
El matrimonio como acto civil en México, data de la época de la Reforma. Durante
el gobierno Juarista, en 1859, se expidió la Ley Orgánica del Registro Civil, que /
marca la secularización del Registro Civil y define entre otros actos del estado civil
al matrimonio, como un contrato civil monogámico e indisoluble.
El establecimiento del divorcio como fórmula legal para disolver el matrimonio, data
de 1917, año en el que Venustiano Carrranza promulgó la Ley sobre Relaciones
Familiares, misma que representó un giro en la concepción social de la familia, al
considerar que su constitución debía hacerse sobre bases más justas y racionales.
La generación sistemática de las estadísticas de matrimonios se remonta al año de
1893, en tanto que la de los divorcios al de 1926; recayendo desde entonces, la
responsabilidad de su producción y difusión, en la Dirección General de Estadística
(DGE).
Desde su inicio y hasta principios de la década de 1980, el proceso de generación
de las estadísticas de matrimonios y divorcios no sufrió cambios considerables. Las
fuentes informantes (Oficialías del Registro Civil y Juzgados de lo Familiar, de lo
Civil y Mixtos) llenaban formatos colectivos en los que reportaban los matrimonios
y/o divorcios que tramitaban mensualmente. El tratamiento manual y electrónico de
la información era realizado centralmente por la DGE.
A partir de 1985 cambió el procedimiento; los formatos colectivos fueron
sustituidos por cuadernillos, en los que las fuentes transcribían la información en
formatos individuales. Adicionalmente, con la creación en 1983, del Instituto
Nacional de Estadística, Geografía e Informática (INEGI) y su estructura
desconcentrada, las tareas de tratamiento manual y electrónico de la información
pasaron a ser responsabilidad de las Direcciones Regionales.
Otro hecho importante para las estadísticas de matrimonios y divorcios -y en
general para las estadísticas vitales-, ocurrió en agosto de 1980, con la creación de
la Dirección General del Registro Nacional de Población e Identificación Personal
(RENAPO), dependencia de la Secretaría de Gobernación, responsable de la
coordinación de las Direcciones Estatales del Registro Civil.
Gracias al desempeño de RENAPO, se diseñaron formatos uniformes en el país, de
las actas de nacimiento, matrimonio y defunción, se les incluyó una sección de
datos complementarios (que permitieron profundizar en el análisis de carácter
socio-demográfico) y se destinó, a partir de 1987, una copia de cada acta para el
INEGI, eliminando así, las tareas de transcripción.

El proceso de generación de las estadísticas de matrimonios y divorcios es a
grandes rasgos, el siguiente: las Oficialías del Registro Civil (ORC) reportan al INEGI
los matrimonios y los divorcios administrativos, en tanto que los Juzgados de lo
Civil, de lo Familiar y Mixtos le entregan divorcios judiciales. El formato de
captación para la estadística de matrimonios es el acta, mientras que en el caso de
la de divorcios es un cuadernillo para reportar cinco casos individuales.
Las oficinas estatales del INEGI reciben en el transcurso de los primeros diez días
de cada mes, la información de los matrimonios que registraron las ORC, y de los
divorcios que las ORC y los Juzgados, consumaron el mes anterior. Después de
revisar la cabalidad de la información, ésta es turnada a las sedes de las
Direcciones Regionales del Instituto, donde es codificada, capturada y depurada.
En las oficinas centrales del INEGI, se integran los archivos nacionales de cada
estadística, se generan y difunden resultados.
La información recopilada en la presente publicación, ofrece algunas de las
variables que permiten caracterizar el fenómeno de la nupcialidad, entendido como
la formación y disolución de las uniones legales en el país; no incluye, por tanto,
los matrimonios exclusivamente religiosos, las uniones libres o consensúales, la
disolución de estos dos tipos de uniones, ni las separaciones de hecho.
La información contenida en la presente publicación fue recopilada de varios
volúmenes de la serie Anuario Estadístico de los Estados Unidos Mexicanos; se
recurrió también a tabulados originales sobre matrimonios y divorcios, que se
encuentran en la Biblioteca Gilberto Loyo del INEGI; algunos de los datos de 1985
a 1992 han sido publicados previamente en la serie Cuaderno de Población,
números 3, 4 y 5.
Al comparar datos de algunos Anuarios, se encontró que estos diferían de un
volumen a otro, o que las cifras de varios años no coincidían con los tabulados
originales. Entre las explicaciones de las diferencias se pueden citar los errores de
impresión, el empleo de información preliminar y la utilización indiscriminada de
cuadros con distinto nivel geográfico (uso indistinto de clasificaciones por entidad
federativa de registro y por entidad federativa de residencia habitual de los
contrayentes o de los divorciados). En consecuencia, fué necesario verificar los
datos de Anuarios con ios de tabulados originales, y siempre que estos lo
permitieran, corregir las cifras; de igual manera fueron corregidos los errores de
carácter algebraico detectados.
En virtud de lo anterior, conviene tener en cuenta las observaciones siguientes:
1. Las tasas de nupcialidad se calcularon exclusivamente para los años de 1950,
1960, 1970, 1980 y 1990, para los que se cuenta con población censal. Las
tasas de divorcialidad (relación divorcios por cada mil matrimonios) en cambio,
se presentan anualmente.

2. A partir de 1976 se capta la variable "entidad federativa de residencia habitual"
(de los contrayentes y los divorciados). A ello se debe que para los
matrimonios, la información de 1976 a 1984 esté referida geográficamente a la
entidad de residencia habitual de la contrayente, en tanto que para los años
restantes se refiere a la entidad de registro.
Algo similar ocurre con la información de los divorcios: para las variables "edad
de los divorciados", se encontrará que en los años de 1976 a 1984 se empleó
la clasificación de entidad de residencia habitual de la divorciada; para las
demás variables se hace lo mismo de 1978 a 1984. Los años restantes se
presentan por entidad de registro.
3. Las variables "edad del divorciado" y "edad de la divorciada" se presentan
únicamente para el periodo de 1976 a 1992, en virtud de que no se encontró
esa información por entidad federativa para los años anteriores. La variable
"tipo de trámite" se presenta a partir de 1985, debido a que en ese año se
inició su captación.
No se encontró el desglose de la variable "duración del matrimonio" para el año
de 1971.
4. No confundir las variables "tipo de divorcio" y "tipo de trámite". La primera
hace referencia al hecho de que si el divorcio es necesario o voluntario, es
decir, si el divorcio se realizó por mutuo consentimiento o si medió una causa
contenciosa; en tanto que la segunda se refiere a si el divorcio fue resuelto en
el Registro Civil o en un Juzgado. (Ver Definiciones).
Los divorcios por mutuo consentimiento o voluntarios, se pueden trámitar tanto
en el Registro Civil como en los Juzgados, mientras que los divorcios por una
causa contenciosa, también llamados "necesarios", se tramitan exclusivamente
en los Juzgados.
5. El "divorcio administrativo" que se tramita en el registro civil es aquel que se da
cuando no hay hijos en una pareja de mayores de edad, se ha disuelto el
régimen de sociedad conyugal y existe mutuo consentimiento para disolver el
matrimonio. Este tipo de divorcio que tiene la característica de ser rápida su
resolución, no está definido en los Códigos Civiles de los estados de Coahuila,
Chihuahua, Durango, Guanajuato, Hidalgo, Morelos, Oaxaca, San Luis Potosí,
Sonora, Tlaxcala y Zacatecas; sin embargo, en el cuadro 111.5 usted encontrará
información en ellos,, debido a una falla en el procedimiento existente hasta el
año de 1992, para la generación de las estadísticas de divorcios.

La situación era la siguiente: al llegar el trámite de un divorcio en un juzgado a
su culminación, es decir, al dictar sentencia "ejecutoria", debía ser turnado al
Registro Civil para su "legalización"; esto provocaba que estos divorcios fueran
reportados al INEGI tanto por los Juzgados como por las ORC, dando origen al
doble conteo de casos.
Este problema ha sido corregido a partir del año 1993, mediante el empleo de
un formato especial para captar los divorcios que se tramitan en los Juzgados,
en tanto que las ORC reportan exclusivamente los divorcios administrativos en
actas.
6. Conviene aclarar, en relación con el cuadro III.6, que no se empleó ningún
criterio especial para elegir las principales causas de divorcio, se trata más bien
de una selección de causas permitida por la información. A lo largo del tiempo
se han manejado diferentes clasificaciones de la causa del divorcio, según se
aprecia en el cuadro siguiente:

8. En la serie de divorcios se registra en 1971, una fuerte caída en el total nacional
y en particular, para el estado de Chihuahua; ello obedece a que a partir de ese
año se prohibió la realización en nuestro país, de divorcios de personas
residentes en el extranjero.

NOTAS: La Estadística de Matrimonios se generó por entidad de registro en los períodos de 1950 a 1975 y de 1985 a 1992 y por
entidad de residencia habitual de la contrayente de 1976 a 1984. La Estadística de divorcios de 1950 a 1977 y de 1985
a 1992 se presenta por entidad de registro y de 1978 a 1984 por entidad de residencia habitual de la divorciada, motivo
por et cual para estos años se presenta la clasificación de residencia en el extranjero y de entidad no especificada.
Hasta el arto de 1970 la Legislación Mexicana permitía ios divorcios de extranjeros no residentes en ei pals, situación
que afectó principalmente al estado de Chihuahua.
El Incremento de las cifras que se muestran para los años de 1972 y 1974 se debe a que se incluyeron matrimonios
registrados durante la "Campaña Familia Mexicana".
A la población total de 1950 se incorporaron 11 763 habitantes correspondientes a información complementarla, sin
ubicar su lugar de residencia.
1/ Para 1977 en la estadística de divorcios, la clasificación por lugar de registro incluyó la entidad no especificada y
se captó sólo un caso.

NOTAS: De 1950 a 1970 los contrayentes con edad menor a 15 artos se presentaban en el grupo de 15 a 19 artos y el grupo de 40 a 44 anos, se
encontraba incorporado en el grupo de 40 a 49 años. Para el año de 1979 se publica la información de la misma manera, debido a que
no se dispone del tabulado original y estas cifras corresponden a las del Anuario Estadístico de los Estados Unidos Mexicanos, 1982.
De 1950 a 1975 y de 1985 a 1992 se generó información por entidad de registro y en el periodo de 1976 a 1984 por entidad de
residencia habitual de la contrayente, motivo por el cual para estos años se presenta la clasificación de residentes en el
extranjero y de entidad no especificada.
El incremento de las cifras que se muestran para los años de 1972 y 1974 se debe a que se incluyeron matrimonios registrados
durante la "Campaña Familia Mexicana".
