The Federal Bureau of Investigation, United States Department of Jus­

tice, is charged with the duty of investigating violations of the laws of the United States and collecting evidence in cases in which the United States is or may be a party in interest.

The following list indicates some of the major violations over which the Bureau has investigative jurisdiction:-

National Motor Vehicle Theft Act Interstate transportation of stolen property valued at $5,000 or more

National Bankruptcy Act

Interstate flight to avoid prosecution or testifying in certain cases

White Slave Traffic Act Impersonation of Government Officials Larceny of Goods in Interstate Commerce Killing or Assaulting Federal Officer Cases involving transportation in interstate or foreign commerce of

any persons who have been kidnaped Extortion cases in which interstate commerce or interstate communication

is an element Theft, Embezzlement or Illegal Possession of Government Property Antitrust Laws Robbery of National Banks and Member Banks of Federal Reserve System National Bank and Federal Reserve Act Violations, such as embezzlemont,

abstraction or misapplication of funds Crimes on any kind of Government reservation, including Indian Reserva­

tions or in any Government building or other Government property Neutrality violations, including the shipment of arms to friendly nations Frauds against the Government

Crimes in connection with the Federal Penal and Correctional Institutions Perjury, embezzlement, or bribery in connection with Federal Statutes or

officials Crimes on the high seas

Federal Anti-Racketeering Statute The location of persons who are fugitives from justice by reason of vio­

lations of the Federal Laws over which the Bureau has jurisdiction, of escaped Federal prisoners, and parole and probation violators.

The Bureau does not have investigative jurisdiction over the violations

of Counterfeiting, Narcotic, Customs, Immigration, or Postal Laws.

Law enforcement officials possessing information concernjng violations

over which the Bureau has investigative jurisdiction are requested to promptly forward the same to the Special Agent in Charge of the nearest field

division of the Federal Bureau of Investigation, United States Department of Justice. The address of each field division of this Bureau appears on the inside back cover of this bulletin. Government Rate Collect telegrams or telephone calls will be accepted if information indicates that immediate action is necessary.

NATIONAL STOLEN PROPERTY FILE

An interesting identification recently effected through the Na­tlonal Stolen Property File indicates clearly one of the many advantages that this file possesses to law enforcement agencies.

On September 16, 1934, six pistols were stolen from the Nation­al Guard Armory at Clinton, Tennessee, and as far as it could be determined all but two of these had been recovered. One of the two, a .45 calibre Colt automatic pistol, Serial number 502216, had not as yet been found.

Wi th the inauguration of the National Stolen Property File by thlS Bureau on April 1, 1936, a systematic check was made of all pending in­vestigations being. conducted by this. Bureau and al1 unrecovered property sufficiently well described to enable indexing was searched against the rec­ords of the National Stolen Property File. As a resu1 t, a record of the above described gun was identified as the one having been used by John Daugherty, with aliases, during the robbery of the Fluvanna County Bank, Fort Union, Virginia, on September 23, 1935, this gun having been previously identified as the weapon which killed State Trooper W.R. Thompson of the Virginia State Police. Incidentally, Daugherty was convicted on a p1ee_ of gUi! ty in the Sta te Court at Palmyra, Virginia, and on November 20, 1935, sentenced to death with additional sentences of thirty and forty years.

It is apparent that many similar identifications oan be antici­pated by law enforcement agencies taking recourse to the facilities of this file wherein a record of ANY STOLEN ITEM CAPABLE OF DESCRIPTION WILL BE IN­DEXED. As indicated in the special announcement in the FBI Law Enforcement Bulletin dated April 1, 1936, particular care should be used to furnish se­rial numbers whenever possible or any other posi ti ve means by which the ar­ticle can be later identified. Reports as to stolen property and requests for searches in this file may be submitted in the manner usually employed by the reporting agency.

As a matter of sugges"Lion, the following information is consid­ered essential in requesting a search and indexing firearms:

The type of firearm (revolver, pistol, rifle, shotgun, et cet­era); serial numbers; make (name of manufacturer); calibre (gauge); monograms, initials, inscriptions, or other descrip­tive data; name of the complainant and his address; type of offense; date of offense; the police department (or reporting agency) report number; the name of the contributor (police de­partment, sheriff's office, et cetera), city, state; remarks of any unusual circumstances which are believed material for recording.

THE POLICE IDEAL OF SERVICE By

The i deal of service impl i es serving mankind to the best of the donorls abil ity , in the considerati on of whi c h , thought must be g iven to the sp irit inspi ring this i deal . The sp irit of service has been a motivating influence for the betterment of mankind . The development of the uses of electr i c i ty , the a i rplane , and sc ient i f i c contribut ions too numerous to re­count have been made possible because of this creative spirit of service . In the years that have gone , Gal i l e o , Copernicus , Darwin , and other great idealists blazed new trails . Each contributed something to the total knowl­edge of the world of the ir period , and at the same time laid the solid foun­dation for modern and future science . This foundation ennobled l iving and made it ri cher. The posses or of an i deal is never content with inaction, but is impe l l ed by an irresistible urge to act in accordance with that i deal .

Attendant to the ideal of service is courage---not physi cal courage, for never i n the history of police departments have pol i cemen ever been charged with exhi bi ting physical coward i ce. Moral courage makes it pos­sibl e for pol i c emen to depart from old traditions in the face of professional ridicul e and publ i c scepti Cism to experiment with new i deas and i nventions . The use of the Hol lerith Tabulator , the l i e detector , fingerprinting and simi lar sc i enti f i c instruments or methods are evidence of moral forti tude on the part of some pol i ce off i cial of the p8.st . Pol i cemen exhibit moral courage by standing for the ri ght, even unto death if that is necessary.

An i ntegral part of service is the spirit of tol eranc e . No country, institution , or has a monopoly on Truth, and recognition of thi s should command inte l l igent pol i ce off i cers to respect, the other man I s poi nt of view . The pol i ceman who , i n his own opinion , is always correct, i s proverbi a l ly the man who is most always wrong by actual observation . Pol i ce­men are parti cularly required to have sympathy for, and interest in , the other policemanls point of view, attitude , and opinion. Such a man has gain­ed an estimation of the meagreness of knowl edge even in its total ity .

Each year new discoveries are made , wider fields of thought ex­plored . The greatest sc ientific men of thi s age have tol erance for the oth­er manls view , be cause they know that knowl edge is inf inite . Their attitude thus assures the betterment of world conditions: Aga in, tol erance for the other manls re l i gious bel i ef i s a personal obl i gation i nasmuch as each manls own be lief is his road to Heaven. The pol i ceman must be imbued with these i deals of service because Man and the fate of mankind become his chief in­terest in l i fe , upon his i nduction i nto pol i ce work . The service ideal aspires to the personal atta inment of knowledge , ---the guiding princ ipl e be­ing joy and pl ea.sure i n l earning. This motivates the pol i c eman to delve profoundly into the theory and practi ce of deal ing with human be i ngs, as i n­dividual s and as groups. His search i nto natural , biological and soc ial sc i­ences i s an eternal quest for that clue whi ch , i f found , wil l aid the pol i ce­man in deal ing more inte l l igently with his fel l ow men. With this spirit of sci entif i c understanding, he accords to the l owly IIbum , II drink-sodden and

covered with vermin, that degree of sympathy and consideration to which that unwilling weakling is entitled as tb¾ victim of the immutable laws of his inheritance or of environment. Why do some human beings kill, others steal, and still others commit the many varieties of sex offenses?---These answers can only be known by the policeman who seeks knowledge in all fields related intimately or remotely to the task at hand, penetrating that realm wherein may be found the means liO live a more abundant life. Offenders, complain­ants, witnesses, prosecutor and judge are all human beings. Accordingly, the poli¿eman must intimately know the factors underlying human behavior if he hopes to succeed in his chosen profession.

Associated with the ideal of service is the spirit of optimism. No group of men have a finer opportunity to spread the gospel of good cheer than the policemen of today. They come in contact with every phase of hu­man suffering, and if they add to the gloom that surrounds them, they are unfitted for the duties they are expected to perform. Policemen must ever look forward with confidence and certainty to the day when man shall real­ize his spiritual potentialities, and here, spiritual is used in its broad­est sense. Policemen may look forward with certainty to the period when service will conquer selfishness; when joy, peace, good will, rule the heart and mind. The personali ty beams in that individual who possesses an undi­luted spirit of optimism.

The spirit of creativeness is always present in the ideal of service. With this spirit the policeman may not let things remain as they are. He is forced by an impulse over which there is no control, to do his share in making the world a better place to live in. Policemen in the ser­vice today are like a connecting link between those who follow, and those who have gone before. Whatever has been worthily and constructively done, must be carried on in this spirit of creativeness, and in addition thereto, policemen will add to that which has been accomplished so that those who follow should be better able to serve, passing on to them the best of to­day, so that they may improve the future. Since all humans differ, one from the other, this creative and constructive force will manifest itself in every aspect of police service.

Inseparable frOID the ideal of service is the spirit of sacri­fice, which in the last analysis must always remain a spiritual offering. Men who enter the police department should be informed in advance that there is no material wealth possible in their chosen profession. Men who expect to become weal thy should be advised to enter another field. Policemen can­not be concerned with material possessions if they have the true spirit of sacrifice. They cannot pursue their calling for wealth or fame for these are not to be found in this branch of government. They must be willing to fore-,. go many of the pleasures of social life because of their connection with the police force. If they have the true spirit of sacrifice, their pleasures will be derived from their labors. There are today thousands of men who are not getting the salary that they should receive; but they are just as devot­ed to their task, and to the people they serve, as any human being could be devoted to any worthy cause.

All ied with the ideal of s ervice is the spiri t of humil i ty . The right type of pol iceman is ever mindful of the d i gn i ty of pol ice service , and i s fully aware at all t imes of the respons ibi l i ty and privilege of ser­vice and all of i ts i mpl ications. Merely serv ing the people , cashing the pay check at the end of the month and doing a good turn dai ly , is not enough . Pol icemen mus t give constant thought to the various unwri tten dut i e s and al-· ways be eager to ful f i l l the ir obl igations.--Not those obl i gations that can be commanded by rul e s and regulations , but that free will offering tha t can never be commanded , but i s soul giving .

Rum i l i ty has been defined as being humble i n spiri t , free from arrogance and egotism . No pol iceman can be arrogant , and no pol iceman can be an egot ist , and surely every pol iceman mus t be humble in spi r i t , for the work that he does must always be done in gentle modesty and self-effacement, and wi thout hope of reward save the consciousnes s of a duty wel l done .

I n mentioning the ideal of service , the mind instantly reverts to the spi r i t of perseverance , becaus e i n pol ice service , "holding-on" i n the face o f defeat and against overwhelming odds , require s a perseverance that admits of no defeat . Even though failure s e ems inevi table the spirit of perseverance will dri ve the pol iceman on . Suffice for him that the ob­j ective be atta ined . Regardle ss of obstacles , hardship, suffering, ridicule, and pain he will unf l i nchingly carry-on w i th a tenaci ty that assures suc­cess and will ul timately dominate the s i tuation regardless of i ts difficul­t i es .

The i deal of s e rvice also i ncludes the spiri t of integr i ty . Wi thout that qual i ty of moral soundness , pol ice departments or pol ice offi­cials do not command the respect of the communi ty . The pol iceman who takes peanuts from the s tand of a peanut peddler is no less criminal than is the grafter , gangster or racketeer who steals mill ions . He who i s di shonest or unrel iable in any particular has no place in any branch of pol ice s e rvice. With integri ty everything i s possible , wi thout this priceless attribute of character the pol iceman is doomed to fai lure in his chosen profession . The spi r i t of integri ty comprehends , al so , the obl i gation of the pol iceman to deal fairly with superiors and subordi nates alH:e; there will be no decep­t ion of e i ther by the possessor of this virtue . The violation of a single promise made by a pol iceman reflects upon the integr i ty of the entire organ­ization . Every agreement entered i nto with another , regardless of the sta­tion of the individual , is inviolate and mus t be kept as faithfully as a con­tract protected by a bond . One need not be fearful that a pol iceman w i l l resort t o sharp pract ices or dece i t i f h e has integr i ty . Especially does thi s apply to the members of the criminal fratern i ty . They know , when they are prosecuted by dependable pol icemen , that these off i ci als will introduce not only that evidence which is l ikely to convict them but will present to the court all of the informat ion gathered, irrespective of whether i t i s for or aga inst the defendant . Truthfulness in all its impl ications i s an in­separabl e part of i ntegr ity , and thi s spirit should dominate and d irect the thoughts , feel ings , and act ions of every member of a pol ice organizat ion.

Finally, in the ideal of service there is the spirit of friend­

shi p . --The type of f r iendship that radiates happiness, kindly humor, friend­l iness , and conf idence in each other. Wherever pol icemen possess thi s spi r­i t of friendship , there i s less discord, less gloominess, l e ss mental de­pres s ion and misunderstanding in pol ice departments than i s to be found in any other walk of l ife. The policeman who has thi s spir i t of f r iendship will f ind, as he passes on hi s way that he will impart thi s spir i t to all with whom he may come in contact; the poor , the down-and-outer , the lowly and the rich , the good and the bad. Of him it can be t ruly said , as by a l i ttle Japanese in referring to Patrolman Riley of the Los Angeles Pol ice DeparT-­ment, "He i s like the sun; he shines all the t ime with his smiles and fri end­l ines s . "

The ideal of s ervice i s not the s imple type of s ervice ordina­r i ly thought of by unthinking persons, but i s of i tself a great sun , around which revolve many planet s , al l be ing important in perfect ing the constella­t ion . Therefore , the pol iceman who has the ideal of service as here con­ce ived , i s certain to rai s e the l evel of the organizat ion to which he i s at­tached and improve the character of the community that he s e rve s .

The purpose of the art icles publ i shed in the FBI Law Enforcement Bullet i ns of November and December, 1936, and January , 1937, in regard to the use of the word "APPLICANT" was to insure search of appl icant prints taken on the Bureau's personal ident ification f ingerpr int form and has no bearing whatever on criminal pr ints which are all searched against the crim­inal f il e s.

In some instances prints on the Bureau's criminal f ingerprint form have been rece ived in its Ident i f ication Divis ion reflect ing a current criminal charge as well as the notati on "APPLICANT . "

Contr ibutors are urged t o make a distinction between f ingerpr int cards submi tted in the case s of appl icants and thos e forwarded for the pur­pos e of furnishing criminal records . I t i s suggested that to avoid confu­sion in this respect contr ibutors use the pe rsonal ident.ifica t ion f i nger­print form with the word "APPLICANT" indicated thereon by s tamp or in some di s t inc"tive manner. CIRCUMSTANTIAL EVIDENCE

As we have pr'ogre ss ed i n the detect i on of crime and the suc­cessful prosecuti on of cri minals , the law enforcement officer's familiarity wi th the rules of evidence has begun to be cons i de red one of his valued qualificati ons .

There are t imes Wlen the inves ti gat ing officer f inds s ome uncer­tainty in h i s mind as to the acceptability of certain kinds of evidence in the courts. Particularly does th i s occur when the officer weighs in h i s mind the admi s s ibility and effect iveness of ci rcumstant ial evidence .

There i s probably nothing more misunderstood than ci rcums tantial evidence . There has been much controversy, which undoubtedly i s traceable to sentimentali ty, about convict ing a pers on upon circumstantial evidence . Unless the investigator unders tands the rules concerning evidence he will f ind himself confused and w i th doubts i n his own mind as to the value of cir­cumstantial evidence . This can result only i n lack of directnes s in h i s in­ves tigation and the failure to preserve and develop the very evidence that may be needed to properly prosecute a cas e .

For the purpose of aiding in clearing up tl1e misunderstandings of circulilstantit:'.l evidence, we can divide evidence into two types , di rect and circumstant ial . As s tated in U. 8. v. Greene, 146 Fed . 803 l1Direct and

evidence diffei' merely in the i r logical relat i on to the fact in issue . Evidence as to the exi s tence of the facts i s direct . Circumstan­tial eviuence i s composed of facts which rai s e a logical inference as to the exi s tence of the fact i n issue. 11 Ot' let us pres ent i t this way: Direct evi­dence of a cr ime is evidence 01' testimony given by an eyewitne s s , his own knowledge of the fact about which he i s testifying . (The criminal law in­cludes in thi s ca egory confess i ons I admi s s i ons of the accus ed and dying declara· ions . ) Circumstantial evidence cons i s ts of proven facts frolD which a j ury may infer by proces s of reasoning , or deduction according to the com­mon experience of mankind that the accus ed commi tted a certa in crime .

The nece s s i ty of frequent resort to ci rcumstantial evidence to prove guilt in a criminal proceeding i s apparent in the very nature of things . A criminal will endeavor to perform his acts in secrecy . His move­ments are s o planned as to avoid an eyewi tnes s ever observing him or any of his acts in the cO ll i s s i on of a cr ime. Naturally he chooses a time and occa­s i on which favor his concealment, s edulously scheming to render detect i on im­possible . I n such cas e s there can be no di rect evidence 8S there will in all probability be no eyewi tnesses, If circumstant ial evidence were to be exclud­ed in s uch cas e s , the major i ty of criminals would certainly go unpuni shed .

evidence; in the concrete, it may be infinitely stronger. A fact positive­

ly sworn to by a single eyewitness of blemished character is not satisfac­torily proved as is a fact which is the necessary consequence of a chain of other facts sworn to by many witnesses of undoubted credibility. All evi­dence is more or leso circumstantial, the difference being only in the de­gree; and it is sufficient for the purpose when it excludes disbelief. Cer­tain cases of circumstantial proofs to be found in the books, in which in­nocent persons were convicted, have been pressed on your These, however, are few in number and they occurred in a period of some hundreds of years. They are constantly referred to in capital trials to frighten juries into a belief that there shou] if be no conviction on merely circum­stantial evidence. But the law exacts a conviction wherever there is legal evidence to show the prisoner I s gui 1t beyond a reasonable doubt; and cir­cumstantial evidence is legal evidence.1I

That circumstantial evidence is legal evidence is accepted law and cannot be denied. The hue and cry that is raised condemning circumstan­tial evidence is an effort to make the jury believe that the use of circum­s ²antial evidence takes odvantage of t,he accused and does not safeguard his rights.

So that the investigator may have no uncertainties in his own mind as to whether the accused I s rights are adequately protected when the prosecution is depending upon circumstantial evidence it might be well to discuss bdefly the relative safeguards agtl,inst error as offered by direct evidence and circumstantial evidence.

In Cownonwealth v. Webster, 59 Mass. (5 Cush.) 295 , a leading Massachusetts case the relative advanteees or safeguards of direct and cir­cumstantial evidence are pointed out by Chief Justice Shaw: "The advantage of positive evidence is that it is the direct testimony of a witness to the fact to be proved. Who, if he speaks the truth, saw it done; and the only question is whether he is entitled to belief. The disadvantage is that the witness may be false and corrupt and that the case may not afford the means of detecting his falsehood. 11 In discussing circumstantial evidence the judge s ³ated: "The advantages al'e: that, as the evidence commonly comes from sev­eral witnesses and· different sources, (J, chain of circumstances is less like­ly to be falsely prepared and arr8,nged and falsehood and per jury are more likely to be de´ected and fail in their pvrpose." The advantages and pro­tection afforded the accused in the use of circumstantial evidence is well expressed by Jones, in Vol. 1 Sec. 10 of his commentaries on Evidence: "In­deed, it has been many times observed that strong circumstantial evidence of crimes committed in secret, as happens in the majority of offenses, is t,he most satisfactory of any to point to the guilt of the accused, for men may be seduced to perjury by many base motives, to which the secret nature of the offense may sometimes afford a temptation; but it can scarcely hap­pen that many circumstances, especially if they be such over which the ac­cuser could have no control, forming together the links of a transaction, should all unfortunately concur to fix the presumption of guilt on an in­dividual, and yet such a conClusion be erroneous."

No capable investigating officer would be satisfied with the mere statement of one individual that he had seen the accused fire upon kill the victim. He would not rest his case there. This, however, would be direct evidence. But if we WAre to depend on direct evidence of this type we could not help but question the veracity of the witness. Did he have a reason for pinning the guilt upon the accused or did he possibly, honestly believe his accusation although he has been mentally tricl<ed by some mis­perception. To insure justice to the aocused it would be incumbent upon the

officer to search for the fingerprints of the accused upon the wea.pon used in the killing; the fatal bullet would be examined to determine its similar­ity to a test shot fired from the weapon, to prove scientifically by fire­arms identification that the fatal shot had been fil-ed by 'Óhe weapon on which the accused's fingerprints were found. None would say that evidence of this type was prejudic:ed or intended to deny accused of any of his rights. Yet thjs is clearly in the field of cirCUffib ajltial evidence. True Ôhis example is extremely simple but the S8.me process follows in complex cases. This type of evidence is being favored more and more. It is elsa for this reason that scientific processes are coming into prominence in investigating The

clever criminal plans his crime to avoid the possibilities of developing di­rect evidence in so far as is posoible, however, circumstantial evidence un­wittingly left at the crime scene, impersonally, witho1J.t the pOGsibDities of human error and prejUdice speaks of his acts scientifically. The latent fingerprint, a strand of rope, a blood stain, all circumstantial and yet the success that has so far been acl1ieveu ose worldng along these lines should inspire law enforcement officers to make full use of the facilities which the crime laboratory is placing at their disposal.

It has not been the purpose of this short comment to go complete­ly into the realm of the extensive law pertaining to direct and circumstan­

tial evidence in all of its ramifications, but it is hoped that the investi­gator may have had cleared in his rrind some of those points which may have disturbed him when thinking of evidence in relation to its acceptance by court and jury.

It may well be stated that circumstantiÕl evidence is often bet­ter and more convincing than other evidence. It is equally truo that where circ\.\ms·Öantial evidence is pl'e-erninent that the officer shoulCl 1;e most care­ful. A set of circumstances can too easily be made to fit an accepted theo­ry. The investigator should constantly guard against the danger of forming a pn)concei ved theory and make· every effort to preserve an open mind to as­sure of a proper investigation of the case on hand.

BONES AIDING I N IDENTIFICATION OF UNKNOWN DEAD

W . K . Merr i l l , District Ranger , Wawona , Cal ifornia , has adv i sed the FBI of an interesting ident i f i cati on of an unknown dead person by Rang­e rs of Yos emite Nat i onal Park and the Berkel ey Pol ice Department .

Whi l e on a reconna i s sance i n February , 1934 , Ass i s tant Chi ef Ranger Wegner and Park Forester Ernst found s everal p i ec e s of what loolced l ike human bones in the talus s l ope of Half Dome , e levation 8852 feet . The bones were taken to headquarters where they were at f irst thought to be the rema ins of Godfrey Wondroselc of Chi cago , a man reported to have been lost in thi s regi on the year before .

I t was a month later before snow had mel ted suff i c i ently for Rangers to make a thorough search of the secti on where the bones had been found . I nve s t i gat i on d i s c losed that parts of bones and cl othing were s cat­tered for a di stance of a quarter of a m i l e pe rhaps by coyotes and bears . A be l t with the initial "H" on the buckle was found along with a wal l e t that conta i ned no ident i f i cation . All ident i f i cation marks had been removed from the c l othing . However , back under a huge overhanging rock an overcoat was di scovered w i th a t imetabl e in one of the pockets . The t ime table was dated September 21 , 1 930 , and had a penc i l check mark i ndicat ing that the party had evidently taken the 1 1 : 30 p . m . train from the Ferry Bui lding i n San Fran c i s c o for Yosemi te .

The Chi ef Ranger ordered that the jawbone be taken to the res i ­dent dent i s t , Dr . Davi e s , who determined that the bone belonged to a man be­tween the age of twenty-three and twenty-f ive year s . Pol i c e Departments in the Bay region were not i f i ed of the discovery and in less than twenty-four hours the Berke l ey Po l i ce not i f i ed that thei r f i l e s showed that a young man by the name of Vincent V. Herkomer , age twenty- three , Univer s i ty of Cal i for­nia s tudent , had been mi s s i ng from Berke l ey s ince October , 1930 .

The father of thi s boy was not i f i ed and he came to Yosemite wher e h e ident i f i ed the belt and clothing as having belonged to his son . Mr . Her­komer stated that his son had been suffering from severe head pains shortly before h i s disappearance and he bel i eved that h i s son had commi tted sui c ide .

When the Los Ange l e s , Cal iforni a , Po l i ce Department arrested Jame s Scott on susp i c i on of a s sault w i th a deadly we8,pon th e viet.im of the a s s ault was bel i eved to be near death . The Los Ange l e s Pol ice Department d e s i red to have a report as s o on as pos s ible of any criminal rec ord on f i l e f o r Scott . I t was be l i eved tha t Scott might poss ibly b e wanted i n the east­ern s e c t i on of the c ountry and that a nota·� i on of h i s being wanted. m i ght be i n c l uded in the f i l e s of the I dent i f i ca t i on Divi s i on of the Fe�eral Bureau of Inve s t i gat i on , together w i th any rec ord of pr i or arre s t s .

The fastest ma i l between Los Ange l e s , Cal ifornia , and Washing­t on , D . C . , would have to trave l ove r three thousand mi l e s . It was d e c i ded , therefore , t o effect instantane ous transmi s s i on of the f i nger impre s s i ons thr ough the fac i l i t i e s of a coas t to coast t e l ephoto system hook-up . The tel ephoto rec ord of Scott ' s f ingerprints was rece ived in the I dent i f i cat i on Divi s i on of the Federal Bureau of Inve s t igat i on in the late afternoon o f November 20 , 1936 . The tel ephoto impre s s i ons were immedi8;t a ly s ea r che,l through the fingerprint f i l e s of the I dent i f i ca t i on Divi s i on and f ound t o b e i dent i ca l wi th the prints o f James Scott .

The criminal record of thi s man ind i C8. t.ed he was arre s t ed at Chi cago , I l l ino i s , on February 25 , 1936 , for murder . His c r iminal care e l' stf.rted when he was rece i vad at the Um ted States Di s c ipl inary Ba.rrack s , Fort Leavenworth , Kansas , on O ct ober 14 , 1 91 6 , on a charge of mal i c i ou s assaul t to s e rve 8. s entence o f two years . O n May 1 , 1923., he was rece ived at the State Peni tent iary at J o l i e t , I l l inoi s , on a cllarge of murde r to s erve a s entence of twenty yeal' s . A notat i on i n the f i l e s of the I dent i ­f i cat i on Divi s i on indi cates , howeve r , that he was d i s charged f rom J o l i e t , I l l ino i s , on July 3 1 , 1 934 .
