On 5 November, thousands of medical and sales representatives of the country again came out in the streets in major cities and towns in almost all states and Union territories to observe Victory Day as Central government retreated and restored Industrial Tripartite Committee for the Sales Promotion Employees on 27 October following countrywide protests and agitation with impending future higher industrial actions by FMRAI. With full enthusiasm, the Victory Day was celebrated by way of street rallies, processions, handbill distributions, hall meetings, poster pasting, two wheeler rally etc. Some of the units of UPMSRA observed the day in different dates due to Moharrum festival. In Jharkhand rally could not be organized due to election code of conduct. In many districts of Maharashtra, administration denied rally permission due to rallies took out by dalits on that day following incidents of atrocity against them in Ahmednagar. Aggrieved and infuriated medical and sales representatives of the country had to resort to countrywide protest and agitation beginning with 5 August against the arbitrary and authoritarian decision of Central government of dissolution of Industrial Tripartite Committee for the Sales Promotion Employees in July which was constituted in January of this year as a result of two decades struggle by them for effective enforcement of law, amendment and expansion of law in the background of thousands of victimization of the medical and sales representatives; rampant violation of labour laws, litigations and agitations by the medical and sales representatives. The restoration decision came amidst preparation of the medical and sales representatives for massive dharna and demonstration before Parliament in November and countrywide strike in December. In West Bengal, with immense enthusiasm around two thousand WBMSRU members of Coochbehar, Uttar Dinajpur, Murshidabad, Nadia, Birbhum, Burdwan, Midnapore East, Midnapore West, Hoogly, Howrah, North 24 Parganas, South 24 Parganas, Darjeeling, Murshidabad and Kolkata district celebrated by way of campaign through poster pasting, holding street corner meetings, rallies etc. Torch light rallyprocession was organised by Uttar Dinajpur district. Around 800 members of Howrah, North & South 24 Parganas and Kolkata took out a street procession from Subodh Mallick Square which culminated in a public meeting at Dorina Crossing, Esplanade, addressed by FMRAI’s general secretary Aloke Banerjee its treasurer Partha Rakshit, WBMSRU secretary Partha Roy and presided by WBMSRU vice president Sumit Roy. Around 2000 BSSRU members participated in victory rallies at different units of Bihar on 5 November. Majority of the units organised torch light processions. At Patna, rally was taken out from BSSR Union office and culminated in medicine market at Govind Mitra Road. Joint general secretary Anupam Kumar addressed the meeting. At Jharkhand unit meetings were organised and press statements were released.In Odisha Victory Day was observed in all 15 districts by organizing rallies and street corner meetings. In Berhampur, 200 members participated in a rally which marched through the main town and culminated in a street corner meeting, addressed by the leaders of CITU, DYFI and others. In Cuttack, street corner meeting was organized in front of SCB Medical College & Hospital. Hall meetings were organized in Bolangir, Angul, Balasore and Bhubaneswar.In North East, Victory Day was observed Nearly3000 field workers of Macleods Pharmaceuticals out of total estimated around 4000 staged state-wise day long dharnataking casual leave en masse on 10 November in pursuance of two demands, as notified by FMRAI. On the previous day, Macleods field workers ofall divisions -Pharma, TBCare, Gencare, Acuphar, ProcareAHT, Procare CV, Oxalis, Osteva and Macpharmet in state- wise conventions, adopted resolutions on the demands and movement and submitted to management next day during dharna in a delegation at Howrah, Cuttack, Patna, Guwahati, Allahabad, Jaipur, Chandigarh, Raipur, Indore, Nagpur, Hyderabad, Vijayawada, Ernakulam and Bangalore. In pursuance of two demands– settlement of pending charter of demands and implementation of mutually agreed decisions arrived at in Welfare Committee meetings of 14 March 2013 and 14 April, 2014, FMRAI notified the management for this industrial action. Management attempted to sabotage Dharna at Allahabad the programme of 10 November. Despite advance notification, management arranged foreign trip,as an incentive for field workers, coinciding with FMRAI’s dharna programme. But the determined Macleods field workers did not fall prey andlarge number ofthem protested management’s attempt, refused to go and sat in dharna.State council sub committees of FMRAI in solidarity with Macleods field workers held gate meetings which were addressed by leaders of FMRAI, its state units and Macleods council. Field workers took leave but dharna and demonstration could not be staged but attended a convention in Ranchidue to AcharSanhita in Jharkhand.In Tamilnadu field workers participated in unit level meetings taking leave. Dharna and demonstration did not take place in Delhi and Gujarat. Macleods management underplayed with the determination of the company’s field workers who have been patiently pursuing their collective bargaining, trade union and legal rights. For upward improvement of service conditions, FMRAI submitted charter of demands in 2010 which was subsequently revised and submitted in February last. But, instead of discussing on the COD, management adopted delaying tactics.Further, despite management called grievance committee (Welfare Committee) meetings, signed minutes of understanding but did not implement many of the decisions mutually arrived at. Under the Macleods council leaders Tapan Karmakar and Ayan Saha. In north-west, field workers of Punjab,Chandigarh and Himachal Pradesh staged dharna at Chandigarh. Out of total 106 field workers in North-West, 90 took casual leave including 10 non members of Punjab.The convention held on the previous day was addressed by PCMSRU general secretary Shiv Awasthy, its vice president Naginder Kumar, HPMRA Mandi Unit’s leaders Yatinder Thakur and Anil Sharma and Macleods council convener Arvind Chaoudhry.There was no field worker in Haryana and J&K.According to available information 31 out of 35 Fieldworkers assembled in Sri background, all India Macleods council committee in its meeting of 20 September last decided movemental steps. In Odisha, 103 out of 154 fieldworkers participated in dharna in front of the company’s C&F at Cuttack. Gate meeting was addressed by OSRU president BijayKrushna Das, general secretary Subhankar Das, Macleods council convenerSangramKeshariMallick and others. In North East states, field work was completely paralysed in all 7 states. Gate meeting at Guwahati was addressed by CRU leader Rahul Purokayastha. Gate meeting at Patna was addressed by BSSRUgeneral secretary Debashish Roy and others. In West Bengal, 204 out of total 267field workers staged dharna at Howrah. Gate meeting was addressed, among others, FMRAI’s vice president Alok Ganguli, Howrah district CITU’s office bearer Md.     It is another attack of Modi government on the legal rights ofthe sales promotion employees. On 25 November, The Labour Laws(Exemption from Furnishing Returns and Maintaining Registers byCertain Establishments) Amendment Bill, 2011 was passed bymajority in Rajya Sabha on 25 November and by the Lok Sabha on28 November, 2014. By this amendment certain establishments areexempted from submitting annual returns and maintaining registersof 16 labour laws, one of which is the Sales Promotion Employees(Conditions of Service) Act, 1976.

    The original 1988 Act had such exemption provision for thecompany establishments which are having total number of workersup to 19. This exemption threshold has been raised from 19 to 40 bythis amendment. That means, those company establishments, whichare having total number of workers up to 40, need not submit annualreturns and maintain registers as required by different labour lawsincluding SPE Act. In any case they have to abide by the law. Theexemption is from submission of annual returns and maintainingregisters.

    These small establishments would have to furnish just one returnin place of several returns as existing. Further, the amendment allowedthe employers to maintain registers / records electronically in computersor other devices and submitting return electronically etc. etc.

    The total number of factories and huge number of workers willbe adversely affected by this amendment as majority of the factoriesemploy workers less than 40. As far as the Sales PromotionEmployees are concerned, very few small scale sector companies,having total number of workers upto 40, employ the Sales PromotionEmployees. But, the field workers must remain vigilant against anymove by the employers to take advantage of the amendment for anescape route from maintaining registers etc. In this background,the ongoing state-related programme and all India programme tocertain drug producing states for enforcement of SPE Act hasbecome priority.

    There was an earlier attempt for amendment of the Act in 2005.Parliamentary Standing Committee returned the 2005 Bill to thegovernment with approval of proposed stronger punishment clausefor violation, but for raising threshold for exemption recommendedconsensus with the trade unions. That time government withdrew theBill.

    The present Bill is silent on punishment clause for violation ofthe laws by the employers; increased the number of labour lawsfrom 9 to 16; increased the threshold to 40 workers withoutconsultation with the trade unions; and was placed and passed bythe Parliament.

    Under section 5 and Rule 22(1) under the Act, each salespromotion employee shall be provided with appointment letter inprescribed Form-A. But, large number of pharmaceutical companiesis issuing illegal appointment letters. With the advent of economicliberalization, pharmaceutical companies are recruiting salespromotion employees under the designations of officers with anaim to push them out of the purview of SPE Act in order to denythem the benefits of law. Further, under section 7 of the Act, employersare to maintain service books and other registers in prescribedformats which are also grossly violated by the employers. Ironically,the State governments, who are to enforce this law, remain simpleonlookers. The Inspectors, appointed under the law, did not evenverify as to whether appointment letters were issued to salespromotion employees in prescribed Form A or not, as to whetherregisters are being maintained or not.

    Violation of existing laws by employers and inaction of thegovernments enforcement authorities are leading to large numberof victimizations, litigations and anarchy in the industry. This hasforced FMRAI to press demands before Central government foreffective enforcement of laws, for expansion of laws and constituteIndustrial Tripartite Committee for the Sales Promotion Employeeswhich was constituted in January this year by UPA government,dissolved by Modi government in July and following agitation andprotest by fieldworkers again restored in October.

    Against the retrograde amendment of labour laws, field workerswill oppose the Central governments move and will participate inthe national protest day on 5 December, as decided in the nationalconvention of joint platform of all the central trade unions andnational federations/organizations including FMRAI.

    In Rajasthan, aroundthousand of RMSRU membersof Bikaner, Kota, Jodhpur, Pali,Alwar , Udaipur, Jaipur unitscelebrated victory day throughrallies, special general bodymeetings, gate meetings,pamphlets distribution amongmember and non members,whole sale distributors, chemistsand doctors. Sweets had beendistributed among and beyondthe members in some of the subunits. Both print and electronicmedia gave wide coverage. InPunjab and Chandigarh,members of PCMSRU observedthe day through unit meetings,rallies etc. In Chandigarh 125 fieldworkers attended a general bodymeeting on 4 November,addressed by unit secretary S DAgnihotri.After then a rally wastaken out from Cheema Bhawanand culminated at Labourcommissioner office ofChandigarh. Unit general meetingsat Moga was addressed by unitsecretary SachinWadhera and atPathankot, addressed by unitpresident R SJ a s r o t i a . B a t h i n d a u n i torganisedgeneral body meeting 19November addressed by unitsecretary Chandermohan. A rallywas conducted from GandhiMarket to Teacher Home.

    HPMRA membersinHimachal Pradesh organizedrallies and gate meetings in allits units-Mandi, Shimla, Kangra.Dharamshala,Hamirpur, Una,

    Solan and Jassure. A rally wasorganized at state centre Mandi,was addressed by theHPMRAgeneral secretaryJagdish Thakur. Media gave duecoverage.UPMSRA members InUttar Pradesh-Uttarakhandobserved the day ina befitting manner. Victory rallies,special general bodymeetings,postering were held atBasti, Ballia, Jaunpur,Gorakhpur,Lucknow, Gorakhpur, Ghazipur,Moradabad, Kanpur,Aligarh,Dehradun, Meerut,Bareilly,Shahjhanpur,Allahabad,Barabanki,Sitapur, Orai and inother places.237 members ofJaunpur unit oraganised a historicrally of 5 kilometer. UPMSRAgeneral secretary Hemant Singaddressed the Lucknow rally atAminabad. Lucknow unit againconducted a huge rally on 28November in medicinemarket.Ballia meetingwasaddressed By CPI(M)leader PN Rai, CITUleaders and others;UPMSRAstate committeemembers Manoj SrivastavandRaghubanshUpadhyay.

    Despite prohibitory orders onrallies in majority districts inMaharashtra, MSMRAmembers of Wardah, Gondia,Amravati, Jalgaon, Dhule, Jalnaand Parbhani units took out streetprocessions, distributed handbillsand held unit meetings on theVictory Day. At Nagpur,Yavatmal, Akola, Khamgaon,Nashik, Sangamner, Nanded,Satara, Karad, Sangli andRatnagiri, large number ofMSMRA members participated inspecial general body meetingsorganized on this occasion. InGujarat, Junagadh unit observedvictory day on 5 November byholding special unit generalmeeting. FMRAIs workingcommittee member M. N.Dattani explained issuesinvolved. Similar programmeswere conducted in Surat andBaroda.On the Victory Day,large number of MPMSRUmembers in Madhya Pradesh-Chattisgarh participated invictory rallies, public meetingsat Satna, Rewa, Jabalpur, Katni,

    Bhopal, Betul, Chhindwara,Indore, Ratlam,Khargone,Bilaspur,Raipur and inother places.Due to Code ofConduct for municipal election,Ratlam unit could notorganizerally.

    On the day, in Kerala,KMSRA members conductedvictory rallies and conventions in10 district units. Rally andconventions were held atTrivandrum, Trichur, Alleppey,Palakkad, Calicut, Kasaragode,Kannur, Pathanamthitta,Ernakulam and Kottayam inwhich 715 members participated.Trivandrum and Kottayam unitsconducted conventions on theprevious day. In all the ten units,the rallies were concluded in publicmeeting where the leaders fromfraternal trade unions addressed.CITU leadership and the StateSecretariat members of KMSRAinaugurated the public meeting.Kollam and Malapuram district unitcould not conduct the programmeon the day due to some localissues. In Perinthalmanna,unitsecretary E P Shibu andKMSRAoffice bearer LakshmiNarayanan addressed the rally.InKannur,distictpresident C SJayanaddressed. In Tamilnadu,hall meetings were conducted atKanchipuram, Vellore, Pondy,Cuddalore, Villupyram.A bike rallywas conducted at Dharmapuriwhich culminated at a street cornermeeting.5000 leaflets were printedand distributed by units ofTNMSRA among field workers inall the units. In Adhra Pradesh-Telengana, Victory Day wasobserved in befitting manner.Around 1700 members ofS r i k a k u l a m , V i j i n a g r a m ,Kakinada, Tanuku, Elur, Ongole,Vizag, Vijayawada, Guntur,Kurnol, Ananthapur, Hyderabad,Kukatpally, Secunderabad,Warangal, Khammam,Mahabubnagar, Karimnagar,Jagtial, Nalgonda and in satelliteunit Adilabad etc took out streetprocessions. The rallies wereaddressed by IMA, two MLCs,fraternal organizations. Bothelectronic and print media coveredthe news.

    Nagar availing casual leave andconducted convention. In UttarPradesh-Uttarakhand, 300 fieldworkers staged dharna in frontof C&F at Allahabad. FMRAIsecretary R P Singh, Lupin andDeys councils all Indiaconveners - Sourabh Bose andSubrata Banerjee respectivelyand Macleods all Indiaconvener Rahul Mishraaddressed the participants in thegate meeting. 202 out of total235 Macleod field workers ofRajasthan assembled andstaged dharna before C&F atJaipur. Gate meeting was heldthere, addressed by RMSRUleaders Niladri Roy, JagmohanJoshi and others.

Whereas inChattishgarh, 52 out of 72 fieldworkers staged dharna atRaipur. MPMSRUs jointgeneralsecretary NaveenGupta, its president N PShukla, and others addressedthe gate meeting. InMaharashtra, 105 field workersstaged dharna at Nagpur.

    In Kerala, 102 out of total156 participated in the dharna,held in front of C&F atErnakulam. FMRAIsvicepresident G.Madhu inauguratedthe dharna. Macleods councilleaders Manoj, Jyothish C. M,and R.Ramakrishnan alsoaddressed. KMSRA vicepresident Paul

    Vargheseinaugurated theconvention held on the previousday. Karnataka field workersstaged dharna in front of C&Fat Bangalore. A gate meetingwas held there, addressed byKSM&SRA leadersChandraKumar and others.189 fieldworkers of Telengana andAndhra Pradesh participated inthe dharnas held at Hyderabadand Vijaywada. FMRAI secretaryT. Kameswar Rao and othersaddressed the gate meetings. InTamilnadu, field workers tookleave and attended conventionsin Kanchipuram, Pondy,Thanjavur, Nagercoil, Salem,Erode, Madurai, Trichy,Tirunelveli, Coimbatore,Dindigul andKumbakonam.

    All India council Macleodscouncil meeting has been calledon 17-18 January to take stockof the situation and to decidefuture course.

    unanimously resolved to furtherstrengthen the unity of thepharma council, to mobilize allfield workers of other divisionsand to remain vigilant againstunfair trading. FMRAIs presidentR Viswanathan inaugurated theconference. Former leaders ofGerman Remedies council, whowere specially invited, namely AJ Mukherjee, T K Biswas and RN Ghosh greeted theparticipants.

FMRAIsgeneral secretary Aloke KumarBanerjee in his deliberationexplained the onslaught on theworking class due to corporatefriendly and anti-people policiespursued by the successivecentral governments. He alsonarrated the rampant law violationby the employers of thepharmaceutical industry. Heurged upon the participants toremain vigilant to protect therights and gainsthat wereachieved through struggle.Others who addressed includeFMRAIs joint general secretariesDipak Bhattacharya and K BKadam; its secretary KameswarRao; MPMSRUs generalsecretary Shailendra Sharma andtreasurer Anurag Saxena.

    248 elected delegatesrepresenting nearly 500 fieldworkers of Albert David attendedtheir 3rd all India council conferenceheld at Comrade Manoj DharManch in Comrade DeepakReheni Nagar, Lucknow, during22-23 November. The participantscame from all over the countryincluding Jammu & Kashmir,Himachal Pradesh, Hariyana,Delhi, Uttar Pradesh-Uttarakhand, Punjab-Chandigarh,Maharashtra, Madhya Pradesh-Chhattisgarh, Gujrat, Bihar-Jharkhand, North-East, WestBengal, Odisha, AndhraPradesh-Telengana, Tamilnadu,Karnataka and Kerala carrying thestrong message of unity andstruggle. Entire Motinagar area ofLucknow, the venue of theconference, was decorated withposters and chain flags.

    CITUs vice president andFMRAIs former general secretaryJ S Majumdar inaugurated theconference. He called upon the

    participants to get prepared to fightin defence of field workersprofession which is at presentunder tremendous attack. He alsosuggested to launch movementin defence of Indianpharmaceutical companiesincluding the public sectorundertakings. He narrated howAlbert Davids brand Placentrexwas banned due to multinationalspressure on the governmentincluding the drug authority andhow FMRAI fought at differentlevels to withdraw such ban. Hecautioned the participants againstthe tendencies of opportunismand parasitism which shouldneither come in the way ofadvancing bilateral industrialrelation nor become a hindrancein advancement of councilmovement.

Hehighlighted that bilateral industrialrelation has been improved in thecompany and many issues havebeen settled through discussion.He, however, urged upon theparticipants to remain vigilant indefending the rights and gainsachieved through years ofstruggle.

    Wife of late ComradeManoj Dhar, former AlbertDavid council convener ofUPMSRA who died in a roadaccident in 2011 and wife oflate Comrade Deepak Reheni,a field worker of the companywho died due to heart attackin 2012 attended andaddressed the conferenceacknowledging the councilscontribution during their crisis.

    of BSSR Union attended their47th conference held atComrade Ratan ChakrabortyManch in Comrade RanjitBasuNagar (Shree Krishna MemorialHall), Patna during 7-9November. This year, BSSRUnion is celebrating thediamond jubilee year as it wasemerged as a trade unionorganization in way back 1954.Ever since, BSSR Union iscarrying a rich history of unityand struggle.

    On the occasion, a colourfulprocession was taken outwhich began fromMaharanaPratap Hall andculminated into a rally at ShreeKrishna Memorial Hall aftermoving through the mainthoroughfare of Patna city.SitaramYechury, polit bureaumember of CPI(M) inauguratedthe conference. He called uponthe members of BSSR Unionfor their renewed pledge amidstdiamond jubilee yearcelebration to face the newerchallenges arising out of thenew situation. He reminded that,as far as the fight for reductionof drug prices andrationalization of drug policiesare concerned, the people of thestates of Bihar and Jharkhandhave expectations from BSSRUnion and, therefore, they havelot of responsibilities to comeup to the peoples expectations.He sharply criticized Modigovernment for unleashingfresh attacks on the people ofthis country in the name of

He urged upon themembers of BSSR Union tofight for the reversal of the anti-people polices of the centralgovernment.

    In his greetings, FMRAIspresident R Viswanathanpointed out that celebratingdiamond jubilee year itself is agreat moment for any tradeunion organization. He recalled

    the rich contribution of BSSRUnion in building and carryingforward the movements ofFMRAI and CITU. He calledupon the participants to getprepared for higher struggle incase the central governmentdoes not concede the demandsof FMRAI.

    Reports placed by thegeneral secretary DipakBhattacharya and treasurerKalyan Acharya wereunanimously adopted followingdiscussions by 76 participants.The conference adoptedresolutions which include10,000 memberships by thenext conference besidemedicine related issues andothers.

    FMRAIs general secretaryAloke Kumar Banerjee whilesumming up the discussion,dealt with the subjects likenewer forms of attack on thefield workers including attackson their jobs and profession;attacks on trade union andcollective bargaining rights;advancement of policy relatedmovement at both central andstate government levels;council networking;membership; collectivefunctioning and company wisedevelopments.

    The conference elected 49-member state executivecommittee with 19 officebearers which include AnirbanBose as president, DebashishRoy as general secretary andManoj Chaudhary as treasurer.
