1. Principles

Hazardouds substances can be found at nearly all workplaces, including small andmedium enterprises e.g.:

Hazardous substances are any liquids,gases or solids that affect workers’ healthor safety.

These are also substances which aregenerated or released (welding fumes,emissions from diesel engines, wooddust, flour dust etc.) during processing aswell as those where no labelling is re-quired. These substances are deliveredor stored in different types of packaging.

Identification of Dangerous Chemical SubstancesADR/RID EC-Directive 67/548/ECC GHS

Legal basesThe Council Directive 98/24/EC of7 April 1998 (14th individual Directive ofthe Framework Directive 89/391/EECon worker protection), regulates the min-imum prescriptions for the protectionof workers from the risks related tochemical agents at work. This Directivewas transposed into national law by theOrdinance on Hazardous Substances.

Manufacturers,importers and usersOn 1 July 2007, the REACH Regulation, anew law on chemicals applicable with-in the European Union came into force(EC No. 1907/2006).

REACH is the short form for Registration,Evaluation, Authorisation and restrictionof Chemicals.

REACH is intended to force manufac-turers and importers of chemical sub-

stances by means of a registration andassessment procedure to provide suffi-cient data for a safety assessmentof the chemicals. This information isentered in the safety data sheets andserves as an important base for riskassessment.

There is a new global classification andlabelling of chemicals regulated by theGHS system (Globally Harmonized Sys-tem). GHS is implemented in Europe bythe CLP Regulation (classification, la-belling and packaging of Substances andMixtures) and will apply to substancesfrom 1 December 2010, including transi-tion periods, and to mixtures from 1 June2015.

Concerning different labelling of chemi-cals according to the regulation on car-riage of dangerous goods by road andrail, to the hazardous substances regula-tion and to GHS/CLP see the followingfigure.

The employer shall ensure that hazards ofemployees caused by hazardous sub-stances are identified, eliminated or re-

duced to a minimum by means of protec-tive measures.

2. Risk Assessment

2.1 Systematics of Risk Assessment

The individual steps for the risk assess-ment (see scheme) are described in the

following clauses.

2.2 Identification of hazardous Substances at the Workplace

Pursuant to the Hazardous SubstancesOrdinance, the employer shall first deter-mine whether hazardous substances arepresent at the workplace.

Registration of hazardoussubstances, their propertiesand their effectsHazardous substances are systematical-ly registered in the table of hazardoussubstances (see Annex 1). This table canbe prepared related to the workplace,work area or department.

If many working substances are used ata workplace or in a work area (e.g. inchemical laboratories, pharmacies), alsorepresentative substance groups suchas acids/bases (key components) may

be chosen. The risk assessment is thenprepared for these key components.

2.4 Further Information about the Workplace

Working conditions shall be identified bytaking into account technical, organisa-tional and personal measures. This shallbe done in cooperation with the workersand superiors concerned.

Technical measuresTechnical protective measures availableat the workplace such as local ventilationor forced ventilation shall be considered.The efficiency of this equipment shall bechecked at regular intervals.

Processing conditionsFor the type of processing, workplacespecific circumstances such as increasedtemperature or pressue shall be consid-ered. Furthermore, the processing tech-nology shall be taken into account, e.g.spraying, dip coating, painting.

Quantity usedLimitation of hazardous substances pre-sent at the workplace to a quantity re-quired for the relevant work.

Level of exposureThe evaluation is carried out on the basisof reliable measuring values representingthe exposure level at the workplace. If nolimit value is specified, international limitvalues shall be used. If no internationallimit value exists, limit values for homo-logous substances or substances withcomparable chemical effect shall beused.

Work intensityThe respiratory volume and hence theintake of hazardous substances is in-fluenced by different intensities of work.

Exposure time (duration of exposure)A crucial criterion for the weigth of ex-posure of persons by a hazardous work-ing substance is the duration of ex-posure at the workplace of the workerconcerned.

Co-exposed persons,exposure of bystandersAre other, possibly noninvolved employ-ees also exposed due to the workingmethod at the workplace?

Aptitude, training, instructionEmployees shall regularly, at least annu-ally, be instructed and trained in workingwith hazardous substances.

Required PPE(personal protective equipment)The provided PPE shall meet the require-ments of the safety objective andbe consequently used. It shall alwaysbe in perfect condition. The employeris responsible for its provision and func-tionalibity.

Eye/skin contactSkin/eye contact shall be prevented, e.g.by using suitable protective gloves (e.g.acid-proof, oil resistant, solvant resistant)particularly for work with toxic, caustic,irritant, allergising or skin-resorptivesubstances. Information is given in thesafety data sheet. Eye contact is prevent-ed, if complete spectacles (e.g goggles)or a face screen are used.

2.5 Risk estimation

On the basis of the “substance pro-perties” (degree of possible harm) and„probability of occurrence of harm“, therisk of handling a working substanceis evaluated. Risk elimination is actuallythe first principle for prevention.

Carcinogens and mutagents shall be re-placed at the workplace by less dan-gerous substances. This obligation existswhenever it is technically and econo-mically possible to do so. This processis supported by registration, evaluation,authorization and restriction of chemicalsaccording to the REACH ordinance.Thus, Annex XVII of the REACH Regu-lation contains restrictions for manufac-turers for the placing in the market anduse of certain substances, preparationsand products.

Such chemicals have special health risksor hazards (carcinogenic (K), mutagenic(M) and/or toxic to reproduction (RF) orteratogenic (RE) in categories 1 or 2).

Categorie 1:explicitely proven in human beings

Categorie 2:proven in animal experiments

The substances are labelled with thedanger symbol toxic (T) and theR-sentences R45, R49, R46, R60 andR61 and all combinations with other R-sentences.

Examples for such substances:K1: benzene, asbestos,

chromate (VI) compoundsK2: hydrazene, cadmium compoundsM2: cadmium and its compounds

RE1: passivesmoking, lead,carbon monoxide

RF1: special hormones

When these listed substances are usedat workplaces, they have to be sub-stituted.

To help employers, there is a list of sub-stances subject to authorisaton in AnnexXIV of REACH. The manufacturer andthe importer shall indicate on the safetydata sheet for which process the sub-stance is authorised. The user wantingto work with the authorized substancesshall check whether his/her processconditions comply with the authorisa-tion.

The purpose of a risk assessment isto evaluate the riks for exposed personsand the possible hazards dependingon the conditions given at the work-place.

The risk occurring during work withhazardous substances may depend onthe following factors:● risk generated due to hazardous

chemical reactions whichmay affect the health and safety ofworkers (chemical reactivity andinstability of hazardous substancesetc.)

● risk due to inhalation of substancesdepending on the toxicity of thesubstances, exposure time, andsensitising properties

● risk due to absorption throughthe skin depending on the toxicityof the substance as well ason the type, duration and frequencyof contact

● risk due to contact with the skinor eyes

● risk due to ingestion depending onthe toxicity of the substance and onpersonal hygiene habits

● risk due to penetration throughthe parenteral route(toxicity of the hazardouschemical agent, damage to the skinetc.)

● risk of fire and explosion dependingon the physical condition: gas,liquid, solid, dust, temperature, pres-sure, flammability, heat capacity,explosion limits, ignition sources:smoking, welding, electrostaticcharge, mechanical sparks and ex-otermic chemical reactions

Based on the obtained findings, the workof employees has to be evaluated. First

the inhalative, dermal, and physical-chemical hazards are to be identified andassessed and then be consolidated in theoverall assessment.Prolonged contact with the hazardoussubstances (from a few minutes to years)may possibly affect the health of the em-ployees even if contact was relativelyshort. In individual cases, occupationaldiseases may occur as a result of expo-sure. In case of an accident the risk is al-so due to the property of the hazardoussubstance.The EU Member States have differentsystems of risk assessment. The em-ployer may obtain relevant informationfrom the national health and safety au-thorities.Further information can be found inthe clause on National Aspects.

It is not always possible to eliminaterisks. Therefore, appropriate protectivemeasures are nessessary, the efficien-cy of which must be checked.

During work with hazardous sub-stances, it shall in principle be checkedwhether the hazardous substancecan be substituted by a less dange-rous substance (substitution test) orwhether exposure can be prevented orreduced by changing the workingprocess.

When carrying out protective meas-ures, the following sequence of meas-ures shall be observed:

● Use of working substancesas non-hazardous as possible,i.e. use of working substances withthe smallest hazard possible forpersons.

● Working processes and workingoperations shall, if technicallypossible, be so designed that em-ployees cannot come into contactwith hazardous working substancesand that hazardous gases, vapoursor suspended matter cannot bereleased. Minimization of thecapability of release or improve-ment of technical equipment.Written working instructions shallbe laid down in which individualsafety requirements and theirmonitoring are specified.

● If measures cannot preventhazardous gases, vapours

or particulate matter from beingreleased, they shall be completelycaptured at their outlet or pointof generation and then removedwithout any hazard for the employ-ees, as far as allowed by the stateof the art. If such a capture is notpossible, ventilation measuresshall be provided which correspondto the state of the art.

● Limitation of quantity ofavailable hazardous working sub-stances to the extent essentialfor work.

● Limitation of duration andintensity of a possible exposureof employees to hazardoussubstances to the essential extent.This obligation is of special impor-tance in case of carcinogenicsubstances. This could be access-ed by providing sufficient ventila-tion of premises or by an effectiveroom ventilation.

● Limitation of number of employeeswho are exposed to hazardousworking substances, e.g. bylimiting acces to certain work areasat risk or by spatial separation.

● Where despite the measuresgiven in the different items a suffi-cient protection can still not beobtained for the employees, theemployer shall ensure that appro-priate personal protective equip-ment is used, e.g. eye, skinprotection, respiratory equipment.

3.2 Documentation

Based on the check list, risks and protec-tive measures shall be documented. Itshall also be laid down how protectivemeasures are controlled.

Other applicable documents for the do-cumentation are the hazardous sub-stances list, safety data sheets and oper-ating instructions.

3.3 Operating instructions and instruction

Further measures shall be initiated by theemployer for work with hazardous sub-stances. Employees shall have access towritten operating instructions in a formand language they understand.

The operating instructions shall containinformation on hazardous substancesoccurring at the workplace. In particular,the following information shall be given:● designation of the hazardous substance● hazards to human beings and to the

environment● information on protective measures

and rules of behaviour

● behaviour in case of danger● first aid● correct disposal

On the basis of the operating instructions,employees shall annually receive oralinstruction by the employer on occurringhazards and corresponding protectivemeasures. The instructed persons shallconfirm this by signature. The proof ofinstruction (content, time, participants)shall be kept.

Hodnotenie rizika

Model hodnotenia rizika rakúskej úra-zovej poisťovne AUVA pracuje so zoz-namom klasifikácie látok, ktorý berie doúvahy účinky chemikálií (akútne a chron-ické), ich schopnosť uvoľňovať sa do pra-covného prostredia, technické a organi-začné opatrenia a individuálnepodmienky zamestnancov. Modelumožňuje navrhovať a riadiť opatrenia nazníženie rizík.

Počet bodov na odhad rizika v závislostiod chemikálií na pracovisku vychádzaz nasledovného vzorca:Rchemikálie = (Wa + Wch) ⋅⋅ FW = StoffwirkungWa = akútne pôsobenieWch = chronické pôsobenieF = Schopnosť uvoľňovať sa

Vyššie číslo pre Rchemikálie znamenávyššie je riziko poškodenia zdraviaúčinkom chemikálie na pracovisku.

Počet bodov pre odhad rizika v závislostiod podmienok na pracovisku vychádzaz nasledovného vzorca:

Môže sa použiť matrica rizík ako podkladpre určovanie priorít. V zmysle tejto ma-trice môže byč riziko determinované.

Hodnotenie rizík chemikáliíVýsledkom hodnotenia rizík chemickýchlátok je zníženie ohrozenia zdraviaa zlepšenie pracovných podmienok a totak vo vzťahu k cnebezpečným vlastnos-tiam hemikálií ako aj vo vzťahu k pracov-ným podmienkám na pracovisku.
