Dr Carter agreed to comoupon notification by telephoneHo asked a continuance until Moriday but Mr Robertson appearingfor defendant objected on theground that there bad already bennseveral continuances Ho said thathe understood that Carter had dodined to come

Judge Humphreys granted ttiemotion for a continuance but statedthat ho could not consider the ser-vice

Synodsman Tosta offerod threemotions The first lhat the votetaken on Resolution No 2 bo roconeiderod which was passed at thepreceding meeting the second thatthe report on Synodioal expenses boaccepted and placed ou fle and thethird that the report of tho Trustees be accepted and placed on Gle

and that the addendum already re-

ferred¬

to above bo referred to aspecial committee of throe to reporttomorrow this evening All themotions were duly seconded

After thosPr notices of motionshad been put in the motion to reconsider Evolution No 2 was takenup In Bpeaking on it Mr Testasaid

I think wo ran up againsta snag in Resolution No 2

and the sooner wo straighten outthe difficulty the better In thelast paragraph of the resolution ac-

cording¬

to the way it stands atcresent we practically hand overtho property of the church here tothe Protestant Episoopal Ohurch inthe United Stales of America whenas a matter of fact and to conformwith the wording of the charter theproperty of the Anglican Ohuroh inHawaii should be handed over totheFrotostant Episcopal Church in

the Hawaiian Islands The propertyis for the use of the local churchand not to be used by the church atlarge

The motion being put was carried Some difficulty arose as toparliamentary usages SynodsmanT Olive DavieB quoting Cushingewherein be held that no amendmentcould be put to the Resolution butmust be put in as the original mo ¬

tion Mr Testa demurred and said

that when reconsideration was car-

ried¬

the Synod was brought face toface With- - the original motion to

pasB Jhe resolution which motionwaaeubjobt to amendment It wasfinally left to the meeting and theSynod decided that the intendedAmendment must be put as the ori-

ginal¬

motion to pass which Mr

Testa declared relieved him of theresponsibilityand placed it on theSynod The motion on the resolu ¬

tion was put and passed by a unani-

the full text as amended of

THE AMENDED OIUnTEB

The above resolution having being disposed of Syuodemnn TOlive Ddvies moved that the Synodresolves itself into a committee ofthe whole for the further considera-tion

¬

of the proponed amendedcharter which was carried andSynodaman Pond again took thechair as of the previous evoningAfter some few entaiiglemuuts andchanges tho remaining nine par -

graphs were passed upon and dual ¬

ly passed as a whole We yesterday published the Charter in full

Synodsman T Olive Davias thenmoyed lhat the committee rise andreport progress but SynodsmanTesta said that he rememberedmaking the motion the previousevening including the by laws Tbeminutes was then resorted to andfound that it only referred to thecharter Mr Dovies graciouslywithdrew his motion and Mr Testamoved to reconsider the minutes inorder to make this necessary correc-tion

¬

But after some Utile confu-

sion¬

Mr Tosta withdrew his motionand moved that the committee riseaud report which was carried Theby laws will be considered later

Tho President resuming the chairtho chairman of the committee oftbe whole reported that tbe amend ¬

ed charter as a whole was passedwith certain slight amendmentswhiob report on motion of MrTesta was adopted A motion togo into committee of the whole onthe by laws was not carried

TRUSTEES IlErORT AND ATTENDUM

At this stage of tho meetingSynodsman Tpsta suggested thetaking up for consideration of mo-

tions¬

now on the table of the secretaries which the President so order-ed

¬

Mr Testas motion on tho re-

port¬

of the Trustees and the adden-

dum¬

thereto was taken up Thisbrought Synodsman Geo F Dsviosto his feet and he asked permissionto read an already prepared andwritten speech Ho represented StAugustines Ohurch at Kohala andthe addendum had roforence to thetransfer of oertiin property tharewho said that as he understood thomatter it bad been a case of secur-ing

¬

a good house on good terms bycomplying with certain conditionsor also neglecting an opportunitywhich could not be duplicated

The Bishop seemed to yiow thematter differently Suppose Iwanted to send a clergyman to Ko-

hala¬

ho said I would have noauthority to give him that houseHe would have no house iu whichto lire unless tho trustees who con-

trol¬

the house ohoose to hand Itover to him As it if tho house is

not ohuroh proportj it is iu thohands of tbreo men who are trusteesfor the congregation Suppose thatcongregation moves away what b

comes of the houset It is not se-

cured¬

to the ohurohAt this point Mr Testa Bupgestert

the propriety of reading the adden ¬

dum in order that members mayfamiliarize thomselvos with the mat-

ter¬

that brought about his motionwhich was so ordered During therending both the two kqn reportersof our groat morning papers yeroseen to have their eyes closed andasleep in their chairs both sittingalmoal upwright with a slight leanof the bead forward

The Rev Canon Ault expressedhimself ns opposed to tho way thotransaction had been oairied outOthers also rxprossod thomsolveafreely Synodsman Smith thoughtthe affair was but nn echo of asimilar transaction which had beeneffected iu Honolulu SynodsmanTesta thought so too

This mattor was finally referredto a committee or three and theBishop PrfRidont appointed Synodsman F Ji Testa Rev Canon Aultand Synodsman Ohang Kim
