AGENDA OF 57th MEETING OF COMMERCIAL COMMITTEE TO BE HELD ON 11th JANUARY 2011 AT WRPC OFFICE, MUMBAI
ITEM No.1: CONFIRMATION OF THE MINUTES OF THE 56th MEETING OF
COMMERCIAL COMMITTEE Minutes of the 56th meeting of Commercial Committee held on 22.10.2010 at
Mumbai were circulated to the constituents vide WRPC letter No.WRPC/Comml-
I/CCM/Min/2010-10016 dated 29.10.2010.
M/s Torrent Power vide letter No. TPL/SUGEN/COMMERCIAL/10-11/0162 dated
8.11.2010 (enclosed at Annexure-1) have sent their comments on item No. 7 of
the 56th CCM wherein M/s TPL have observed and requested amendment in
para as below :
Quote:
“GM, Torrent Power, stated that Torrent did not agree with decision of WRPC in
13th meeting and now they have filed petition in CERC against above decision for
sharing of inter-regional transmission charges and wheeling of ISTS power to DD
& DNH through GETCO transmission system and wheeling of ISTS power to
Goa & DNH through MSETCL transmission system.” -Unquote
to be amended to:
“TPL representative, who attended the 56th Commercial Committee meeting,
represented that WRPC should direct CTU/PGCIL to stop charging of (a)
Transmission charges for inter-regional links between WR and other regions i.e.
ER/NR/SR and (b) wheeling charges payable to Gujarat and Maharashtra for
wheeling of Central Sector power to DD, DNH and Goa until necessary
clarification is obtained from the Honorable CERC, for which TPL has submitted
its petition.”

ITEM No.2: SIGNING OF PPA WITH RGPPL (FOR 5% ALLOCATED CAPACITY) AND ITS SCHEDULING
2.1 The matter regarding signing of PPA by RGPPL with DD, DNH and Goa to
enable scheduling of 5% capacity of RGPPL power, to the above beneficiaries as
per MoP order i.e. 2% each to DD & DNH and 1% each to Goa had earlier been
discussed in meeting held on 31.8.2010 and in 56th CCM where in for review of
status of scheduling of RGPPL, wherein the RGPPL had intimated that signing of
PPA may be done by end of November, 2010. WRPC vide letter No.
WRPC/Comml-I/Alloc.2010/1467 dated 28.10.10 had requested RGGPL to
expedite finalization of the PPA as the scheduling of 5% allocated power from
RGPPL could commence only after completion of all formalities viz., signing of
PPA, obtaining necessary open access, opening of Letter of Credit by the
beneficiaries of the generating station commensurate with the allocated power,
completion of all formalities by the beneficiaries etc. RGGPL and the
beneficiaries concerne viz. DD, DNH and Goa are requested to intimate current
status on above.
2.2 WRPC vide WRPC/Comml-I//6/Alloc-2010/1265 dated 15.09.2010 had also
requested RGPPL to intimate the date on which power station started operating
at full load (1940 MW) to enable effecting of the 5% allocated power to
beneficiaries vide MOP allocation order dated 29.3.2010. During 56th CCM
RGPPL has intimated that power station started operating at full load (1940 MW)
in April 2010 however they would intimate the date and time for the same. A
communication from RGGPL in this regard is awaited.
RGPPL may indicate the status of signing of PPA and date on which power station started operating at full load (1940 MW).
2.3 ED, WRLDC vide letter no WRLDC/OS/1664/2010/2312 dated 24.12.2010
addressed to Secretary, CERC (enclosed at Annexure-2) have sought direction
of the Commission on transfer of Jurisdiction of RGPPL from SLDC to WRLDC

with reference to the para 98 of the Commission’s order dated 18.08.2009 in
petition No. 283/2009.
Committee may like to note. ITEM No. 3: ISSUES RELATED TO SHIFTING OF CONTROL AREA OF
NSPCL FROM SLDC, CSPTCL TO WRLDC The matter related to shifting of shifting of control area of NSPCL from SLDC,
CSPTCL to WRLDC was deliberated in 55th Commercial Committee Meeting and
in a meeting held on 27.09.10. In 55th CCM representative of Chhattisgarh
agreed for shifting of control area in respect of 2x250 MW Bhilai Expansion
power plant of NSPCL to WRLDC for scheduling, controlling etc. CSPTCL
representative had added that 220kV lines from NSPCL-BSP are dedicated links
meant for drawal of NSPCL share by SAIL-BSP and any reversal of power flow
on these links shall be treated as a drawal of power by BSP from CSTPCL grid.
A meeting among SLDC, CSPTCL, CSPDCL, NSPCL, BSP, WRLDC and WRPC
was held on 27.09.2010 to discuss various issues concerning shifting of control
area of 2x250MW NSPCL power station at Bhilai from SLDC, CSPTCL to
WRLDC ( record notes enclosed at Annexure-3.1) . In this meeting, it was
agreed that emerging issues between NSPCL, CSPDCL and BSP SAIL
regarding any ISTS transmission charges or losses applicable to BSP, STU
transmission charges or losses applicable to BSP, bifurcation of combined UI
accounting for CSPDCL and BSP by SLDC etc. will be sorted out and thereafter
the subject matter of shifting of control area will be taken up.
NSPCL vide letter 01:CP&C:103 dated 3.12.10 has enclosed a copy of the
minutes (enclosed at Annexure-3.2 ) of the meeting held between CSPDCL,
NSPCL, BSP & SLDC on 23.11.10 at Raipur to decide modalities for transfer of
control area of NSPCL from SLDC to WRLDC.

ED, WRLDC vide letter no. WRLDC/OS/1610/2010 dated 24.12.2010 (enclosed
at Annexure- 3.3) has communicated views of WRLDC on the minutes of the
meeting held on 23.11.10 at Raipur.
SLDC, Chhattisgarh vide letter No. CGLD/WRPC/NSPCL_SHIFTING/CCM-4736
dated 3.01.2011 have requested that the matter may be put up in CCM for
review. Committee may like to discuss. ITEM No.4: INCLUSION OF NON-ISTS ASSETS FOR IMPLEMENTATION OF
POINT CONNECTION METHOD FOR POINT OF CONNECTION CHARGES
CERC Regulations, 2010 on "Sharing on transmission charges and Losses"
regulation 2010 are to come in force from 1.1.2011. The determination of
transmission charges as per this Regulation is required to be limited to the
network owned, operated and maintained by the ISTS Licensees or those
transmission licensees / SEBs whose assets have been certified by RPCs as
being used for inter-state transmission.
Only such assets as above will be included in for implementation of point
connection method for point of connection charges. Preparation of a cogent
network requires consideration of state owned lines also. The YTC for such lines
shall be based on the YTC of the transmission licensee / SEB as approved by
the Appropriate Commission.
The philosophy for inclusion of non-ISTS assets of WR for POC charges were
discussed in 56th Commercial Committee meeting of WRPC held on 22.10.2010
which were approved in 15th WRPC meeting. WRPC has submitted the list of the
lines certified for inclusion of non-ISTS assets to implementing agency and all the
constituents.

GETCO vide letter No.SLDC/MIS/1509 dated 3.12.2010 and MPPTCL vide letter
No.04-02/PSP-386/1408 dated 9.11.10 have requested inclusion of following
lines for certification as non-ISTS assets of WR for POC charges :

Committee may like to discuss. ITEM No.5: TRANSMISSION CHARGES FOR USE OF MSETCL
TRANSMISSION SYSTEM FOR CONVEYANCE OF CENTRAL SECTOR POWER TO GOA AND RGPPL POWER TO GOA, DD & DNH FOR THE PERIOD 1.04.10 TO 31.03.2011
5.1 The above issue for calculation of transmission charges for use of MSETCL
transmission system for conveyance of Central Sector power to Goa for the year
2010-11 was discussed during 13th WRPC meeting and 55th Commercial
Committee Meeting.
Chief General Manager (L&RA), MP Tradco vide letter dated 20.09.2010 have
submitted their observations on computation of above transmission charges
which are briefly highlighted below :

1. Return on Equity (ROE) calculated on the basis of tax rates received from
MSETCL (33.2175 %) while those should have been calculated at MAT rates of 11.33 %.
2. Interest of loan considered by WRPC as SBI PLR @12.25 as on 1.04.2009 while those should have been considered as it is claimed by PGCIL in its petition for the year 2010-11.
3. Depreciation not to be allowed after useful life of the transmission line is ended.
During 56th CCM MSETCL representative clarified that they are paying income
tax at corporate tax rate of 33.2175 % which has been communicated vide letter
MSETCL/STU(R&C)/ WRPC/16409 dated 20.10.2010 and this tax rate
@33.2175 % is applicable to MSETCL for FY 2010-11.
Further, Commercial Committee during 56th meeting expressed that issue can be
discussed in presence of MPTradco and as MPTradco was not represented in
the 56th CC Meeting discussion was deferred for next meeting.
Committee may discuss. ITEM No.6: LEVY OF TRANSMISSION CHARGES & LOSSES OF GETCO
NETWORK FOR TRANSMISSION OF 100 MW CONTRACTED POWER TO MP FROM SUGEN POWER PROJECT OF TPCL
6.1 The matter regarding levy of transmission charges & losses of GETCO
network for transmission of 100 MW contracted power to MP from Sugen power
project of TPCL MP TRADECO was discussed during 55th Commercial
Committee of WRPC held on 15th July 2010 and also during 14th WRPC meeting
held on 19.08.2010 wherein WRP Committee deliberated the matter and
Chairman, WRPC/CMD, MPPTCL directed both parties i.e. Torrent Power Co.
Ltd. and MPTRADCO, to sit together with the relevant documents and sort out
the issue amicably at the earliest.
6.2 Subsequenty, Torrent Power Ltd. vide letter No. TPL/Sugen/Commercial/10-
11/0200 dated 31.12.2010(copy enclosed at Annexure-6) intimated that the
meeting in this context was held on 15.11.10 at Jabalpur between MPTradco,

TPL and PTC India Ltd.(PTC) for sorting out the issue for initiation of 100 MW
power to MP. Torrent Power Ltd. further intimated that the issue wad discussed
and resolved between the parties and MPTradco agreed to start the off-take of
power from 1.12.10 and has yet to initiate off-take of 100 MW contracted power.
MPTRadco & Torrent Power Ltd. may indicate the status on above.
ITEM No.7: DECLARATION OF TRANSMISSION ELEMENTS INTO COMMERCIAL OPERATION BY PGCIL
7.1 PGCIL vide letter No. WR-II/VDR/510 dated 1.11.2010 have intimated that
125 MVAR, 400 kV bus reactor at Dehgam under WRSS-VII has been put into
regular operation. Accordingly, the monthly transmission charges of the above
reactor will be payable by concerned WR constituents w.e.f. 1.11.2010
7.2 PGCIL vide letter No. WR-II/VDR/509 dated 1.11.2010 have intimated that
315MVA, 400 kV transformer at Bina (MP) has been put into regular operation.
Accordingly, the monthly transmission charges of the above reactor will be
payable by concerned WR constituents w.e.f. 1.11.2010
Committee may like to note. ITEM No. 8: POWER PURCHASE AGREEMENT IN RESPECT OF SUBANSIRI
LOWER HE PROJECT (2000 MW) Chief Electrical Engineer, ED, Goa, Vide letter No. 101/01/CEE/Tech/1435 dated
24.11.2010 addressed to Chief Engineer (Comml), NHPC with a copy to Member
Secretary, WRPC have intimated that they had requested NHPC for holding a
meeting amongst the beneficiaries of Subansiri Lower HE Project in WR for
completing the formalities viz. signing of PPA etc. and so far no reply/comments
have been received from NHPC. A copy of above referred letter is enclosed at
Annexure-8).

RECORD NOTES OF DISCUSSION OF MEETING HELD ON 27.09.10 AT WRPC OFFICE, MUMBAI TO DISCUSS ISSUES RELATED TO SHIFTING OF
CONTROL AREA OF NSPCL FROM SLDC, CSPTCL TO WRLDC
List of participants is enclosed at Annexure-I.
A meeting among SLDC, CSPTCL, CSPDCL, NSPCL, BSP, WRLDC and WRPC
was held on 27.09.2010 to discuss various issues concerning to shifting of control
area of 2x250MW NSPCL power station at Bhilai stations from SLDC, CSPTCL to
WRLDC.
Member Secretary, WRPC welcomed the participants from SLDC, CSPTCL,
CSPDCL, NSPCL, BSP, WRLDC in the meeting. Initiating the discussion, M.S.,
WRPC stated that as per IEGC 2010 the control area for NSPCL station which is a
central government owned company comes under jurisdiction of WRLDC and
neither party viz. SLDC, CSPTCL and WRLDC have any objections to it. SLDC,
CSPTCL had agreed for shifting of control area earlier in 55th CCM held on
15.07.2010. SLDC, CSPTCL has requested deliberation vide letter dated 23.09.10
on following issues related to the matter which may be discussed:-
1. Deletion of meter No. NP-2302A & NP-2178A for the drawal energy mechanism of CSPDCL.
2. Deletion of setoff of DD-DNH scheduling from the net drawal schedule of SCPDCL.
3. Inclusion of CSPDCL share in the NDS of the CSPDCL from the central sector.
4. The beneficiaries from the NSPCL Bhilai 2 x 250 MW Power Project shall remain the existing one only i.e. SAIL. UT-DD, UT-DNH & CSPDCL.
5. NSPCL be clearing all the dues on them in the form of UI and SLDC charges etc. before the shifting.
6. The drawal from the 220kV (or at any EHV voltage level) from the CSPDCL end to NSPCL shall be treated as power drawn by NSPCL from the CSPDCL network for which necessary agreements copies has to be made available to SLDC and WRLDC for needful reference.
7. To decide the effective shifting date.
ED, POSOCO, WRLDC stated that NSPCL is CGS captive plant and whether it
should be considered as a generating station unlike others, needs clarification.
However, if both CSPTCL and NSPCL agree, WRLDC will not have any problem
in carrying out scheduling, controlling etc. of NSPCL station. Further apart from
the agenda items given in SLDC letter dated 23.09.10 the periphery of NSPCL

where the scheduling & injection would be done and loss application on these
parameters are of most importance.
General Manger (CP & Comml.), NSPCL stated that CERC regulations do not
differentiate between captive plant and generating station GM (CP & Coml.),
NSPCL referring to IEGC 2010 stated that NSPCL being ISGS station owned by
Government Company is to come under control area jurisdiction of WRLDC in line
with Clause 6.4.2(a) of IEGC. He said that during 47th CCM held on 19th
September 2007 it was intimated that WRLDC have worked out the requirement
of SEMs to be provided along with their locations for accounting of energy injected
into the grid from NSPCL and approval for procurement of 13 Nos. SEMs and 4
Nos. DCDs were accorded. These meters are available with PGCIL and can be
used for metering. He added that DD, DNH, CSPDCL and BSP have firm
allocations of 100, 70, 50 & 192.5 MW respectively from NSPCL and balance 87.5
MW (surrendered by BSP) have again allocated to DD, DNH, CSPDCL as 39, 36
and 12.5 MW respectively wherein for CSPDCL power there is no STOA. He
further added that agreement for above 12.5 MW with CSPDCL is applicable up to
21.10.10 and the same will be reallocated to DD and DNH w.e.f. 22.10.10. GM,
NSPCL informed that as per MoM of the meeting held on 28.11.2008 between
CSPDCL, BSP and CSTPCL there will not be any UI applicable to BSP.
ED, POSOCO, WRLDC stated that control area of NSPCL will be taken over by
WRLDC only when WRLDC is requested by SLDC, CSPTCL for this and action is
initiated by SLDC for the same. Further, when WRLDC commences the
scheduling of NSPCL then CSPDCL & BSP, SAIL will be considered as
embedded utility as per notional model. Combined scheduling for UI accounting
for CSPDCL and BSP, SAIL will be issued and bifurcation would be done by
SLDC. He further stated that UI for NSPCL will be calculated at the periphery as
presently being done by SLDC but in addition WR transmission losses will be
required to be booked on SAIL, BSP transactions.
ED, WRLDC stated that as there is no direct line (STU line) from NSPCL to
CSPDCL therefore CSPDCL should draw its share of 50 MW either through long
term open access agreement or short term open access agreement, otherwise
WRLDC will not be able to schedule power for CSPDCL. LTOA / STOA for
scheduling power to CSPDCL would require payment of the charges by it

including the transmission charges & losses as per OA regulation provisions. He
further added that no previous minutes of the meeting between NSPCL, CSPTCL
and BSP dated 28/11/2008 or related decisions governing conditions when
NSPCL had been under control jurisdiction of Chhattisgarh would remain effective
after the control area is shifted to WRLDC. BSP drawl will be shown as CSPDCL
drawl and BSP load will be considered as embedded load of CSPDCL. The
surrendered share of 87.5 MW will be scheduled through STOA provisions to DD,
DNH or CSEB and the scheduling will be done on NSPCL bus. He further stated
that registration at WR pool & other formalities would require to be completed with
WRLDC by NSPCL before commencement of the scheduling of NSPCL.
It was expressed during the meeting that Unit wise scheduling of NSPCL, Bhilai
2x250 MW plant by SLDC, Bhilai will not be possible and scheduling is to be done
for the power station as a whole only.
Addl. Chief Engineer, CSPDCL agreed to apply to CTU for Long Term Open
Access for 50 MW power from NSPCL.
The matter regarding utilization of un-requisitioned power from NSPCL was
discussed and the committee was of the view that URS is applicable only for
allocated portion of power and not for the surrendered portion which was
reallocated by NSPCL.
DGM (Power Systems), BSP, Bhilai stated that with the shifting of control area
jurisdiction to WRLDC, there should not be any additional transmission charges or
losses applicable to BSP. He further expressed that they would not like transfer of
the control area from SLDC, CSPDCL to WRLDC before the issue involved are
amicably addressed. The subject matter was deliberated and it was agreed that emerging issues
between NSPCL, CSPDCL and BSP SAIL will be discussed among themselves
and will be shorted out preferably by the end of October 2010. There after action
plan for shifting of control area jurisdiction of NSPCL from CSPTCL to WRLDC
may be initiated.
