2. Relief Sought: The defense seeks an extension of time to respo nd to AE052 until 13

September 20 12.3. Facts:

a. On 10 August 20 12, the accused were served with AE052. AE052 concerns amatter of consid erable importance to both the prosecu tion and the defense.

b. The defendants' re sponse is currently due on 24 August 20 12, during the motionshearin g commenc in g on 22 August 20 12. Per AE059 Amended Docketing Order, thecommiss ion will hear 26 mot ions at that hearing.

C. Counse l for the accused will of necess ity devote most of the next two weeks topreparat ion for the 22 August hearing, mak ing an adequate re sponse to AE052 difficu lt orimpossible und er the current time frame.

4. Law and Argument:a. Rule of Court 3(7)(c)(I ) provides that, "Unless the Military Judge provides

otherwise, a re sponse is due with in 14 calend ar days after a mot ion is f iled subject to paragraph6, above." This Rul e exp lic itly permits the Mi li tary Judge to modify th e time for filing whenappropriate .

b. AE052 is an important mot ion requirin g an adequate response. The mili tarycommiSS ion w ill benefit from the opportuni ty for fu ll br ief ing of the issues presented by themot ion. 13 September 20 12 is two weeks from 30 August 20 12, the first day after return fromthe scheduled hearing.

c. The requested extension until 13 September 20 12 w ill cause no prejud ice to theprosecut ion or the military commiss ion, and w ill not affect the hearing scheduled to beg in on 22August.

d. By jo ining this request, the defendants do not waive the ir claim for relief in

AE020 Motion for Un specified Delay in Submission of Responses to Gove rnment Motions, Repliesto Gove rnment Responses to Defense Motions, and Other Requests .
