Payment of Installments : All payments shall be made by the allottees by Cheque / Pay Order / Bank Draft in the name of Lakhani Presidency and sent to or deposited at Office or authorized agent. (All allottees are advised do not pay by cash). At the time of confirmation of provisional allotment, the allottees shall make mandatory payment of balance installments through post dated cheques. the time fixed for each and every payment is the essence of the contract. In case of failure a demand notice of 15 days shall be sent to the buyer by ordinary post / E-mail, which will be followed by another notice of 15 days by e-mail.

Non Payment : For all sums not paid on due dates, the allottee shall bear fine from the period of first Payment due and in case of continuous non-payment the company shall serve the FINAL NOTICE and then cancel the Provisional Allotment and the amount received as installments will be refunded after deducting 20% of the total cost as establishment/service charges, but such refund will only be made after 12 months of the completion of the project. Subletting and transfers of Allotment : The allottee shall not sublet, transfer or sell his/her apartment to any one before taking possession, without prior written permission of the company. The company may allow such transfer only before the execution of sub lease in favour of allottee on receipt of payment of all outstanding dues upto that time and transfer fee shall be payable at the rate of 5% of the total cost of unit in lieu of expenses in connection with documentation done as service charges.

Delay in taking over possession : The allottee shall take over possession of the unit within 15 days of receipt of the intimation letter from the company. In case of delay, the company shall charge Rs 20000/- per month from the allottee for caretaking of the allotted unit. In case of any losses or damages to his/her booked unit or fixture and fittings therein, due to theft, malicious tactics, natural climatic occurrences, antisocial activities, riots and forced/illegal occupancy etc., the resultant loss or damages will be made good by the applicant.

Disputes : Any dispute arising between Allottee & Developer will be resolve/settled as per Pakistani Law, Rule & Regulations.

Price of Unit : No escalation in price shall be done, except under the unforeseen circumstances and unbearable changes in the national price structure of building materials, national calamity, force-majeure, war, strikes or any other reason beyond the control of the company and delay in payment from allottees, if this will occur the possession of the project may be delayed. Unit price may change according to the increment or decrement of size of apartment.

Possession : possession of the project for phase - I is 24 months and phase II is 48 monthes after confirmation of provisional allotment, if the company fails to give possession within time limit, then company will compensate to pay the rent of the unit ( as market rate ) proportionate to its payment made to company.

Maintenance Charges : The allottees shall pay in advance at least 24 months maintenance/service charges to the company at the rate of Rs.8,000/= per month (or as company decide) and also registration charges at the time of taking over possession to enable the company to make regular payment to maintenance company for the proper upkeep of the Project.

Use of Unit : The allottees / purchasers shall not bring inside the building any goods which are hazardous and combustible. Heavy machinery shall not be transmitted to any floor for which it is not designed. The allottees / purchasers shall not make any internal or external addition, alteration or modifications in the unit without prior approval of the competent authorities, and the unit can’t be use other than residential purpose.

Policy Changes : The company has the right to issue instructions & policy changes which the allottee shall accept and abide by as part of this agreement.

Name and Location of the Project : The name of the project shall be Lakhani Presidency and is being constructed on plot # 1Survey No 42, Deh-Okewari, off National Stadium Road, Gulshan-e-Iqbal, Karachi.

Booking : The project is offered for sale on ownership basis and the same shall be booked on first-come first-serve basis. The terms and conditions, specifications, schedule of payment and application form etc. shall be signed by the buyer and will form part of this Contract Agreement for provisional allotment of the required unit. The unit #, type, the total price and commitment if any, shall be confirmed by the builder along with the provisional allotment letter.

Lease Execution : The lease/sub-lease of the unit shall be executed in favour of the buyer after the allottee has made full payment of the unit, as well as cost of lease documentation charges and legal expenses etc. The buyer will extend full cooperation to the company in connection with the lease/sub-lease by providing relevant documents to complete the lease/sub-lease formalities..

Availability of loan ( Islamic Financing) The loan amount is expected one, which will be obtained from any loan giving agency. However, the grant of loan shall be subject to availability of funds with loan giving agency and on compliance of the requirements of loan giving agency by the buyer within 3 months of the booking. If loan is not granted by loan giving agency for any reason, the allottee shall make arrangement for payment of such amount to the company from his/her own resources.

Availability of service : Although the company would make efforts to obtain permanent domestic electric, gas and water connections and meters in the name of the individual applicant at the earliest and will make payment to the authorities in connection with these services, the availability of the above mentioned services, however, depends on the authorities and the company accepts no responsibility, if the availability of these services delayed due to the policy of the concerned department.

Documentation Charges : Apart from the price of the unit the buyer shall also pay documentation charges for sub-lease, loan, outer-development, security system, connection/meter charges for electricity, gas, water & sewerage. Such extra charges including any miscellaneous charges which may be incurred by the company in fulfilling the formalities of the various departments on demand. That may be between 12% to16% of the total cost of the unit.
