現代日本におけるジェンダーと戸籍:姓·権力·特権Gender and the Koseki in Contemporary Japan: Surname, Power, and PrivilegeBy Linda White

The Japanese koseki system is the legal and social structure keeping record of all Japanese citizens. Determined by the Civil Code and the Koseki Law, for activ-ists challenging it, the koseki is also an ideological structure, which has produced patriarchal control through single-surname households. Based on ethnographic fi eldwork in Tokyo, this book engages with issues of gender hierarchy and struc-tural inequality in Japanese society. Studying several decades of feminist activism and critique of the koseki system, it analyses the strategies of activists who have creatively circumvented koseki rules in order to maintain their natal names in mar-riage. It examines the case studies of members of the fūfubessei (separate surname movement) and the movement to end discrimination against children born out of wedlock, and in so doing this book illuminates the contradictions in current family law and koseki practice that have animated a generation of feminists in Japan.

In Healthcare and Human Dignity, individual worth, equality, and au-tonomy emerge as the dominant values at stake in encounters with doctors, nurses, hospitals, and drug companies. Although the public is aware of legal battles over autonomy and dignity in the context of death, the everyday patient’s need for dignity has received scant attention. Thus, in Healthcare, law professor Frank McClellan’s col-lection of cases and individual experiences bring these stories to life and establish beyond doubt that human dignity is of utmost priority in the everyday process of health care decision making.

Here, Martin describes the social life of a neighborhood police sta-tion during the fi rst rotation in executive power following the dem-ocratic transition. He shows an apparent paradox of how a strong democratic order was built on a foundation of weak police powers, and demonstrates how that was made possible by the continuity of an illiberal idea of policing. His conclusion from this paradox is that the purpose of the police was to cultivate the political will of the community rather than enforce laws and keep order.

By Paul W. Kahn

Paul W. Kahn shows how project and system have long been at work in our theo-logical and philosophical tradition. Against this background, Kahn explains the development of the modern legal imagination in the nineteenth century as a movement from project to system. Americans began the century imagining the constitutional order as their common project: a deliberate construction of We the People. They ended the century imagining that order is continuous with the com-mon law: an immanent development of the principles of civilization. This imagina-tive shift aff ected ideas of legal text, sovereignty, citizenship, interpretation, history, and science.

法はいつ許すべきかWhen Should Law Forgive?By Martha Minow

Who has the right to forgive? Who should be forgiven? And under what terms? Minow tackles these foundational issues by exploring three questions:

What does the international response to child soldiers teach us about the legal treatment of juvenile off enders in the United States?

Why are the laws surrounding corporate debt more forgiving than those govern-ing American student and consumer debt, and sovereign debt in the developing world?

When do law’s tools of forgiveness, amnesties, and pardons strengthen justice, peace, and democracy (think South Africa), and when do they undermine law’s promise of fairness (think Joe Arpaio)?

This collection offers a study of the regimes for the recognition and enforcement of foreign commercial judgments in 15 Asian jurisdic-tions: mainland China, Hong Kong, Taiwan, Japan, Korea, Malaysia, Singapore, Thailand, Vietnam, Cambodia, Myanmar, the Philippines, Indonesia, Sri Lanka and India. This timely book argues that it is im-perative to adopt a uniform system for the recognition and enforce-ment of judgments throughout Asia if there is to be traction for the enhanced cross-border commerce that is expected to result from endeavours such as the ASEAN Economic Community (AEC), the Belt and Road Initiative (BRI), CPTPP (also known as TPP-11), and RCEP.

アジア太平洋地域における航海の自由:戦略的、政治的、法的要因Freedoms of Navigation in the Asia-Paci c Region: Strategic, Political and Legal FactorsRoutledge Research on the Law of the Sea

By Sam Bateman

This book discusses how law, politics and strategy intersect to provide diff erent per-spectives of freedoms on navigation in the Asia-Pacifi c region. These freedoms are very important in this distinctively maritime region, but problems arise over inter-preting the navigational regimes under the law of the sea, especially with regard to the rights of foreign warships to transit another country’s territorial sea without prior notifi cation or authorisation of the coastal state, and with determining the availability of high seas freedoms of navigation and overfl ight in an exclusive economic zone.

In recent years, more attention has been paid to the intersection be-tween history and law that accompanies historians’ entry into the courtroom. Very little, however, has been written about this intersec-tion with a focus on a single case study. Based on original research in several German archives and first-hand interviews, Turner addresses these connections through a study of West Germany’s most famous trial, and the monumental work of history produced from the en-gagement of historical expertise in court.

International Institutions and Power Politics: Bridging the Divide

272 pages October 2019 Georgetown U.P.Hardback 9781626167001 US$134.95

This book moves scholarly debates beyond the old question of whether or not international institutions matter in order to examine how they matter, even in a world of power politics. Power politics and international institutions are often studied as two separate do-mains, but this is in need of rethinking because today most states strategically use institutions to further their interests.
