C.S. No. 53-A/15 11.05.2015 Present:- Proxy Counsel for plaintiffs with plaintiffs Proxy Counsel for MCD with JLO and with Sh. Rajeev Kumar, Administrative Officer in person Sh. Ajit Kumar, Licensing Inspector in person. It is submitted on behalf of MCD that written statement could not be filed for want of attestation,  due to Lawyers being on strike.  I have perused the copy and returned the same.  Perused the record also.  The stand taken by the MCD appears that no permission was granted by the MCD ever for running the weekly Bazaar.  It is further submitted that NOC was declined by Traffic Police in 2011 itself.  On inquiry, it is submitted that there are six weekly Bazaars being organized in Dwarka and in none of those,  MCD has ever granted permission.  It is further submitted that MCD is simply issuing Tehbazari Receipt/R-4 to the hawkers in those weekly Bazaars.  It is further submitted, on inquiry that only once around in 2011 for one  day Tehbazari receipt/R4 was issued to the Hawkers. Even, in the weekly Bazaar in Sector-7. Subsequently or earlier, it has never been issued and no bazaar is being organized over there for long.   My attention was drawn on behalf of plaintiffs to a letter at page no. 21 of the list of documents which appears to be a letter written by DDA in respect of inspection by Dwarka

    Even,intheweeklyBazaarinSector7.Subsequentlyorearlier,

    ithasneverbeenissuedandnobazaarisbeingorganizedover

    thereforlong.

    letteratpageno.21ofthelistofdocumentswhichappearstobe

    Planning Office on 23.11.2007 wherein reference to weekly

    BazaarbeingorganizedatSector7isalsothere.Thisletterwas

    tobeplacedbeforetheCommissioner,MCDalso. Thisfurther

    refersthatMPD2021recognizesweeklymarketandtalksabout

    theplanningforoperationoftheseweeklymarketssothatthese

    markets be not locatedonmaster planroad/zonal planroad

    whichcouldinterferewiththeTrafficbutcouldbelocatedinthe

    parkingandotheropenspace.

    MCDis directedto file detailedwrittenstatement

    takingintoconsiderationall theaforesaidacpects. It appears

    that the aforesaid weekly bazaar was infact operating on the

    serviceroadalongthewallofSikhshaBhartiSchoolasperthe

    survey conducted by DDA, Dwarka, as reflected in the office

    letterofMCDitself.
