It is submitted on behalf of MCD that written

statement could not be filed for want of attestation, due to

Lawyersbeingonstrike. Ihaveperusedthecopyandreturned

thesame.Perusedtherecordalso.

The stand taken by the MCD appears that no

permissionwasgrantedbytheMCDeverforrunningtheweekly

Bazaar.ItisfurthersubmittedthatNOCwasdeclinedbyTraffic

Policein2011itself.

Oninquiry,itissubmittedthattherearesixweekly

BazaarsbeingorganizedinDwarkaandinnoneofthose,MCD

hasevergrantedpermission.

It is furthersubmittedthatMCDissimply issuing

TehbazariReceipt/R4tothehawkersinthoseweeklyBazaars.It

isfurthersubmitted,oninquirythatonlyoncearoundin2011

for one dayTehbazari receipt/R4wasissuedtotheHawkers.

Even,intheweeklyBazaarinSector7.Subsequentlyorearlier,

ithasneverbeenissuedandnobazaarisbeingorganizedover

thereforlong.

Myattentionwasdrawnonbehalfofplaintiffstoa

letteratpageno.21ofthelistofdocumentswhichappearstobe

aletterwrittenbyDDAinrespectofinspectionbyDwarka

Planning Office on 23.11.2007 wherein reference to weekly

BazaarbeingorganizedatSector7isalsothere.Thisletterwas

tobeplacedbeforetheCommissioner,MCDalso. Thisfurther

refersthatMPD2021recognizesweeklymarketandtalksabout

theplanningforoperationoftheseweeklymarketssothatthese

markets be not locatedonmaster planroad/zonal planroad

whichcouldinterferewiththeTrafficbutcouldbelocatedinthe

parkingandotheropenspace.

MCDis directedto file detailedwrittenstatement

takingintoconsiderationall theaforesaidacpects. It appears

that the aforesaid weekly bazaar was infact operating on the

serviceroadalongthewallofSikhshaBhartiSchoolasperthe

survey conducted by DDA, Dwarka, as reflected in the office

letterofMCDitself.
