監管一一手樓楷銷售

先生:

有闋規範發展商推售一手樓事,我希望加入規範代理.現時發展商給予代理

2.5%的個金太豐厚了,動輒過十萬.代理出動人海戰術包圍客人,街頭攔截汽車

行人,以專車接載游說屋都師奶參觀樓盤,更惡劣的是以甚多不實的數據哄蝠她

們入局,卑劣如一般街頭寶藥黨,但政府放任前者卻有效地打擊後者.以下是我

們慘痛經歷:﹒

。5 年,我們透過美耳其欲買一百餘萬的二手樓作退休安居,他們有帶我們參觀多

閱價錢相若的單位. 一個週末,他們單獨請我太太參觀調景嶺都會厭.會場內,

我太太被一眾美耳其經紀包圍硬銷,甚麼替他們預留,必賺,甚至借給近十萬元的

臨時訂(付件 1),結果我太太被他們由二時鐘甚至t時直至簽了臨時訂才放行.

由於我們已是退休上不了會,亦供不起,故要求取消,但被拒絕.他們給我一張

稱已升了 30%,60 萬至 200萬的新價單(付件 2),並連同他們的沙田地區董事一再

保証一定替我們轉售.無奈地一錯再錯只好信他們,前後我們損失了五十多萬!

我曾投訴於地產代理監管局,該局以該價單不是成交理由而拒不受理(付件 3),

但該局的守則 3.3.1"確慚愧秉持誠實待客"(付件 4) 卻沒交代.又以私穩理由

不約見有闋經紀(私穩專員稱這是交易過程,不涉私穩)

作為小市民,對著這些奸商,我們付不起昂貴的訴訟費,惟望政府挂肚加以立法

保護.

Dear Sir or Madam,

Like many HK residents, I believe that property developers have been getting away with murder. There are just so many areas we need mandatory rules to regulate the sale of new flats by developers. If you ask me what the most important area for regulation is, I would say it is the area size of a new flat. suggest:

1. Each new flat must be identified by its actual usable size, which is defined as the area a buyer can actually use and measure himself. For this reason, the developer must provide the detailed measurements of each room or area within a flat which can be verified by any potential buyer. 2. Failure of the developer to provide such measurements should be made a fraud. 3. The relevant government agency in charge of enforcing regulations can prosecute any developer for failure to comply the rules. 4. Any buyer can sue the developer for providing false measurements ofthe flat.

Dear Sirs/Madam,

1 strongly support the proposed legislations to regulate the sale of first hand residential prope巾es. As residential prope巾es usually represent one of the most impor旭nt and biggest investments of ordinary people of Hong Kong, they should en也tle the protection to the same extent at least if not be投er 出甜甜e protection 0仔ered by the Securities and Futures Ordinance wi出 regards to securities 。他red to the public.

My opinion with regards to the present regulations:

1. S. 10 Contents of sales brochure : information required to be set out In sec. 10 (2) (b). the proposed legislation requi陀s that the vendor's information 切 be set out. Since sec. 62 will make the company officers personally liable for misrepresenta甘on , etc, it will be

desirable to make it compulsory to set out the names of the company officers in the sales brochure. (Just like in the securities IPO prospectuses, the names of directors of the company to be listed will be set out as well). So please include the names of responsible officers in the Schedule 1 Part 1 Section 2.

2. s. 62 Liability of Company Officers: As it is common practices to use a special purpose vehicle to hold a pa吋cular pr吋ect, the company

officers could be a junior staff in a big developer which is really owning the residential pr吋ect. For instance, eve叩one knows that Mr. Chiu Kwok Hung (who is a senior management staff of Cheung Kong Holding and supposedly responsible for the 臼le of Cheung Kong's newly developed residential proper口es) is the mastermind of the sales of prope吋es developed by Cheung Kong. If he is not an officer of the SPV owned a residential project, his activities in relation to the sales of a residential project will not be regulated. Since he is such a high profile figure, whatever he says about the subject residential property, it may have strong promo甘onal 甜的.

So it may desirable to extend the definition of company officers to the level (like shadow directors in companies ordinance) that it will make the real mastermind liable for the 0仟:ences , if any.

3. Necessity for a fast route low cost tribunal.

Therefore it may be desirable to set up a tribunal so that the ordinanry public may seek efficient low cost adjudication. It will also be desirable if the consumer council could provide funding to fund class actions against the developers.

規管銷售多於一棟住宅物業之銷售建議意見

前言: 、

本人認同應嚴厲監管各地產賣樓虛假廣告,例如堆填區之臭味竟用心曠神怡形容、新

界沙田區叉形容跟九龍塘成為一體,明明樓房週邊無任何大型公園或海景、但售樓書

或電視廣告竟可將屋苑變出人間仙境、樹林處處、小橋流水、鳥語花香,這種種虛假

廣告,竟無任何規管,叉無實物提供參觀,地產賣樓虛假廣告成為潮流,請問成何體

統!

把售樓虛假說明和誤導手法刑事化是必需的,因買樓是一般中、下市民一生之最艱辛投資、亦是最長期的負擔,往往需時二十多年,不容被騙,本人覺得最好禁止出售樓花,如政府不欲禁止,亦可將樓花定義為以該項目巳完成建築部份80%或已申請到入

伙紙才可作樓花出售,以下是本人意見

(A) 銷售條例-售樓說明

全新未落成住宅樓宇﹒售樓說明書應清楚列出以下項目:

1) 將相關樓宇之屋宇署註冊及經批准圖則、批准文件、公契等重要文件印出,及列出各出售單位之實用面積、但不包括窗台、露台等

2) 其它公用設施之實際面積,叉如住客可使用之會所、車場及車位數目、球場、花園及遊樂場等均需讓買家知悉清各類資料

3) 在售樓說明書內不可有畫家筆下之天馬行空想像,應將出售樓房地盤位置及

週邊實景從實列出,附上鳥轍園,並另列出附近有否其它公共設施如巴士總站、體育館、泳池、圖書館等

4) 各單位之真正座向,例如座北向南等等

5) 各單位價格表需出售前三天公開

6) 每日售出單位數量及價格需24/J、時後於網上及售樓處公佈

7) 有任何殺訂或巳退回之單位亦需24小時後於網上及售樓處公佈

8) 虛假交易或造市行為必需刑事化,主謀之地產商董事及行政總裁等需罰款

最多1%罰款

其它於艾件內之種種建議,本人大致贊成,只是將本人最關註之事項給予意見

It is vital that there be 100% transparency in the property market and all of the transactions that are conducted.

Before making Hong Kong my home 13 years ago, 1 lived in Chicago where 1 worked for 6 years in Property Management & Real Estate, so 1 have experience in this area.

To be a Real Estate Agent in the US, there are many hours of c1asses that need to be taken as well as passing an exam in order to get your Real Estate license.

There are strict rules by which all conduct is govemed, for the protection ofboth the buyer & seller.

It is extremely unfortunate that the Hong Kong Govemment is letting the Property Developers dictate the rules by which they are held accountable, at the detriment ofthe purchaser.

Hong Kong tries to b i1l itself as "A Wor1d Class City", but it never will be unless the govemment has the overall public's best interest at heart, not the Înterest of just a select few.

When 1 explain the ways in which business in the property market is conducted, and that the square footage of a flat inc1udes public area, they are totally perplexed as to why the govemment allows such a policy to take place. It is a "Buyer Beware" situation.

What the govemment has failed to realize is that by not have just & fair laws on the books, it is harming the reputation on Hong Kong, the govemment & its view of affectiveness, as well as hurting the public.

When 1 was looking to purchase a flat, 1 would immediately reduce the square footage by 25% to know what 1 was really trying to buy.

They Govemment must put laws in place that force the property agent丸 the developers, and al1 parties involved to have complete transparancy. Why shouldn't there be.

The real question is not "Should there be transparency?" but "Why should there NOT be transparency?"

面積,也很複雜難搞清楚街市買菜一斤 16 兩尚更清楚

街市商舖呃稱,有海關檢控證券市場造市虛假交易,有證監會監管但我要問問特

首和唐英年先生地產市場的造市虛假交易由誰去監管這涉及香港人

地產市場從來都不是個自由市場,因為政府控制住土地的供應以及土地的價格,每年

推多少土地由政府定,實地價遠不到政府定價就收回 幾個大地產商投得土地建

屋後,什麼時侯推售,以什麼價推售,推多少,都白發展商定,推推停停,連售樓價單都不

顧意問共看透有多少人排隊搶購再定價,同時人為制做缺貨抬價,遲些

買不到或者要出高一些價才買到的氣芬 這是自由市場嗎??政府到現在還

認為這個是自由市場而不肯管

每次開售公屋,居屋,夾屋 申請人是出售量的幾+倍 08 年金融海嘯樓價未見跌

多少, 09 年至今已上升超出 50% 就充分說明房屋市場早已被嚴重扭

曲,需求量大于供應量許多倍

你去買 部電視機的說明書都比"買樓說明書"長盡,而購買樓宇後補養期只有半

年,比任何商品都短為什麼地產商可以如此苛刻而其它產品供應商不敢這麼樣做,

就是政府的高地價政策,高樓價政策,少量地提供土地導至樓價狂升供不應求令

地產商坐大,政府成為地產商鯨吞香港人財富的幫凶

通脹猛于虎政府堅持聯繫í~率等于要迫香港市民搭艘正在下沉的大船,聯í~ 令香

港輸入通脹基層市民生活艱難困苦眾所周知香港的通脹是因為港幣的不

斷貶值而導至輸入性通貨膨脹

2011 年 1 月 7 日香港金管局公布的香港外涯儲備是2689億美圓中國的外í~儲備是3 萬

美圓全球最高特首曾蔭權在立法會答問大會回答議員提問時說

"放棄聯繫í~率害怕炒家來炒港幣"坐擁如此巨額的外灌儲備 還怕炒家來試問有

哪個炒家有比香港外j匡儲備還要多的資本叉愿意來和香港及中國鬥曾蔭權

特首害怕炒家來炒港幣就象有槍的警察隊害怕小偷樣甚至於成立小組去研究應否堅

持聯繫j匯率也不敢,當年打大騁的勇氣哪里去了?

自從金融海嘯以來,美國以鄰為鑿,不負責任地大量印抄 QE1 , QE2,做成大量熱錢

jt入新興經濟體及貨幣自由流通地區如香港等香港因為實行聯繫

í~率,更直接受到熱錢的沖擊聯繫j匯率在 80 至 90 年代是對香港有好處但到實施

柴,米,泊,鹽,醬,醋,茶,衣帽鞋襪,愉由,等等衣食住行相關產品,香港都需要從

國或內地購買,皆囡"聯涯"令港幣貶值而導至輸入通貨膨脹如果 100 港元兌換 130 元人

民幣香港通J劃到長就會消失 因為聯繫涯率,香港無法通過港幣升

f值直或加息等手段去壓抑通貨膨脹政府高官多次說加息會有更多熱錢流入請高官

安知日道 熱錢炒炒、樓

對民生有直接影響 但是'熱錢不會炒賈雞蛋'炒賈大米'炒炒、鼓泊'炒炒、衣服'這些民生

用品不是熱錢令這些市民生活必必、需品大巾幅高副1脹長價而是港幣貶f值直令港人要多

付錢購買這些生活必需品所以熱錢流入并不可怕,只要金管局有所作為就可以了,長

遠更可奠定,鞏固香港作為國際金融中J~、的地位

熱錢湧入香港炒股涯,政府可以監察熱錢沖擊樓市,政府可提高印花稅至 100% 或

150% 去冷卻

熱錢jt入不可怕,而可怕的是不合時宜,疆化的聯繫íl!率令香港輸入通脹基層市民

生活艱難困苦政府堅持聯繫íl!率等于要迫香港市民搭艘正在下沉的大船

任何政策都需要“因事制宜“因時制宜政策不合時宜就要改故此,包括"諾貝

爾"經濟獎得主在內的許多有識之士都認識到香港是放棄"聯繫灌

率"的時侯了政府應從善如流,不要因為任期快屆滿而把該負的責任留給下

屆應實行浮動íl!率或挂靠人民幣

It's happy to have a chance to express my ideas and experience upon buying first hand properties in the past 30 over years in HK. There is one most important draw line is before and after year 1997... the changing of HK into HKSAR

1 totally agree with the government currently published proposa l, in additon 1 would like to suggest ONE most important regulation measure as below:

Before year 1997 , all the developer when they launch their units to sell, initially and upon every periodical reselli時 they are required to publish (i .e. posting a selling statistic on the site/modle flat , 吋蚓叫II山li叫Iwell as all the member of the publi叩c. Through which we know the selling progress of each project... .. .. Thus we can plan and desire to buy or no t. Simplily if the public knows there is still a lot of this project allow us to choice .. ... .. naturally we know we have more time to consider.. .... . hence leading to much less complaints to Govenment after purchase.. .. . thus reducing a lot of Govt 's working pressure.

Me and many of my friends have such unhappy experiences that after a few hours or few days launching we were told the project is above to sold out (BUT actually is was not).. ... Then we were forced to make up our mind immediately as influenced by wrong info .... .. leading to WRONG desicision. This kind of info. for the progess of selling is quite

NON-tranparent now when compare with before 1997.

For your info. Now my experience told me that even in China SHENZHEN , member of the public can easily get info from the Gov t. Housing Regisgtry webpage as to the selling "PRICE of each unit and Progress of each project" of every new project 3-7 days after each selling and maintain there for 3 years.

This Government action makes me and all of my friends feel much advance and civilize. We sincerely hope we can have same level of info.… and HK people deserve.
