Dear Ms. Belin-Pyles:
This letter serves as a reminder of the state statue 18A:7-8(j) and state administrative code 6A:23A-3.1. As of thisdate, June 21, 2010 the District is not compliant with this statue for the position(s) of Interim Superintendent andInterim Assistant Superintendent.
The Executive County Superintendent must review and approve, prior to Board of Education approval, allemployment contracts for the Superintendent, Assistant Superintendent(s) and Business Administrator. Thisincludes review and approval of the following:
1. All new employment contracts, including contracts that replace an expired contract for that employee (tenuredand non-tenured);
2. All renegotiation, amendment and other alterations of terms of existing contracts that have been approvedby the Executive County Superintendent; and3. All contract extensions where such term was not included in the original employment contract or is differentfrom the term contained in the original contract.
The statue permits only Superintendent contracts to exceed one year. Therefore, the Executive CountySuperintendent must review and approve Assistant Superintendent and Business Administrator contracts (tenured andnon-tenured) at least annually consistent with N.J.A.C. 6A:23A-3.1, and cannot approve such contracts for a termgreater than one year.
The contract of the Superintendent, Assistant Superintendent and Business Administrator is consideredunenforceable until the District submits the contract for review and receives approval from the Executive CountySuperintendent.

As per our conversation, in response to your letter dated June 21, 2010 and receivedin my office on June 25, 2010; Ms. Caryn Cooper and I, in our respective roles asInterim Superintendent and Acting Assistant Superintendent, are not currentlunder contractual agreements with the Plainfield Board of Education. Howeverin our roles as Interim Superintendent and Acting Assistant Superintendent, weare receiving additional compensation in the form of stipends.
Please review the attached supporting documentation approved by the PlainfieldBoard of Education regarding the above mentioned appointments. Based on ou
conversation, it is my understanding that the cited state statue 18A:780) and state administrative code 6A:23A-3.1 does not apply in eithecircumstance and therefore the district is in compliance.
