MARPOL Phu luc IV Cac quy đinh vê ngăn ngưa ô nhiêm do nươc thai tư tau

Chương 1 – Qui đinh chung Qui định 1 Đinh nghia Trong Phu luc nay sư dung cac đinh nghia sau đây: Tau mơi la tau:

.1 co hơp đông đong mơi đươc ky hoăc nêu không co hơp đông đong mơi, sông chinh cua tau đươc đăt, hoăc tau đang ơ giai đoan đong mơi tương tư, vao hoăc sau ngay Phu luc nay co hiêu lưc; hoăc

.2 đươc ban giao sau ba năm hoăc hơn kê tư ngay Phu luc nay co hiêu lưc.

1 Tau hiên co la tau không phai la tau mơi.

2 Nươc thai la:

.1 nươc va ac phê thai khac tư bât ky nha vê sinh, nha tiêu nao;

.2 nươc tư cac hô, bê tăm va lô thoat nươc ơ trong buông chưa bênh (phong chưa bênh ngoai tru, buông bênh nhân, ...);

.3 nươc tư cac buông chưa đông vât sông; hoăc

.4 cac dang nươc thai khac khi chung đươc hoa lân vơi nhưng loai nươc nêu trên.

3 Ket chưa la ket dung đê thu gom va chưa nươc thai.

4 Bơ gân nhât. Thuât ngư “ cach bơ gân nhât” nghia la cach đương cơ sơ ma tư đo lanh hai cua bơ tương ưng đươc thiêt lâp phu hơp vơi luât quôc tê, nhưng thuât ngư “cach bơ gân nhât’ trong Công ươc nay khi ap dung ơ vung bơ biên đông-băc Ôxtrâylia thi phai co nghia la tư môt đương ke tư điêm trên bơ biên nươc Ôxtrâylia:

Quy định 2

Pham vi ap dung

1 Nhưng quy đinh cua Phu luc nay ap dung đôi vơi cac tau hoat đông tuyên quôc tê:

.1 tau mơi co tông dung tich tư 400 GT trơ lên;

.2 tau mơi co tông dung tich nho hơn 400 GT đươc phep chơ trên 15 ngươi;

.3 tau hiên co co tông dung tich tư 400 GT trơ lên, sau 5 năm kê tư ngay Phu luc nay co hiêu lưc; va

.4 tau hiên co co tông dung tich nho hơn 400 GT, đươc phep chơ trên 15 ngươi, sau 5 năm kê tư ngay Phu luc nay co hiêu lưc.

2 Chinh quyền hang hai phai đam bao rằng cac tau hiên co, theo cac tiêu muc 1.3 va 1.4 vua qui đinh nay, co sông chinh đươc đăt hoăc ơ giai đoan đong mơi tương tư trươc ngay 2 thang 10 năm 1983 phai trang bi, đên mưc co thê thưc hiên đươc thiêt bi nươc thai theo cac yêu câu cua qui đinh 11 cua Phu luc nay.

1 Qui đinh 11 cua Phu luc nay không ap dung đôi vơi:

.1 Thai nươc thai tư tau la cân thiêt cho muc đich đam bao an toan cho tau, ngươi trên tau hoăc trên biên; hoăc

.2 Thai nươc thai do hư hong tau hoăc thiêt bi trên tau nêu đa ap dung tât ca cac biên phap co thê đươc trươc va sau khi xay ra hư hong nhằm thưc hiên ngăn ngưa giam thiêu thai.

Chương 2: Kiểm tra va chứng nhận

Qui định 4

Kiểm tra

1 Tât ca cac tau, phu hơp theo qui đinh 2, yêu câu phai thoa man cac điều khoan cua Phu luc nay phai chiu cac loai hinh kiêm tra sau đây:

.1 Kiêm tra lân đâu trươc khi đưa tau vao khai thac hoăc trươc khi câp Giây chưng nhân lân đâu theo yêu câu cua qui đinh 5 Phu luc nay, bao gôm kiêm tra toan bô kêt câu, trang bi, hê thông, thiêt bi va vơi khôi lương yêu câu trong Phu luc nay. Kiêm tra lân đâu đê xac nhân rằng kêt câu, trang bi, hê thông, thiêt bi va vât liêu cua tau hoan toan phu hơp vơi cac yêu câu ap dung cua Phu luc nay.

.2 Kiêm tra câp mơi đươc tiên hanh sau nhưng khoang thơi gian do Chinh quyền qui đinh, nhưng không qua 5 năm, trư trương hơp ap dung qui đinh 8.2, 8.5, 8.6 hoăc 8.7 cua Phu luc nay. Kiêm tra câp mơi đê xac nhân rằng kêt câu, trang bi, hê thông, thiêt bi va vât liêu cua tau hoan toan phu hơp vơi cac yêu câu ap dung cua Phu luc này.

.3 Kiêm tra bô sung co tinh chât chung hoăc tưng phân, tuy thuôc vao tưng trương hơp cu thê, phai đươc tiên hanh sau sưa chưa do kêt qua thẩm tra như yêu câu ơ muc 4 cua qui đinh nay, hoăc sau bât ky lân sưa chưa hoăc thay mơi quan trong nao đươc thưc hiên. Kiêm tra bât thương như vây la đê bao đam rằng nhưng sưa chưa hoăc thay mơi cân thiêt đa đươc thưc hiên co hiêu qua, vât liêu va chât lương sưa chưa hoăc thay mơi, về moi phương diên, đều thoa man va tau hoan toan phu hơp vơi yêu câu cua Phu luc nay về moi phương diên.

2 Chinh quyền hang hai phai co biên phap cân thiêt đôi vơi nhưng tau không phai ap dung cac yêu câu trong muc 1 cua qui đinh nay vơi muc đich đam bao thưc hiên cac yêu câu ap dung cua Phu luc nay.

3 Thanh tra viên cua Chinh quyền hang hai phai tiên hanh kiêm tra tau nhằm thưc hiên cac qui đinh cua Phu luc nay. Nhưng Chinh quyền hang hai co thê uỷ quyền viêc kiem tra cho cac Thanh tra viên đươc chỉ đinh hoăc cho tô chưc đươc Chinh quyền hang hai công nhân.

4 Chinh quyền hang hai chỉ đinh Thanh tra viên va công nhân tô chưc tiên hanh kiêm tra như nêu ơ muc 3 cua quy đinh nay, it nhât phai trao quyền cho ho đê:

.1 Yêu câu tiên hanh sưa chưa tau; va

.2 Thưc hiên kiêm tra, nêu Chinh quyền cua quôc gia co cang đề nghi.

Chinh quyền hang hai phai thông bao cho Tô chưc biêt về trach nhiêm va điều kiên cu thê đa đươc giao cho Thanh tra viên đươc chỉ đinh hoăc cho tô chưc đươc công nhân đê gưi cho cac Thanh viên cua Công ươc nay vơi muc đich thông bao về nhưng chưc trach.

5 Nêu Thanh tra viên đươc chỉ đinh hoăc tô chưc đươc công nhân xac đinh rằng trang thai cua tau hoăc trang bi cua no, về cơ ban không phu hơp vơi cac đăc điêm cua Giây chưng nhân, hoăc tau co thê gây nguy hiem cho môi trương biên, thi Thanh tra viên đươc chỉ đinh hoăc tô chưc đươc công nhân phai bao đam nhanh chong ap dung nhưng biên phap khăc phuc va kip thơi bao cho Chinh quyền hang hai biêt. Nêu cac biên phap khăc phuc không đươc thưc hiên thi phai thu hôi Giây chưng nhân va nhanh chong bao cho Chinh quyền hang hai biêt về viêc nay. Nêu tau nằm ơ cang cua môt Thanh viên khac thi cũng phai nhanh chong bao cho Chinh quyền quôc gia co cang biêt về viêc nay. Sau khi nha chưc trach cua Chinh quyền hang hai, Thanh tra viên đươc chỉ đinh hoăc tô chưc đươc công nhân đa bao cho Chinh quyền quôc gia co cang biêt, Chinh phu cua quôc gia co cang đo phai giup đỡ nha chưc trach, Thsnh tra viên đươc chỉ đinh hoăc tô chưc đươc công nhân đê ho thưc hiên nhiêm vu cua minh phu hơp vơi qui đinh nay. Khi cân thiêt, Chinh phu cua quôc gia co cang phai ap dung cac biên phap đê đam bao tau không đươc rơi cang tơi khi nao no đi biên hoăc tơi nha may sưa chưa tau gân nhât ma không gây nguy hiêm cho môi trương biên.

6 Trong moi trương hơp, Chinh quyền hang hai liên quan phai hoan toan đam bao tinh chât đây đu va hiêu qua cua viêc kiêm ta, cũng như chiu trach nhiêm đam bao cac biên phap cân thiêt đê thưc hiên nghia vu nay.

7 Tau va trang bi cua no phai đươc duy tri ơ trang thai thoa man yêu câu cua Công ươc nay đê phu hơp vơi viêc đi biên va không gây nguy hiêm cho môi trương biên về moi phương diên.

8 Sau khi đa tiên hanh bât ky kiêm tra nao theo yêu caua ơ muc 1 cua qui đinh nay, nêu không đươc Chinh quyền hang hai châp thuân thi không cho phep bât ky thay đôi nao trong kêt câu, trang bi, cac hê thông, thiêt bi hoăc vât liêu đa đươc kiêm tra, trư trương hơp thay thê trưc tiêp cac trang bi đo.

9 Trong moi trương hơp khi trên tau xay ra sư cô hoăc phat hiên hư hong co anh hương đên tinh toan vẹn cua tau, hoăc hiêu qua, hoăc tinh đây đu cua trang bi nêu trong Phu luc nay, thi thuyền trương hoăc chu tau phai bao ngay viêc nay cho Chinh quyền hang hai, tô chưc đươc công nhân hoăc Thanh tra viên đươc chỉ đinh – ngươi chiu trach nhiêm về câp giây chưng nhân biêt. Ho la ngươi quyêt đinh co cân thiêt phai tiên hanh kiêm tra theo yêu câu ơ muc 1 cua qui đinh nay hay không. Nêu tau đang ơ cang cua Thanh viên khac, thi thuyền trương hoăc chu tau cũng phai thông bao ngay cho Chinh quyền hang hai cua quôc gia co cang biêt. Thanh tra viên đươc chỉ đinh hoăc tô chưc đươc công nhân phai đam bao rằng đa co thông bao như thê.

Qui định 5

Cấp hoặc Xac nhận giấy chứng nhận

1 Giây chưng nhân quôc tê về ngăn ngưa ô nhiễm do nươc thai đươc câp cho tau thưc hiên nhưng chuyên đi đên cac cang hoăc bên xa bơ thuôc chu quyền cua cac Thanh viên khac tham gia Công ươc, sau khi kiêm tra lân đâu hoăc kiêm tra câp mơi cac tau hiên co phai ap dung yêu câu nay sau 5 năm kê tư ngay Phu luc nay co hiêu lưc.

2 Giây chưng nhân như vây sẽ đươc Chinh quyền hang hai hoăc do ca nhân

hoăc tô chưc đươc Chinh quyền hang hai uỷ quyền câp hoăc xac nhân. Trong moi trương hơp, Chinh quyền hang hai phai chiu trach nhiêm hoan toan về giây chưng nhân đo.

Qui định 6

Giấy chứng nhận do chính phủ khac cấp hoặc xac nhận

1 Theo yêu câu cua chinh quyền hang hai, Chinh phu cua môt Thanh viên Công ươc co thê uỷ quyền kiêm tra tau va khi nhân thây tau thoa man nhưng yêu câu cua Phu luc nay thi sẽ câp hoăc uỷ quyền câp cho tau Giây chưng nhân quôc tê vê Ngăn ngưa ô nhiễm do dâu gây ra, va nêu phu hơp, xac nhân hoăc uỷ quyền xac nhân vao Giây chưng nhân co trên tau theo qui dinh cua Phu luc này.

2 Môt ban sao Giây chưng nhân va biên ban kiêm tra phai đươc gưi ngay cho Chinh quyền hang hai đa yêu câu kiêm tra.

3 Giây chưng nhân đươc câp theo hinh thưc như vây phai đươc ghi la đa câp theo yêu câu cua Chinh quyền hang hai, co hiêu lưc va đươc thưa nhân như Giây chưng nhân câp theo qui đinh 5 cua Phu luc nay.

4 Giây chưng nhân quôc tê về ngăn ngưa ô nhiễm do dâu gây ra không đươc câp cho tau mang cơ cua quôc gia không phai la Thanh viên Công ươc.

Qui định 7 Mẫu giấy chứng nhận Giây chưng nhân quôc tê về ngăn ngưa ô nhiễm do nươc thai phai đươc lâp theo mâu như nêu trong phu chương cua Phu luc nay va phai viêt it nhât bằng tiên Anh, Phap hoăc Tây Ban Nha. Nêu ngôn ngư chinh thưc cua quôc gia tau treo cơ cũng đươc sư dung, thi ngôn ngư nay sẽ đươc ưu tiên trong trương hơp xay ra tranh châp hoăc không thông nhât. Qui định 8 Thời han va hiệu lực của Giấy chứng nhận

1 Giây chưng nhân quôc tê về ngăn ngưa ô nhiễm do nươc thai phai đươc câp vơi thơi han do Chinh quyền hang hai qui đinh nhưng không qua 5 năm.

2.1 Bât kê cac yêu câu ơ muc 1 cua qui đinh nay, khi kiêm tra câp mơi đươc hoan thanh trong vong ba thang trươc ngay hêt han cua Giây chưng nhân hiên co, Giây chưng nhân mơi sẽ co gia tri kê tư ngay hoan thanh kiêm tra câp mơi đên thơi điêm không qua 5 năm kê tư ngay Giây chưng nhân hiên co hêt han

2.2 Nêu kiêm tra câp mơi đươc hoan thanh sau ngay hêt han cua Giây chưng nhân hiên co, Giây chưng nhana mơi sẽ co hiêu lưc tư ngay hoan thanh kiêm tra câp mơi đên thơi han không qua 5 năm kê tư ngay hêt han cua Giây chưng nhân hiên co.

2.3 Nêu kiêm tra câp mơi đươc hoan thanh qua ba thang trươc ngay hêt han cua Giây chưng nhân hiên co, Giây chưng nhân mơi sẽ co gia tri tư ngay hoan thanh kiêm tra câp mơi đên thơi han không qua 5 năm kê tư ngay hoan thanh kiêm tra câp mơi đo.

3 Nêu Giây chưng nhân đươc câp vơi thơi han ngăn hơn 5 năm thi Chinh quyền hang hai co thê gia han hiêu lcj cua Giây chưng nhân vơi thơi hanj tôi đa vươt qua ngay hêt han cua Giây chưng nhân như nêu tai muc 1 cua qui đinh nay.

4 Nêu kiêm tra câp mơi đa hoan thanh ma Giây chưng nhân mơi chưa đươc câp hoăc chưa co ơ trên tau vao trươc ngay hêt han cua Giây chưng nhân hiên co thi nha chưc trach hoăc tô chưc Chinh quyền hang hai uỷ quyền co thê xac nhân vao Giây chưng nhân hiên co. Giây chưng nhân co xac nhân như vây phai đươc công nhân co gia tri vơi thơi han bô sung không qua 5 thang kê tư ngay hêt han.

5 Chính quyền hang hai co thê gia han hiêu lưc cua Giây chưng nhân, nêu tau, vao thơi điêm hêt han cua Giây chưng nhân, không ơ cang đê kiêm tra, nhưng viêc gia han đo chỉ đê cho phep tao điều kiên cho tau hoan thanh chuyên đi tơi cang kiêm tra, va chỉ trong nhưng trương hơp điều đo la hơp ly. Không đươc gia han qua ba thang cho bât ky môt Giây chưng nhân nao va tau đươc gai han khi đên cang kiêm tra không đươc sư dung sư gia han như vây đê rơi cang ma không co Giaya chưng nhana mơi trên tau. Nêu kiêm tra câp mơi đươc hoan thanh, Giây chưng nhân mơi sẽ co thơi han hiêu lưc không qua 5 năm kê tư ngay hêt han cua Giây chưng nhân hiên co trươc khi viêc gia han đươc thưc hiên.

6 Giây chưng nhân câp cho tau thưc hiên cac chuyên đi ngăn chưa đươc gia han theo nhưng điều khoan nêu trên cua qui đinh nay co thê đươc Chinh quyền hang hai gia han đên môt thang tinh tư ngay hêt han. Nêu đơt kiêm tra câp mơi đươc hoan thanh, Giây chưng nhân mơi co thơi han hieuẹ lưc đên thơi điêm không qua 5 năm kê tư ngay hêt han cua Giây chưng nhân hiên co trươc khi viêc gia han đươc thưc hiên.

7 Tuy theo Chinh quyền hang hai quyêt đinh, trong nhưng trương hơp đăc biêt, Giây chưng nhân mơi không nhât thiêt phai tinh thơi han hiêu lưc tư ngay hêt han cua Giây chưng nhân hiên co như yêu câu ơ muc 2.2,5 hoăc 6 cua qui đinh nay. Trong nhưng trương hơp như vây, Giây chưng nhân mơi phai co hiẹu lưc không qua 5 năm tinh tư ngay hoan thanh viêc kiêm tra câp mơi.

8 Giây chưng nhân câp theo qui đinh 5 hoăc 6 cua Phuc luc nay sẽ bi mât gia tri hiêu lưc trong bât ky trương hơp nao sau đây:

.1 Nêu nhưng kiêm tra theo yêu câu không đươc hoan thanh trong thơi han nêu trong qui đinh 4.1 cua Phu luc nay; hoăc

.2 Khi tau chuyên sang mang cơ cua quôc gia khac. Chỉ câp Giây chưng nhân mơi cho tau nêu Chinh phu câp Giây chưng nhân mơi hoan toan thoa man rằng tau phu hơp vơi qui đinh 4.7 va 4.8 cua Phu luc nay. Trong trương hơp chuyên cơ giưa cac nươc la Thanh viên, nêu đươc yêu câu sau khi chuyên cơ trong vong ba thang thi Chinh phu Thanh viên ma tau treo cơ trươc phai chuyên cho Chính quyền hang hai ban sao giây chưng nhân co trên tau trươc luc chuyên cơ va nhưng ban sao co liên quan khac, cang sơm cang tôt.

Chương 3: Thiết bi va kiểm soat thai

Qui định 9

Hệ thống xử lý nươc thai

1 Tât ca cac tau, theo qui đinh 2, yêu câu thoa man cac điều khoan cua Phu luc nay, phai trang bi môt trong cac hê thông xư ly nươc thai sau:

.1 Hê thông xư ly nươc thai la loai đươc Chinh quyền hang hai phê duyêt, co lưu y đên cac tiêu chuẩn va phương phap thư do Tô chưc

ban hành, hoăc

.2 Hê thông nghiền va diêt trung đươc Chinh quyền hang hai phê duyêt. Hê thông nay phai đươc trang bi bằng cac thiêt bi thoa man yêu câu cua Chinh quyền hang hai cho viêc chưa tam thơi nươc thai khi tau cach bơ gân nhât dươi 3 hai ly, hoăc

.3 Ket chưa co thê tich thoa man yêu câu cua Chinh quyền hang hai , chưa đươc toan bô nươc thai, co lưu y đên chê đô hoat đông cu tau, sô lương ngươi trên tau va cac yêu tô liên quan khac. Ket chưa phai co kêt câu thoa man yêu câu cua Chinh quyền hang hai va phai co thiêt bi chỉ bao nhin thây lương nươc thai chưa trong đo.

Bích nối tiêu chuẩn

1 Đê đam bao viêc nôi đương ông cua thiêt bi tiêp nhân vơi đương ông xa cua tau, ca hai đương ông phai co bich nôi tiêu chuẩn va co kich thươc theo bang dươi đây:

Bich dung cho đương ông co đương kinh trong tơi 100mm va phai đươc chê tao bằng thep hoăc vât liêu tương đương co măt ngoai phằng. Bich nay cung vơi đêm lam kin thich hơp phai phu hơp cho viêc sư dung ơ ap suât 600 kPa.

Đôi vơi tau co chiều cao man ly thuyêt tư 5m trơ xuông, đương kinh trong cua bich nôi co thê bằng 38 mm.

2 Đôi vơi cac tau hoat đông thương mai chuyên dung, vi du như cac pha chơ khach, thau cho đương ông thai cua tau, Chinh quyền hang hai co thê châp nhân trang bi nôi thai khac, vi du như cac khơp nôi nhanh.

Qui định 11

Thai nươc thai

1 Theo các yêu câu ơ qui đinh 3 cua Phu luc nay, câm xa nươc thai ra biên, trư cac trương hơp sau đây:

.1 Tau xa nươc thai đa nghiền va khư trung ơ cach bơ gân nhât trên 3 hai ly, bằng hê thông đươc Chinh quyền hang hai phê duyêt thoa man qui đinh 9.12 cua Phu luc nay, hoăc nươc thai chưa đươc nghiền hoăc khư trung ơ cach bơ gân nhât trên 12 hai ly, vơi điều kiên trong bât ky trương hơp nao nươc thai đa đươc chưa trong ket chưa, hoăc nươc thai xuât phat tư cac khu vưc co đông vât sông, phai đươc thai đều ( không thai ô at) khi tôc đô tau đang hanh trinh không dươi 4 hai ly; cương đô xa phai đươc Chinh quyền hang hai

phê duyêt dưa trên cac tiêu chuẩn do Tô chưc ban hanh; hoăc

1 Môt tau khi ơ trong cang cua môt Thanh viên khac phai chiu kiêm tra do các nha chưc trach đươc Thanh viên đo uỷ quyền thưc hiên liên quan tơi cac yêu câu khai thac theo Phu luc nay, nêu co nhưng bằng chưng rõ rang chưng to rằng thuyền trương hoăc thuyền viên không quen vơi cac qui trinh cân thiêt trên tau về viêc ngăn ngưa ô nhiễm do nươc thai gây ra.

2 Trong cac trương hơp ơ muc 1 cu qui đinh nay, Thanh viên thưc hiên viêc kiêm soat phai ap dung cac biên phap cân thiêt đê đam bao rằng tau không đươc tiêp tuc hoat đông cho đên khi đươc khăc phuc thoa man cac yêu câu cua Phu luc này.

3 Cac qui trinh liên quan đên kiêm tra cua quôc gia nay co cang đươc nêu ơ điều 5 cua Công ươc nay phai đươc ap dung đôi vơi qui đinh nay.

MARPOL ANNEX IV REGULATIONS FOR THE PREVENTION OF POLLUTION BY SEWAGE FROM SHIPS

Chapter 1 General Regulation 1 Definitions For the purposes of this Annex: 1 New ship means a ship:

.1 for which the building contract is placed, or in the absence of a building

contract, the keel of which is laid, or which is at a similar stage of

construction, on or after the date of entry into force of this Annex; or

.2 the delivery of which is three years or more after the date of entry into

force of this Annex. 2 Existing ship means a ship which is not a new ship. 3 Sewage means:

.1 drainage and other wastes from any form of toilets and urinals;

.2 drainage from medical premises (dispensary, sick bay, etc.) via wash

basins, wash tubs and scuppers located in such premises;

.3 drainage from spaces containing living animals; or

.4 other waste waters when mixed with the drainages defined above.

4 Holding tank means a tank used for the collection and storage of

sewage.

5 Nearest Land. The term "from the nearest land" means from the baseline from

which the territorial sea of the territory in question is established in accordance

with international law except that, for the purposes of the present Convention

"from the nearest land" off the north eastern coast of Australia shall mean from a

line drawn from a point on the coast of Australia in:

Convention applies to a port outside such country, or conversely.

7 Person means member of the crew and passengers. 8 Anniversary date means the day and the month of each year which will

correspond to the date of expiry of the International Sewage Pollution

Prevention Certificate. Regulation 2 Application 1 The provisions of this Annex shall apply to the following ships engaged in

international voyages:

.1 new ships of 400 gross tonnage and above; and

.2 new ships of less than 400 gross tonnage which are certified to carry more than 15 persons; and

.3 existing ships of 400 gross tonnage and above, five years after the date of entry into force of this Annex; and

.4 existing ships of less than 400 gross tonnage which are certified to carry more than 15 persons, five years after the date of entry into force of this Annex.

2 The Administration shall ensure that existing ships, according to

subparagraphs 1.3 and 1.4 of this regulation, the keels of which are laid or

which are of a similar stage of construction before 2 October 1983 shall be

equipped, as far as practicable, to discharge sewage in accordance with the

requirements of regulation 11 of the Annex.

Regulation 3 Exceptions

1 Regulation 11 of this Annex shall not apply to:

.1 the discharge of sewage from a ship necessary for the purpose of

securing the safety of a ship and those on board or saving life at

sea; or

.2 the discharge of sewage resulting from damage to a ship or its

equipment if all reasonable precautions have been taken before and

after the occurrence of the damage, for the purpose of preventing or

minimizing the discharge.

Chapter 2 Surveys and certification

Regulation 4 Surveys 1 Every ship which, in accordance with regulation 2, is required to comply

with the provisions of this Annex shall be subject to the surveys specified below:

.1 An initial survey before the ship is put in service or before the

Certificate required under regulation 5 of this Annex is issued for the first time, which shall include a complete survey of its structure,

equipment, systems, fittings, arrangements and material in so far as

the ship is covered by this Annex. This survey shall be such as to

ensure that the structure, equipment, systems, fittings, arrangements

and material fully comply with the applicable requirements of this

Annex.

.2 A renewal survey at intervals specified by the Administration, but not

exceeding five years, except where regulation 8.2, 8.5, 8.6 or 8.7 of

this Annex is applicable. The renewal survey shall be such as to

ensure that the structure, equipment, systems, fittings,

arrangements and material fully comply with applicable requirements

of this Annex.

.3 An additional survey either general or partial, according to the

circumstances, shall be made after a repair resulting from investigations prescribed in paragraph 4 of this regulation, or

whenever any important repairs or renewals are made. The survey shall be such as to ensure that the necessary repairs or renewals have been effectively made, that the material and workmanship of

such repairs or renewals are in all respects satisfactory and that the ship complies in all respects with the requirements of this Annex.

2 The Administration shall establish appropriate measures for ships which

are not subject to the provisions of paragraph 1 of this regulation in order to

ensure that the applicable provisions of this Annex are complied with. 3 Surveys of ships as regards the enforcement of the provisions of this

Annex shall be carried out by officers of the Administration. The Administration

may, however, entrust the surveys either to surveyors nominated for the purpose

or to organizations recognized by it. 4 An Administration nominating surveyors or recognizing organizations to

conduct surveys as set forth in paragraph 3 of this regulation shall, as a minimum,

empower any nominated surveyor or recognized organization to:

.1 require repairs to a ship; and .2 carry out surveys if requested by the appropriate authorities of a Port State.

The Administration shall notify the Organization of the specific responsibilities and

conditions of the authority delegated to the nominated surveyors or recognized

organizations, for circulation to Parties to the present Convention for the

information of their officers. 5 When a nominated surveyor or recognized organization determines that the condition of the ship or its equipment does not correspond substantially with the particulars of the Certificate or is such that the ship is not fit to proceed to sea without presenting an unreasonable threat of harm to the marine environment, such surveyor or organization shall immediately ensure that corrective action is taken and shall in due course notify the Administration. If such corrective action is not taken the Certificate should be withdrawn and the Administration shall be notified immediately and if the ship is in a port of another Party, the appropriate authorities of the Port State shall also be notified immediately. When an officer of the Administration, a nominated surveyor or recognized organization has notified the appropriate authorities of the Port State, the Government of the Port State concerned shall give such officer, surveyor or organization any necessary assistance to carry out their obligations under this regulation. When applicable, the Government of the Port State concerned shall take such steps as will ensure that the ship shall not sail until it can proceed to sea or leave the port for the purpose of proceeding to the nearest appropriate repair yard available without presenting an unreasonable threat of harm to the marine environment. 6 In every case, the Administration concerned shall fully guarantee the

completeness and efficiency of the survey and shall undertake to ensure the

necessary arrangements to satisfy this obligation. 7 The condition of the ship and its equipment shall be maintained to conform with

the provisions of the present Convention to ensure that the ship in all respects will

remain fit to proceed to sea without presenting an unreasonable threat of harm to

the marine environment. 8 After any survey of the ship under paragraph 1 of this regulation has been

completed, no change shall be made in the structure, equipment, systems, fittings,

arrangements or material covered by the survey, without the sanction of the

Administration, except the direct replacement of such equipment and fittings.

9 Whenever an accident occurs to a ship or a defect is discovered which substantially affects the integrity of the ship or the efficiency or completeness of its equipment covered by this Annex the master or owner of the ship shall report at the earliest opportunity to the Administration, the recognized organization or the nominated surveyor responsible for issuing the relevant Certificate, who shall cause investigations to be initiated to determine whether a survey as required by paragraph 1 of this regulation is necessary. If the ship is in a port of another Party, the master or owner shall also report immediately to the appropriate authorities of the Port State and the nominated surveyor or recognized organization shall

ascertain that such report has been made. Regulation 5 Issue or Endorsement of Certificate 1 An international Sewage Pollution Prevention Certificate shall be issued,

after an initial or renewal survey in accordance with the provisions of regulation 4

of this Annex to any ship which is engaged in voyages to ports or offshore

terminals under the jurisdiction of other Parties to the Convention. In the case of

existing ships this requirement shall apply five years after the date of entry into

force of this Annex. 2 Such Certificate shall be issued or endorsed either by the Administration or

by any persons or Organization1 duly authorized by it. In every case the

Administration assumes full responsibility for the Certificate. Regulation 6 Issue or Endorsement of a Certificate by another Government 1 The Government of a Party to the Convention may, at the request of the

Administration, cause a ship to be surveyed and, if satisfied that the provisions of

this Annex are complied with, shall issue or authorize the issue of an International

Sewage Pollution Prevention Certificate to the ship, and where appropriate,

endorse or authorize the endorsement of that Certificate on the ship in accordance

with this Annex. 2 A copy of the Certificate and a copy of the Survey report shall be

transmitted as soon as possible to the Administration requesting the survey.

3 A Certificate so issued shall contain a statement to the effect that it has

been issued at the request of the Administration and it shall have the same force

and receive the same recognition as the Certificate issued under regulation 5 of

this Annex.

4 No International Sewage Pollution Prevention Certificate shall be issued to

a ship which is entitled to fly the flag of a State, which is not a Party.

Regulation 7 Form of Certificate

The International Sewage Pollution Prevention Certificate shall be drawn up

in the form corresponding to the model given in the Appendix to this Annex and

shall be at least in English, French or Spanish. If an official language of the issuing

country is also used, this shall prevail in case of a dispute or discrepancy. Regulation 8 Duration and validity of Certificate 1 An International Sewage Pollution Prevention Certificate shall be issued for

a period specified by the Administration which shall not exceed five years.

2.1

Notwithstanding the requirements of paragraph 1 of this regulation, when the renewal survey is completed within three months before the expiry date of the existing Certificate, the new Certificate shall be valid from the date of completion the existing Certificate.

2.2

When the renewal survey is completed after the expiry date of the existing Certificate, the new Certificate shall be valid from the date of completion of the renewal survey to a date not exceeding five years from the date of expiry of the existing Certificate.

2.3

When the renewal survey is completed more than three months before the expiry date of the existing Certificate, the new Certificate shall be valid from the date of completion of the renewal survey to a date not exceeding five years from the date of completion of the renewal survey.

3 If a Certificate is issued for a period of less than five years, the

Administration may extend the validity of the Certificate beyond the expiry date to

the maximum period specified in paragraph 1 of this regulation.

4 If a renewal survey has been completed and a new Certificate cannot be

issued or placed on board the ship before the expiry date of the existing

Certificate, the person or organization authorized by the Administration may

endorse the existing Certificate and such a Certificate shall be accepted as valid

for a further period which shall not exceed five months from the expiry date.

5 If a ship at the time when a Certificate expires is not in a port in which it is to be surveyed, the Administration may extend the period of validity of the Certificate but this extension shall be granted only for the purpose of allowing the ship to complete its voyage to the port in which it is to be surveyed and then only in cases where it appears proper and reasonable to do so. No Certificate shall be extended for a period longer than three months, and a ship to which an extension is granted shall not, on its arrival in the port in which it is to be surveyed, be entitled by virtue of such extension to leave that port without having a new Certificate. When the renewal survey is completed, the new Certificate shall be valid to a date not exceeding five years from the date of expiry of the existing Certificate before the extension was granted. 6 A Certificate issued to a ship engaged on short voyages which has not

been extended under the foregoing provisions of this regulation may be extended

by the Administration for a period of grace of up to one month from the date of

expiry stated on it. When the renewal survey is completed, the new Certificate

shall be valid to a date not exceeding five years from the date of expiry of the

existing Certificate before the extension was granted. 7 In special circumstances, as determined by the Administration, a new

Certificate need not be dated from the date of expiry of the existing Certificate as

required by paragraph 2.2, 5 or 6 of this regulation. In these special

circumstances, the new Certificate shall be valid to a date not exceeding five

years from the date of completion of the renewal survey. 8 A Certificate issued under regulation 5 or 6 of this Annex shall cease to be

valid in either of the following cases:

.1 if the relevant surveys are not completed within the periods specified under regulation 4.1 of this Annex; or

.2

upon transfer of the ship to the flag of another State. A new Certificate shall only be issued when the Government issuing the new Certificate is fully satisfied that the ship is in compliance with the requirements of regulations 4.7 and 4.8 of this Annex. In the case of a transfer between Parties, if requested within 3 months after the transfer has taken place, the Government of the Party whose flag the ship was formerly entitled to fly shall, as soon as possible, transmit to the Administration copies of the Certificate carried by the ship before the transfer and, if available, copies of the relevant survey reports.

Chapter 3 Equipment and control of discharge Regulation 9 Sewage Systems 1 Every ship which, in accordance with regulation 2, is required to comply with the provisions of this Annex shall be equipped with one of the following sewage systems:

.1 a sewage treatment plant which shall be of a type approved by the Administration, taking into account the standards and test methods developed by the Organization2, or

.2 a sewage comminuting and disinfecting system approved by the Administration. Such system shall be fitted with facilities to the satisfaction of the Administration, for the temporary storage of sewage when the ship is less than 3 nautical miles from the nearest land, or

.3 a holding tank of the capacity to the satisfaction of the Administration for the retention of all sewage, having regard to the operation of the ship, the number of persons on board and other relevant factors. The holding tank shall be constructed to the satisfaction of the Administration and shall have a means to indicate visually the amount of its contents.

Regulation 10

Standard Discharge Connections 1 To enable pipes of reception facilities to be connected with the ship's

discharge pipeline, both lines shall be fitted with a standard discharge

connection in accordance with the following table: SEE INTERPRETATION

existing ships national specifications are acceptable.

The flange is designed to accept pipes up to a maximum internal diameter of 100 mm and shall be of steel or other equivalent material having a flat face. This flange, together with a suitable gasket, shall be suitable for a service pressure of 600 kPa.

For ships having a moulded depth of 5 metres and less, the inner diameter of the

discharge connection may be 38 millimetres. 2 For ships in dedicated trades, i.e. passenger ferries, alternatively the

ship's discharge pipeline may be fitted with a discharge connection which can be

accepted by the Administration, such as quick connection couplings.

Regulation 11

Discharge of Sewage 1 Subject to the provisions of regulation 3 of this Annex, the discharge of

sewage into the sea is prohibited, except when:

.1 the ship is discharging comminuted and disinfected sewage using a

system approved by the Administration in accordance with regulation 9.1.2 of this Annex at a distance of more than 3 nautical miles from the nearest land, or sewage which is not comminuted or disinfected at a distance of more than 12 nautical miles from the nearest land, provided that in any case, the sewage that has been stored in holding tanks shall not be discharged instantaneously but at a moderate rate when the ship is en route and proceeding at not less than 4 knots; the rate of discharge shall be approved by the Administration based upon standards developed by the

Organization; or

.2 the ship has in operation an approved sewage treatment plant which

has been certified by the Administration to meet the operational

requirements referred to in regulation 9.1.1 of this Annex, and

.2.1 the test results of the plant are laid down in the ship's

International Sewage Pollution Prevention Certificate; and

.2.2 additionally, the effluent shall not produce visible floating

solids nor cause discoloration of the surrounding water. 2 The provisions of paragraph 1 shall not apply to ships operating in the

waters under the jurisdiction of a State and visiting ships from other States while

they are in these waters and are discharging sewage in accordance with such less

stringent requirements as may be imposed by such State. 3 When the sewage is mixed with wastes or waste water covered by other

Annexes of MARPOL 73/78, the requirements of those Annexes shall be complied

with in addition to the requirements of this Annex.

Chapter 4 Reception facilities Regulation 12 Reception facilities 1 The Government of each Party to the Convention, which requires ships

operating in waters under its jurisdiction and visiting ships while in its waters to

comply with the requirements of regulation 11.1, undertakes to ensure the

provision of facilities at ports and terminals of the reception of sewage, without

causing delay to ships, adequate to meet the needs of the ships using them. 2 The Government of each Party shall notify the Organization for

transmission to the Contracting Governments concerned of all cases where the

facilities provided under this regulation are alleged to be inadequate.

Chapter 5 – Port State Control

Regulation 13

Port State control on operational requirements3 1. A ship when in a port or an offshore terminal of another Party is subject to

inspection by officers duly authorized by such Party concerning operational

requirements under this Annex, where there are clear grounds for believing that

the master or crew are not familiar with essential shipboard procedures relating to

the prevention of pollution by sewage. 2. In the circumstances given in paragraph (1) of this regulation, the Party

shall take such steps as will ensure that the ship shall not sail until the situation

has been brought to order in accordance with the requirements of this Annex. 3. Procedures relating to the port State control prescribed in article 5 of the

present Convention shall apply to this regulation. 4. Nothing in this regulation shall be construed to limit the rights and

obligations of a Party carrying out control over operational requirements

specifically provided for in the present Convention.”

Unified Interpretation of Annex IV

Reg.10.1 All ships subject to Annex IV, irrespective or their size and of the

presence of a sewage treatment plant or sewage holding tank, shall be provided

with a pipeline and the relevant shore connection flange for discharging sewage to

port sewage treatment facility.
