Макаров, Александр Николаевич (1888—1973)

Российский юрист, в 1925 г. вынужденный эмигрировать в

Германию, где прошла вторая и большая часть его жизни.

Внес большой вклад в немецкое право о гражданстве,

освободив его от перспективы развития только во

внутринациональном направлении и подняв его на высокий научный

уровень с коллизионной, компаративистской и международно-

правовой точек зрения. По приглашению правительства ФРГ

А. Н. Макаров состоял членом комиссии по пересмотру закона о

гражданстве ФРГ, а изданными им комментариями к этому закону

пользовался, в том числе, Верховный суд ФРГ при вынесении своих

решений. Исследования А.Н. Макарова не утратили своей ценности и

сегодня.

языке сборник источников МЧП, причем как

национальных (включая сборники межобластного

права) так и международных. Этот сборник охватывал

разнообразные внутренние источники 60 государств

(не считая например штаты США, а также колонии и

другие зависимые территории), а также включал в себя

извлечения из более чем двухсот международных

договоров (включая перевод двух первых книг Кодекса

Бустаманте.

В 1972 г. А. Н. Макаровым была написана небольшая

работа об источниках МЧП для «Международной

энциклопедии сравнительного права», изданная в

рамках последней отдельным изданием.

Ehrenzweig, Albert Armin (1906—1974)

He won worldwide recognition in his two principal fields of endeavor,

conflict of laws and jurisprudence, to which he contributed several

pioneering books and a vast array of articles. Born in Vienna, he received his

civil law education in Heidelberg, Grenoble, and Vienna. He earned his

J.U.D. degree from the latter university in 1928. On the basis of his first

major monograph on «Culpability as Basis of Liability for Damages», which

was published in 1936, Ehrenzweig joined the Vienna law faculty in 1937,

but his promising career in Austria terminated soon with the rise to power of

a hostile government. After a brief period at the University of Bristol,

England, Albert and his family migrated to the United States and there he

embarked on a second legal education at the University of Chicago

(1939―1941) and Columbia University (1941―1942). From 1942―1944

Ehrenzweig was a member of the staff of the Law Revision Commission of

New York and subsequently joined the prestigious Cravath law firm in New

York. In 1947 he was invited to teach during the summer session at Boalt

Hall, an association that was made permanent in 1948.

Professor of Law at King’s College London from 1947—1974, Joint Editor

of the International and Comparative Law Quarterly in 1955—1961, and

President of the International Association of Legal Science in 1960—1962,

of the Society of Public Teachers of Law (became The Society of Legal

Scholars in 2002) in 1972—1973.

Professor, University of Milan.

He graduated in Law at the University of Turin in 1995, obtained an LL.M.

in German Law at the LMU University in Munich (Germany) in 1997, and

the diplomas of first and second cycle in Comparative Law at the

International Faculty of Comparative Law of the University of Strasbourg

(France) respectively in 1989 and 1990. He is fully qualified since 1999.

Gutzwiller, Max (1889—1989)

Max Gutzwiller wurde am 1. Oktober 1889 in Basel als Sohn des

Bankiers Karl Gutziller und der Frauenpolitikerin Emilie Gutzwiller ―

Meyer geboren. Gutzwiller nahm ein Studium der Rechte an den

Universitäten Basel, Freiburg, ab 1908 Berlin sowie ab 1911 Bonn auf, das

er ebendort mit dem Erwerb des akademischen Grades eines Dr. iur.

abschloss.

In der Folge hatte er von 1921 bis 1926 sowie 1937 bis 1956 den

Lehrstuhl für Römisches Recht und von 1925 bis 1926 sowie 1937 bis 1956

den für Internationales Privatrecht an der Universität Freiburg im

Üechtland inne. Dazu wirkte er von 1926 bis 1936 als ordentlicher

Professor für Deutsches Privatrecht und Römisches Recht an der Ruprecht

― Karls ― Universität in Heidelberg. 1946 gründete Gutzwiller die Reihe

«Arbeiten aus dem Iuristischen Seminar der Universität Freiburg», mit der

Kurzform (AISUF). Daneben fungierte er von 1949 bis 1970 als Redakteur

und Herausgeber der Zeitschrift für Schweizerisches Recht.

Während seiner akademischen Karriere lehrte Max Gutzwiller Römisches

Recht auf Französisch und Deutsch. Besondere Anerkennung fand er auf

dem Gebiet des Internationalen Rechts. Gutzwiller gehörte der Vereinigung

für Internationales Recht an und präsidierte die Konferenz von Luzern von

1952. 1951 und 1956 vertrat er die Schweiz an den Sessionen der Haager





Konferenz für Internationales Privatrecht. 1954 wurde er als Mitglied in das

Institut für Internationales Recht aufgenommen.

Max Gutzwiller gilt als einer der «geistigen Väter» des «Übereinkommens

der Vereinten Nationen über Verträge über den internationalen Warenkauf»

von 1980. 1959 wurde ihm die Ehrendoktorwürde der Universität

Amsterdam zuteil.

Juenger, Friedrich K. (1930—2001)

Friedrich K. Juenger, professor of law at UC Davis, who was a

leading authority on private international law. One of the world’s leading

authorities in the fields of conflict of laws and comparative law, Friedrich

Juenger was a fervent advocate of the comparative perspective on law

reform.

The author of four books and over 70 articles, Fritz served as

president of the American Society of Comparative Law from 1990 to 1994

and later as president of the Common Law Group of the International

Academy of Comparative Law. An active and valued member of the Board

of Editors of the American Journal of Comparative Law for over 30 years,

he also served as a member of the Secretary of State’s advisory committee

on private international law and as general reporter for the 12th

International Congress of Comparative Law in 1986. In the last year of his

life, he served as the chair of the American Association of Law School’s

section on conflict of laws. Less than a month before he died, he chaired a

panel at the Association’s annual meeting. Appropriately, the title for this

panel was «The Role of Comparative Law in the Conflict of Laws», one of

the dominant themes of his professional life.

Kahn-Freund, Otto (1900—1976)

Professor of comparative law, University of Oxford, and a path

breaking scholar.

He was appointed professor of comparative law, University of

Oxford, and fellow of Brasenose College, Oxford in 1964 and elected FBA

in 1965. He became an honorary bencher of the Middle Temple in 1969

and a QC in 1972. He was knighted in 1976.

Lalive, Pierre, D’Epinay, (1923—н.в.)

Professor Pierre Lalive is one of the world’s leading specialists in

international disputes with over fifty years of experience in international

law and arbitration. He has acted as arbitrator or counsel in several hundred

international arbitration proceedings either ad hoc or conducted under the

rules of all main arbitration institutions and dispute resolution bodies. A

key part of his practice involves inter ― state and state ― investor disputes

and he has acted for several States before the International Court of Justice

in The Hague. He was one of the seven experts appointed by the Swiss

government to draft the 1987 Swiss Code of Private International Law,

including the rules on international arbitration. Professor Lalive frequently

also acts as counsel or expert in relation to art law disputes. He was the

president of the UNIDROIT Diplomatic Conference of Governmental

Experts on the Protection of Cultural Property and instrumental in the

elaboration of the 1995 UNIDROIT Convention on Stolen or Illegally

Exported Cultural Objects.

chairman and founder of the Commission on European Contract Law

(PECL) and member of the Study Group on a European Civil Code. In

August 2008 he was granted through the hands of H.R.H. Prince Joachim

of Denmark the «Knut and Alice Wallenberg Award» for his outstanding

jurisprudential efforts, especially for his writings in international and

comparative law, that is considered of great importance to the Nordic and

the European development of law.

Mancini, Pasquale Stanislao (1817—1888)

Italian jurist, diplomat, and statesman. Professor at universities in

Turin, Naples, and Rome.

Mancini held the posts of minister of justice, of education, and of

foreign affairs in the Italian government. He supported the national

unification of Italy, the establishment of a constitutional monarchy, the

liquidation of the temporal power of the pope, the abolition of the

Inquisition, and the nationalization of church property. Mancini was the

founder of the 19th ― century Italian doctrine of private international law

(the national theory). Mancini argued that every man preserves his rights as

an individual outside the country of his citizenship and that consequently

the law of citizenship (lex patriae) is a basic principle of the branch of law

known as conflict of laws; he held that every foreigner living abroad was to

be judged by the laws of his own country. These principles were

consistently followed in the Italian Civil Code of 1865, which was

developed with Mancini’s participation. They can be found in the German

Civil Code of 1896, the Japanese Civil Code of 1898, and The Hague

conventions on international private law. Many scholars were Mancini’s

followers, including I. Esperson and P. Fiore of Italy, A. Weiss of France,

and F. Laurent of Belgium.

Meijers, Eduard Maurits (1880—1954)

Eduard Maurits Meijers was a Dutch jurist, who was the founding

father of the current Dutch civil code, the Nieuw Burgerlijk Wetboek.

In 1897 Meijers entered the University of Amsterdam to study law.

He finished his doctorate under Johannes Houwing in April 1903. His

dissertation had an emphasis on philosophy, defending utilitarianism

against Kant’s rationalism and posing that in general well ― being should

be the final goal of every law institution.

After his studies he ran a law practice in Amsterdam. In 1910 he

accepted a chair in private law and private international law at the Leiden

University. He was particularly interested in legal history and his

publication were of great influence on the development of this field in the

Netherlands. He became internationally recognized and received honorary

degrees from the universities of Aberdeen, Brussels, Glasgow, Leuven,

Lille and Paris. From 1918 to 1922 Meijers was dean of the law faculty in

Leiden; in 1926 and 1927 he was rector of the university.

Rabel, Ernst (1874—1955)

Ernst Rabel was Professor of Law at the Universities of Leipzig,

Basel, Kiel, Göttingen, Munich and Berlin until in 1937 the political

situation forced him to emigrate to the United States. There, he became

professor at the Law Schools of Ann Arbor and Harvard. Rabel’s academic

interest covered a wide range of fields, including Roman law, modern civil

law, conflict of laws and comparative law, and the lasting importance of his

work continues to be acknowledged.

As the first Director of the Kaiser Wilhelm (now: Max Planck)

Institute for Foreign and International Private Law in Berlin (1926), Rabel

had a decisive influence on the development of a modern, systematic

comparative law focusing on issues of legal policy. He was also among the

first to recognise the significance of comparative law as groundwork for

law unification projects. His treatise Law of the Sale of Goods (first

published 1936) created a model for later endeavours in this field. The

Conflict of Laws: A Comparative Study (1945) has become a standard

work, and the Journal for Foreign and International Private Law (RabelsZ),

which Rabel founded in 1927, is one of the most respected publications in

this area.

Professor Reese was a director of the New York Legal Aid Society

from 1951 to 1971, the chairman of Community Action for Legal Services

in Harlem and the Bronx from 1967 to 1970 and the president of the

Foreign Law Association from 1965 to 1968. He retired from Columbia in

1981, becoming a professor emeritus. Board Chairman and Delegate He

was also a former special hearing officer for the Justice Department on

conscientious objectors, a president of the board of the Millbrook School

and a mayor of Hewlett Bay Park.

Professor Reese had also been an American delegate to the Hague

Conference on Private International Law for five years and a chairman of

the Committee on International Law of the New York State Bar

Association and of the Board of Community Action for Legal Services.

Von Mehren, Arthur Taylor (1922—2006)

Born on August 10, 1922 in Albert Lea, Minn., von Mehren

graduated from Harvard College in 1942 and from Harvard Law School in

1945. In 1946 he was awarded his doctorate in government from Harvard

and was appointed assistant professor at HLS. von Mehren spent the first

three years of his more than 50-year career at Harvard Law School in full-

time study of Swiss, German and French law at the Universities of Zurich

and Paris. In 1953 he was named a tenured professor of law at Harvard and

in 1976 assumed the Story Professorship. Since 1991 he has been the Story

Professor of Law, Emeritus.

von Mehren founded the Joseph Story Fellow program, under which

talented young German academics would come to work as his research

assistant for one year periods. The 12 graduates of this program are now

members of both German and American law faculties. At the time of his

death, the Story Fellow alumni were in the process of preparing a

commemorative volume of essays to be published in his honor.

Professor an der Freien Universität Berlin.

Wengler forschte und publizierte auf einer Reihe von Teilgebieten,

namentlich dem Völkerrecht, dem deutschen und ausländischen

öffentlichen Recht wie auch dem Internationalen Privatrecht.

Er war einer der letzten deutschen Rechtsprofessoren, die sowohl

eine Lehrbefugnis für das Völkerrecht wie auch das Internationale

Privatrecht besaßen. Aus Wenglers Feder stammen mit „Völkerrecht“

(zweibändig, erschienen 1964) und „Internationales Privatrecht“ (ebenfalls

zweibändig, erschienen 1981) Grundlagenwerke zu beiden Rechtsgebieten.

Wengler war Mitglied des Institut de Droit international und von

1973 bis 1975 dessen Präsident.

Für seine wissenschaftlichen Leistungen verliehen ihm die

Universitäten Thessaloniki (1972), Löwen (1978) und Coimbra (1981) die

Ehrendoktorwürde.

Zum 65. Geburtstag Wenglers erschien eine zweibändige Festschrift.

Die Privatbibliothek Wenglers ging nach seinem Tode auf die Käthe

und Wilhelm Wengler-Stiftung über. Die Bibliothek umfasst rund 5.000

Bände mit den Schwerpunkten internationales Privatrecht, Völkerrecht und

vergleichende Rechtswissenschaft und befindet sich heute als

Westlake, John (1828―1913)

He was an English law scholar, born at Lostwithiel, Cornwall, the son of a

Cornish wool-stapler. He was educated at Lostwithiel and, from 1846, at

Trinity College, Cambridge, where he graduated BA (6th Wrangler and 6th

Classic) in 1850. He was fellow of Trinity from 1851 to 1860, called to the

bar at Lincoln’s Inn in 1854, and became a bencher of the Inn in 1874. In

1885 he was elected to Parliament as Liberal member for the Romford

Division of Essex; from 1888 to 1908 he held the Whelwell Chair as

professor of international law at Cambridge; in 1900―1906 he was a

member for Great Britain of the International Court of Arbitration at The

Hague. His Collected Papers on Public International Law were edited by L.

Oppenheim in 1914.
