Your Legacy - Creating a Brighter Future
From our comprehensive state-of-the-art facilities in central Manchester we serve
over one million people every year. Clinical research is the cornerstone of first-class
healthcare but much of the development of innovative care lies outside the core
funding provided to the NHS.
That’s why we need your help. A legacy can help us to explore new research areas,
then translate them into real solutions to the problems that affect the lives of so
many of our population - of every age.

Using a solicitorMost of us need expert legal help at some time in ourlives. Some of the most common issues are to do withbuying a house, getting a divorce or making a will. You might also need help if you are setting up homewith your partner, starting your own business or organising an elderly person's finances. The law canbe complicated so it's important to get the best adviceyou can. Solicitors are the experts when it comes tothe law and how it affects you. So for legal advice thatyou can rely on, contact a solicitor.
What sort of legal help do I need? A firm of solicitors may offer services in a wide rangeof legal subjects, although more and more firms are specialising in only one or two areas of the law. If yourusual firm of solicitors cannot help you with all yourneeds, they will be happy to refer you to another solicitor. Or, if you prefer, they can get the advice of aspecialist on your behalf.
How can I be sure they are qualified to help me? All solicitors in private practice must hold a practising certificate issued by the SolicitorsRegulation Authority, the independent regulator (setup by the Law Society) which sets the rules that allsolicitors must follow. This guarantees that thesolicitor is qualified to practise and has insurance toprotect you if anything goes wrong.
Individual solicitors might also be members of 'quality-assured accreditation schemes' that cover anumber of legal areas. To join one of these schemes, solicitors must show that they have considerable specialist knowledge and expert skills. You can finddetails of solicitors in your area who are members ofone of these schemes by visiting the 'Find a Solicitor'area of the Law Society website,www.lawsociety.org.uk.
Do they do legal aid work?If you are on a low income or receiving benefits, you may be eligible for legal aid. You can find this out by contacting your nearest citizens' advice bureau or lawcentre. As some solicitors' firms do legal aid work andsome do not, if you are eligible for this kind offunding, you will need to narrow your search to firmsthat do. You can find solicitors that do legal aid workon the Community Legal Service website atwww.clsdirect.org.uk. Legal aid is managed by theLegal Services Commission, which makes sure that allsolicitors' firms that offer legal aid meet high quality standards.
Do they work on a conditional fee basis? For certain types of case, including personal injury, your solicitor may be prepared to work on aconditional fee basis, also known as a 'no win, no fee'arrangement. If you win the case, your solicitor's feeswill usually be paid by the other side. If you lose, youdo not have to pay your solicitor's fees. You may beasked to take out an insurance policy to pay for theother side's costs if you lose. There are various typesof conditional fee arrangement, but not all solicitors'firms take cases on this basis.
Be prepared The more preparation you do before the meeting, themore you'll get out of it. Make a list of the main pointsyou want to make or the questions you want to ask.Get together any paperwork that is relevant and put itin some kind of order so you can refer to it quickly. This will make it easier for your solicitor tounderstand your circumstances and give you properadvice.
At the meeting Check how long the meeting will last so that you don'tsuddenly find that 'time is up' before you've made allyour points. Have your notes in front of you and tickoff each point as it is covered. Ask for clarification if anything is said that you do not understand. At theend of the meeting ask your solicitor to send you aletter after the meeting to summarise the advice youhave been given.
Solicitors ChargesCharges vary between solicitors, and will depend onthe expertise and experience of the individual solicitoras well as the complexity of the work. Before making a decision about which firm to use, you may want to'shop around'. Decide on what sort of solicitor youneed to speak to and get quotes from several. Manysolicitors charge little or nothing for a short firstinterview. It is worth asking. However, price is not theonly thing you have to consider. Above all, try to finda solicitor who you are comfortable with and whoseadvice you feel you understand.
Keeping in touch Once you have appointed a solicitor, they must consultyou at every important stage, to check how you wantto proceed. Similarly, you need to tell your solicitorabout any changes to your personal circumstanceswhich could affect the case. This includes any changesin your financial position which could alter youreligibility for legal aid.

Industrial DiseasesThere are five main asbestosrelated conditions:
MesotheliomaThis is a terminal cancer caused byexposure to asbestos. It affects thelungs and less frequently theabdomen. Symptoms can includebreathlessness, chest or back pain, apersistent cough and weight loss.
Victims do not need to have beenexposed to a lot of asbestos dust todevelop mesothelioma. There is noconnection with cigarette smoking. There is a long latency periodbetween exposure to asbestos dustand the development of the disease. Compensation claims formesothelioma are usually £100,000or more.
Asbestos-Related Lung CancerAsbestos has been known to causelung cancer since 1955 or earlier.

Harkin Lloyd SolicitorsAsbestos affects as many as 1 in 100
men over the age of 40 in this country,as well as many women. Asbestos hasno respect for socio-economic group oroccupation.
Most people label all asbestos-related diseases
"asbestosis", but that is only one type of asbestos-related illness. In fact, the majority of people affected
by asbestos have benign pleural disease (either plaques
or thickening of the lining of the lung). Unfortunately, some
people do develop asbestos-related malignancies
(either mesothelioma or lung cancer) which are usually fatal.
The Harkin Lloyd Industrial Disease Team deals exclusively with claims for victims of asbestos related
diseases. Other departments within Harkin Lloyd also deal with Probate and all Personal Injury.

People who have asbestosis andsmoke cigarettes are much morelikely to get lung cancer thanpeople who have asbestosis andhave not smoked. It usually takes20 years from being exposed toasbestos before lung cancerdevelops.
A court will award between £45,000and £65,000 for the disease itselfand in addition, compensation isavailable for loss of earnings, care, and the cost of any specialist aidsand equipments required as a resultof the disease.
AsbestosisThis is a form of scarring or fibrosiswhich tends to develop 20 years ormore after exposure to asbestos. Itis necessary to have inhaled a lot ofasbestos dust to develop asbestosis.Symptoms can includebreathlessness, chest pain and acough. For mild asbestosis courtswill award in the region of £15,000.For advanced asbestosis courts willaward in the region of £75,000.Additional compensation can beobtained if the victim has lost theirjob, cannot work or needs care.
Diffuse Pleural Fibrosis or ThickeningThe pleura is a very thin liningbetween the lung and the rib cage.It can be damaged by inhalingasbestos dust. It can affect onelung or both and can get worsegradually or suddenly. Sufferersusually have an increased risk ofdeveloping another asbestos relateddisease.
As with the above conditions, victims can claim against formeremployers who negligently exposedthem to asbestos dust. If theemployer no longer exists asolicitor can bring them back into existence for the purpose of a compensation claim, provided theycan find their Employers LiabilityInsurers at the time of the exposureto asbestos. Sufferers have thechoice of a ‘once and for all’ awardor of keeping open their right toreturn to court for morecompensation if they develop amore serious asbestos illness in thefuture.
Pleural PlaquesPlaques are scars in the lining of thelungs which are visible on x-ray. Inmost cases the sufferer has nobreathlessness or disability. In 2007the House of Lords removed theright to claim compensation forpleural plaques. Sufferers inEngland and Wales have been toldthey will have to wait until the endof MP’s summer recess to hearwhether the government willoverturn this decision in theirfavour.
Claims for asbestos diseases can be difficult. There can be problems in tracing employers, in tracinginsurers where employers havegone bust, proving the illness wascaused by asbestos, etc. It isimportant to ensure that you obtainlegal advice from solicitors whospecialise in this work.

Immigration
A solicitor who specialises in
immigration can assist you in a
number of areas including
• Asylum work
• Human rights
• Business immigration
• Foreign students, and
• Marriage cases
Qualifying for asylum depends on
whether you are a refugee, as
described in the United Nations 1951
Refugee Convention. It says a refugee
is someone who is outside their
country of origin because of a well-
founded fear of persecution for one of
five reasons:
race; religion; nationality; membership
of a particular social group; or political
opinion.
A refugee needs to be able to show
that they are in real danger and need
protection for one of these reasons. It
is vital to seek advice from a specialist
solicitor.
Human rights
It's also possible to make a claim for
asylum based directly on Article 3 of
the European Convention on Human
Rights. This prohibits torture or
inhuman or degrading treatment. The
UK Government would be breaching
the Human Rights Act if it sent
someone back to a country where they
would face such a risk.

and this includes dealing with staff
issues before they become legal issues.
A solicitor can advise companies, from
