    FIRST CLAIM FOR RELIEF(Infringement of the 0'359 Patent)

    10. Oakley repeats and incorporates by reference the allegations oparagraphs 1 through 9 above as if fully set forth herein.

    11. Oakley is informed and believes, and based thereon alleges, thaKohl's and Accutime (collectively "Defendants") have manufactured, usedoffered for sale, sold, and imported into the United States, and continue tomanufacture, use, offer to sell, sell, and import, watches covered by the 0'359patent ("the Infringing Products") without permission or license from Oakley. TheInfringing Products include, but are not limited to, the "Viviani Gunmetal Watchsold by Kohl's through its website www.kohls.com and elsewhere. Defendanthave infringed, contributorily infringed, and/or induced infringement of th0'359 patent by making, using, selling, offering to sell, or importing into theUnited States the Infringing Products and/or inducing others to make, use, seloffer to sell, or import the Infringing Products. Defendants continue to infringecontributorily infringe, and/or induce infringement of the D'359 patent.

    12. As a result of Defendants' acts of infringement, Oakley has sustainedand will continue to sustain economic damages. Oakley is entitled to recover itdamages from Defendants pursuant to 35 U.S.C. 284 and 289.

    13. As a result of Defendants' conduct, Oakley has suffered damage toits reputation and goodwill, which has caused Oakley irreparable harm and fowhich Oakley cannot be compensated by monetary relief. Defendants wi
