    OFFICE ORDER No. 192/2014

    The President is pleased to promote the officers mentioned in Annexure-I

    & IIto the grade of Assistant Commissioner of Customs & Central Excise in Pay

    Band 3 with Grade Pay of Rs.5400/- on purely ad-hoc basis with immediate effect

    and until further orders.

    2. The promotion to the grade of Assistant Commissioner of Customs and

    Central Excise are made purely on ad-hoc basis and does not confer any right on

    the officers so promoted for any claim for continued officiating or regular

    promotion in the grade of Assistant Commissioner and the period of such service

    shall not count for seniority or as qualifying service for further promotions.

    Government reserves the right to terminate the ad-hoc appointment and revert the

    officers to the post from which he/she was promoted.

    3. The ad-hoc promotions of the officers mentioned in Annexure-I & IIshall be initially on in-situ basis, till the time their posting orders on ad-hoc

    promotion are issued.

    4. The ad-hoc promotion shall be subject to the decision of the Competent

    Authority for regular promotion based on UPSCs recommendation.

    5. The ad-hoc promotions are ordered taking into account the interim order

    dated 3.9.2014 of Honble CAT, Chandigarh Bench in OA No. 060/00770/2014

    filed by Shri Rajesh Rai & Ors vs UOI. In terms of interim order dated

    17.10.2014 passed by the Honble CAT, Bombay in OA No. 571/2014 filed by

    Shri Pradeep Kumar & Ors Vs. UOI, the recommendations of the DPC held on

    17-20thOctober, 2014 in respect of the feeder grade of Customs Appraisers have

    been kept in a sealed cover. The ad-hoc promotions shall be subject to the

    outcome of the above matter pending before Honourable Tribunals and any other

    Court cases related to the subject.

    6. The Chief Commissioners / Directors General, CBEC and all other

    supervisory authorities concerned shall ensure that if any of the officers whose

    name has figured in Annexure-I & IIto this order is under suspension or facing

    any charge sheet or prosecution, he/she should not be allowed to assume charge

    of the post of Assistant Commissioner and this fact should be reported to the

    Board immediately. Further, if any of the officers figured in Annexure-I & II is

    undergoing any penalty, he/she should be allowed to assume the charge of the

    post of Assistant Commissioner only after the expiry of the currency of the

    penalty period. This fact may also be reported to the Board.
