    AN ORDINANCE AMENDING THE REVISED GENERAL ORDINANCES OF THE

    TOWNSHIP OF EWING IN THE COUNTY OF MERCER, TO ESTABLISH APERMIT PROCEDURE, INCLUDING A FEE, FOR TEMPORARY CONSTRUCTION

    AND SALES TRAILERS

    WHEREAS, an ordinance is required to establish a procedure whereby persons

    expanding their existing building or structures located within the Township of Ewingmust obtain a permit for the use of temporary construction and/or sales trailers pending

    the completion of construction; and,

    WHEREAS, an ordinance is required to establish a permitting fee, when theproject exceeds the estimate for the completion of the work, for the temporary

    construction and/or sales trailers equal to the value that would be assessed if the trailers

    were permanent fixtures.

    NOW, THEREFORE, BE IT ORDAINED by the Township Council of the

    Township of Ewing that the Revised General Municipal Ordinances of the Township ofEwing be amended to establish the above described permitting process and fee.

    Section 1: The Revised General Municipal Ordinances of the Township of Ewing are

    hereby amended to add the following:

    Permit Required for Temporary Trailers. Any person expanding an existing building

    or structure located within the Township of Ewing will be required to obtain a permit touse temporary construction and/or sales trailers pending the completion of construction.

    Applications will be made to the Construction Office. Such permits shall be issued at the

    direction of the Township Construction Official and shall be valid for a period of six (6)months, with one (1) extension for up to six (6) months to be granted in the discretion of

    the Township Construction Official. Any additional application for extension beyondone (1) year must be made to the Township Council, who, in their discretion, may grant

    an additional extension.

    Temporary Construction Trailers. A temporary construction trailer may be at the site

    for the period of construction beginning with the issuance of a construction permit andconcluding before the final certificate of occupancy is granted.

    Temporary Sales Trailers. A temporary sales trailer may be at the site for the period

    beginning with the posting of bonds for the project and concluding before a certificate of

    occupancy is granted (or the last certificate of occupancy in the case of a residentialproject).

    Removal of Trailers; Assessment for Non-Removal. When a permit for constructionand/or sales trailer expires, the business, person or persons who applied for the permit

    must remove the trailer from the property within five (5) business days of such

    expiration. If a temporary construction or sales trailer remains on the property after thefive (5) business days allowed for removal, the business person or persons shall be

    assessed, at the current tax rate, as if the trailers were permanent fixtures.

    Section 2 This Ordinance shall take effect after final passage and publicationaccording to law.

    STATEMENT

    This Ordinance amends the Revised General Municipal Ordinances of the Township ofEwing to establishing a permitting procedure and fee for the use of temporary

    construction and/or sales trailers.
