    ABSTRACT

    Purpose: This Instruction implements the OSHA Field Operations Manual (FOM),

    and replaces the September 26, 1994 Instruction that implemented theField Inspection Reference Manual (FIRM). The FOM is a revision ofOSHAs enforcement policies and procedures manual that provides thefield offices a reference document for identifying the responsibilitiesassociated with the majority of their inspection duties.

    Executive Summary

    This Instruction cancels and replaces OSHA Instruction CPL 02-00-103, Field InspectionReference Manual (FIRM), issued September 26, 1994, and two of the three remaining parts ofthe prior Field Operations Manual, CPL 02-00-045, which are still in effect. The one remaining

    part of the prior Field Operations Manual, the chapter on Disclosure, will be added at a later date.This Instruction constitutes OSHAs general enforcement policies and procedures manual for useby the field offices in conducting inspections, issuing citations and proposing penalties.

    Significant Changes for November 2009 Edition

    Clarifies that critical inspections, for consultation visits in progress, may includereferrals.

    Clarifies that compliance officers are to present their credentials whenever they make

    contact with management representatives, employees or organized labor representativeswhile conducting inspections.

    Clarifies that although employers have four hours to provide recordkeeping records,compliance officers are to begin the walkaround inspections as soon as the openingconference is completed.

    Clarifies final order dates for repeated violations.

    Clarifies that when the proposed penalty for a posting violation would amount to lessthan $100, a $100 penalty shall be proposed.

    Clarifies that only the penalty reduction factor for Size shall apply when proposingpenalties for any 1903.19 violations.

    Clarifies the definitions of formal and non-formal complaints, and referrals.

    Clarifies that a formal complaint alleging a recordkeeping deficiency indicating theexistence of a serious safety or health violation is a criterion warranting an inspection.

    Chapter 1

    INTRODUCTION

    I.

    Purpose.

    This Instruction implements the Field Operations Manual (FOM), and replacesOSHA Instruction CPL 02-00-103, Field Inspection Reference Manual (FIRM),issued September 26, 1994. This Instruction also replaces two of the threeremaining parts of the prior Field Operations Manual (CPL 02-00-045) that arestill in effect. The one remaining part, the chapter on Disclosure, will be added ata later date. This FOM is a revision of OSHAs enforcement policies andprocedures as stated in the FIRM, which provides the field offices a referencedocument for identifying the responsibilities associated with the majority of theirinspection duties.
