This Court has subject matter jurisdiction over this action in

accordance with 28 U.S.C. §§1331 and 1338 a).

2 This Court has personal jurisdiction over the Defendant for at least the following

reasons: i) Defendant has committed acts of patent infringement and/or contributed to or induced

acts of

patent infringement by others in this District and elsewhere in the State

ofNew

York and the

United States; and ii) Defendant regularly does business or solicits business, engages in other

persistent courses

of

conduct, and/or derives substantial revenue from products and/or services

provided to individuals in this District and in this State.

Plaintiff Oyo Box Corp. (hereinafter Oyo Box or Plaintiff Oyo Box ), is a

domestic business corporation organized and existing under the laws of he State

5. Upon information and belief, Defendant Bey-Berk International, Inc. (hereinafter

Bey-Berk or Defendant Bey-Berk ) is a corporation organized and existing under the laws of he

State of California, with an office and principal, regular and established place ofbusiness at 9145

Deering Avenue, Chatsworth,

CA

91311. Upon information and belief, Bey-Berk imports into the

United States, offers for sale, sells, and/or uses in the United States decorative furniture and

accessories for the home and office.

B CKGROUND F CTS

6. Plaintiff Oyo Box is the owner of all right, title, and interest in and to U.S. Design

Patent No. D723,801, entitled EYEWEAR HOLDER, issued by the U.S. Patent and Trademark

Office on March 10,2015 (hereinafter the '801 Design Patent ). A copy of he '801 Design Patent

is attached as Exhibit A.

7. Plaintiff Oyo Box produces, advertises and sells eyewear holders made in accordance

with the design

of

the '801 Design Patent in and across the United States.

Bey-Berk has been advertising, selling, and offering for sale eyewear holders under, at

least, their item numbers BB664BRL, BB664RED, BB664WHT, BB643BLK, BB673RED, and

BB673BLK to customers in the United States, including customers in the State

ofNew

York, at least

through its website at www.bey-berk.com and, upon information and belief, to retail stores and

wholesalers across the United States, including in the State

ofNew

York. Printouts and screenshots

of the www.bey-berk.com website displaying the products labeled BB664BRL, BB664RED,

BB664WHT, BB643BLK, BB673RED, and BB673BLK (hereinafter collectively referred to as the

Infringing Products ) are attached as Exhibits B-G, respectively.

Bey-Berk has exhibited and offered for sale its goods, including the Infringing

Products, at trade shows in the Jacob Javits Convention Center in New York City.

10.

As seen in Exhibits B-D and F, Bey-Berk's website was interactive, allowing

customers in all locations to purchase the Infringing Products on-line and have them shipped to

them.

patent rights in the

CAUSE OF ACTION: INFRINGEMENT OF

'801 DESIGN PATENT

Plaintiff Oyo Box repeats and re-alleges paragraphs

hereof, as

if

fully set forth

herein.

Upon information and belief, Defendant Bey-Berk is directly infringing, inducing

others to infringe, and/or contributing to the infringement

of

the '801 Design Patent by making,

using, selling, and/or offering to sell in the United States, or importing into the United States,

products whose design is identical to, and/or at least substantially the same as, the design claimed in

the

801 Design Patent, including without limitation, the Infringing Products. A comparison of the

protected design found

on

the copy

of

he 801 Design Patent ofExhibit A hereto against the images

of Defendant Bey-Berk s Infringing Products found in Exhibits B-G hereto, establishes the clear

basis of Plaintiffs claim herein and the infringing activity ofBey-Berk alleged herein.

14. Upon information and belief, Bey-Berk has profited through its infringement ofOyo

Box s

patent rights. As a result

ofBey-Berk s

unlawful infringement

of

he 801 Design Patent, Oyo

Box has suffered and will continue to suffer damage. Oyo Box is entitled to recover from Bey-Berk

the damages suffered by Oyo Box as a result

ofBey-Berk s

unlawful acts.

15. On information and belief, Bey-Berk s infringement of the 801 Design Patent is

willful and deliberate, entitling Oyo Box to enhanced damages and reasonable attorney s fees and

costs.

16. On information and belief, Bey-Berk intends to continue its unlawful infringing

activity, and Oyo Box continues to and will continue to suffer irreparable harm, for which there is no

adequate remedy at law, from such unlawful infringing activity unless Bey-Berk is enjoined by this

Court. Such injunction being proper due, at least, to the actual sales ofPlaintiffs protected eyewear

holders.

JURY DEMAND

17. PlaintiffOyo Box hereby demands a trial by jury.

WHEREFORE Plaintiff demands that:

Defendant Bey-Berk be declared to have infringed, induced others to infringe and/or

committed acts of contributory infringement with respect to the claim of the 80 1 Design Patent as

alleged above;

B Defendant Bey-Berk, its officers, employees, agents, servants, related companies and

all parties acting or attempting to act in active concert or in participation with them or acting on their

behalf, be permanently enjoined from further infringement

of

the 801 Design Patent;

C Defendant Bey-Berk be ordered to account for and pay to Plaintiff Oyo Box all

damages caused to Oyo Box by reason

of

Bey-Berk s infringement of the 80 1 Design Patent in

accordance with 35 U.S.C. § 284;

D Defendant Bey-Berk be ordered to pay treble damages for willful infringement

of

he

801 Design Patent in accordance with 35 U.S.C. § 284;

E

This case be declared exceptional under 35 U.S.C. § 285 and that PlaintiffOyo Box

be awarded its attorney s fees, expenses, and costs incurred in this Action; and

G

Plaintiff Oyo Box be granted such other and further relief as the Court may deem just.
