PEMBEBASAN KEW AJIBAN VISA BAGI PEMEGANG PASPOR DIPLOMATIK DAN PASPOR DINAS

Pemerintah Republik Indonesia dan Pemerintah Republik India ( selanjutnya disebut sebagai "para Pihak"),

MENGAKUI hubungan bersahabat yang terjalin antara kedua negara;

BERHASRA T untuk memperkuat dan untuk mengkonsolidasikan hubungan persahabatan tradisional mereka;

BERHASRA T lebih lanjut untuk memberikan kemudahan perjalanan antara kedua negara;

Telah menyetujui sebagai berikut:

PASAL I PEMBEBASAN

1. Warga Negara dari salah satu Pihak pemegang paspor diplomatik atau paspor dinas yang berlaku, dibebaskan dari keharusan memperoleh visa masuk, visa transit dan visa keluar dalam hal dapat diberlakukan, ketika memasuki, transit melalui atau keluar dari wilayah Pihak lain.

2. Warga Negara dari kedua negara yang memegang paspor diplomatik atau paspor dinas yang berlaku, yang dikeluarkan oleh pihak yang berwenang, dapat diijinkan untuk memasuki dan berdiam di wilayah Pihak yang lain untukjangka waktu 14 hari, tanpa harus memperoleh visa terlebih dahulu.

PASAL II PEMBERIAN VISA

1. Anggota Misi Diplomatik atau Konsulat dari salah satu Pihak yang ada di wilayah Pihak lain dapat diberikan visa yang sesuai yang berlaku untuk masa penempatannya atas permintaan tertulis dari Misi Diplomatik atau Konsulat yang bersangkutan, asalkan mereka merupakan warga negara Pihak tersebut dan memegang paspor diplomatik atau paspor dinas.

2. Fasilitas yang disebutkan dalam paragrap 1 Pasal ini juga berlaku pada istri I suami dari suatu anggota Misi Diplomatik atau Konsulat dan anak-anak mereka yang belum menikah yang berusia dibawah 21 tahun, asalkan mereka memegangjenis pasport yang sama atau nama-nama mereka tercantum dalam paspor ayah atau paspor ibu mereka.

PASAL III KEWAJIBAN

1. Persetujuan ini tidak mengecualikan pemegang paspor dimaksud dari kewajiban untuk menghormati segenap peraturan perundang-undangan yang berlaku di negara penenma.

2. Salah satu Pihak memiliki hak untuk menolak masuk atau memperpendek masa tinggal warga negara dari Pihak lain.

3. Pemegang pasor diplomatik atau paspor dinas dari salah satu Pihak yang merupakan pejabat intemasional atau yang dipekerjakan oleh suatu organisasi intemasional, badan, lembaga atau institusi semacam, akan diwajibkan untuk memperoleh visa sebelum perjalanan mereka ke wilayah Pihak lain untuk kunjungan dinas.

PASAL IV CONTOH DAN PENERBIT AN P ASPOR

ATAU DOKUMEN PERJALANAN

1. Setelah penandatanganan Persetujuan ini, kedua Pihak melalui saluran diplomatik akan melakukan pertukaran contoh paspor yang digunakan oleh masing-masing Pihak, dalam waktu 30 hari sejak penandatangan Persetujuan ini, dan contoh dari setiap Paspor baru, paling tidak 30 hari sebelum paspor tersebut diterbitkan.

2. Apabila warga negara dari salah satu Pihak kehilangan paspomya dalam wilayah Pihak lain, yang bersangkutan hams memberitahukan instansi yang berwenang dari negara penerima unruk keperluan penanganan yang selayaknya. Misi Diplomatik atau Konsulat terkait akan mengeluarkan paspor baru atau dokumen perjalanan bagi warga negaranya dan memberitahukan instansi yang berwenang dari Pemerintah daerah setempat.

PASAL V PENUNDAAN

Demi kepentingan keamanan nasional atau kesehatan masyarakat, salah satu Pihak dapat menunda sementara waktu sebagian atau seluruh Persetujuan ini. Pihak yang memutuskan penundaan sementara atau penghentian sebagian atau seluruh Persetujuan ini harus segera memberitahukan Pihak lain mengenai keputusan tersebut melalui saluran diplomatik.

PASAL VI PEMBERLAKUAN, MASA BERLAKU, PENYELESAIAN

SENGKETA DAN AMANDEMEN

1. Persetujuan ini mulai berlaku 30 hari sejak tanggal diterimanya pemberitahuan terakhir dimana para Pihak sating memberitahukan melalui saluran diplomatik bahwa seluruh persyaratan bagi berlakunya Persetujuan ini sebagaimana diatur dalam peraturan perundang-undangan nasional masing-masing telah dipenuhi.

2. Persetujuan ini berlaku untuk jangka waktu lima (5) tahun dan dapat diperpanjang kembali berlakunya untukjangka waktu - jangka waktu lima (5) tahun berikutnya atas dasar kesepakatan bersama secara tertulis.

3. Setiap perbedaan atau sengketa yang timbul dari pelaksanaan ketentuan Persetujuan ini akan diselesaikan secara damai melalui konsultasi atau perundingan antara para Pihak tanpa melibatkan pihak ketiga atau peradilan intemasional.

4. Persetujuan ini dapat dirubah atau diperbaiki, apabila dipandang perlu, berdasarkan kesepakatan bersama secara tertulis oleh para Pihak. Perubahan atau perbaikan tersebut akan berlaku pada tanggal yang akan ditentukan oleh para Pihak.

SEBAGAI BUKTI, yang bertanda tangan di bawah ini, telah menandatangani Persetujuan ini.

DIBUAT di New Delhi pada tanggal 3 April tahun dua ribu dua, dalam dua rangkap asli, masing-masing dalam Bahasa Indonesia, Hindi dan Inggris, semua naskah mempunyai kekuatan hukum yang sama. Dalam hal terdapat perbedaan penafsiran, naskah Bahasa Inggris yang berlaku.

AGREEI\IENT

BETWEEN

THE GOVERNMENT OF THE REPUBLIC OF INDONESIA

AND

THE GOVERNMENT OF THE REPVBLIC O:F INDIA

ON

VISA EXEMPTION FOR DIPLOMATIC AND OFFICIAL PASSPORT HOLDERS

The Government of the Republic of Indontsia and the Government of the Republic of India (hereinafter referred to as th.0 Parties);

RECOGNISING the friendly ties existing between the two countries;

DESIROUS of strengthening further and to consolidate their traditional friendly relations;

DESIROUS further of facilitating travel between the two countries;

Have agreed as follows :

ARTICLE 1 EXEMPTION

1. A citizen of either Party holding a valid dipiomatlc or official passport shall be exempt from entry visa, transit vis8 and exH visa where applbable, while entering into, transiting through or exiting ;:-urn the territory of the other Party

2. The nationals of both countries who hold valid diplomatic or official passports, issued by the authorities concerned, shall be allowed to enter and stay in the territory of the other Party for a period of 14 days, without having to obtain visa previously.

ARTICLE II GRANTING OF VISA

1. Members of the diplomatic Mission or Consulate of either Party located in the territory of the other Party shall be granted a suitable visa valid for the duration of his/her assignment at the written request of the diplomatic Mission or Consulate concerned, provided they are citizens of that Party and are holding diplomatic or official passports.

2. The facilities enumerated in paragraph 1 of this Article shall also apply to the spouse of a member of the diplomatic Mission or Consulate and their unmarried children under the age of 21 years, provided they are holding a similar category of passport or the children's names are entered in their

father's or mother's passport.

ARTICLE III OBLIGATION

1. This Agreement does not exempt the holder of the said passport from the obligation of respecting all regulations under existing laws of the host country.

2. Either Party has the right to refuse entry or to cut short the duration of stay of any citizen from the other Party.

3. The holders of diplomatic or official passport of either Party who are international civil servants or who are employed by an international organization, body, agency or any other such entity, would be required to obtain visa prior to their travel to the territory of the other Party for official visits.

ARTICLE IV SAMPLE AND ISSUANCE OF PASSPORT OR TRAVEL DOCUMENT

1 . After the signing of this Agreement, the two Parties shall exchange through diplomatic channels the sample of the passport being used by each Party, within 30 days of the signing of this Agreement, and the sample of any new passport, at least 30 days before it is introduced.

2. If a citizen of one Party loses his/her passport in the territory of the other Party, he/she shall inform the authorities concerned of the host country for appropriate action. The diplomatic Mission or Consulate concerned will issue a fresh passport or travel document to its citizen and inform the concerned authorities of the local Government.

ARTICLE V SUSPENSION

In the interest of national security or public health, either Party may temporarily suspend a part of or the whole Agreement. The Party which decides to temporari1y suspend or denounce a part of/or the whole Agreement shall immediate1y infonn the other Party of such a decision through diplomatic channels.

ARTICLE VI ENTRY INTO FORCE, DURATION, SETTLEMENT OF DISPUTE

AND AMENDMENT

I. This Agreement shall enter into force thirty (30) days from the day the receipt of the last notification in which the Parties have informed each other through diplomatic channels that all requirements for entry into force of the Agreement as stipulated by their respective national legislation have been met.

2. This Agreement shaU remain in force for a period of five (5) yearh)'abti may·. - ~
